Mr. stu Stephen, the Regional Assessment Commissioner, was present and
it was moved by Reeve Neukamm and seconded by Reeve Benner that he
be now heard. Mr. Stephen advised Council that the City of st. Thomas,
at his presentation to them, requested that the implementation of
County-Wide Reassessment be deferred until 1993. He explained that
Bill 165 was presently before the legislature and would allow a
phasing-in over a four-year period to minimize the drastic shift. He
stated that because st. Thomas had made this request, he did not

follow through with the meetings with each of the local councils. His
recommendation was that the County also request that it be deferred to
1993. Mr. stephen fielded questions from the various members of
Council and Warden Lyle advised him that it would be discussed further.

anyone of them are hereby authorized for and on behalf of the Corpo-
ration from time to time:
(a) to make, sign, draw, accept, endorse, negotiate, lodge, deposit
or transfer all or any cheques, promissory notes, drafts, acceptances,
bills of exchange, orders for the payment of money, evidences of
indebtedness and contracts for letters of credit and forward exchange,
whether or not an overdraft is thereby created in any account of the
Corporation; also to execute any authority to any officer of CIBC to
accept and/or pay all or any drafts, bills of exchange or promissory
notes on behalf of the Corporation; also to execute receipts for and
orders relating to any property of the Corporation held by or on
behalf of CIBC;
('\ (b) to execute CIBC's form of agreement as to the operation and veri-
fication of the accounts of the Corporation; and also to execute any
agreement with or authority to CIBC relating to the banking business
of the Corporation whether generally or with regard to any particular
transaction (including, without limitation, CIBC's Agreement re:
Instructions and Information by Telephone and Fax, Form 5666).

3. THAT anyone of the following L.B. Shewfelt, Treasurer or
R.M. Daniel, Deputy-Treasurer are hereby authorized for and on behalf
of the Corporation from time to time to negotiate or deposit with or
transfer to CIBC (but for the credit of the Corporation's account
only) all or any cheques, promissory notes, drafts, acceptances, bills
of exchange and orders for the payment of money, and for such purpose
to draw, sign or endorse the same, or any of them, or to deliver the
same, or any of them, to CIBC endorsed with the name of the Corpora-
tion impressed thereon by a rubber stamp or other device; also to
receive all paid cheques and other debit vouchers charged to any
account of the Corporation and to execute CIBC's form of receipt
therefore.
4. THAT all acts and things done and documents executed on behalf of
the Corporation as hereinbefore authorized may be relied upon by CIBC
and shall be valid and binding upon the Corporation whether or not the
corporate seal of the Corporation has been affixed to any such
document.
5. THAT the Corporation shall provide CIBC with a copy of this reso-
lution and a list of the names of the persons authorized by this
resolution to do any act or thing, together with specimens of their
signatures, to be acted upon by each branch of CIBC with which any
dealings are had by the Corporation until notice to the contrary or of
any change therein has been given in writing to the Manager or Acting
Manager of such branch.

ELGIN COUNTY PIONEER MUSEUM
Mrs. Jean Leitch, of the Board, and Miss Deborah Herkimer, Curator,
were present to review their budget and answer any questions which may
arise. They requested an allocation from the County of $50,045.00.
FAMILY & CHILDREN'S SERVICES OF ST. THOMAS & ELGIN
Mr. Ron Lidster, Business Administrator, was present to speak to the
Children's Aid budget which is requiring a County contribution of
;-----...., $211,892.00 for 1992. The overall increase in their budget was 3% and
r , the County share, due to a change in Children In Care, was a decrease
of 1%.

Dr. Thomas Wilson, MOH, and Mrs. Donna Brock, Business Administrator,
were present to speak to the Elgin-st. Thomas Health Unit budget which
required a contribution of $428,874.00 from the County. This is an
increase of 3.68% over the 1991 contribution. Mrs. Brock explained
that they were tied to wage settlements for three years and were also
confronted with pay equity.
Linda B. Shewfelt commenced to review the budget line by line. When
budgets for the various departments were encountered, any questions
were directed to either the Department Head or Chairman to answer.

A delegation from the st. Thomas-Elgin Education and Recreation Complex
steering Committee was present and it was moved by Reeve Millman that
they be now heard. Mr. Michael O'Dea, Chairperson, addressed Council
and reviewed the project on the eighty-eight acres of land south of the
City limits on Fairview Avenue. He indicated that it was a joint ven-
ture between the Separate School Board, the city, and Fanshawe College.
The development would take several years to complete and would co-
ordinate the project so that there would be no cost waste. Facilities
would be shared between Fanshawe College and the Separate School Board
for library, food services, and child care.
Questions were fielded from members of Council and Mr. O'Dea asked
Council to consider approving and/or supporting the concept of the
st. Thomas-Elgin Education and Recreation Complex. The delegation
left at this time.
A delegation from the Ministry of the Environment was present upon
request and it was moved by Reeve Neukamm that the representatives
from the Ministry be now heard. Overhead presentations were made to
explain the Environmental Assessment Process which Mr. Bob McCaig is
currently undergoing and also Waste Management Master Planning. The
various members of the delegation answered questions from Council.

WHEREAS the inconsistent drafting of the White Paper on "Open Local
Government" makes the full intent of these proposals vague and uncer-
tain; and
WHEREAS several of the proposals in the White Paper have potentially
serious implications for local government, including those relating to
the:
- disclosure of assets;
- disclosure of gifts;
- duties of "advisors" and "advisory bodies";
- use of privileged and confidential information;
- post-elected office employment restrictions;
- effect of closed meeting legislation on local boards acting as a
tribunal;
- the lack of detail relating to the disposal of property; and
- the uncertainties as to the content of the proposed code of conduct
for municipal staff; and
WHEREAS despite the fact that the White Paper was released by the
Honourable David Cooke, Minister of Municipal Affairs, in the ontario
Legislature on December 19, 1991, municipalities across the Province
did not receive copies of the White Paper until the first or second
week in February; and
WHEREAS, as a result of this delay, the response of municipal associa-
tions, such as that of the Association of Municipalities of Ontario,
will not be known to member municipalities before the March 31, 1992
deadline.

1. The Honourable David Cooke, Minister of Municipal Affairs, be
informed of the many concerns of the members of the Elgin County
Council resulting from the:
- vagueness and uncertainty created by the inconsistent craftsmanship
of the White Paper; and
- the delay in the circulation of the white Paper which has made it
impossible for the municipal councils to effectively review the con-
tent with their municipal associations.
2. The Minister be requested to extend the deadline for response to
the White Paper for such period of time as is necessary to enable
municipal councils, school boards and local boards to consult with
their various associations and to review the reports of those associa-
tions, to ensure that a co-ordinated response is made to the White
Paper proposals.
3. A copy of this resolution also be sent to the Honourable Peter
North, M.P.P., Elgin, Minister of Tourism and Recreation, requesting
that he make representation of these concerns on behalf of the members
of the Elgin County Council.

Reeve Mezenberg read a letter from the Aldborough/Rodney/West Lorne
Amalgamation Committee in which they ask that the urban rebates con-

of New Brunswick in an effort to reduce cross-border shopping and

f' EMPLOYEE PRESENTATIONS
Mr. R.G. Moore, who retired as County Engineer on May 1st, 1992, was
present. Warden H.F. Lyle and Reeve H.J. Mezenberg, Chairman of the
Roads Committee, presented Mr. Moore with a Certificate indicating
thirty-five years of service and a cheque. They expressed apprecia-
tion for his service to the County and Mr. Moore responded. He is to
attend the noon luncheon.
Mr. John Lambert, Director of Marketing, ECNG Inc., was present upon
request and it was moved by Reeve Chute that he be now heard. Mr.
Lambert reviewed the role that his firm played in negotiating purchase
of natural gas at the wellhead. He reviewed the history involving
A.M.O. and the deregulation of the gas purchase. He explained that
the present purchase price of natural gas was too high and the firm
from which we purchase had agreed to lower the price and would like an
additional one year's extension on their five year agreement. A letter
of authorization for them to accept the price was left for Council to
approve. In addition, an agency agreement authorizing ECNG Inc. to
act on the County's behalf was left for signatures. various members
of Council asked questions of Mr. Lambert and, on conclusion, he left

THAT the First Report of the General Government and Property Committee
be adopted.
Reeve Neukamm stated that he felt that the minutes of the General
Government and Property Committee indicated that the payment for the
AdHoc members of the Penitentiary Committee should be the responsibil-
ity of the local municipality. After discussion it was agreed that
the minutes should be amended to delete at the expense of the local
municipality. The Clerk will have this amendment done.

A delegation composed of Mr. James Timlin, Clerk-Treasurer-
Administrator for the Village of Port Burwell, and Mr. Paul Skinner,
Architect, were present and it was moved by Reeve Neukamm that they be
now heard. Mr. Skinner reviewed the proposed waterfront development
project for the Village of Port Burwell. He had photos and a scale
model of the project. He reviewed the steps taken from the time it
was started in November 1989 up to date. The project is ready to go,
however, due to the economic times, it will probably not be started
until sometime within the next two years. He emphasized that there is
absolutely no government funding in this project. The Warden thanked
Mr. Skinner for giving Council an update on this project.
The Treasurer provided members of Council with a Financial Statement
to May 31st and a Statement of the Remuneration and Expenses for
members of County Council and Outside Boards as well as members of the
Land Division committee to May 31st, 1992.

update on the status of the amalgamation in that the Ministry has been
asked to prepare a by-law for amalgamation for first reading by the
three municipalities. Public meetings are to be held at West Lorne
Legion at 7:30 P.M. on Monday, July 20th and at 7:30 P.M. at the
Rodney Community Centre on Tuesday, July 21st.

provincial Ministries, who, when soliciting comments from the County
and local municipalities on proposed changes, restrict the time frame
for returning them by not allowing sufficient time for the proper
review of the particular topic. This results in the Province not
receiving the most informed comments or none at all.

make recommendations to Cabinet regarding disentanglement; and

WHEREAS the Municipal Council of the Corporation of the County of
Elgin is concerned that the Province may take action without directly
seeking input from the municipalities which will be affected; and
WHEREAS the Municipal Council of the Corporation of the County of
Elgin is concerned that the changes will affect farming, commerce,
tourism and public safety.
BE IT THEREFORE RESOLVED THAT the Province of ontario not take any
action and our local M.P.P. not vote on any legislation until both
the Province and the local M.P.P.'s have directly consulted with all
Municipal Councils; and
THAT this resolution be sent to the Premier of Ontario, the Minister
of Municipal Affairs, the Local Member of Parliament and the Minister
of Transportation of ontario.

It was moved by Deputy Reeve Webber that the members of the Advisory
Committee for the program "Ten Steps to Community Action", through
Ontario Ministry of Agriculture and Food be heard. Reeve West intro-
duced Jackie Van Ryswyk, who reviewed the purpose of the "Ten Steps to
Community Action". She answered questions from various members of
Council. She indicated that they would like a letter of endorsement,
from Council, to assist them in obtaining finances. Reeve West
indicated that they would be asking for the use of the Council
Chambers, to hold a mock session.
COUNTY-WIDE REASSESSMENT
It was moved by Reeve Millman that Mr. S.C. Stephen, Regional
Assessment Commissioner, be heard with respect to County-Wide
Reassessment. Mr. Stephen introduced his staff who were present:
Mr. Bob Winter, Mr. Fred Slater and Mr. Dave Kampman. Copies of
the up-to-date changes were provided to members of Council. Mr.
Stephen reviewed the summary page indicating the various changes that
would result, in bringing everyone up to 1988 values. He reported
that the City of st. Thomas had adopted County-Wide Reassessment on
last Thursday, for 1993. He would now make presentations to the local
municipalities and come back to County Council, at the October Session
in hopes of obtaining a resolution for adopting County Reassessment
for 1993. Mr. Stephen explained that he had made presentations to
both school boards because of the phasing-in option.

Reeve Fisher advised that he would like to give notice that he was
going to discuss a paper put out by the Village of Rodney on taxes.

Elgin County Council. Chairman Neukamm explained that a review had
been made of this item, and a new job description for the Clerk pre-

DELEGATIONS
Alderman Ray Parkes of the City of st. Thomas, was present and
explained to Council that Mayor Peters and himself had come before
county Council in the Spring, and requested assistance in the amount
of $2,500.00 to help in the O.S.U.M. Conference to be held in st.
Thomas. It was such a successful conference, that a profit resulted
and he was here today to present a cheque for the $2,500.00, that the
County advanced. Warden Lyle thanked Alderman Parkes for the
returning of the money.

Municipal Affairs be heard with regard to County Restructuring. Mr.
Peter Boles, Executive CO-Ordinator, Field Management Branch, Ministry
of Municipal Affairs was present to speak to the County on
restructuring. Members of city Council and staff, were present to
~, hear the presentation. Mr. Boles reviewed the history of county
i : studies with regard to restructuring, and indicated that a number had
been undertaken, however, Simcoe County is the only one that endorsed
the changes. The Province felt that the financial involvement in
these studies was not good, in that only one in ten accepted the
recommendation. He pointed out that the Province would be willing to
support a county study, providing that:

(1) The City would be involved in a meaningful way to investigate
ways and means of improving and expanding co-operation, and would be a
key partner in the study.
(2) They would be looking for a resolution by all sixteen munici-
palities, that they would look at the service delivery, structure or
boundary changes and to look at alternatives.
(3) With the City and local municipalities in, the Province would
participate financially and would provide staff from London - not a
resident, however, the finances would allow for a consultant to come
in. Mr. Boles indicated that the next step would be for the Ministry
to put in writing what he indicated at this meeting, and then terms of
reference should be developed and made available, prior to local
municipalities considering the issue, and it might alleviate some
local fears. Alderman Brooks from the City, advised that the City is
interested in participating in the study. The delegation left at this
point.

Banquet. He explained that personal invitations were on each
Councillor's desk, as well as admissions for four additional. These
would be charged to the Councillors, if they wished to use them, at
$14.50 each.

EMPLOYEE PRESENTATIONS

Reeve Chute, Chairman of the Homes for Senior citizens Committee and
Warden Lyle presented Mrs. Marilyn Barrett, Assistant Administrator
with a certificate for having completed a three year university course
on long term care.
DELEGATIONS
Mr. W.K. Doggett, CPPO, Chairman, st. Thomas-Elgin Inter-Governmental
Co-Operative Purchasing Association was present and it was moved by
Deputy Reeve Volkaert that he be heard. Mr. Doggett addressed Council
reviewing the history of the Co-Op Purchasing group, and the fact that
considerable taxpayers' dollars have been saved through volume pur-
chasing of like commodities. He outlined the benefits of belonging
and advised the Reeves and Deputy Reeves to go back and talk this over
with their administration staff.

Mr. Roy Broadbear, President, Port Stanley Terminal Rail Inc. was
present and it was moved by Deputy Reeve Spenard, that he be heard.
Mr. Broadbear reviewed the background of the railroad, with their nine
year struggle from start to present date. He indicated that they had
attended fourteen meetings, where reassessment was explained to the
various councils. He advised that a petition was being circulated to
lobby for a change in assessing railroad property. Under the proposed
new County reassessment, the railway taxes would increase 166%. He
asked Council to consider this, when deliberating on county-wide
reassessment, as the railroad was one of the biggest tourist attrac-
tions in Elgin County.
COUNTY-WIDE REASSESSMENT
The Clerk advised Council that presentations had been made to all the
local municipalities on the effect County-wide reassessment would have
on their municipality. Copies of resolutions or letters were received
from fifteen of the sixteen municipalities. Of the fifteen municipal-
ities replying, eleven indicated support for County-wide reassessment,
while four opposed it. The Clerk advised that County Council were now
in a legal position to consider passing a resolution, asking that
County reassessment be introduced for 1993.

Mr. S.C. Stephen, B.A., MIMA, Regional Assessment Commissioner, was
present and it was moved by Reeve Neukamm that he be heard. Mr.
Stephen thanked the local municipalities for the reception he and his
staff received during the various reassessment presentations. He
advised that he was not irresponsive to the P.S.T.R. position, but
advised that it was a court ruling on how properties for railroads was
to be assessed. During a discussion of phasing-in the results of
reassessment, Mr. Stephen advised that the Ministry of Municipal
Affairs would be receptive to any phasing-in that was acceptable to
the municipalities.

that they are in favour of county-wide reassessment, subject to a
phasing-in period, that the Minister of Revenue be requested to imple-

Mr. Kenneth E. Monteith, M.P., was present and it was moved by Reeve
Mezenberg that he be heard. Mr. Monteith addressed Council on the
pending Referendum Vote on the Constitution, to be held October 26th,
1992. He reviewed the Government's position on this Referendum and
fielded questions from the members of Council.
ELGIN-ST. THOMAS HEALTH UNIT
Dr. T.N. Wilson, M.O.H., and Mr. Donald Holmes of the Elgin-St. Thomas
Health Unit were present and it was moved by Reeve Geier that they be
heard. Dr. Wilson addressed Council indicating that November was
Rabies Awareness Month, and that as long ago as 1820, the Governor
General died of rabies from his pet fox. Mr. Holmes advised that
there were 94 cases of rabies identified in 1992, with 67 persons
receiving treatment. The total cost for treating one person is
approximately $3000.00. A notice was given to all members of Council
indicating that clinics would be held with a discount of 25% off, from
November 16th to 30th, sponsored by the Veterinarians of Elgin. The
notice listed all the available veterinarians who were participating
in the reduced clinics.

COUNTY RESTRUCTURING
The Clerk reported that he had received a fax letter from Mr. Peter
Boles, a copy of which was given to all members of Council. It
reviewed the comments he made at the previous council Session and it
was referred to the General Government and Property Committee with a
copy to be taken back to the local municipalities.
Reeve Millman referred to the October 2nd minutes of the General
Government and Property Committee, in which a letter was received
concerning invitations to the Warden's Banquet and possibly some staff
missed. She felt that there should be the same consideration given to
all departments. She also asked if there was anything further with
respect to renovations for the Personnel Department and receptionist
at the front door. Chairman Vandierendonck advised that they were
looking at various options, such as the phone system, the Personnel
Department relocation and the possibility of a receptionist.

Warden Lyle read a Notice of Motion made by Alderman Ray Parkes, made
to the st. Thomas City Council with respect to garbage. It indicated
that some action would have to be taken to impress upon the government
to reopen the Green Lane Landfill site.

1. The ontario Flue-Cured Tobacco Growers' Marketing Board with copy
of a report prepared by the Economic Development Officers, regarding
an effective plan of action for the tobacco industry, and request for

1992. He indicated that the Committee was concerned that the office
was closed for one and one-half days per week and thought it was an
imposition on the part of individuals coming and finding no one there.
They would like to have it open five days per week.

The Clerk advised Council that they normally gave two $300 scholar-
ships for the two students from Elgin County attaining the highest
academic standing. He was telephoned and advised there were no such
qualified recipients and wondered if they could award $150 entrance
scholarships to the students from Elgin County instead.

election, or County restructuring whichever came first; and also that
urban rebates continue until 1997, or until County restructuring is
undertaken, whichever comes first.

A letter was read by the Clerk from the City of st. Thomas in which a
resolution was quoted, appointing an ad hoc committee to review and
make recommendations on the development of a Solid Waste Management
Master Plan, for Elgin and st. Thomas.

Mr. Janes addressed Council and reviewed the events to date, with
respect to the Green Lane Landfill closure and attempts to have it
re-opened. He indicated that without municipal support, the request
for a five year extension was at risk. He outlined the steps that
should be taken, and indicated that a meeting is going to be held next
week with the Ministry of the Environment, with regard to a master
plan and hopefully the city and County can jointly attend. Council
members asked various questions of Mr. Janes, Mr. Barrett and also of
Mr. Murray. The delegation left at this time.
The Report of the Special Committee to strike the Standing Committees
for the year 1993, was presented by Reeve Mezenberg and adopted on
motion of Reeve Mezenberg and Reeve Chute.

Rural Representative - Reeve Hofhuis nominated Deputy Reeve Wilson and
Deputy Reeve Benner nominated Reeve Lyle. A vote by a show of hands
was taken, and Deputy Reeve Wilson won the appointment.

WHEREAS the County of Elgin is concerned over the potential effect
that recent Provincial planning initiatives will have on local
('\, planning issues. Specifically, the County is referring to the Interim
Land Use Planning Guidelines published by the Ontario Ministry of the
Environment; and the Growth and Settlement Policy Guidelines pub-
lished by the Ontario Ministry of Municipal Affairs; and correspond-
ence sent to Elgin County municipalities from the Elgin-st. Thomas
Health Unit pertaining to Part VIII of the Environmental Protection
Act (re: private sewage systems); and
WHEREAS our concerns are as follows:
1) Development has historically, and is currently capable of proceed-
ing in an environmentally responsible fashion on privately serviced
lots of one-half acre or less in many parts of the County of Elgin;
2) The assignment of a two-acre minimum lot size is arbitrary and
requires further prescription of lot dimension and shape in order to
be an effective planning guideline;
3) Local municipalities cannot support a policy initiative designed
to encourage municipal management and responsibility for communal
sewage and water systems, due to the high costs and the difficulties
0, which typically arise in the administration of private civil matters;
4) The use of policy guideline documents often tend to eventually be
enforced unilaterally as policy or regulation, rather than as they are
intended as a guideline for municipalities, to assist in the evalua-
tion and administration of planning and development issues.
NOW THEREFORE BE IT RESOLVED THAT due to the technical complexity of
the issue of private servicing, and the vast physical diversity of the
County, there is certainly one viable solution or approach to this
issue, namely, each application, whether it be for an individual lot,
small cluster of homes, or a rural sUbdivision, be evaluated on its
own merits, after the completion of appropriate geotechnical investi-
gations, which are not biased by the subject guidelines; and
THAT this resolution be circulated to Premier of Ontario, Minister of
the Environment, Minister of Municipal Affairs, Minister of Health,
Minister of Agriculture and Food, Peter North, M.P.P, Elgin-st. Thomas
Health Unit, Elgin County Land Division Committee, R.O.M.A., Leaders
of the Opposition Parties, and all municipalities in Ontario.
