EMPLOYEE PRESENTATIONS

Mr. Floyd B. Humphries who retired as General Superintendent, in the
county Engineers Department was present. Warden R. Vandierendonck and
Reeve H. J. Mezenberg, Chairman of the County Roads Committee,
presented Mr. Humphries with a certificate indicating nine years
of service, and a cheque. They expressed appreciation for his service
to the County and Mr. Humphries responded.
COUNTY-WIDE REASSESSMENT
Ms. Linda Shewfelt, County Treasurer, expanded on phase-in protection
over a four year period, and what assistance could be provided to the
local municipalities, at a 15% or 19% protection level. Mr. stu
Stephen, Regional Assessment Commissioner, Ministry of Revenue, and
Mr. Roger Moyer, Municipal Advisor, Ministry of Municipal Affairs
were present to answer questions, and Warden Vandierendonck introduced
them to Council. Mr. Stephen reviewed what would be involved in a
grant from the county, and by-laws that would be required at the local
level. He indicated a request form would have to come from a

municipality, to request support from the County. He answered many
questions from Council members as to the negative effect on some
municipalities and positive effect on others. Mr. Moyer reviewed
protection levels and a $200.00 threshold, for tax increase or
decrease. Mr. Moyer also indicated that if the local clerks need
help the Ministry of Municipal Affairs and the Ministry of Revenue,
would be available to offer assistance. Representatives from the
Elgin County Board of Education and the Elgin County Separate School
Board were also present, and some of the local clerks. They were
asked if they had any questions they wanted to ask of Mr. Moyer and
Mr. Stephen, and they indicate that most of their questions had
already been answered. The Representatives from the School Boards
indicated that they had not decided on phase-in yet and indicated that
they were waiting to see what the County's approach would be.

THAT for 1993 budget purposes a grant to a maximum of $40,000.00 in
total be provided to those municipalities that choose to participate
in a phase-in program, based on a 15% protection level with a $200.00
minimum tax increase/decrease. The County will provide financial
assistance for the balance of the phase-in program.

participate in the phase-in program, in order to ease the .
social/economic impact to the local municipalities in Elgin County in

regarding scrap tire management and that Elgin County Council urge the
Province of ontario to implement a system of collection and processing

fuel be approved in the Province of Ontario; and that this
resolution be circulated to the Premier of ontario, the Minister of
the Environment, the Association of Municipalities of ontario and the
County of Northumberland.

Reeve Mezenberg introduced an amalgamation agreement for the Township
of Aldborough and Village of Rodney, and requested Council's support.
He indicated that he will be bringing it to the February 26th
Session, and would be asking Council's endorsement.

1. D.A. Gordon, Clerk, Township of Kingston, requesting endorsement
of their resolution petitioning the Minister of Municipal Affairs to
ensure that the process of disentanglement results in the
strengthening of local government.

tation be accepted as the consultation for adoption of policy state-

Reassessment, limiting decreases and increases in all classes of
assessment at the fifteen percent level over a four year period, and
that no phase-in adjustment be made unless the reassessment equals

DELEGATIONS
Council agreed to hear Mr. Terry Shackleton's presentation regarding
the Buddy Bear Program. Mr. Shackleton reported that the program is
based on a simple and universal concept, that all children when faced
with a traumatic situation seek a comfort source to help them through
the trauma. Mr. Shackleton also reported that a number of first
responders, such as fire departments in Elgin County, are equipped
with their own Buddy Bears. County Council was then requested to
endorse the program for the County of Elgin.

Reeve Mezenberg highlighted the main aspects of the amalgamation
agreement for the Township of Aldborough and the Village of Rodney
which was previously circulated to County Council. He indicated that.
both municipalities would appreciate receiving Council's endorsement
of this initiative.

will not be able to represent the County at the forthcoming meeting
respecting amalgamation. Accordingly, Deputy Reeve Volkaert nominated
Deputy Reeve Hentz to represent the County at the amalgamation meeting.
Deputy Reeve Hentz accepted the nomination and Council subsequently
appointed him to the position.
COUNCIL CORRESPONDENCE
1. Fred Upshaw, President, ontario Public Service Employees union,
urging municipalities to say "NO" to the draft agreement on Phase I of
Disentanglement.
2. John Sewell, Chair, commission on Planning and Development Reform
in ontario, in response to County Council's endorsement of the Town-
ship of Osprey's resolution concerning the pUblic consultation for
Policy Statements required under section 3 of the Planning Act, noting
that Cabinet can decide whether to carry out further consultation; and
that the Commission will be holding a public forum in London on the

was filed.
Council Correspondence #2 from John Sewell, Chair, Commission on Plan-
ning and Development Reform in Ontario, was introduced. After consid-
erable discussion, the Executive Committee of Council was directed to
prepare a response to the Sewell Commission's Draft Report for consid-
eration by County Council on March 23, 1993.
NEW BUSINESS
A discussion took place regarding the potential impact of the draft
agreement on Phase I of Disentanglement. The consensus was that
Council would discuss the impact of disentanglement further at its
meeting of March 23rd, 1993 after attending a consultation session in
Chatham ontario on March 1st.
Reeve Hofhuis surveyed the members of Council regarding those munici-
palities who are planning to use the phase-in provision of market
value assessment.

Deputy Reeve McPhail, the County's appointee on the Four Counties Gen-
eral Hospital Board, distributed a brief regarding the 1993/94 Capital
Expansion Appeal on behalf of Four Counties General Hospital. Deputy
Reeve McPhail outlined the nature of the Four Counties General Hospital
Capital Expansion Appeal respecting the Ambulatory Care Center. He
described the financial position of the hospital, the efficiency of its
administration, and its use by County residents. Deputy Reeve McPhail
concluded by asking County Council to reconsider pledging a grant for
the Expansion Appeal.

mailed to all members of Council. Members of Council, in turn, raised
questions respecting various proposed budgetary allocations.

respecting the Road Department's transfer from Equipment pool Surplus
(1992) .

Council agreed to hear Mr. Michael O'Dea, Barrister and Solicitor,
representing the Elgin Law Association. Mr. O'Dea reported that the
Elgin Law Association has very serious concerns as to the future of
Court services within the County of Elgin. Particular reference was
made to the possible regionalization of Court services in London and
the effects that move may have on the County. Mr. O'Dea asked Council

to consider appointing members to a joint committee composed of
representatives from the Elgin Law Association and the city of
st. Thomas, who would be responsible for monitoring the presence of
Courts and Court facilities in the County.
('\ Council agreed to consider Mr. O'Dea's request during the afternoon
Session.
Council agreed to hear Mr. Glen White's presentation regarding the
1993 County Budget increase. Mr. White expressed concern regarding
the 7.9% increase in County Levies for 1993, noting that an increase
of this magnitude is difficult to comprehend in today's recessionary
climate. He urged Council to be creative and demonstrate leadership
by finding ways to reduced the increase. Mr. White circulated a
letter outlining his concerns to members of Council.

RESOLUTION ON DISENTANGLEMENT

WHEREAS, after a period of extensive consultation, review and
revision, representatives of the Province of ontario and municipal
governments, boards and agencies have recommended an agreement
respecting funding arrangements for roads, general welfare assistance
and property assessment; and
WHEREAS the "draft" agreement on Phase I of Disentanglement is now
being considered by the Association of Municipalities of ontario
(AMO); and
WHEREAS the Municipal Corporation of the County of Elgin, as an
affected party to that agreement, deems it necessary and appropriate
to formulate its official position on Disentanglement.
NOW THEREFORE the Municipal Corporation of the County of Elgin hereby
declares as follows:
(1) That the County of Elgin recommends to the AMO that the agreement
on Phase I of Disentanglement be endorsed and signed; and

(2) That the AMO be informed that, despite its acceptance of the said
agreement, the County of Elgin has two reservations which it deems
worthy of mention; they are:
(i) The reliance on unconditional grants to balance the fiscal trade.
County Council would prefer that the grants allocated for road
purposes be conditional grants, thereby ensuring that those
allocations will be spent only on roads. Making these grants
unconditional, allows Councils to use these funds for other services
and not necessarily for roads purposes, as originally intended. Road
programs may become vulnerable and susceptible to change depending on
the priorities of Council at that time.
(ii) The level of authority and control to be vested in Property
Assessment Services. If the newly created Crown Agency is to be
effective, then the Board must have complete control over priority
setting, labour negotiations and settlements, personnel complements
and budgets. County Council is genuinely concerned that the Board of
Directors will be thwarted by existing collective agreements, current
and future Provincial Policies and a general lack of control over the
Agency's budget.
(3) That the County of Elgin's official position on this matter be
forwarded to all the municipalities within Elgin County and to the
Association of Municipalities of ontario in accordance with its April
7th, 1993 deadline.

Mr. Gary Gowland, Manager, 9-1-1 Emergency Services, Bell Canada,
provided information on Bell Canada's Subscriber Billing Application
that is currently before the C.R.T.C.. Bell Canada's neutral answer-

conducting civic addressing throughout the County. Mr. Gowland's
presentation was followed by a series of questions from Council
respecting various aspects of the 9-1-1 Emergency Service.
ENQUIRIES BY MEMBERS
Councillor Spenard asked why the grant to the Elgin Tourist
Association is to be paid on December 15th, 1993 instead of quarterly,
as was the case last year. The policy with respect to the payment of

Director's of A.M.O. with particular reference to the following
statements made by that Board:
Whereas this Government purports to act in a co-operative manner and
to give the appearance of treating the municipalities of ontario as an
equal partner;
And whereas this government then proceeds to download $1.285 billion
dollars onto the backs of local property taxpayers;
('\ Be it resolved that the Association of Municipalities of ontario
denounces attempts by the Provincial Government to solve its own fis-
cal difficulties by transferring its financial burden to municipali-
ties and other transfer partners through both the Expenditure Control
Plan and the Social Contract process;

That AMO demand that the Province enter into legitimate negotiations
with their transfer partners regarding these issues;

And that with regards to the social Contract process the Provincial
Government is proposing wage roll backs and controls by toothless

direct legislative means to achieve payroll expenditure reductions and
these means should be used and no program (e.g. pay equity) should be
excluded.

DELEGATIONS
Mr. Peter North, M.P.P., addressed Council regarding the recent
announcement by the Provincial Government on the Expenditure Control
Program and Social Contract process. Due to an ever burdening
Provincial debt, Mr. North indicated that the Government is intent on
reducing expenditures by $2 Billion through the Social Contract
process; however, the Government is somewhat flexible on how that
reduction is made. Mr. North also emphasized the job creation
component of the Provincial Budget which is manifested in the Jobs
ontario Community Works Program. That Program was formerly known as
Community Economic Development, PRIDE and other programs all rolled
into one. Members of Council, in turn, asked Mr. North a series of
questions respecting the timing of the announcements and the impact of
the reductions among other items.
Lieutenant-colonel G. C. Holden of the Elgin Regiment addressed
Council by explaining the mandate and the role of the Regiment, in
the Elgin Community. Lieutenant-Colonel Holden's presentation was
followed by a number of questions respecting various aspects of the
reserve units.

Councillor Lyle read aloud a press release from the st. Thomas-Elgin
General Hospital, indicating that the five top senior executives of
the hospital declined salary increases granted to them earlier in May.
Councillor Mezenberg announced the plans for the west end regarding
the celebration of their pending amalgamation which is to take place
on July 1st, 1993. Councillor Mezenberg also indicated his intention
to seek the Office of Warden this coming December 1993.
Councillor Neukamm expressed his interest in seeking the Office of
Warden in December 1993.

to approve leave(s) of absence without pay according to the following
parameters:
1) such leave(s) of absence will not in any way affect the operation
or efficiency of the services being provided by the department; it
being understood that those employees on leave of absence will not be
replaced temporarily or otherwise during the course of their leave;

2) such leave(s) of absence will be offered to all employees of the
County, both union and non-union, on a voluntary basis;
3) said leave(s) of absence will be offered during the term of the

4) Department Heads, who have grant~d leave(s) of absence during
this interim period, shall report such actions directly to their
appropriate standing Committee;
5) except as stated above, all other terms and conditions respecting
leave(s) of absence shall apply;
6) the County reserves the right to alter, amend or rescind said
policy with at least two weeks' notice if circumstances change during
the course of the Social Contract.

THAT, commencing in December 1993, the election of Warden for the
County of Elgin be determined by secret ballot and that By-Law No.
88-64 be so amended.

The County Clerk was instructed to survey neighbouring counties
regarding their method of election for warden, chairman of standing
committees and composition of standing committees and to report back
to the General Government and Property Committee.
Warden Vandierendonck reminded Council and staff that a tentative
County Council meeting date had been set for August lOth, 1993 com-
mencing at 1:00 P.M.. The Warden also indicated that this date may be
subject to change depending on what happens with the Social Contract
process.
Councillor Spenard reported that the Elgin Tourist Association is
waiting for some municipalities to remit their contribution for adver-
tising which was predetermined at $.50 per capita. Councillor Spenard
also highlighted the promotional campaign for Elgin County and indi-
cated the events which are taking place in the coming months.
(~) The Personnel Administrator asked for volunteers from Council for the
city/County Volleyball event which is to take place on July 1st, 1993.
The Director of Homes for Senior citizens also noted that Elgin Manor
will be holding a pork and beef barbecue in commemoration of Seniors'
Month to be held on July 2nd, 1993.

employees in the Municipal and Health Sectors and Recommendation No. 1
of the Executive Committee Second Report to County Council dated August
lOth, 1993 be approved with the following amendments:
a) THAT the items related to unpaid leaves of absence be deleted;
b) THAT in keeping with requirements of the Legislation, the Plans
will not adversely affect those employees who earn less than
$30,000 annually;
c) THAT all references to reduced benefit levels be deleted; and,
d) THAT there be no increase in compensation for employees earning
above the Low Income Cut Off ($30,000) except grid movements.

regarding the appointment of the Medical Director to Elgin Manor and
refrained from discussion and voting on the item. Councillor Hofhuis
is the wife of the new Medical Director for Elgin Manor.
DELEGATION
Mr. Alan Bailey, Ministry of Culture, Tourism and Recreation, and Mr.
Roger Moyer, Ministry of Municipal Affairs, presented a video on
Strategic Planning entitled "Paradigms". Mr. Bailey emphasized the
relationship between the word "change" and community strategic planning
and the need to re-evaluate the way we do business.
Mr. Moyer, using an overhead slide, highlighted the main aspects of the
report entitled "The city of st. Thomas and County of Elgin Strategic
Plan".

of Green Lane Landfill was introduced.

THAT the Council of the Corporation of the County of Elgin register its
strong objection to the appeal filed by Connie Drew and Glen williams,
on the Environmental Assessment Board's Decision respecting the Interim
Expansion of Green Lane Landfill, with particular emphasis on the
following:
a) The appeal represents an affront to the interim expansion
hearing process; a process that included representations
made on behalf of the appellants; and,
b) The appeal, if allowed to proceed, will force municipalities
in the County and the City of st. Thomas to continue to
transport waste over long distances and at exorbitant costs
- the cost of hauling waste to the Ridge landfill site in
neighbouring Kent County is approximately $10,000.00/day
for Elgin municipalities for each and every day that the
site remains closed.
And,

THAT, if the appeal is heard, the Cabinet be requested to make this
item a top priority, to act quickly and decisively, and to resolve this
matter as expeditiously as possible;
And further,
THAT the Premier of ontario and all members of the Provincial Cabinet
be informed immediately of Council's position on this very important
and urgent matter.

CLERK'S REPORT - REVIEW OF STANDING COMMITTEE STRUCTURE
The Clerk presented a report regarding a review of the County of
Elgin's Standing Committee Structure and indicated that the report has
been circulated to members of Council for discussion purposes only and
that no decision respecting the recommendation in the report is
required at this Session. A number of questions and comments were
raised respecting the purpose of the Executive Committee; the terms of
reference of the Executive Committee versus the General Government and
Property Committee; rural and urban representation on the Roads
Committee; as well as the method of appointment to outside boards and
agencies.

It was indicated that these questions and concerns would be taken under
advisement when the Executive Committee further reviews the report.

Ms. Cathy Grondin, Co-ordinator, and Mr. Doug Seanor, Placement
Consultant, addressed Council on behalf of the jobsOntario Training
Program in Elgin County. It was noted that the object of the program
is to maintain a highly skilled labour force throughout Ontario and to
put people back to work. The mechanics of the program, as well as the
eligibility criteria, were explained to members of County Council.
This was followed by a short question and answer period on various
elements of the program.
The Warden then thanked the delegation for their presentation and
excused them from the meeting.

Mr. D.L. Holmes, Assistant Director, Elgin-st. Thomas Health Unit,
addressed Council regarding rabies in the community and the need to
have pets vaccinated. The role of the Health unit in the prevention
and awareness of rabies was discussed, as well as various statistics
relating to the number of rabies occurrences in Elgin County. Mr.
Holmes emphasized the high cost of vaccinating as a result of exposure
to rabies and encouraged municipalities to hold rabies clinics.
Warden Vandierendonck thanked Mr. Holmes for the presentation and
excused him from the meeting.

in the Procedural By-Law and that Council Day will be held on December
16th, 1993 at 10:00 A.M. Members of Council and senior staff were
asked to correct their 1993 Municipal Directory which incorrect Iv
listed the dates of the Warden's Election and Council Day on the 7th
and 9th of December 1993 respectively.

behalf of the Elgin-st. Thomas united Way Campaign and explained the
geographical area served by the united Way, its twenty-three agencies,
its role in the Community and its goal for 1993 which is $710,000.00.
Councillor Wilson along with Councillor Millman volunteered to canvass
County Council members to obtain support for the campaign.

Warden Vandierendonck informed Council of a delegation from Green Lane
Environmental Group to the Ontario Legislature in protest to the
appeal of the E.A. Board's decision, scheduled for December 7th, 1993
at 8:00 A.M. The Warden encouraged members of Council to attend this
event.
Councillor Chute informed members of the Executive Committee that there
will be a meeting of the Committee on December 8th, commencing at 1:30
P.M..

ELECTION OF WARDEN
The Clerk asked that members of Council wishing to run for the
Office of Warden please stand. Councillors Chute, Mezenberg and
Neukamm offered their candidacy for the position of Warden of Elgin
County Council for 1994. Each candidate was then given an opportunity
to address Council in alphabetical order.
BALLOTING PROCEDURES
The Clerk explained the composition of the ballot and that he, the
Deputy Clerk and Mr. Chuck Raven, of Raven & Company, will be counting
the ballots in the Warden's Office. In the event that one candidate
does not receive the majority of votes in the first ballot, the
candidate with the lowest number of votes will drop off and a second
ballot would be required between the two remaining candidates.

RESULTS OF FIRST BALLOT
The Clerk announced that there will be a second ballot between
Councillors Chute and Mezenberg.
SECOND BALLOT RESULTS
The Clerk announced that the Warden for Elgin County for 1994 is
Councillor D. Vane Chute of Bayham Township.
Councillors Mezenberg and Neukamm, in turn, congratulated Warden Chute
on his election and together with all members of Council unanimously
pledged their support.
Warden Chute took the Declaration of Office and Oath of Allegiance as
administered by the Clerk. The Warden left the room and was gowned and
re-entered the Council Chambers where he was officially presented with

the Chain of Office, the Lord Elgin Watch and the Gavel of Office, by
Past-Warden Roger Vandierendonck. Councillor Chute delivered his
inaugural address to Council, thanked them for their support and
outlined the items of interest and importance for consideration in

Federal Government's infrastructure program. Mr. Knutson explained the
criteria for the program, the funding levels allocated for the
initiative, the level of participation involving municipalities, the
Province and the Federal Government, the requirement that projects be
environmentally sound and the composition of the Management Committee
("" which will be reviewing applications. Mr. Knutson then answered a
\ number of questions from County Council.
Warden Chute thanked Mr. Knutson for his presentation and looked
forward to the County's continued association with the Federal
Government. Mr. Knutson was then excused from the meeting.

meeting date for 1994.

Clutterbuck. The Committee will meet on the 1st Wednesday of the
month at 9:00 A.M.

The Chairman of the County Roads Committee is Councillor Neukamm. That
Committee will meet on the 2nd Tuesday of the month, commencing at 9:00
A.M.

The Chairman of the General Government and Property Committee is
Councillor Mezenberg. The Committee will meet on the 1st Friday of the
month at 9:15 A.M.
The Chairman of the Homes for senior citizens Committee is Councillor
MacGinnis. The Committee will meet on the 2nd Wednesday of the month
at 5:30 P.M.
RESOLUTION ON BOBIER HOME
The following resolution was introduced as a result of a meeting of
the Homes for Senior citizens Committee:

THAT the Management Team be responsible for the operation and signing
authorizations for the Bobier Home effective January 1st, 1994.

Council took a short break prior to the selection of urban and rural
r appointees to the Executive Committee.
ELECTION OF URBAN AND RURAL APPOINTEES
On motion of Councillor Hentz and seconded by Councillor Benner,
Councillor West was nominated for the position of Rural Representative
on the County's Executive Committee. There being no other nominations,
councillor West was declared the Rural Representative.
On motion of Councillor Derrough and seconded by Councillor Webber,
Councillor Vandierendonck was nominated as the Urban Representative on
the County's Executive Committee.
On motion of Councillor Hofhuis and seconded by Councillor Wilson,
Councillor Spenard was nominated as the Urban Representative on the
County's Executive Committee.
By show of hands, Councillor Vandierendonck was elected as the Urban
appointee.
Council took a short break while the Executive Committee met to select
r, a Chairman and to choose a regular monthly meeting date.
When Council reconvened, Councillor Vandierendonck announced that he
had been elected Chairman of the County's Executive Committee and that
the Committee would meet on the 2nd Wednesday of the month, commencing
at 9:00 A.M.
