88-35 OF ELGIN By-Law No. 88-35 BEING A BY-LAW TO AUTHORIZE THE CLOSING OF A BRIDGE OVER A PORTION OF THE THAMES RIVER BETWEEN THE TOWNSHIP OF DUNWICH. IN THE COUNTY OF ELGIN. AND THE TOWNSHIP OF EKFRID. IN THE COUNTY OF MIDDLESEX. MORE COMMONLY REFERRED TO AS "TATES BRIDGE"." WHEREAS the Corporation jointly with the Corporation of the County of Middlesex maintain a Bridge over a portion of the Thames River separating the Township of Dunwich, in the County of Elgin, and t,he Township of Ekfrid, in the County of Middlesex; and WHEREAS an examination of the said Bridge has indicated that the Bridge is so damaged that it would be neCessary to rebuild the Bridge; and WHEREAS it has been determined that the rebuilding of the Bridge would entail a larger expenditure than would be reasonable, having regard to the use that would be made of the Bridge if it were built. BE IT THEREFORE ENACTED AS FOLLOWS: 1. That the Bridge between the Township of Dunwich on one side of the Thames River and the Township of Ekfrid in the County of Middlesex on the other side, more commonly referred to as "Tates Bridge" be closed. 2. That the Corporation authorizes the Warden and Clerk in consultation with the County Solicitor to make application to The Ontario Municipal Board, if necessary under The Municipal Act, and in particular Sections 284(10) for relief from the obligation to rebuild the Bridge.
