03-30 COUNTY OF ELGIN By-Law No. 03-30 "BEING A BY-LAW TO ESTABLISH MINIMUM MAINTENANCE STANDARDS FOR THE CORPORATION OF THE COUNTY OF ELGIN ROAD SYSTEM AND TO REPEAL BY-LAWS NO. 96-15 AND 01-30' WHEREAS pursuant to Section 11 (2) of the Municipal Act, 2001, S.O. 2001, c.25, an upper-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction described in the Table to this section; and regulating municipality to pass by-laws WHEREAS said Table authorizes an upper-tier highways under its jurisdiction; and and WHEREAS the Corporation desires to implement policy to identify certain minimum and desirable standards for roadway services on roads within the jurisdiction of the Corporation, subject to other authority; the standards, described in "Minimum Maintenance Standards for Municipal Highways, Ontario Regulation 239/02 made under the Municipal Act 2001, S.O. 2001 c.25, filed August 8, 2003, as published in the Ontario Gazette, attached as Schedule "A"; and subject to the established annual average daily traffic counts and road classes attached as Schedule "B"; shall apply. is deemed expedient and necessary to have such standards it WHEREAS the Municipal Council of the Corporation of the County of Elgin enacts NOW THEREFORE as follows 1. THAT the standards herein, and amended from time to time, be hereby adopted and come into effect on the 1 st day of October 2003. the 2. THAT all operational activities of the municipal road department be directed to pro desired roadway services as herein described where care is taken first to assure that the minimum standards are maintained, and second that such services are efficiently and effectively rendered. vide that 3 THAT neither the Corporation nor its Officials make any promise or assurance roadway services will be in excess of the minimum standards herein defined 4. (3) Despite subsection (2), for high mast illumination, if all of the luminaires on consecutive poles are not functioning, the minimum standard is to deploy resources as soon as practicable after becoming aware of the fact to repair the luminaires.
