TO ·CONFIRM By-Law No. 1158 o;C the Council o;C the Township o;C
Bayham ;Cor closing and stopping up a portion of Second
Street in the Hamlet of Eden in the ~6wnship of Bayhamo
WHEREAS the Council of the Tcwnship of Bayham did on the 28th
day of October 1946 finally pass .their By-Law No. 1158 to stop
up and close that part of the said :Road in t'hesaid Township and
hereinafter described, and
WHEREAS by subsection 6 of Section 495 of the Municipal Act it
is enacted as follows.:
itA By-Law of the council of a township, passed under
the authority eonferred by clause (c) of subsection 1,
in the case of a tovmship in unorganized territory,
shall not have any force unless and until approved by
a ~udge of the District Court of the district in which
the township is situated, and in other cases unless and
until confirmed by a by-law of the council of the county
in which the township is situated passed at an ordinary
meeting of the council held not sooner than three months
or later than one year after the passing of the by-law
of the council of the township!! and
WHEREAS the said township of Bayham is situate in the County
of Elgin and the said Council of the said Tovmship .have applied to
this Council to pass a by-law confirming the said by-law No. 1371
at the ~urrent, ordinary and regular sittings of this Council
commèncing on the lOth day of ~une A. D., 1947 the same being
held not sooner than three months nor later than one year after the
passing of said By-Law No. 1158 of the said Council of the Township
of Bayham and it appears proper that the said by-law shall'be
confirmedo
WHEREAS it is deemed necessary to close up that portion of Second
Street in the Hamlet of Eden commencing at the intersection of the
southerly boundary of said Second Street with the westerly bounda:t'Y of
Township of Bayham Lot numbered 23, Concession 9, thence proceed south
easterly along the southerly limit of said Second Street to the westerly
limit of Provincial Highway No. 19, thence north easterly along the
westerly limit of said Highway No. 19 a distance of Fifteen Feet,
thence north westerly parallel with the southern boundary of said
Second Street to the westerly limit of said TO\Vllship of Bayham Lot
numbered 23, to the point of beginningo

AND WHEREAS this portion of Seoond Street is not at present
used by the travelling pub1io and whereas a portion of a
permanent building, owned by a ratepayer of adjoining land,
projeots over on this portion of said street;
AND WHEREAS it is deemed neoessary and expedient that this
portion of said street be stopped up and olosed.
THEREFORE IT IS ENACTED BY THE COUNCIL OF THE CORPORATION OF THE
COUNTY OF ELGIN:-
That, that portion of Second Street in the Hamlet of Eden,
more partiou1ar1y desoribed as fo11ows- COroIrrenoing at the
intereeotion of the southerly boundary of said Seoond Street
with the westerly boundary of Township of Bayham Lot numbered
23, Concession.9, thenoe prooeed south easterly along the
southerly limit of said Seoond Street to the westerly limit of
Provinoia1 Highway No. 19, thenoe north easterly along the
westerly limit of said Highway No. 19 a distanoe of Fifteen
Feet, thence north westerly parallel with the southern bourn ary
of said Seoond Street to the westerly limit of said Township of
Bayham Lot numbered 23, thenoe southerly along the westerly
limit of said Lot numbered 23, to the point of beginning; be and
the same is hereby closed up and stoppedo
