02-38 COUNTY OF ELGIN By-Law No. 02-38 01-37 BEING A BY-LAW TO AUTHORIZE SPEED LIMITS "TO AMEND BY-LAW NO WHEREAS pursuant to Section 128, Subsection 2, of the Highway Traffic Act, being Chapter H.8, RS.O. 1990, as amended, the council of a municipality may by by-law prescribe a different rate of speed for motor vehicles driven on a highway or portion of a highway under its jurisdiction than is prescribed in Section 128, Subsection 1 (a); and WHEREAS the County of Elgin did pass By-Law No. 01-37 prescribing different rates of speed for motor vehicles on certain highways under its jurisdiction and to prescribe a different rate WHEREAS it is deemed expedient to amend said By-Law of speed on certain highways under its jurisdiction the Municipal Council of the Corporation of the County of Elgin NOW THEREFORE enacts as follows 3, THAT Schedule "A" of By-Law No. 01-37 setting out a maximum rate of speed of 50 kilo metres per hour be and is hereby amended by deleting the wording in item #30 and replacing with the following of the east line of Plank 30. County Road #38 (Heritage Line) - From 1525 metres east property line of Plank Road to 861 metres west of the east property Road, in the Municipality of Bayham 14, of the Highway Traffic THAT the penalties provided in Section 128, Subsection shall apply to offences against this by-law. 4.
