recently been ascertained that our leading authoritie" 011 Municipal Law

damages." Persons travelling ont.he high\vays should do so at th61r OWll
risk. If they do not wish to assume the risk, they should elect-Councillors,

nort.h bridge to be maintained joint.ly by {jounty and Cit.y, it being' a. bridge
over a boundry line. and,
2, That tbeCity aggrees to the repeal of the Special Act of 1863 subject
to the above condition to take effect when the Oounty ubtains control of the
'1'011 Road and that we be authorized to apply for the passing a Special Act
confirming the agreemellt,,-Carried.

Since your last meeting', I received notice of 1-11 action for damages,
caused by an accident. on the County Bridge in Vienna, which resulted ill
t.he death of a young man named Bartlett. I made careful enquiry into the
c~tcum~tallCt:S connected with this case and do not tP.illk that the county is
liable. No further proceedings, other than the service of the writ have been
taken.

the Landau and Port Stauley Toll Road. were uuable to arrive at an agree~
mentand, althongh an attempt. was made to procure Ilegislat.ion that would

eliminate the r(lad from the operation of the Toll Roads Expropriation Act,
An amendment was ~ecured that would providp for thepnrc:hase of the Toll
Road in Eayham. This, h~wHer, ba8 beEn rendered undesirable

That after baving examiuE'd the bridges ou the London and Port Stanley
Gravel Road and finding one being repaired and others temporarily repaired
and its having come to thfl knowledge of this Council that the lessees have
mortaged tbeir interest in the said road, which said mortage might contain
an assignment of the lease, the County Solicitor be instructed to notify the
mortgagees that the bridges on the said road must be put in a proper state of
repair according to tht'J lease or the Connty will take action to have the lease
voided and that this matter be left iuthe hands of the Warden to protect
the interests of the County, he being hereby empowered to take whatever
action the circumstances may warrallt.'-Carried.

:MARTIN VS ELGIN,..
The cnse of Martiu vs Elgin, being for damages sustained at the count.y
bridgein Vielma, bas been s~ttled for the sum of $225. No liability all the
part of the County was admitted but it was thought to be the CblO'llpest w~y
of dl$.posing of the matter as it was doubtful if the county would have beeu
able to collect costs had their defense been successful. .
POOR HOU~E FAR}I.
For some time, it has been the opinion ()f some of the members of the
Council and the management of the,Honse of Industry that the farm should
be enlarged The present one is in a high state of cultivation alld I believe
that the Keeper, with the assistance of the inmates, could easily manage u-
farm double the size of the present one. Several pieces of land conveniently
situated are, I believe, available and it may be a faVorable opportunity for
the cou!lcil to consider the math.!r.
TOLL ROAD.
Since our last session, the lessees have completed the repairs to the
Brewery bridge but as yet nothing has been doue to the Nort.h or
ELGIN COUNTY COUNCIL.

COUNTY ROADS.
The estab'ishmeut of a COUll tv road sJ~tem. as explained at the Jurie
Session, seems to huye met with the approval of the local-councils fOl'two-thirds
of the towllshIPS have designated the roads to be assumed. TheCount.y
COUllCil should, I think, pass a bv law designating thp, roads, as provided in

present programme, a "Book Education," it is of the highest'importance that
a child sbould receive such training as will enable- him to read ,vit.h
attention l1udunderstaudiug. In t.hi8 cOllnection I must report that liuwy of
the schools are very deficient in dictionaries and libraries:
Many years ago the Education Department supplied rural schools with
libraries at a very small outlay 011 the partof the sections. Siuce this prac ice
wasdiscoutillued, the public school library has practically bec0me a thiug'
of the past. However, I am glad to be able to report that the Department has
decided again to enoourage the establishing of school libraries, by proposing
to p~y each section, to use in -the purchase of books. a sum ('qual to oue-half
the sum exp~nded by the Board of Trn tees for the same purpose. A list
suitable bookS is being prepared, from which Boards of Trustees may
These books are chosen with the intention of giving the .pupil a taste for
such reading as will iuterest him.. in the literature pertainill~ to his fut.ul'e
vocation 1ll life as well as to develop in ~im an acti.e and
citizenship.

balance to the credit of the count.y to the amoll.ut of $648.04. And to meet
the various expenseF-. we have bOl'rowed from the Molsons Bank at that date,
17,000 and there has been paid all. county line bridges $3121.00.
I have received from Provincial Treasurer for continuation classes,
$73500, which has been paid to the schools mentioned in the order and it
will be necessary for you at present meeting of council to pass orders for the
payment of an equivalent sum I enclose you the former order.

to the London audPort Stanley Gravel Road and answers to the questions
which yo~ submitteil to me.
The lease made by t.he Coamy Council to the late Robert Hepburn
among Othei' tJ:1ings provides that if the road or 'any of the bridg-esor culverts
or any partthereofbe out of reasonable repair for the space of one month,
thtmand. III such case tbe lease shall be void at the option of the Municipal
CouliciLalld tIley shall thereafter be at liberty to take possession thereof and,
,o;e the toll.houses aud tolls by their officers and servants aud to expel the.said
~Robert Hepbul"U.. his executors, administrators and assigns from the same
and,every part thereof,and tb~ said. Robert Hepburn. amoug other things
covenanted with the County, that he woulJ from time toUroe and all times
during the demise, repair and keep ill repair the said road and bridges thert of
and the toll-houses and gates thereon as tho sa.me ought to be kept in repair.
and further that he would save harmles!'l and keep indemllHiedthe Municipal
Council of, from and against allrlamages; charges aud costs to which the said
Couucil might be subjected by reason of the said road or any of the bri~ges.

Tl1e second question asked by you is as follows:
(2) If the County is responsib~e what course should be taken to ascer-
tain the condition of the bridges?
In my opinion the best course to he taken to ascertain the condition of
the bridges upon the road is to have the Bridge Ins'{.lector of the M. C. Rail-
wa.y go along with the Count,y Engineer and make au examination of the
bridged. If I remember rightly that course was adopted some time ago and
as a result I think that the persolls now interested in t.he road made some re-
paIrS upon bridges and perhaps if ::tllother examination were had and a report
made the bridges that are out of repair would be repaired so as to make the
road rlasOlJably safe for public travel.
The third question is as follows:-
(3) What class of meu would be qualified to make au inspeCtlon I)f the
bridges?
:My answ('r to the second qu~stion makes it unnecessary to answer this
question.
The fourth que~tion is as folluws:-
(4) If bridges are reported unsafe for public travel what would be the
proper coursE' forme to take to protect the interest of the County?
If the experts whom I have recommended to be appointed report the
bridges unsafe for public ~ravel, the present owners of the lease should be
asked to immediately pnt the road in proper repair and that in default of so
doing the lease would be declaren. null aud void and the Council would take
possession of the road if the road should be suffered to be out of repair for
one month
The fifth question is as follows :-
(5) Would it change or weaken the position of the County in an action
for damages on -bridges should present lessees assign or mortgage their inter-
est in said road?
In answer to this question I have to say that no assignment ,or mortgage
of the lease can effect the position of the County as far as I can see. . The
County- will contmue responsible in regard to the road. as I have already
-stated aud its rights under the lease c'annot be prejudiced because an assignee
or mortgagee :)f the lease cannot stand upon any higher ground or better po-
sition than the origi:nallessees.

and Brewery Bridges are not in a safe state to carry the traffic they are sub.

regarding the condition of the bridges all w'l\at is known as The, London and
Port Stanley Gravel Road.
According to this report, t,hese bridges appear to be in a very unsafe con-
dition. In view of the letters writtell to you in tho past on behalf of the
County Council pointing out the fact that this road :has notbeeu' kept in a
proper state of repair, the County Council intend to take advantage of the
remedies provided by the ortginallease between the County of Elgin and the
late Robert Hepburn and among other remedies providt!d by thatlt'aE"e the
Oounty is entitled t? declare the lease void and resume possession of theroad
when the road is allowed to be out of repair for, the time mentioned ill the
lease.

Aldboroagh, be and is hereby set apart uS a Police Village.

shall compri&€ all and siugular that certain parcel or'tract of land shuate,
lying aud being in the Township of'Aldborough, ill the COllUty of Elgin and
Provin'ce of Ontario, being composed of the scuth halves of 10ts number eight.
