2318 · COUNTY OF ELGIN By-Lm.¡ No. 2318 "AUTH01U6ING SPEED Ll!UT3." WHEI¿EAS subsection 7 of section 82 of the Highway Traffic Act (R.S.O. 1970, Chapter 202) a.uthorizes the Council of a 'rownship or County by By-Law to prescribe a lower or hig'her rate of speed for motor vehicles on r) highway or portion of highvv"ay under its jurisdiction that is not wi thin a built-up area or suburban district {-hart is prescribed in clause (a.) of subsection 1 of section 82, but such ra.te of speed shall not be less than 35 miles per hour or more than 60 miles per hour; \ AND ·\VHEJ.\'EAS it is deemed expedient that the speed limi t for n\otor vehicles on certa.in highways in the County of Elgin be either decreased or increased or both; NOW 'rI-IEREFOl"i:E the Council of the Corporation of the County of Elgin enacts as follows: 1. 'vJhen any highway or portion of highway set out in Schedule A, appended hereto is ma.rked in complia.nce with the regulations under The Highway Traffic Act the maximum rate of speed thereon sha.ll be the rate of speed' prescribed in the schedule. 2. The penalties provided in subsection 16 of section 82 of the Highway Traffic Act shall apply to offences against this By-Law. 3. This By-Law shall not become effective until a.pproved by the Ministry of Tra.nsportation a.nd Communications. READ a first time this 18th day of September, 1974.
