The proceedings of the previous meeting were read and
the Warden authorized to sign them after which it was
Moved and seconded, that the Report of the Grand Jury
of the 2nd Quarter Sessions reported by the Clerk to have
been received by him, by Clerk of the Peace, be now read
by the Clerk.

The Clerk read the report, after which
The Warden addressed the Council in reference to the
report after which it was
Moved by Mr. McColl and seconded by Mr. Parish that
a committee of five members of this Council be now appointed
to examine the County Buildings and report to this Council
tomorrow morning.

Carried.

By vote of the Council, the following gentlemen,
Messrs. McColl, McIntyre, Parish, McCready and Wilson
were appointed the said Committee after which it was
Moved by Mr. McBride, seconded by Mr. McIntyre that
in as much as a difficulty exists in the Township of
Aldborough in consequence of the Western Cross Road being
fenced in, that this Council take into consideration the
most proper way to acertain the Government allowance and
cause said road to be opened.

Moved by Mr. McIntYre, seconded by D. Harvey that
John Gillies be heard by this Council in reference to
said road.
Mr. Gillies addressed the Council after which it was

Moved by Mr. McCready and seconded by Mr. McIntyre
that the Clerk be instructed to notify Mr. John Gillies
and George Henry to open the Road allowance between Lot D
and Number one on the thirteenth concession of Aldborough
and to be opened by the first day of March next.

Moved by L. J. Clark, seconded by J. Clark that the
tenders for printing the proceedings of this Council and
published in pamphlet form be now opened and laid before
this Council.

Carried.
The Clerk opened and read three tenders.
.
On motion of Mr. McColl and seconded by that
two members be added to the Finance Committee in lieu of
Mr. Elliot and Mr. Fowler who are absent.
By vote of the Council Mr. McIntyre and Mr. Weaver
were added to Finance Committee pro.tem.
.
Moved by Mr. McColl, seconded by Mr. Parish that all
accounts presented against this Council be laid before the
Finance Committee.
.
On motion the Finance Committee were instructed to
meet this evening at the North American Hotel.
Carried.
On motion the Council adjourned till tomorrow
morning at 9 o'clock.

Moved and seconded, that this Council do now resolve
itself into Committee of the whole on said report.
Mr. L. J. Clark in the Chair.
The Council resumed.

On motion it was moved and seconded, that the report
of Finance Committee be adopted without amendment.
After which it was moved by Mr. Parish and seconded
by Mr. Wilson that the words five thousand pounds in the
proposed By-Law drafted last Session of the Council be
expunged and the words seven thousand pounds inserted
within stead.

After which it was moved by L. J. Clark and seconded
by Mr. Weaver that this Council state some definite sum
to be awarded to the Clerk of this Council for copying
the proceedings of this Council and revising the same
for the press.
Carried.

Moved by Mr. McBride and seconded Mr. McCready that
in as much as the Clerk is called upon to copy the pro-
ceedings of the Council, that he be allowed two pounds
ten shillings for copying the preamble of the By-Laws
motions, resolutions, and reports of Committees.
Carried.
.
Moved by Mr. McBride and seconded by Mr. McCready
that in as much as it has been discovered by recent
enquiry that a considerable property in the Township of
Aldborough has reverted to the Crown, and further as the
most of the Lots. composing said tract of-land are at
present occupied and improved, it is therefore the
earnest request of the mover that this Council petition
the Legislature and Government of this-Province to dispose
of the Crown property referred to the present occupants
in order to prevent speculators being privileged to pur-
chase as such would retard the settlement of the Town-
ship and subject those occupants to a painful incon-
venience and loss.

Friday 13th January 1854
Moved by L. J. Clarke, seconded by J. Clarke of
Dunwich that the Clerk of this Council draw up a peti-
tion referred to in previous resolution to the House
of Assembly in behalf of certain persons located in the
Township of Aldborough.

After which it was moved by Mr. McCready and seconded
by Mr. McBride that the Road Directors do now meet and draw
up a report with respect to the County Roads to lay before
this Council at five o'clock this evening.
Carried.

On motion the Council adjourned till five o'clock
this evening.
The Council met at five o'clock this evening pursuant
to adjournment.

For want of a quorum, the Warden adjourned the Council

that the Rev. Edward Sheppard be appointed Local Super-
intendent of Common Schools for the Township of Mala-
hide in place of Walter E. Murray resigned.

_ Moved by Mr. McCready, seconded by Mr. Wilson that
the Clerk be instructed to copy some of the By-Laws at
full length and that By-Laws No. 10 and 11 be of them.

After which it was moved by Mr. McIntyre and seconded
by Mr. McBride that the Report of the Road Directors be
now read.

The Clerk read the Report.
On motion the Council resolved itself into Committee
of the whole on Report of Road Directors.

The Council resumed.

The Chairman reported the adoption 9f the Report
without amendment.

On motion the Report of Road Committee was adopted.
After which it was moved by Mr. Parish and seconded
by Mr. McColl that the sum of ten shillings, be paid to
John Smith for use of rooms for Committee at sundry times.

Saturday 14th January 1854
.
Moved by N. McColl, seconded by Mr. Parish that the
Clerk be ordered to draft and the Warden to sign a peti-
tion to the Legislature to furnish the different Munici-
palities with six copies of the Statutes, commencing with
12th Victoria and continue from that period instead of the
Journals and proceeding of the House of Assembly they
being of no real value to the parties and incur a large
expense to the Country.

Moved by Mr. McBride and seconded by Mr. McIntyre
that in as much as is necessary to make the rules gover-
ning Hawkers and Pedlars sufficiently known through the
Country, that this Council order that one of the public
papers printed here insert By-Law No. 10 for two months
and that the Clerk cause the same to be published as soon
as convenient.

Moved by Mr. McCready, seconded by Mr. McIntyre that
the Clerk be instructed to draft a petition to the dif-
ferent Houses of Legislation of this province, praying
that the Government pass an Act making it imperative on
the part of the several Registers of this Province to
scrutinize the Titles brought to be registered at their
offices and that a fee be affixed by the Government to
remunerate said registers for such inspection.

Moved by Mr. L. J. Clarke, seconded by John Clark
that the Clerk of this Council draw up a petition to the
different departments of Governments and signed by the
Warden that all amended Acts of the Municipal law do not
take effect till six months after then passing as much
difficulty has incurred on account of them not being
immediately in the possession of said Councils for some
time after being passed.

The Municipal Council of the County of Elgin met
pursuant to the statute in such case made and provided
at the Town Hall in St. Thomas on Monday the 23rd day
of January 1854.

The County Clerk produced the certificates of the
several Municipal Clerks in the County whereby it

Monday, 23rd January 1854
.
The Warden presented to the Chairman the Oath of
Office as sworn before D. J. Hughes Esquire, Judge of the
County of Elgin, it was filed by the Clerk and the Warden
took his seat accordingly.
Mr. L. J. Clarke, seconded by J. Gregory moves that
this Council appoint Road Directors for the present year.
By vote of the Council the following Gentlemen were
voted Road Directors for the present year.

Mr. N. McCOll, seconded by W. L. J. Clark moves that
E. T. Claris Esquire be appointed one of the auditors for
the County. .
The Warden nominated M. Childs Esquire to be an
auditor for the County for the present year.
Moved by Mr. N. McColl and seconded by Mr. Fowler
that a standing Committee on Education composed of three
members of this Council be now appointed.

By vote of the Council Messrs. Parish, Fowler and
Johnston were appointed said Committee.
Moved by Mr. Johnston and seconded by Mr. McIntyre
that a committee be struct on public improvements.

By vote of the Council Messrs. Alexander, D. McColl,
Wilson, Parish, and Clark of Malahide were voted said
Committee of five after which it was

Moved by Mr. N. McColl seconded by Mr. Johnston that
in as much as it is expedient to appoint Trustees for the
Grammar School at this meeting of the Council, the Committee
on Education recommend in their report persons to fill
that office.

Mr. L. J. Clarke, seconded by John Gregory moves that
the Charge of the Township lines in this County and also
the County lines be and are hereby to be under the control
of the different respective Councilllors where the same
are located.

On motion the following Gentlemen were voted Com-
mittee of five to examine County Buildings

Mr. R. Johnston, seconded by Mr. McIntyre moves that
this Council do proceed to appoint Superintendents of
Common Schools for the County for the ensuing year which

Rev. John Fraser be reappointed Superintendent of Common
Schools for the Township of Yarmouth for the present year.
Mr. Gregory, seconded by L. J. Clark moves that the
Revd. Edmund Sheppard be local Superintendent for the Town-
ships of South Dorchester and Malahide.
Mr. D. McColl, seconded by Mr. McIntyre moves that the
Revd. Donald McMillan be appointed Local Superintendent
for Common Schools in the Township of Aldborough for this
year.
Mr. J. G. Wilson, seconded by G. Weaver moves that
Isaac Hughes be appointed Local Superintendent of Common
Schools for the Township of Bayham in place of Mr. Newcomb
resigned and to be continued for the ensuing year.
Mr. John Clark seconded, by L. J. Clark moves that
Nelson Me Garvin M.D. be appointed Local Superintendent of
Common Schools for the Township of Dunwich for the ensuing
year.
On motion the following Gentlemen were voted a
Committee of five on Finance
Messrs. Wilson, N. McColl, Alexander, Parish,

On motion the Council adjourned till 10 o'clock

ment.

report of the Committee on Education be received and read.

On motion the Council. resolved itself into Committee
of the whole on the report of Committee on Education.

On motion the report was adopted with addition.
Mr. Johnston, seconded by Mr. Parish moves that the
resolution passed last session of this Council that this
Council do petition the Government to make it imperative
on County registrars to scrutinize titles before Regis-
tration be recinded.
Mr. L. J. Clark, seconded by N. McColl moves that a
committee of five members be appointed to consider the late
amended Assessment Act and to adopt some-uniform plan.
On motion the following Gentlemen were voted a Com-
mittee of five on assessment. -
Messrs. Locker, Fowler, Gregory, McColl of Southwold,
and Alexander of Vienna.

On motion the report of the Committee on Assessments
be received and read.
Clerk read report.
On motion the Council resolved itself into Committee
of the whole on report of Committee on Assessments.
Mr. Clark in the Chair.
The Council resumed.
The Chairman reported the adoption of the report with-
out amendment.
On motion said report was adopted without amendment.
Mr. N. McColl, seconded by Mr. Weaver moves that the
Clerk be ordered to draft and the Warden to sign a peti-
tion to the Legislature to amend the Assessment Act, so as
to render Mortgages taken for money but liable to taxation
as well as notes of hand.
Moved by Mr. N. McColl and seconded by Mr. Fowler
that the County Auditors be appointed to audit the accounts
of the County Treasurer and other officers to whom school
monies shall have been intrusted.
Motion carried.
Mr. McIntyre, seconded by Mr. Fowler moves that
Charles Fraser be, appointed County Engineer at the rate
of fifteen shillings per day when employed by this
Council.

Tuesday the 24th of January

Mr. McIntyre, seconded by Mr. Johnston moved that
the Auditor's Report be received and read.
In amendment Mr. Alexander, seconded by Wilson moves
that the Report of the Auditor be not received as said
report was made out and prepared before their appoint-
ment by this Council and Warden.

Amendment carried, original motion lost.
.
Moved by R. Johnston and seconded by Mr. Alexander
that a committee be appointed for the purpose of taking
into consideration the propriety of printing the neces-
sary forms to be returned by Justices in Cases of Summary,
Conviction and Indictable offences at the expense of this
County and that each Justice do pay an amount that shall
be settled by this Council for the quantity they require.
Carried.

By vote of Council, Messrs. Weaver, Alexander and
Johnston be appointed said committee of three.

report of the Auditors be received tomorrow at two
o'clock.

Previous to signing the proceedings Mr. Parish moved,
seconded by Mr. Alexander that the appointment of County
Engineer be rescinded which was lost after which
Mr. L. J. Clark, seconded by J. Gregory moves, that
the report of the Committee on printing the forms for
Magistrates be laid over till next Session of this Council.

In amendment it was moved by Mr. Weaver, seconded by
Mr. Wilson that the report of Committee on Justices forms
be adopted.

On motion, the Messenger was ordered to request Mr.
Burke to appear before the Council and explain in relation
to his tender for printing.
Mr. Burke addressed the Council and stated that he
would print the pamphlet of proceedings in Octavo size
with long primer or small Pica type at five shilling
York per page including stitching and covers and every-
thing complete.

The Council met at 2 o'clock according to adjourn-
ment.
On motion the Auditor's Report was received and read
by the Clerk.

On motion the Council resolved itself into Committee
of the whole on the report. .
Mr. Alexander in the Chair.
The Council resumed.

The Chairman reported the adoption of the Financial
Statements submitted by the Auditors.
On motion the Financial Statements were adopted.
Moved by L. J. Clarke and seconded by J. Gregory
~hat the Chairman of the Committee on Public Improvements
do now present their report.

On motion the Council resolved itself into Committee
of the whole on report of Committee of Public Improvements.

The Council resumed.
The Chairman reported the adoption of the report
with amendment.

On motion the Council adopted the report with amend-
ment as amended in Committee of the whole.
Mr. Parish moved, seconded by ~I. Alexander that the
Clerk draw up the necessary By-Laws for taking railway
stock and submit them to this Council tnmorrow morning.

Mr. Fowler moved seconded by Mr. McIntyre that Hiram
Lumley Back Street be appointed Local Superintendent of
Schools for Southwold this ensuing year.
On motion the Council adjourned till 9 o'clock to-
morrow morning.

Fourth Day
Thursday 26th January 1854

The Council met at 9 o'clock.

The Warden in the Chair.
The proceedings of the previous meeting were read
and the Warden authorized to sign them.

The same members being all present.
The Warden intimated that he had been served with an
account of R. Cussack for digging drain, amount E 4.
On motion the Warden was ordered to defend any action
which may be brought against him in reference to said
account.
.
On motion the Council adjourned for an hour to
visit the Public Buildings.
.

Mr. Johnston, seconded by Mr. Wilson moves that the
Finance Committee do obtain the Treasurer's books and
accounts for examination and to report the state of those
Books to this Council at the time they report on other
matters pertaining to their duties as such committee.

Chairman of Committee on the Public Buildings sub-
mitted report.
Mr. A. Wilson, seconded by Mr. McIntyre moves that
the report of the Committee on Public Buildings be adopted.

In amendment Mr. Parish, seconded by Mr. Johnston
moves that the internal arrangement of Court room be made
as follows viz, floor for Judge's Bench 3 feet 6 inches
high, 5 feet deep and 12 feet long, floor for Jury Boxes
3 feet high, Petit Jury Boxes 8 feet 6 inches deep and 14
feet long. That the door in rear of the Judge's Bench be
closed up and the other doors on each side placed at
equal distances from the Judge's bench-as shown by plan
here unto annexed and that the work be finished according
to said plan in every particular.

ffur. Clarke of Malahide, seconded by John Clark moves
that the Warden make a statement and give us information
as to what has been done in respect to procuring the
"Royal Arms" for the Court House. The Warden ordered the
Clerk to read Mr. Cochrane's letter in reference to the
different designs and the cost of making such. Clerk sub-
mitted designs and read Mr. Cochrane's letter after which
.
Mr. Parish, seconded by Mr. Fowler moves that the
Warden be authorized to have a proportionate set of "Royal
Arms" erected on the Court House and similar to design
submitted by the Clerk to Mr. Cochrane with the animals
fully exposed to view.
.
In amendment Mr. L. J. Clark, seconded by Mr. Johnston
that a design similar to the Brantford Royal Arms' be

to sell the Agricultural Grounds in the County of Mid-
dlesex and give the County of Elgin its share according
to the population of said Counties.

to sign the same to determine the mode of decision to
be adopted in acertaining the approval or disproval of
certain By-Laws ordered by this Council to be published

E 20,000 stock in the London and Port Stanley Railroad.
On motion, the Clerk read proposed By-Law for taking
E 50,000 stock in the contemplated Railway Company to be
incorporated for the purpose of constructing a railway

The Warden accordingly signed in open Council for
eight hundred shares in the Stock Book of London and
Port Stanley Railway Company.

Warden be authorized to sign all debentures and transact
all business connected with the London and Port Stanley
Railroad Company.

Moved by L. J. Clarke, seconded by Mr. Johnston that
the Warden in compliance with the requisition of the
secretary of the London and Port Stanley Railway Company
attend their meeting in London on the 22nd March next.

whereas this Council have by By-Law been authorized to

after which it was moved by Mr. Johnston, seconded by
Mr. Clark, Malahide that the subject of the County
Grammar School in St. Thomas be deferred until next

by Mr. Fowler that in the event of the County Grammar
School being deficient of funds to carry out its objects
within the next six months this Council pledges itself
to make up such deficiency if it does not exceed fifty
pounds.

from the Receiver General intimating that the By-Law of
the Municipality of the County of Elgin for a loan of
E 20,000 under the Consolidated Municipal Loan Fund has
been approved by His Excellency in Council on theJrd
May and now awaiting for the instructions.

Moved by L. J. Clark, seconded by Mr. Alexander that
the account of Mr. Reuben Nelson Temperanceville be
allowed and refunded to the Township Council of Malahide
to the account of fourteen pounds ten shillings for
expenses in conveying Julian Walker, a lunatic to the
Asylum in Toronto.
Mr. McIntyre, seconded by Mr. Parish moves that Mr.
Ferrin and others in his employ be allowed to pass Gate
No. 3 when going to and from his Brick Yard for one third
toll.

Board of Directors do advertise the taking of Toll Gates
No. 3 and 4 to be taken from the first of June until

Mr. Boggs be ordered to fulfil his contract of furnishing
stone in 1853 and that the Clerk of this Council notify

The Warden introduced Mr. Lawrason, President of
the London and Port Stanley Railway Company, who addressed
the Council in reference to the E 20,000 stock taken by
this Council in the said Company.

amount of stock taken in the London and Port Stanley
Railway Company be placed in the hands of the Board of
Directors of said railroad, provided the Board give
satisfactory security to the Warden as required by this

that the Board of Road Directors be authorized to order
the County Engineer to make a survey of Centre Street in
the Town of St. Thomas from its Western limit to the
County Gravel Road known as Nelson Street on a grade of
one foot rise in 20 feet and also a grade of one foot in
15 and report as soon as possible and if the Board of
Directors deems the improvement advisable they be author-
ized to let the work immediately.

statement in reference to his contract for stone which
was referred to Finance Committee.

and diverting the said Road through the Town of St.
Thomas and if the advice is favourable to said altera-
tion, the Road Directors be authorized to proceed with

The Warden made statements to the Council that the
Committee appointed to make a final settlement with the
County of Middlesex attended a meeting of the Council of
Middlesex without coming to any definite arrangement.
The Warden laid before the Council presentment of
the Grand Jury which was read by the Clerk, after which
Mr. Fowler, seconded by Mr. Johnson moves that the
Warden be authorized to put the County Buildings and all
the County property connected with the County Buildings
into the hands of the Sheriff of the County, as the
Buildings seem to be nearly completed.
Mr. D. McColl, seconded by Mr. Johnson moves that
the sum of five pounds Cy, be refunded to the Munici-
pality of Aldborough. Said amount being paid by said
Municipality for conveying a destitute insane person
to the Lunatic Asylum Toronto, named Mr. Fisher from
the said Township of Aldborough.
Mr. Johnson, seconded by D. McColl moves that this
Council do indemnify Duncan McColl in his costs to be
incurred in prosecuting the County Council of Middlesex
for the sum of B 25, a debt due the Township of Aldbor-
ough on Roads in said Township.
Mr. J. Weaver, seconded by Mr. Alexander moves that
Simon Newcomb be appoin~ed Superintendent of Common
Schools in the Township of Bayham in plage of Mr. Hughes
removed from the Township.
Mr. J. Weaver, seconded by Mr. Parish moves that the
sum of twelve pounds, nineteen shillings and three pence
being the expense of conveying Norah Ryan a lunatic from
Port Burwell, to the County Jail and from thence to

that a discount as well as the interest at 8 percent

reference to said Road.

On motion, Mr. Godwin addressed the Council and
stated that if he must open theroad, hoped time would
be given him to fence it.
Mr. McIntyre, seconded by Mr. Johnson that the
Council authorize the Warden to issue an order or
orders on Messrs. Godwin and Shotwell for the opening
of the road between the seventh and eighth concessions
of Yarmouth and in front of Lots No. 20 and 21, also in
rear of Lots No. 65 and 66 south on Talbot Road and
that the said road be opened by the first day of Sep~
tember 1855 provided that the said Messrs. Godwin and
Shotwell will agree to let Mr. MacKay pass and repass
without doing any unnecessary damage to their crops
within the said time allowed by this Council.
Moved by Duncan McColl, seconded by John Clark
that this Council shall order the Treasurer to appear
tomorrow morning at 10 o'clock and shew cause why he did
not take immediate action in the collection of arrears
of taxes due the Townships of Dunwich and Aldborough
from Wild Lands as heretofore instructed by this Council.
Moved by Mr. Johnson, seconded by Mr. McIntyre that
Mr. McColl be indemnified on the costs on a suit between
the County of Middlesex and Mr. McColl, the Reeve of
Aldborough, and that this Council do still indemnify
him in his costs provided he prosecutes the County of
Middlesex in the Queens Bench in the County of Elgin
only, for the sum of E 25, a sum appropriated by the
Counties of Middlesex and Elgin in the year 1852 to the
Township of Aldborough.

Clerk be ordered to draft and the Warden to sign a peti-
tion to the Legislature to amend the Jurors Act of 1851
so that the expenses of balloting, summoning, and making
of jurors lists may be materially diminished.

Joseph Calbert, Yarmouth, be appointed Pathmaster for a
certain portion of the Township line between Yarmouth
and Malahide lying between the rear end of Talbot Street
lots and the TOWnline of Dorchester, to be notified of
appointment by Clerk of this Council.

house be erected at a proper distance from the buildings.

County of Elgin procure a loan of E 2,500 from the
Municipal Loan Fund of Upper Canada for the purpose of
assisting the Township of South Dorchester to build a

Clerk do furnish the County Board of Agriculture with
copy of proceedings of this Council in reference to the
disposal of the Agricultural Block in London and would
recommend them to Petition the Legislature for a first

poses in this County.
Mr. Alexander, seconded by Mr. Johnson moves that the
Warden be authorized to consult some Lawyer of this town
in reference to the Agricultural Block in the Town of

Law be drawn up to authorize the Warden to issue Deben-
tures upon the credit of the non-resident Land Fund as
per Statute 16th, Victoria Chapter 182, Section 70 as
soon as the Municipal Clerks shall make returns of the
non-collected school rates that each Municipality may
receive the several portions due them.

On motion, the Chairman of Board of Road Directors
make statements in reference to Tender, etc. and sub-
mitted Report of County Engineer in reference to the
several works in progress which report was read.

salary of the Clerk and Treasurer of this County be
seventy five pounds per annum.

In amendment, L. J. Clark, seconded by John Gregory,
moves that twenty five pounds be added to the salary of
the Clerk of this_ Council, William McKay, in consideration
for his daily attendance being required at his office in
the Court House according to Statute and that twenty five
pounds be added~to the salary of the Treasurer, Henry
Black, for the present year.

Duncan McColl seconded by L. J. Clark moves that in
the event of the Council of Middlesex assuming the half
of the Wardsville Bridge, that this Council shall assume

of Parliament for the East riding of Elgin and
On motion Dr. Southwick was requested to make state-
ment to this Council in reference to Parliamentary action

thanks to Dr. Southwick for the very able and satisfactory
explanation he has made in relation to the various matters

to Thomas Locker, Esquire, Warden, for the satisfactory
