BEING A BY-LAW TO AUTHORIZE THE EXECUTION OF A MEMORANDUM OF
UNDERSTANDING WITH THE ONTARIO MINISTRY OF THE ATTORNEY GENERAL
FOR PROVISION OF COURT ADMINISTRATION AND SUPPORT FUNCTIONS. AND
OF THE PROVINCIAL OFFENCES ACT'

PROSECUTIONS UNDER PARTS I AND
WHEREAS the Attorney General recognizes that under Bill 108 "An Act to Deal
With the Prosecution of Certain Provincial Offences, to Reduce Duplication and to
Streamline Administration", 1997, Statutes of Ontario 1998, Chapter 4, future
improvements in service delivery to the public for local justice matters can best be
achieved in partnership with local governments; and

WHEREAS the Attorney General has Invited
Court System as a justice partner; and
WHEREAS the County of Elgin has demonstrated its commitment to engage in fu
partnership with the Attorney General to assume justice responsibilities under the
Provincial Offences Act, R.S.O. 1990, Chapter P.33, as amended; and
WHEREAS the Attorney General has the power under the Provincial Offences Act
to enter into an agreement authorizing the municipal partner to perform all court
administration and court support functions under Parts I, II, and III of the Act and
prosecutions of matters commenced under Parts I and II of the Act; and
WHEREAS the Attorney General continues to be responsible for the integrity of the
administration of justice, the Attorney General will enter into a Memorandum of
Understanding with every municipal partner.

NOW THEREFORE
enacts as follows:
1. THAT the Warden and the Chief Administrative Officer be authorized to sign the
Memorandum of Understanding between the Corporation of the County of Elgin and Her
Majesty the Queen, in right of Ontario as represented by the Attorney General concerning
the court administration and court support functions under Parts I, II and III of the
Provincial Offences Act and prosecutions of matters commenced under Parts I and of
the Act.
