02-06 COUNTY OF ELGIN By-Law No. 02-06 "BEING A BY-LAW TO AUTHORIZE THE WARDEN AND THE CHIEF ADMINlsTRATIVEQFFICER TO SIGN AN AGREEMENT BETWEEN THE CQUNTY OF ELGIN (COUNTY) AND THE MUNICIPALITY OF CENTRAL ELGIN (MUNICIPALITY FOR THE MAINTENANCE ANDJlPERATION OF THE KING GEORGE LIFT BRIDGE' WHEREAS under the provisions of Section 57(1) of the Public Transportation and Highway Improvement Act, being Chapter P.50, as amended, a local municipality that is not separated from the county and the county may enter into an agreement in writing providing for the construction, widening or maintenance of the whole or any part of any county or suburban road in the local municipality; and WHEREAS "road" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct, trestle or any other structure incidental thereto, any part of which is intended for or used by the general public for the passage of vehicles; and WHEREAS agreement has been reached between the County and the Municipality under which the Municipality will provide for the operation of and maintenance procedures required for the King George Lift Bridge. the Municipal Council of the Corporation of the County of Elgin NOW THEREFORE enacts as follows: 1. THAT the Warden and the Chief Administrative Officer are hereby authorized to sign an agreement with the Municipality of Central Elgin setting out certain terms and conditions under which the Municipality will provide for the operation and maintenance of the King George Lift Bridge. 2002. 1, this by-law shall become effective January THAT 2.
