SICK LEAVE AND LONG TE~M DISABILITY BENEFITS FOR EMPLOYEES

WHEREAS By-Law No. 81-41, as amended by By-Law
No. 82-30, provides for Sick Leave and Long Term Disability
coverage; and
WHEREAS it has been deemed appropriate to alter
these benefits.
NOW THEREFORE the Municipal Council of the Corpo_
ration of the County of Elgin enacts as follows:
1. That Section 3, SICK LEAVE, of By-Law No. 81-41 be
deleted and the following substituted therefore -

3.01 Each non-union employee, upon completion of three
months continuous service with the County, shall be
eligible for the new short term disability benefit.
3.02 Benefits as outlined below (3.03) will commence on the
first day of disability due to non-occupational accident
or sickness and will be payable for up to 75 days for
anyone illness or accident. (For the year 1983 all
entitlements under this plan will be reduced by 50%
as the plan becomes effective July 1st, 1983 with
service as of June 30th, 1983).

3.04 Full salary days will automatically be reinstated at
January 1st of each year, based on the length of
service at that time, whether off sick at the time or
working.
3.05 These days may not be used to top up Workmen's
Compensation.
3.06 An employee absent on a Statutory Holiday will be
charged as one day. In order to qualify for a
Statutory Holiday it is necessary to work on both the
day before and after, the employee is scheduled to
work.
3.07 An employee is entitled to receive the County's con-
tribution towards any benefits as long as they appear
on the payroll.
3.08 Any days to the credit of the employee contain no cash
value, on termination of employment, by reason of
retirement or otherwise
Effective July 1st, 1983, the employer will reimburse
the employees 100% of the premium of a long term
disability insurance plan. The plan will provide for
the payment of 55% of the employee's monthly earnings,
to a maximum of $3,000. A waiting period of 75 working
days is required before the benefits under this plan
take effect. The premium will be taxable while the
benefit will not. Upon completion of the probationary
period, all employees, not covered by a collective
agreement, shall as a condition of employment, become
members of the long term disability plan

2. That Section 6, HEALTH AND WELFARE, Subsection 6
entitled "Long Term Disability (LTD)" of By-Law No. 81-41,
amended by By-Law No. 81-67, be repealed and the following
substituted therefore

Any employee accumulated leave days, with
less than 5 years of continuous service, at the date
of terminating and freezing of the sick leave plan,
will be entitled to receive all the benefits outlined
above, ,once they have completed 5 years of continuous
employment

Any employee with accumulated sick days in excess of
260 will retain those excess days to top up the new
short term plan, or payments from Workmen's Compensation
with sick
In addition, an employee will be allowed to deplete
their accrued sick leave days (maximum of 130 days) to
a maximum of approximately ten percent (10%) in any
calendar year, calculated on his/her current rate of
pay (minimum of payout $1,000). For every day paid,
two days will be deducted from an employee's accumu-
lated days. For 1983, a request for a draw against
accrued sick credits had to be received by June 1st,
with payment being made July 15th. All future requests
for draws of approximately 10%, must be in the hands
of the Department Head by November 15th each year, with
payment being made April 1st of the next year

In the meantime, an employee may use his/her frozen
sick leave days to supplement the new short term
disability plan. or payments from Workmen's
Compensation

Effective June 30th, 1983, the present sick leave plan
will terminate and all existing gratuity sick leave
benefits will be frozen. Each employee will receive
50% of the value of his/her vested accumulated days
upon termination of employment or retirement, based on
the daily rate in effect at that time, to a maximum of
130 days.

After an employee has had three (3) periods of sick
leave of three (3) days or less within a calendar
year, the Employer may refuse to pay for the fourth or
subsequent period of sick leave, notwithstanding that
the employee has accumulated sick leave to his/her
credit. It is understood that this provision is an
endeavour to eliminate abuses of sick leave and is in
addition to any other disciplinary action which the
Employer may deem fit to invoke. Where sick leave
absence has been in excess of five (5) consecutive
days the employee shall not be paid sick leave credits
unless he/she furnishes the Head of his/her Department
with a Doctor's Certificate or other explanations
satisfactory to the Employer

Disability is defined as follows
During the first two (2) years of income payments the
disability must prevent the employee from performing
the duty relating to his/her regular job. After that
time the income benefit will continue if the disability
prevents the employee from engaging in ~~illEl£~~
for which he/she is reasonably qualified by education,
training or experience.
3 That this By-Law shall become effective July 1st, 1983
