COUNTY OF ELGIN By-Law No. 83-39 '- ~~I~G A BY~W ,TO PRESCRIBE A TARIFF OF FEES FQgTHE PROCESSI~G OFLA~D DIVISIO~ COMMITTEE APPLICATIONS." ----- . ... -- -- WHEREAS Section 68, of The Planning Act, R.S.O. 1980, as amended, provides that the Council of a municipality may by by-law prescribe a tariff of fees for the processing of applications by a Land Division Committee; and WHEREAS it has been deemed advisable to set out the fees to be charged for processing applications by the Elgin County Land Division Committee. NOW THEREFORE the Municipal Council of the Corpo- ration of the County of Elgin enacts as follows: 1- That the following tariff of fees be charged for processing applications: (i) Fee to accompany an application for consent - $150.00. (ii ) Once an application for consent has been accepted by the Secretary-Treasurer or designate and in the event it is withdrawn or amended for any reason, prior to the hearing, a portion of the fee will be retained or additional charged in accordance with the following - (a) If withdrawn at least 14 days prior to the date set for the hearing, $50.00 will be retained. If amended at least 14 days prior to the date set for the hearing, an additional $50.00 will be charged. (b) If withdrawn after the time limit set in (a), the entire fee will be retained. If amended after the time limit set in (a), an additional $50.00 will be charged. (c) In the event it is necessary to recon- sider an application once consent has been granted, in order to alter in a minor way, the original decision, it will be treated just as if it were a new application, in so far as order to be heard. In addition, a fee of $5.00 must accompany the letter explaining the reason for the change. 2. That this by-law shall become effective upon passing READ a first time this 21st day of September 1983.
