1765 CORPORATION OF THE COUNTY OF ELGIN BY..LAW NUMBER 1765 A by-la1of to establish a plan of sick leave credit gratuities fOr employees. The Council of the Corporation of the County of Elgin enacts as follows: 1. In this by~la1of - (a) "Employee" meanS any salaried officer, clerk, workman servant Or other person in the employ of the municipality for a period of (not less than one year., (b) "Month" shall mean a calendar month. (c) "Sick leave certificate" means a certificate from a physician verifying a claim for sick leave. (d) "Sick leave absence" means absence from regular attendance by sickness Or other physicial incapacity. (e) "Sick leave credit" means an allowance as provided by this by-law for sick leave absence with pay. (f) "Council" means the Council of the Corporation of the County of Elgin. 2. (a) A plan of sick leave credit gratuities is establiShed for every employee and, subject to the control of Council, the conduct and manafement of the plan shall be vested in the Clerk and County Road Superintendent or both for specific employees). (b) The officials previously mentioned shall maintain and keep a register in which all sick leave credits and sick leave absences fOr every employee shall be recorded so that the register will show the net sick leave credit of every employee which remains after all his sick leave absences have been deducted from his accumulated sick leave credit. 3. (a) For every mon,~Þ of regular attendance, and employee shall"be entitled to a sick leave credit, of (not more than one day per month, and the sick leave credits of ,an employee shall be cumulat,ive (to a maximum of 120 days.) (b) Where ~n emp,foyee,nas been employed for mOre than f1ve years, te Clerk and County Road Superintendent may allow him sick leave absence in excess of his accumulated sick leave credits for not mor~ than 30 days at anyone time provided that the allowance for such sic~ leave absence shall be chargeable to and debited against future sick leave credits to which the employee may become entitled. ¿1~/í/ /) /<':'0' ~;. æ //;'/ 'I (',-'0., ..' THAT By-Law No. Any employee discharged for cause from employment with the municipality shall lose and forfeit all benefits under this by-law. 1739 be, and is hereby repealed. 6. Where an employee having more than five years consecutive service, ceases to be employed by the municipality, there shall be paid to him or to his personal representative, or failing a personal representative, to such other person as the Council may determine, an amount computed on the basis of his rate of pay at the date of leaving the employ" of the municipality for a period equal to 50 percent of the value of his sick leave credits" but the amount shan not exceed six months pay.' 5. Where the sick leave absence has been in excess of three consecutive days the employees shall not be paid any sick leave credits, unless upon return to his work or as soon thereafter as may be practicable he furnish to the (Clerk Or County Road Superintendent etc.) a sick leave certificate. 4 ( b ) An employee shall report his 'illness during the first day on which such employee is absent fr.om his work. . (a) No sick leave credits ahall be given to an employee ~n any mo~th who is absent from duty in that month. (I) (II) without leave. for mOre than than vacation, six days for any reason leave-of-absence; or (d) other ( c ) Where an employee is absynt due to an accident and is ~n receipt or workman s compensation and requests the Council to make up the differ.ence between the amount of wor.kman's compensation paid and his salary, if the Council agrees then the difference shall be charged against his sick leave credits. Dear Sir: RE: COUNTY OF ELGIN SICK LEAVE BY-LAW The above mentioned by-law has been returned to this office 10fith the following suggestions:- The brackets should be removed from Section 2, Sub-section A,so that this Sub-section would then read in part-The plan shall be vested in the Clerk and the County Road Superintendent. Section 3, Sub-section A should read to a maximum of 120 days by removing the brackets from this item, since it is presumed that the County wishes to allow their employees to accumulate a maximum of 120 days sick leave. Paragraph 4 B should be amended by removing the brackets and deleting the 1oford~êt¿:so that this Sub-section B shall read in part -Unless upon return to his 1ofork or as soon after as may be prªcticable he furnish to the Clerk of the County or the Road Superintendent a sick leave certificate.
