02-02 COUNTY OF ELGIN By-Law No. 02-02 BEING A BY-LAW TO AUTHORIZE THE TEMPORARY CLOSURE OF A PORTION OF COUNTY ROAD # 42 (LAKEsHORE LINE) IN THE MUNICIPALITY OF BAYHAM WHEREAS Section 102 of the Municipal Act, RSO 1990, Chapter M.45, authorizes a council of a municipality to pass such by-laws and make regulations for the health, safety, morality, and welfare of the inhabitants of the municipality; and WHEREAS Section 207.43 of the Municipal Act, RSO 1990, Chapter M.45, also authorizes the council of a municipality to temporarily close a highway, or portion thereof, for, among other things, construction, repairs, and/or improvement thereto; and WHEREAS the Corporation of the County of Elgin maintains jurisdictional control and responsibility for that highway known as County Road # 42, also known as Lakeshore Line. in the Municipality of Bayham; and WHEREAS erosion from Lake Erie has moved to within seventeen metres of a portion of the said County Road # 42, also known as Lakeshore Line, between Godby Road and Elgin County Road # 55, in the said Municipality of Bayham; and WHEREAS Council for the Corporation of the County of Elgin has determined that the said erosion constitutes and poses a potential risk to the health, safety, and welfare of the users of County Road # 42 in that location. the Municipal Council of the Corporation of the County of Elgin NOW THEREFORE enacts as follows: 1. THAT County Road # 42, also known as Lakeshore Line, 634 metres from the west limit of Elgin County Road #55 for 715 metres to the east property limit of Godby Road, in the Municipality of Bayham, be hereby closed temporarily to vehicular and pedestrian traffic to permit full and proper investigation of the current risk to the health, safety, and welfare of the public users of such highway and identification and assessment of measures to address such risk, including but not necessarily limited to reconstruction and/or repair or permanent stopping up and closure of the said highway. 2. THAT all necessary barricades, including warning devices, to be erected and maintained at each end of the portion of the said highway to be closed temporarily and, furthermore, that an alternative route, identified by appropriate detour signs, be provided for vehicular and pedestrian users of that portion of County Road # 42 to be temporarily closed. 14. 2002 this By-Law becomes effective February THAT 3. day of February, 2002. this 1 ih time and second READ a first time and finally passed this 1ih day of February, 2002. - n R.
