01-02 COUNTY OF ELGIN By-Law No. 01-02 BEING A BY-LAW TO AUTHORIZE THE EXECUTION OF A LOCAL SIDE AGREEMENT WITH THE ONTARIO MINISTRY OF THE ATTORNEY GENERAL RESPECTING THE TRANSFER OF PROVINCIAL OFFENCES ACT FUNCTIONS TO THE COUNTY OF ELGIN WHEREAS the Attorney General has entered into a Memorandum of Understanding pursuant to Bill 1 08 "An Act to Deal With the Prosecution of Certain Provincial Offences, to Reduce Duplication and to Streamline Administration", 1997, Statutes of Ontario 1998, Chapter 4, with respect to the transfer of Provincial Offences Act functions to the County of Elgin; and terms and conditions that WHEREAS the Memorandum of Understanding contains to every municipal partner; and apply WHEREAS the Attorney General and the County of Elgin recognize there are certain terms and conditions that are specific to the Court Service Area; and WHEREAS the Memorandum of Understanding requires that the Attorney General and the County of Elgin enter into a Local Side Agreement setting out those terms and conditions the Municipal Council of the Corporation of the County of Elgin NOW THEREFORE enacts as follows: 1. THAT the Warden and the Chief Administrative Officer be authorized to sign the Local Side Agreement between the Corporation of the County of Elgin and Her Majesty the Queen, in right of Ontario as represented by the Attorney General concerning court administration and court support functions under Parts I, II and III of the Provincial Offences Act and prosecutions of matters commenced under Parts I and II of the Act. day of January 2001 day of January 2001 this 23rd Read a third time and finally passed this 23rd time and second Read a first McPhai Warden J \ Dunca Mark G.
