92-34 COUNTY OF ELGIN By-Law No. 92-34 "BEING A BY-LAW TO PRESCRIBE A TARIFF OF FEES FOR THE PROCESSING OF LAND DIVISION COMMITTEE APPLICATIONS" WHEREAS section 69 of The Planning Act, being Chapter P.13 R.S.O. 1990, provides that the council of a municipality may by by-law prescribe a tariff of fees for the processing of applica- tions by a Land Division Committee; and WHEREAS it has been deemed advisable to set out the fees to be charged for processing applications by the Elgin County Land Division Committee. NOW THEREFORE the Municipal Council of the Corporation of the County of Elgin enacts as follows: 1. That the following tariff of fees be charged for processing applications: (a) Fee to accompany an application for consent - $250.00. (b) Once an application for consent has been accepted by the Secretary-Treasurer or designate and in the event it is withdrawn, amended or deferred for any reason, prior to the hearing or afterwards, a portion of the fee will be retained or additional charged in accordance with the following - (i) If withdrawn at least fourteen (14) days prior to the date set for the hearing, $50.00 will be retained. If amended at least fourteen (14) days prior to the date set for the hearing, an additional $50.00 will be charged. (ii) If withdrawn after the time limit set in (i) , the entire fee will be retained. If amended after the time limit set in (i) , an additional $50.00 will be charged. (iii) In the event it is necessary to reconsider an appli- cation once consent has been granted, in order to alter in a minor way, the original decision, it will be treated just as if it were a new application, in so far as order to be heard. In addition, a fee of $5.00 must accompany the letter explaining the reason for the change. (iv) Where an applicant requests, in writing, that the application be deferred from having action taken on it, whether after or before a hearing date has been set, a fee of $100.00 must accompany the request for deferral. 2. That this By-Law become effective July 1st, 1992. 3. That By-Law No. 92-26 be, and the same is, hereby repealed. READ a first time this 17th day of June, 1992.
