3. OBOA Southwestern Chapter—request for support of a resolution
regarding re- ualification of Building Officials

WHEREAS municipal building officials are the main
practitioners of the Ontario Building Code (OBC) and use the
OBC on a daily basis in the carrying out of their duties;
AND WHEREAS Bill 124 passed in 2005 required all
municipal building officials to undertake a series of
qualification exams;
AND WHEREAS a subsequent regulation 332112
(knowledge and maintenance examinations) requires our
already qualified officials to re-qualify by taking a similar
series of qualification exams again;
AND WHEREAS this requalification process will provide
municipalities with financial hardships in terms of registration
costs, mileage costs, days away from the office to undertake
their regular duties in performing timely inspections that is
expected by the building industry;
AND WHEREAS municipal building officials acknowledge the
need to stay current with legislation and to undergo
necessary training to do so;
AND WHEREAS the builders and home owners will suffer
slower response time for building permits and inspections
until all of the building officials are qualified;
AND WHEREAS there may be an increase to permit fees to
absorb the additional costs due to train inglcourses,
examinations, travel, accommodations, additional staffing;

NOW THEREFORE the Council of the Municipality of West
Elgin in support of the Southwestern Chapter of the Ontario
Building Officials Association resolves that:
Any amendments to the OBC include provisions for training
opportunities rather than requalification examinations as the
means by which building officials remain current of changes
to the OBC.
That municipal building officials, as the primary practitioners
of the OBC, receive the same treatment as plumbers,
electricians, professional engineers and architects with
regard to exemption from requalification.
That the negative impact and delays that Ontario Regulation
332112 will have on issuance of permits, inspections and
response times to inquiries by municipal building officials
should be taken into consideration.
That municipalities and taxpayers be spared the cost of
'knowledge and maintenance examinations' under the
proposed amendment to the OBC which will provide undue
hardship to municipalities through lost productivity, early
retirement and costs associated with the 13 categories of
examination required by fully qualified inspectors.

will be placed in service as soon as work lighting is installed.
2. "Fence to fence" roadside mowing continues with both units (1 south and
1 north). Main roads are complete with secondary roads in progress.
3. Ditching and culvert replacement on Carroll Line and Gibb Line complete.
4. Culvert replacement on Beattie Line has been completed and ditching
operations there are expected to wrap up shortly.
5. Spot grading is being performed as needed but most gravel roads have
remained in good condition over the summer months
6. Brushing operations are on-going due to calls regarding dead/dying trees.
7. Fall Arrest training being provided as a joint venture with Dutton-Dunwich.
8. Lee Gosnell and Russell Patton will be attending Winter Maintenance
training in London Sept. 24 and 25. Key topics will include Level of
ServicelMinimum Maintenance Standards, proper documentation, winter
weather monitoring and environmental code of practice.
9. This year's Household Hazardous Waste day was held August 17 at our
Public Works garage. Thank you to all the West Elgin/Dutton-Dunwich
employees who rec'd a steady line of residents throughout the day.

Introduction:Monthly report for the Recreation Department.
Background:
1. West Elgin Recreation Center:The Recreation Center project is progressing,although not
without issues.The remaining overhead door had to be replaced,the upper two panels split,
and were bent,the drums on the spring were stripped,not due to misuse or abuse just
merely age and over the past 3 months that door has been used probably more than ever
before. The door expense will be in the maintenance account of the Recreation Center.We
have had great debate and discussions regarding the venting of the storage areas.Currently
there is duct work attached to the south wall to"ventilate"the storage rooms,this will not
be staying in its current form. The electrical portion of the project is not complete.The new
connection to the 3 Phase power was not complete as of Monday at noon.There will be
sufficient power to operate for the fair.There was a miscommunication between the
electrical contractor, Hydro One,and the Electrical Safety Authority.The ESA did their
inspection and Hydro One has 10 days from that date to get their work done,and as such
the hydro service probably will not be switched over to the new service for the fair.The
Kitchen area is looking very nice,the floor should be completed Monday the 9th,the stove
and such will be put back in place on Tuesday,the 10t�,so it will be ready for the fair.The
improvements to the Recreation Center will make the facility more user friendly for a wider
variety of functions.As previously discussed the poor acoustics will be addressed in 2014,
as with the possibility of installing a sound system similar to the one in the arena.
2. The West Elgin Community Pool has been winterized;the building will be done shortly after
the fair,as the washrooms are used for the fair.
3. The organized sporting activities have ended in both Miller and Rodney Parks for 2013.
Therefore the washrooms in Miller Park will be winterized in the near future and the
Marina will be done shortly after that.

4. The Recreation Staff has started to install the ice surface in the Arena,it should be ready
for use as scheduled,September 16 2013.The arena currently is scheduled to be closed on
Monday evenings,due to rescheduling of Minor Hockey and Skating Club ice times.Should
demand increase the option is always there to reopen for that time.Currently the east end
dehumidifier is not functioning as necessary,this is creating some delays in painting the
ice surface.
5. Marty and Connie Kool are returning to the arena to operate the concession for the 2013/
2014 Season.
6. Before the snow flies the frame for the netting behind the soccer nets will be installed to
facilitate the installation of the netting early in the spring.
7. This fall as with every year the parks Department will be planting trees in both Miller and
Rodney Parks.

INTRODUCTION:
The Municipality has received an application to close part of the road allowance
between Lot 14 and 15 Concession 4 WD.
BACKGROUND:
Schedule "A" of By-law 2002-40 provides a procedure to be followed to
permanently close a highway.
DISCUSSION:
Through a title search by the lawyer for the purchaser (McCallum) of the north
half of Lot 15, Concession 4 WD, it was determined that there is an unopened
road allowance. This unopened road allowance is between lots 14 and 15 from
McLean Line to Kintyre Line. The actual road was built between Lot 15 and 16,
being Colley Road. (see attached sketch)
The Public Works Superintendent has no concerns with the closing of the road
allowance as requested.
Schedule "B" of By-law 2002-41 (Sale of Land) notes that an appraisal is not
required for closed highways if sold to an owner of land abutting the closed
highway (s.1 (b). A similar application in 2004 was submitted and Council
determined a purchase price of $1.00 plus all legal, advertising and other costs.

SCHEDULE "A" TO BY-LAW 2002-40
PROCEDURE—TO PERMANENTLY CLOSE A HIGHWAY
1. Application is submitted, along with fee, to Clerk's Department.
a) The application shall include a form signed by the adjoining
property owners that they agree with the closing of the highway or
portion of the highway.
b) Costs for advertising costs, legal fees, registration costs, and
appraisal costs associated with the application are payable by the
applicant. The applicant shall acknowledge, on the application
form, that they are responsible for these costs.
2. A report is prepared by the Clerk and submitted to Council for
consideration.
3. Council shall pass a resolution declaring the lands surplus, establish the
method of determining the purchase price and endorse any other
conditions as are deemed appropriate.
4. If preliminary approval is granted by Council, the applicant is so advised in
writing.
a) Applicant is advised of the resolution of Council, and
b) Applicant is advised to have a proper legal survey prepared, two
copies are to be filed with the Clerk's Department.
5. Upon completion of the legal survey, the following shall be completed:
a) A notice to Ontario Hydro;
b) A notice to Bell Canada;
c) A notice to County of Elgin.
6. Upon receipt of written response to items 5(a)to 5(c), the Clerk shall
schedule the date for the by-law to be considered:
a) Notice to permanently close a highway or portion of a highway shall
be published in the Chronicle for a minimum of two weeks prior to
the by-law being considered by Council.
b) Notice to permanently close a highway shall be posted, clearly
visible and legible from the public highway or other place to which
the public has access, for a minimum of two weeks prior to the by-
law being considered by Council.
7. Prior to the submission of the by-law, Council shall determine the
purchase costs and the applicant be advised.
8. The by-law is submitted to Council for approval on the date specified in 6
(a), above.
9. The Clerk shall prepare a Certificate of Compliance for compliance with
Section 268 of the Municipal Act.
10. The Municipal Solicitor prepares the documents for registration. The
name of the transferee and manner in which title is taken to the road
allowance shall be identical to the abutting lands, to which it is being
added.
11. After registration, the original documents shall be forwarded to the
municipality. The Clerk will forward the registered documents to the
applicant; a copy will be retained for the municipality's records.

RECOMMENDATION:

INTRODUCTION:
Council has requested a procedure be set up regarding recording of votes
BACKGROUND:
By-law No. 2007-112, as amended, is the procedure by-law to govern the calling,
place and proceedings of meetings.
Section 52 states "Where a Member requests, immediately prior to the taking of
the vote, that the vote be recorded, the Clerk shall call all Members present at
the Meeting to vote, with the exception of Members who have declare a
pecuniary interest. The name of each Member who voted and the manner in
which he/she voted shall be noted in the minutes..." The order on voting is not
referenced in the by-law. Past practice has been to call in alphabetical order,
with the Mayor voting last.
DISCUSSION:
There are a number of different ways that the order of voting by Council can
occur. The following are examples from other municipal by-laws:
1. When taking a recorded vote at any meeting, the Clerk shall read the
motion, and the Mayor will ask those in support of the motion to stand, and
the Clerk shall record the names of the members in support of the motion.
The Mayor shall then call for the members that are opposed to the motion
to stand, and the Clerk shall record the names of the members in
opposition of the motion.
2. The Clerk shall call by name the Members present in alphabetical order
except for the Chair whose name shall be called last.
3. Order is determined by Mayor or presiding officer.
4. Voting shall begin with the member who requested the recorded vote, and
continues alphabetically from member onward until the vote is completed.
6. All members present at the meeting must vote in random order as called by
the Clerk, except the Chair who shall vote last.
6. The Clerk shall name each member, beginning with the Head of Council,
followed by the Deputy, then members in alphabetical order.
7. The order of voting shall be determined by the Clerk by drawing the name
of each Member randomly from a Lottery Box provided for such a purpose.
8. The Members shall be called by seating order counter clockwise starting
with the individual Council Member that moved the motion. (In this case,
the seating arrangement is also in the by-law. "The Deputy Mayor shall sit
to the right of the Mayor and remaining seats shall be filled in order of
seniority and thereafter in order of votes polled".)
9. Voting shall proceed simultaneously with the Presiding Officer requesting a
vote for all those in favour and a vote for all those in opposition.
10. The order of voting shall be determined by the Clerk by drawing the name
of the first person to vote from a box which contains all names of Council
members. Thereafter voting is in alphabetical order.
It may be an appropriate time for Council to review the procedure by-law to
determine if other changes should be considered. These may include:
• Consent Agenda —to expedite the meeting, matters of repetitive or routine
nature are included in the Consent Agenda, and all such matters of business
contained in the Consent Agenda are voted on collectively. A Member of
Council can request an item be brought forward to allow debate or for a
separate vote. Examples include items of correspondence where no action
is required, minutes of committee meetings.
• Enactment of By-laws. Except for drain by-laws, there is no legislated
requirement to have separate motions for first, second or third reading of by-
laws. It is common to have first, second and third reading in one resolution.
• Notice of Motion — clarification on procedure to be followed.
• Minutes of the last regular meeting (rather than having minutes only on the
agenda of the first meeting of the month).
• Accounts at every regular meeting.

INTRODUCTION.
The Municipality of West Elgin Fire Chiefs and Administration staff has received
a number of requests for a By-Law to regulate Open Burning. Both the Rodney
and West Lorne Fire Chief's have a number of issues involving Open Bums and
are looking for guidelines/rules to regulate Open Burning in the Municipality of
West Elgin.
DISCUSSION:
Most municipalities in Elgin County (and surrounding Municipalities) have a By-
Law regulate Open Burning (Regulate the setting of fires).
The Open Burning By-Law includes the following:
• Definitions of terms to regulate Open Burning
• The following types of Open Air fires are Allowed anywhere in the
Municipality of West Elgin:
a) Cooking Fires
b) Construction or Maintenance Activites
C) Other Flaming Devices (torches, candles etc)
d) Campfires
e) Chiminea
• Burn Barrels are restricted to the Rural Area with a number of conditions.
• Notification of Open Burn in Rural Area and regulations to follow for such
an Open Burn.
• Burning of Rubbish is Prohibited

THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN?
BY-LAW NO. 2013-
A BY-LAW TO REGULATE OPEN BURNING
WHEREAS the Fire Protection and Prevention Act, 1997, S.O. 1997, c.4, Section
7.1 as amended, states that a council of a municipality may pass by-laws
regulating fire prevention, including the prevention of the spreading of fires, and
regulating the setting of open fires, including establishing the times during which
open air fires may be set.
AND WHEREAS Part 2 of the Ontario Fire Code, O.Reg 388197, provides that
open air burning shall not be permitted unless approved, or unless such burning
consist of a small, confined fire, supervised at all limes, and used to cook food on
a grill or barbeque,
AND WHEREAS the Council of the Municipality of West Elgin is desirous of
enacting a by-law to regulate the setting of fires;
NOW THEREFORE the Council of the Corporation of the Municipality of West
Elgin enacts as follows:
1. Definitions:
For the purposes of this by-law:
a) Approved means approved by the Fire Chief or his/her designate
b) Authorized Agent means any Responsible Person who can provide
reasonable evidence that they are authorized to act for the owner of a
particular property
c) Ban on Open Air fires means a restriction or prohibition on Open Air fires
issued by the Fire Chief or his/her designate
d) Built-Up Area means :
a. The former Village of Rodney and adjacent lands as shown on
Schedule"A"of this by-law
b. The former Village of West Lorne and adjacent lands as shown on
Schedule"B"to this by-law
c. Lands zoned Hamlet Residential (HR), Lakeshore Residential (LR),
Rural Residential One (RR1)and Rural Residential Two (RR2) in the
former Township of Aldborough Zoning By-law No. 90-50, as amended
from time to time or subsequently replaced by a new zoning by-law
e) Building means any structure used or intended for supporting or
sheltering any use or occupancy, but does not include non-enclosing
open-sided structure
f) Chiminea means a device largely made from pottery and which is
equipped with a chimney and a substantially enclosed hearth, approved
by CSA and in which a recreation fire may be set
g) Combustible means any material, combination of materials, or
arrangement of materials in which any portion thereof is susceptible to
catch fire when exposed to heat,flame, or other burning materials
h) Effective Barrier means an enclosure on the ground with a complete
perimeter of metal, masonry, stone or earth,with the enclosure walls
being a minimum height of 113 the diameter or width of the enclosure
i) Exempt means that, under specified conditions, a particular type or
configuration of Open Air fire does not need a Notification of Open Burn
form to be completed.
j) Fire Chief means the Rodney Fire Chief or West Lorne Fire Chief
k) Incinerator means a device that is operated and regulated (licensed)
under a Certificate of Approval from the Ontario Ministry of the
Environment and is not subject to the requirement of this By-law
1) Made Safe means that all reasonable and prudent steps are taken to
guard against injury to persons due to the fire deteriorated condition of a
structure or property and may include, but not be limited to erecting

barriers and signs; grading of property; demolition of unstable structures,
and the removal of residue left from the burning process
m) Municipality means the Municipality of West Elgin
n) Multi-Unit Residential Building means any building in which there are
three or more residential dwelling units as defined by the Ontario Building
Code Act
o) Notification of Open Burn means the completion of the form Notification
of Open Burn (Appendix A), submitted to the Municipality of West Elgin to
set or maintain an Open Air fire, as per any restrictions or conditions
contained in this by-law or as may be specified on the Notification of
Open Burn form
p) Occupancies means the use or intended use of a building or part thereof
as defined in the Ontario Building Code
q) Open Air Fire means:
a. Any fire set outdoors, i.e. not in an enclosed building; or
b. Any fire set in a device or appliance located outside of a building
c. But does not include:
L Fires in incinerators, or
ii. Fires in devices installed outside of a building and the are used as
source of heat or power for the building or that are ancillary to a
manufacturing process, and provided that such device is certified
for the purposed by a recognized and appropriate agency
r) Responsible Person means any adult person (18 years of age or older)
who is capable of exercising the required judgment and capable of
performing the necessary actions to control a fire and prevent its
unwanted spread
s) Rural Area means any lands not designated as Built-Up Area or Trailer
Park
t) Structure means anything constructed or erected, the use of which
requires location on or in the ground
u) Trailer Park means those lands zoned Trailer Park (TP) in the former
Township of Aldborough Zoning By-law No. 90-50, as amended from
time to time or subsequently replaced by a new zoning by-law
2. Restriction on Burning
No person shall set or maintain an Open Air fire except:
a) An exempt fire as described in Section 3 of this by-law ; or
b) As permitted under the conditions specified in the Notification of Open
Burn form, as defined in Section 6 of this by-law
3. Exempt Fires in Entire Municipality
The following types of Open Air fires are exempt and such fires may be set
and maintained anywhere in the municipality provided that the conditions in
this by-law are fully met:
a) Cooking Fires
A charcoal, compressed gas, or wood fire, that is only large enough for the
purpose, and is confined within a barbeque or grill that is constructed of
metal, ceramic, stone,or masonry, and that is exclusively designed for
and being used for the cooking of food for human consumption, and is
continuously supervised by a Responsible Person, and provided that all of
the following conditions are met:
i. Such fire is not on a porch, balcony, or verandah that is roofed
and is attached to a multi-unit residential building
ii. Such fire is not in or near dry vegetation; and
iii. Such fire is not in any other place conducive to the development
or the spread of fire or explosion
b) Construction or Maintenance Activities
An appliance of a portable nature which requires an open flame for the
heating of material during a construction or maintenance process,
provided that such appliance is safe to operate, and provided that it is not

operated in such a manner as to create a fire hazard, and provided that
the fire is attended at all times by a responsible person to supervise it
c) Other Flaming Devices
Other flaming devices such as patio torches,fireworks, and candles
provided that all of the following conditions are met:
i. Such devices are not operated in or near dry vegetation
ii. Such devices are not operated in any other place conducive to the
development or the spread of fire or explosion; and
iii. Consumer(family)fireworks where permitted by by-law
d) Campfires
With the permission of the property owner, a campfire on privately owned
lands provided that such campfire meets all of the following:
i. That the fire is for provision of warmth or for cooking
ii. That, except in the case of a Trailer Park, the areas designated for
the fire is not more than 66 centimeters(26 inches in any
horizontal dimension
iii. That all materials to be burned are contained around the complete
perimeter of the designated area by an Effective Barrier of metal,
masonry, ceramic, or stone; or are within a like-dimensioned pit in
the ground that has a non-combustible wall and is intended to
burn wood safely
iv. That the pile of materials to be burned is not more that 66
centimeters (26 inches) in height, and 66 centimeters (26 inches)
in width and length
v. Tha#the fire is located at least 4 metres (13.1 feet)from any
building, structure, property line, tree, canopy, hedge, fence,
roadway, overhead wire or other Combustible material
vi. That the fire is controlled such that flames and hot embers do not
pose an undue risk of fire to nearby Combustible materials
vii. A means to extinguish the fire are readily accessible
viii. That the fire is attended at all times by a Responsible Person to
supervise it; and
ix. That at the completion of the burn the fire shall be completely
extinguished and the burn site shall be made safe before it is left
unattended.
e) Chiminea
A fire in a Chiminea on any privately-owed lands provided that such fire
meets all of the following:
i. That in a Built-Up Area no portion of the hearth of the Chiminea is
more than 61 centimeters(24 inches) in diameter
ii. That only clean and dry wood or charcoal be burned
iii. That the Chiminea is not located on any Combustible surface
iv. That the fire is controlled such that flames and hot embers do not
pose an undue risk of fire to nearby Combustible materials, and
v. That the fire is attended at all times by a Responsible Person to
supervise it
4. Burn Barrels
An enclosed fire in a burn barrel on privately owned lands that are located in
the Rural Area provided all of the following are met:
i. That the burn barrel is situated securely on level ground
ii. That the burn barrel is in good condition
iii. That all openings in the burn barrel are covered at all times by a
suitable metal wire mesh with a grid opening of not more than 6
mm (114 inch) in diameter; and
iv. That the fire is attended at all times by a Responsible Person to
supervise it

5. Conditions on Exempt Fires
Any person who sets or maintains an Exempt fire as in Sections 3 or 4 of this
by-law shall be responsible to take all necessary steps to ensure that all of
the following conditions are met;
a) Smoke
a. The smoke or other emissions from the fire shall not travel to a
neighbouring property to such an extent or degree that, in the opinion
of the Fire Chief or his/her designate, it may cause discomfort to
persons, loss of enjoyment or normal use of property, interference with
normal conduction of business, or damage to property
b. The smoke or other emissions from the fire shall not travel across any
public roadway to the extent or degree that, in the opinion of the Fire
Chief or his/her designate, it may cause a public safety hazard to any
person travelling on the roadway.
b) Clearances
a. An Open Fire shall be located a distance of at least 10 meters (32.8
feet) horizontally and 10 meters(32.8 feet) below any portion of an
Combustible structure or accumulation of Combustible materials;
except that the lesser clearance shall apply as follows:
L That a barbeque or grill fire shall be located at least 1.5 meters
(59 inches) horizontally and 3 meters(118 inches) below; and
ii. That a Chiminea shall be located at least 3 meters (118 inches)
and 6 meters(236 inches below; and
b. Despite meeting the minimum distances specified in this section,
burning is prohibited at any location where the conditions exist such
that there is a reasonable probability of such fire spreading to a
Building, structure, grass, or other Combustible vegetation or material.
c) Material Restricted
Except as may be more specifically restrictions elsewhere in this by-law,
only the materials listed on Schedule"C"may be burned
d) Extinguishment
At the completion of the burn, the fire shall be completely extinguished and
the burn site shall be made safe before it is left unattended.
6. Notification of Open Burn
a) The Property Owner or Authorized Agent shall submit a completed
Notification of Open Burn form (Appendix A) to the Municipality of West
Elgin
a. That only the items listed in Schedule"C"shall be burnt
b. All of the conditions of Section 5 of this by-law shall apply equally to all
fires
c. Constant supervision of the fire shall be maintained by a Responsible
Person,with the necessary means immediately available to extinguish
d. The property owner shall be held responsible and shall be liable
individually and severally for the actions of their Authorized Agent with
respect to the provisions, conditions, and penalties contained in this
by-law
e. No person shall conduct an open air burn on any public road
allowance or municipal property unless such burning is being
conducted by an authorized employees or Authorized Agents of the
Municipality
f. Fires must be located at least 30 meters (98.43 feet) away from any
Building, Combustible structure, Combustible vegetation, accumulation
of Combustible materials, or as measured on the ground horizontally
from any overhead wires carrying electricity, but in any case, longer
distances may be required, if in the opinion of the Fire Chief, the
material being burned will emit sparks and embers such as to create a
fire hazard

g. Fires must be located at least 150 meters (492.15 feet) away from an
occupied Building when the wind direction is such that at any time
during the course of the fire, smoke from the fire is likely to pass in the
vicinity of the occupied Building
h. The size of any pile of materials to be burned:
i. Shall not exceed 9 square meters (96.84 square feet) in area and
2 meters (78.75 inches) in height unless specifically approved
under application of a Burning Safety Plan
ii. In the case of an area zoned Agricultural, shall not exceed 36
square meters (387.36 square feet) in area and 2 meters (78.75
inches) in height unless specfically approved under application of
Burning Safety Plan; and
iii. In any case, the fire size or materials burned shall be controlled
such that flames and hot embers do not pose an undue risk of fire
to nearby Combustible materials
i. Burning will not be permitted between '/Z hour after sunset and 1/2 hour
before sunrise(i.e. at night) unless specially approved under
application of a Burning Safety Plan
j. No burns shall occur during such periods and in such areas where
gusting or sustained wind speed exceed 20 kilometers per hour(12.43
miles per hour) or where wind directions are changing frequently
k. All burning will be suspended during such periods and in such areas
where the Fire Chief, or his/her designate has determined that there
exists a high or extreme fire weather index(FWI) or other hazardous
conditions
I. The Notification to Open Burn form shall specify as--precisely as . .... ..
possible the civic or street address of the location of the intended fires.
Separate forms are required for properties at different addresses
m.The person who submitted the Notification for Open Burn form is
required to advise Fire Dispatch before any burning commenced and
again when the burning is completed and the fire is extinguished
n. A copy of the Notification to Open Burn shall be kept at the location of
the fire as specified.
7. Burning of Rubbish Prohibited
No person shall install, use, and/or maintain any unlicensed incineration
device for the burning of garbage or other refuse in any class or classes of
Building
8. Fire Ban
the l=ire Chief, or designate, may issue a ban on any or all Open Aire fires or
cause to be extinguished any of all Open Air fires (including Exempt) until
such conditions as the Fire Chief may indicate are met
9. Right to Enter and Enforce
Any fires under the direct and constant supervision and control of the
Municipality are exempt from the provisions of this by-law
10. Fire Department Exempt
Any fires under the direct and constant supervision and control of the
Municipality are exempt from the provisions of this by-law
11. Penalty
a) Every person who knowingly provides false or misleading information or
who contravenes any provisions of this by-law is guilty of an offence and
conviction is liable to a fine provided for in the Provincial Offences Act
b) If the contravention of this by-law result in fire suppression or fire safety
personnel and vehicles being dispatched to respond, the person in
control of the fire and/or the property owner may be charged, at the
discretion of the Fire Chief,for the cost of such response according the
By-law 2013

Fees and Charges By-law as amended from time to time. However,
noting in any schedule of rates shall be construed as limiting the rights of
the Municipality to seek restitution for other direct or consequential
damages or costs incurred beyond those listed,
c) The quantity and type of fire vehicles and personnel dispatched to
respond for the purposes of extinguishing, controlling or investigating any
Open Air fire are at the discretion of the Fire Chief or his/her designate
12. Validity
In the event that any of the provisions of this by-law are deemed ultra vires
by ay Court of competent jurisdiction,the remaining terms and provisions
shall remain in full force and effect.
13. Repeal
Any by-law or by-laws, or parts of any by-law or by-laws that are inconsistent
with this by-law are hereby repealed,
14. Effective Date
That the effective date of this by-law shall be the date of final passage
thereof.

SUBJECT: Municipal Election 2014
RECOMMENDATION:
THAT Council authorizes the use of an alternative voting method — Internet and
Phone Electronic Voting for 2014,
AND that a Request for Proposal be issued.
INTRODUCTION:
In preparation for the municipal election in 2014, it is time for Council to decide
on the voting method to be used.
BACKGROUND:
The Municipal Elections Act allows a variety of"alternative" voting and vote
counting methods.
DISCUSSION:
In 2010 West Elgin used alternative voting methods consisting of internet and
telephone voting as well as paper ballots. The percentage of electors voted was
42.2% with 59.5% of those who voted used the internet or telephone with
internet being the most popular method. This compared to 23% in 2003 and
28.7% in 2006.
In 2010 as an interim measure paper balloting was also available. The theory
being that for the first time paper balloting be allowed but in future elections this
would not be the case. An analysis of voting by ward and type for 2010 is
attached.
There are a number of reasons for not providing paper ballots:
• Cost savings
• Voting location must be accessible
• Parking
• Counting occurs after 8 p.m. on Election Night which is time consuming. If
only internet and telephone voting is used, the results should be available
shortly after 8:00 p.m. In 2010 there were some administrative issues in
conducting the manual count.
• Need for computer literate poll staff as the voters list is on the internet (why
internet availability at the Voting Place is required).
Difficulty in finding a location for paper ballot voting on Election Day that has
internet capability with an electronic voting list.
• No need for an Advance Poll if paper balloting is not offered
• With internet and telephone voting, the voters can vote anytime and
anywhere for a seven day period (Monday October 18th'2010 to Election Day
on Monday October 25th 2010 at 8:00 p.m.). A computer was available at the
municipal office during regular business hours for this period and on Election
Day until 8:00 p.m. for electors to use. Staff were available to assist.
• With internet voting, can also vote at the municipal office and libraries during
their business hours; with telephone voting, can vote using a personal
land line/celphone/smartphone.
Once a decision has been made by Council, an RFP will be prepared and sent to
companies that provide this service.

INTRODUCTION:
At the July 18, 2013 the concern was raised about the Blue-Green Algae that
occurred and the delay in notifying the public of the possible health concerns. At
the meeting Councillor Miller agreed to draft a letter to Elgin-St. Thomas Health
Unit.
DISCUSSION:
Since the discussion at the July 18th Council, the Blue-Green Algae may have
recurred this past weekend and as the letter states gives the residents concern
of whether the water is safe to swim in. Regular monitoring and posting by the
Elgin-St. Thomas Health Unit current policies and procedures be reviewed.
On Thursday September 5, 2013, OCWA nofified the municipality of changes in
water quality and effects of treating water. This was reported to the Health Unit.
A letter has been prepared for Council's consideration, requesting the Elgin
County be proactive to ensure that health of its residents is protected.

Dear Mr. Reffle,
Earlier this summer in Lake Erie along the shore of Chatham-Kent and Western Elgin, a blue-
green algae bloom occurred again. Some councillors had numerous complaints about water quality and
the presence of some strange fish behaviour.
Councillor Norman Miller had heard public safety bulletins aired on Chatham-Kent radio stations
ab.aut_w-ater_quality_health wa_rnings.and-bea6-ctm"esAhr_oughout Chatham-Kent. Councillor Miller
was concerned that the same algae problem existed at Port Glasgow but had not heard about any
warnings or correspondence to make Elgin County residents aware of the issue.
When a call was made to the Health Unit in St. Thomas and he was surprised to find out that the
Elgin St.Thomas Health Unit normally does not sample for blue-green algae unless concerns or
complaints are made. At that point Councillor Miller requested that his call be considered a complaint
and to please consider testing for the algae.The Health Unit was very co-operative and had the test
performed and found the presence of the algae.The beach was closed and it was then in the news
about the problem.
The Municipality of West Elgin is currently assessing the criteria and applying to become a Blue
Flag Beach at Port Glasgow. if Port Glasgow achieves Blue Flag status, most people would assume that
water quality is above-average.
In order to give people this confidence, the Municipality feels that the Health Unit should be
monitoring for blue-green algae on a regular basis. Furthermore, a plan should be put in place that
ensures consistent public notification if and when the blue-green algae blooms occur.
Last week, certain councillors were notified about adverse odours from the waters at Port
Glasgow. One resident said that even after thoroughly washing their bathing suits,they still had a very
putrid,sewage type smell.
It is apparent that the blue-green algae problem is going to be a re-occurring event. Elgin
County must be proactive and ensure that the health of its residents is paramount.Therefore, please
review the current policy regarding blue-green algae testing and the process of notifying the public
about water quality issues.

INTRODUCTION:
The present photocopier is a Toshiba 4511 purchased in 2005 and is
experienced maintenance issues. Our current maintenance costs are $0.021 per
copy for Black and White and $.204 per copy for Colour. The 2013 Budget
included $10,000 for replacement of the Photocopier.

JUNE 28, 2013 AND ORDER OF THE BOARD
BACKGROUND
[1] Having engaged in extensive settlement discussions regarding the appeal and
the secondary planning requirements in Port Glasgow, the parties request that the
Ontario Municipal Board ("Board') issue an Order modifying and approving those parts
of the West Elgin Official Plan ("OP") under appeal. Seaside and Lighthouse would
withdraw their appeals against the lands owned by Lighthouse on Lot 5, Con. 14, and
those parts of the OP under appeal would either remain as approved by the Minister, or
be modified as agreed by the parties, and presented to the Board.
[2] The settlement discussions were Informed by the public council sessions on the
proposed secondary plan. At an open council session members-of the public were
informed that the settlement of the OP appeal would include providing more detailed

policies to guide developments in Port Glasgow in the form of the Port Glasgow
secondary plan. It was also publicly noted that the settlement and secondary plan
policies would be presented to the Board for endorsement in these proceedings.
[3) The Board heard evidence from Gary Bfazak, Registered Professional Planner,
appearing on behalf of the Municipality, that the modifications to the OP proposed
through the settlement appropriately address and reflect the interests of the Council and
the community. In addition, Mr. Blazak demonstrated that the parts of the OP being
considered for approval are consistent with the Provincial Policy Statement, 2005.
DISPOSITION AND ORDER
[4] In light of the settlement and the evidence that the proposed modifications to the
OP as it relates to Port Glasgow represent good planning and are consistent with the
Provincial Policy Statement, 2005, the Board approves the settlement and hereby
Orders:
(A) Section 1.5 of the OP is modified as follows:

The third paragraph of Section 1.5, Growth Management Strategy, is
modified by inserting the following as the second paragraph:
"In addition, the Port Glasgow Community area shall accommodate growth
and development on public and private services in accordance with the
Port Glasgow Secondary Plan in Section 11 of this plan."

The words "including Port Glasgow" are deleted in the third paragraph of
Section 1.5.
(B) Section 5.1 (a) of the OP is approved.
(C) Section 7.1 of the OP is approved.
(D) Section 7.5 of the OP, which was modified through Modification 40, is deleted
and replaced with the following:

7.5 Port.Glasgow Specific Policy Area
The following policies apply to the land designated as-"Port Glasgow
Specific Policy Area" on Figure 6.
Port Glasgow on the snores of Lake Erie lies within the 'Lakeshore Area'
designation and consists of a small concentration of year round and
seasonal dwellings, campgrounds, a yacht club, marina and beach. It is
the one area along the lakeshore within West Elgin where public access to
the lake and views of the lake are the greatest. It is presently serviced by
a municipal water supply system. Improvements to the harbour and
adjoining-municipally-owned lands are on--going:
It is intended that lands within the Port Glasgow Specific Policy Area,
identified on Figure 6, continue to develop as the centerpiece of the
'Lakeshore Area` offering a range of housing types, recreational and
cultural opportunities, and commercial establishments catering to both
residents of the Municipality and visitors from outside the area.
Development within the fort Glasgow Specific Policy Area is anticipated
and encouraged subject to the appropriate level of services being in place.
The natural heritage features; cultural heritage features, access to the
lake, and views of the lake will be protected and enhanced wherever
possible.
A Secondary Plan may be used to establish more detailed land use
policies and land use designations than that of this Plan.
A Secondary Plan has been prepared for lands within the Port Glasgow
Specific Policy Area identified on Figure 6. Prior to amending in the future
the Secondary Plan, the municipality will consult with the public, interested
public bodies, relevant approval authorities, and others.
The Secondary Plan, if amended, will appropriately address the
development of the Port Glasgow Policy Area in accordance with this
section. Such Secondary Plan shall include the following;
(a) population and demographic characteristics;
(b) the type, density and arrangements of uses;
(c) urban design guidelines;
(d) vehicle, bicycle, and pedestrian circulation;
(e) public access to and views of the lake;
(f) lands to be dedicated to the Municipality for public use;

(g) protection and enhancement of potentially impacted natural heritage
and cultural heritage features;
(h} servicing strategies; and,
(i) the phasing of development.
Such Secondary Plan will be comprised of land use policies, (a) concept
plans(s) and supporting schedules, drawings, reports, documents and
information.
The Port Glasgow Secondary Plan is included as Section 11 to this Official
Plan,
The Secondary Plan may be updated or amended, as needed, through
five year review of the Official Plan or an Official Plan amendment, in
conformity with the relevant goals, objectives and policies of this Plan."
(E) Section 11, Secondary Plan for the Port Glasgow area, is added to the OP
through Modification 50, as set out in Appendix "A".
(F) Figure 5, Map 2, as adopted by Council and modified by Ministers Modification #
47(vil) is approved.

SUBJECT: Streetscape — Community Improvement Plan
RECOMMENDATION:
That Ted Haiwa of Monteith Brown Planning Consultants present the final report
of the Streetscape project to Council at the September 26, 2013 Council
Meeting.
INTRODUCTION:
The Community Improvement Plan development started in 2007. The following
actions have come from the development of the Community Improvement Plan:
• Community Improvement Plan was adopted by Council Sept. 10109
• Business Retention & Expansion Task Force was set-up with a
report submitted to Council June 24, 2010
• Potential BIA was investigated with a By-Law drafted, public
meeting held, the By-Law was not adopted (2011)
• Farmers Market (Rodney) Committee was formed
• Arts & Cultural District Task Force (West Lorne) Committee was
formed
• Streetscape Committee was formed with Municipality of West Elgin
Planner as chair and have completed a Master Plan for
consideration by Council.
DISCUSSION:
Council asked that a summary of the costs for the project be prepared by the
Administrator, listed below is a summary of the costs for all Community
Improvement activities by year:
• 2007 $10,971.75
• 2008 $ 7,927.45
• 2009 $17,714.46
• 2010 $12,896.86
2011 $35,445.72
2012 $ 3,086.91
2013 $ 3,3.46.19
$91,389.34
The Streetscape Committee has completed a Master Plan for Council's review and
consideration for adoption. Once the plan has been reviewed and approved by Council,
the implementation schedule to be considered during the annual budget process for
both short-term and long-term planning. The Streetscape Plan is available today for
council to review before the presentation on September 26, 2013.

The Elgin County O.P.P. Detachment is committed to working collaboratively with all of our
municipal partners and community stakeholders.
Historically, members of the Elgin County O.P.P. have provided security/policing roles at Stag &
Does, held in community owned facilities. These members execute their duties in a
professional manner and are compensated in accordance with O.P.P. Paid Duty Policy.
Unfortunately, some privately arranged functions involve activities that contravene the Liquor
License Act and Gaming Control Act. The presence of O.P.P. members gives an inference
police condone unlawful actions and thus place the O.P.P. in a negative position with respect to
liability.
Subsequently, in consultation with the Elgin Group Police Services Board, Elgin County O.P.P.
will no longer provide Paid Duty officers at Stag and Doe licensed events. This letter is being
provided in anticipation of necessary amendments to current by-laws and/or municipal alcohol
policies.
Please be aware of practical alternatives available to municipalities to continue these functions,
such as employing private security firms or municipalities obtaining liquor licenses for
municipal/community buildings.

CAD's and direct the Manager of Planning and the Purchasing Officer to
prepare a Request For Proposal to proceed with a parcel realignment and
correction project on behalf of Elgin's seven local municipalities, effective
in 2014 and that costs be allocated to each local municipality based on
parcel counts and that private sector contributions be pursued in order to
reduce overall costs: and,
THAT County Council directs staff to advise and seek approval from all
local municipal Councils of all costs associated with such project prior
to the County of Elgin entering into any agreement(s) with vendors; and,

SUBJECT: GIS Parcel Realignment and Correction Proposal
INTRODUCTION:
This report will provide County Council with information about Geographic Information
System (GIS) mapping for Elgin County and the process required in providing accurate
parcel mapping for all partner municipalities.
BACKGROUND:
Elgin County receives parcel mapping data from Teranet, a company that supplies
electronic mapping to all Registry Offices in Ontario. The mapping the County receives
is referred to as Digital Assessment Parcel Fabric (DAPF) and is updated quarterly.
This data is shared with partner municipalities for their use through a multi end-user
agreement. The Teranet mapping for Elgin County is called Basic Information Mapping
and is not as accurate as the mapping for some of our neighbouring Counties such as
Oxford and Middlesex. When the DAPF mapping is overlaid onto Elgin's SWOOP 2010
aerial photographs the inaccuracy of mapping becomes very evident. (See attached
property map comparisons between Elgin and Oxford Counties).
The inaccurate mapping is a concern for users especially for municipal staff when
locating property for planning applications and circulation of notices.
This mapping issue has been discussed with partner municipalities, Teranet and a
company called QSP that provides a parcel realignment service. QSP charges a fee of
$2.00 per parcel to make corrections and indicates that it is more cost-effective to carry
out the parcel realignment process on a County-wide basis than for each local
municipality to do this individually. There are approximately 22,000 parcels in the
County which means that a one-time expenditure of about $44,000 would be required to
correct the parcel mapping in Elgin.
The County does not utilize GIS and therefore parcel corrections are only useful to local
municipalities. It was agreed that each municipality should pay for its particular corrections
On June 14, 2013 the issue was brought to an Elgin County GAO's meeting for review
and resulted in a unanimous agreement to proceed with the parcel realignment project
with each local municipality covering its allocated costs based on parcel counts. There
is also a possibility that costs can be shared with a number of private sector partners
including Thames Erie Power and Union Gas. (Parcel counts for each local municipality
are attached).
Through an agreement with Teranet, Elgin County has been obtaining Digital Assessment
Parcel Fabric (DAPF) mapping at an annual cost of$2,900.00 + tax, for a number of years
and shares this data with local municipalities. In addition an agreement with the City of
St. Thomas has been in place since 2008, to host the data and to make such data
available through the Internet on the City's C-Map web server. The annual fee for
hosting the mapping data is $500.00.
Elgin's five-year agreement with Teranet for the delivery of DAPF products expires in
December 2013 and will need to be renewed. Teranet has indicated that the cost will
remain at $2,900.00 plus applicable taxes.
CONCLUSION:
As a result of a meeting with Elgin CAD's there is unanimous agreement that the
County of Elgin should proceed with the parcel realignment and correction process on
behalf of its partner municipalities.
In addition, to be consistent with past practices, Elgin County should continue to cover
the on going costs of obtaining Digital Assessment Parcel Fabric (DAPF) mapping data
through Teranet, on behalf of all local municipalities.
RECOMMENDATION:

Called, Expedition Elgin, this event is designed to move
around Elgin County and highlight our communities and local
charities. This year we are delighted to announce it will take

The event is a 3km route through a TOP SECRET route around
town. Each team of 4 leaves the starting point (Tasty Sweets) with
their first clue.They must decipher that clue to find their next
checkpoint,....then complete a challenge successfully to receive
their next clue.
Pre-Registration is required, and we are expecting up to 50 Teams
of 4 participating and up to 50 volunteers. There are staggered
starts from 9:20am to 11:20am.The average time to complete the

Registration is free; however each participant is required to raise
a minimum of$100 in pledges/donations(donations of$10 or more receive a charitable tax receipt). ft is our

behalf. We award around $5,000 in prizes each year......and the top fundraiser(s) are always the best prizes!

Prizes are awarded at 4pm, music is provided by MyFM. We will invite a food vendor(to be determined).There will
be no alcohol served. By 5pm we will be all packed up and heading home.....

Bayham, Municipality of Central Elgin, Township of Malahide, Municipality of
Dutton/Dunwich, Township of Southwold, Municipality of West Elgin
Subject: Planning Reports -Application for Consent
In an attempt to make sound planning decisions the Land Division Committee carefully
reviews all of the factors involved when deliberating and is therefore requesting that
each individual Planning Report reviewed by all municipal councils be forwarded to the
Committee in advance of their hearings as per the following resolution passed July 24,
2013:
"THAT the Land Division Committee request that all Lower Tier Municipalities forward a
copy of the Planning Report reviewed by their council to the Land Division Committee
in advance of their hearings."

It is the Committees intention to review the Planning Report for each individual
application which will provide additional information when making decisions.

Regular Session
May 14 2013
This regular session of the West Elgin Arena Board was called to order with the
following members present: Bob Purcell, Alphonse Willie, Mary Bodnar, and Recreation
Superintendent Jeff Slater. Member Dug Aldred will be absent as per the e-mail received.

It was decided that it was not necessary to have an In Camera Session.

1. Concession Agreement: The Concession Agreement was deferred until the next
session. It was indicated that Mr. Kool current concession Operator will have to
clearly indicate what and when they want to be closed for. It was also suggested that
the Recreation Superintendent send letters to local service clubs inquiring as to
whether or not they would be interested in operating the concession.

1. Cadets: The Local West Elgin Cadets requested the use of the arena for their Annual

Inspection. The request was deferred to West Elgin Council for their consideration.

Regular Session
June 18 2013
This regular session of the West Elgin Recreation Committee was called to order at 7:00 pm at
Joes Bush with the following members present: James Husband,Doug Staddon,Ken Neil, Dug
Aldred,Joe Seman Jr, Grace Blanchard,Jennifer Blanchard and Parks and Recreation
Superintendent Jeff Slater.
This session of the west Elgin Recreation Committee was held in part at Joes Bush, and then
retired to the Rodney Fire Hall.

Item#4 Business Arising from the Minutes:
1. Fun Run: After some discussion there was no consensus as to the date for the 2014 edition of
the run. There are many conflicting dates with other runs in the area.
2. Thompson's Land: Councillor Dug Aldred reported that the Thompson's Lands previously
discussed were now owned by the Municipality.
Item#5 Correspondence: There was no correspondence presented.
Item#6 New Business:
1. Member Joe Seman Jr inquired as to the possibility of installing Basketball nets in the
parking lot at the arena. The Recreation Superintendent indicated that there were basketball
standards/goals at the West EIgin Senior Elementary School, and that encouraging people to
play in a Parking lot may not be in our best interest.
The members were encouraged to bring their new and innovative ideas to the next session of the
Parks and Recreation Committee in July.
