By-Law No. 86-72
"TO EXPROPRIATE LANDS FOR THE IMPROVEMENT OF COUNTY ROAD
NUMBER 26 IN THE COUNTY OF ELGIN."
WHEREAS it is expedient to expropriate lands for the
purpose of improvement of County Road Number 26 in the County
of Elgin; and
WHEREAS the necessary preliminary proceedings have
been taken as required by The Expropriations Act, R.S.O. 1980;
and
WHEREAS by resolution of the Municipal Council of the
Corporation of the County of Elgin approval has been given to
expropriate the lands hereinafter described.
BE IT THEREFORE ENACTED as By-Law No. 86-72 of the
Corporation of the County of Elgin, as follows:
1. The lands and premises hereinafter described be and
the same are hereby expropriated, namely -
Part of Lot 1 , Block G, and Part of Lots 2 and 3,
Block E, Registered Plan No. 28, in the Township of
Yarmouth, in the County of Elgin, being adjacent to
County Road Number 26 and being designated as Part
No. 1 and Part No. 2 on a Plan deposited in the
Registry Office of the Registry Division of Elgin
(No. 11) as Number llR-2923, the said part containing
2.552 acres.
2 . That a plan of expropriation in respect of the said
lands so expropriated be prepared and registered in the proper
Registry Office.
3. That the Clerk of the Corporation of the County of
Elgin and the County Engineer be and they are hereby authorized
and directed to take all proper and necessary steps and pro-
ceedings, including the employment of valuators, to settle by
arbitration or otherwise, the amount of compensation to be paid
in respect of the expropriation of the said lands, provided
that the amount of such compensation shall not be reached by
agreement unless adopted and approved by a resolution of the
County Roads Committee.
