'A BY-LAW' TO AUTHORIZE THE EXEROPRIATION OF LAND FOR
THE PURPOSE OF WIDENING AND IMPROVING COUNTY ROADS."
WHEREAS under Section 333 of the Municipal Act;, being Chapter
249, R. S. O. 1960, the Council of every Corporation may pass By-Laws for
acquiring or expropriating any land required for the purpose of the
Corporati on.
AND WlffiREAS the Highway Improvement Act, R. S. O. 1960, Chapter
171, Section 66, provides that where, in the exercise of its powers, or
in performance of its obligations under Part VII of the said Act, a
County finds that it is necessary to expropriate land for the purpose of
opening up, widening, improving, protecting from erosion, altering or
diverting a County Road, the Ceunty may proceed in the manner provided
by Part 1 of the said Act:
AND WlffiREAS in the exercise of its powers and in performanoe
of its obligations, the Cerporation of the County of Elgin finds, or
may find, that it is necessary to expropriate lands for widening,
improving, etc., the county roads shown on Schedule A as attached:
BE IT THEREFORE ENACTED by the Corporation of the County
of Elgin
(1) That the Warden and Clerk of the Ceunty of Elgin be,
and are, authorized to sign any and all plans pertaining
to land expropriation for County Roads shown en Schedule
A, and to affix thereto the Seal of the Corporation
of the County of Elgin and to register the same in the
County of Elgin Registry Office.
(2) That the Treasurer be, and is hereby authorized to
pay to the owners of the lands hereby expropriat~d,
such amounts as may be agreed upon as compensation
for the lands expropriated, or such compensation as
may be determined by arbitratien under provisions of
