1794 A BY-LAW TO REGULATE THE LOCATION OF GASOLINE AND DIESEL FUEL PUMPS - - ON LANDS ADJACENT TO COUNTY 1'1.0ADS WHETIEAS it is deemed to be necessa";ya!1ddesirable to regulate the location of gasoline and diesel fuel ~U:ïn~ and appurtenances on lands adjacent to certain County 1'loads; " AND VJHEREAS, authority is granted under Section 65 of the Highway Improvement Act, Revised Statutes of Onta~io 1960 to exercise such restrictions subject to the approval of the Minister of High1ofays. " NOW THEREFORE, the Council of the Corporation of,the County of Elgin enacts as foll01ofs:- l. In this By-Lm.¡ the 1oford "person" shall mean any person, firm or corporation; the word "High1ofay" shall mean a County or a St. Thomas Suburban Road Commission Road of the County of Elgin and 'the Words "1'I.oad Committee" shall mean the Committee or Body appointed by the County of Elgin to have jurisdiction over Elgin County 11oads. "Engineer" shall mean the County Engineer appointed by the Council of the County of Elgin. "Built Up Areal! shall be as defined in Section 1 (1) of the High,.¡ay Traffic Act. 2. This By-La1of shall apply to those Hoads described in consolidating By-Law No. 1052 and amended by subsequent amending By-Laws, and to those Roads in the future are added to the County Road System ""\"\ by the County Council; save and except those in an Incorporated Village or Town. 3. No perSon shall erect, alter, o~ change any gasoline and diesel fuel pump or appu~tenance lying 10fithin 150 feet of any limit of a Highway unless a permit has been issued for such 1ofork by the \', '.)1, County Engineer. 4. This permit must be displ~yÐd in a conspicuous place during such \ "{.'",- erecting, altering, o~ changing. Fees for the permit shall be "'1',1", $2.00 fo~ each pump. App~ication Forms and Regulations for inspection ,,¡ill be as determined by the Road Committee from time to time i 5. All persons selling gasoline 0.... diesel fuel f....om any pump 1ofit,hin 150 feet from any limit of any County Road shall obtain a yea....ly permit from the County Engineer. (Such permit must be conspi- cuously displayed in the Owner's place of business.) The fee fOr any pump 10fithin 10 feet of the closest limit of any High10fay shall be $10.00. The fee for any pump not 10fithin 10 feet of the closest limit of any HiglMay shall be free. This permit must be obtained before March 31st of each year. 6. No person shall erect Or install gasoline or diesel fuel pumps or apPUrtenance; (a) closer than 60 feet from the centre of the original Road all010fance Or within 10 feet of the nearest limit of any County Road 10fhichever case is furthest distant from the present centre line of the Road, (b) on a cUrve Or crest of a hill, and (0) on the tangent to a horizontal or vertical cUrve where the sigh't distance is less than 800 feet in each direction; save and except on any County Road in a Police Village or Built Up area. 7. Further to Regulation (6) no person shall install, erect, Or modify gasoline Or diesel fuel pun~s or appurtenance within 150 feet of the nearest limit of a Highway that will in the opinion of the Road Committee; (1) fOrm a hazard to the motoring public or (2) be detrimental to the future improvements of the High1ofay. 8. No per'son shall erect, alter, or modify any gasoline or diesel fuel pumps or apPurtenance" any part of 10fhich is 10fithin 150 feet from any limit of a High10fay at a closer distance than as shown on Schedule "A" as attached from a Road intersecting a '\\ :~ High10fay Or a Railroad right-of-way intersecting a High1ofay. 9. No person shall erect or install any gasoline Or diesel fuel , ";; pumps Or appurtenance' in a B~ilt Up area or Police Village at a "1'.~ .,. closer distance from the limit of any High10fay than the average building line as determined' by the Hoad Committee from time to time. The building line of other Roads (Section 8) is similarly determined. Section 7 shall apply also 'to Highvvays through Built Up Areas and Police Villages for any reason gasoline or diesel fuel should not be regularly sold from a licensed pump for a period of (, months then the Applicant must conform to all 'Regulations of this By- La10f 10fith regard to erecting, changing, altering, etc. The Corporation of the County of Elgin, by their Engineer , may give notice to the 01rmer or Occupant of any land requiring him to remove or alter any gasoline or diesel fuel pumps or appurtenance erected or installed after the passing of this By- La10f that does not comply wit,h any Section of this By-La1of and each Notice under this Section shall be in 10friting and sent by registered mail, addressed to the 010fner or Occupant of the land. If the person to 1ofhorn the notice is given, under Section 11 abihve fails to comply 10fith it 10fithin 30 days from mailing of such notice, the Corporation of the County of Elgin may direct any officer, employee Or agent of the said Corporation to enter upon the land and do or cause to be done whatever may be necessary, to remove or alter such gasoline or diesel fuel pumps or appurtenance mentioned in the said notice, and change the cost thereof to the 010fner or Occupant. Every person 1ofho violates any of the above provisions of this By-La1of shall be guilty of an offence and upon Summary Conviction shall be liable to a penalty of not more than ~t200.00 for each offence and the continuance of the condition constituting an offence each 10feek after conviction, therefore, shall constitute a ne10f offence. This By-La1of shall come in'to effect the day that it is approved by the Ontario Minister of High1ofays. 'READ a first time this 22nd day of March, 1961.
