03-37 COUNTY OF ELGIN By-law No. 03-37 BEING A BY-LAW TO AUTHORIZE THE WARDENAND THE CHIEF ADMINISTRATIVE OFFICER TO SIGN AN ENCROACHMENTAGREEMENT FOR PROPERTY LOCATED IN THE MUNICIPALITY OF CENTRAL ELGIN WHEREAS it has been established that a portion of the building located at 14090 Belmont Road, Municipality of Central Elgin, described as Lot 8 and Part of Lot 9, Registered Plan 231, Municipality of Central Elgin, encroaches in excess of 0.58 metres (1.9 feet) onto Belmont Road (County Road #74); and the encroachment was detected during a survey being completed at said WHEREAS location; and WHEREAS the Municipality of Central Elgin, owner of said property, has requested an encroachment agreement for iegal purposes; and WHEREAS pursuant to Section 11 (2) of the Municipal Act, 2001, S.O. 2001, c,25, an upper-tier municipality may pass by-laws respecting matters within the spheres of jurisdiction described in the Table to this section and WHEREAS said Table authorizes an upper-tier municipality to pass by-laws regulating highways under its jurisdiction; and the Municipal Council of the Corporation of Elgin enacts as NOW THEREFORE follows: 1 THAT the Warden and the Chief Administrative Officer are hereby authorized to sign an agreement, under certain terms and conditions, between the County of Elgin and the Municipality of Central Elgin, to allow encroachment of a building onto Belmont Road (County Road #74), described as Lot 8 and Part of Lot 9, Registered Plan 231, Municipality of Central Elgin. its passing take effect upon THAT this by-law shall come into force and 2 this 25th day of November 2003. this 25th day of November 2003, Jóhn ÑÍlson Warden. / ........A' L-/'-''V READ a third time and finally passed Mark G. c: na,~, Chief Administrative Officer. time READ a first time and second
