January 27, 1998 Minutes COUNTY COUNCIL Tuesday, January 27th, 1998 The Elgin County Council met this day at the Administration Building at 9:00 AM., in accordance with adjournment, with all members present except Councillor Rock. The Warden in the Chair. ADOPTION OF MINUTES Moved by Councillor Habkirk Seconded by Councillor Walters THAT the minutes of the Elgin County Council meeting held on January 13th, 1998 be adopted. - Carried. Council reconvened 9:20 AM. DELEGATION Mr. Bryce Sibbick, Frank Cowan Company, was in attendance to present the 1998 Insurance Proposal. The area of greatest change was the Road Department's transfer of equipment to lower-tier municipalities and taking on the transfer of Provincial highways. Even though County Roads are now being maintained at the lower tier, the liability for these roads still lies with the County. A seminar on this issue will be held in the near future where the County will have an opportunity for input. The Warden thanked Mr. Sibbick for his presentation and Mr. Sibbick left the Chambers at 9:30 AM. Moved by Councillor VanBrenk Seconded by Councillor Walters THAT the 1998 Comprehensive Insurance Program for the County of Elgin from the Frank Cowan Company be approved in the amount of $190,808.00, plus applicable taxes. - Carried. Moved by Councillor Wilson Seconded by Councillor Stewart THAT we do now go into Committee Of The Whole. - Carried. REPORTS OF COUNCILLORS Council Communications - Warden Clutterbuck The Warden presented his report on improving communications with Councillors. The Treasury Department was directed to contact Fonorola in regard to acquiring telephone calling cards. Councillors that presently have fax machines and do not wish to purchase new ones will be compensated for paper and phone charges. Moved by Councillor Wilson Seconded by Councillor van Kasteren THAT the Warden's Report on Council Communications be adopted and the recommendations contained therein be implemented. - Carried. STAFF REPORTS 1998 Day Care Rates - Director of Social Services Mr. Bell presented his report and indicated that Day Care rates have not been increased in a number of years. Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT the County of Elgin continue with the practice of setting an overall maximum, rather than specific rates, at $27.00 per day for all agencies providing Day Care funded through the County, subject to the approval of the Ministry of Community and Social Services. - Carried. County Council - 3 - January 27, 1998 Homes for Seniors Service AQreements for 1997 - Director/Administrator Mr. Boyes highlighted his report on the Homes' Service Agreements for 1997. Moved by Councillor VanBrenk Seconded by Councillor Stewart THAT the Warden and Administrator/Clerk be authorized to sign the 1997 Service Agreements for Elgin Manor, Terrace Lodge and Bobier Villa. - Carried. Occupancy of Homes for Seniors - Director/Administrator Mr. Boyes advised Council that all Homes have a 91 % - 97% occupancy rate. Once the occupancy rate is over 95%, the Province will fund 100%. Moved by Councillor Walters Seconded by Councillor McPhail THAT the Occupancy Report on the Homes for Senior Citizens be received and filed. - Carried. OverniQhtlWeekend ParkinQ Ford Taurus - ManaQer. EnQineerinQ Services Mr. Watters advised Council of concerns he has regarding overnight parking of the County vehicle at the Administration Building, due to recent vandalism. Central Elgin, who leases the County Garage, has agreed to allow the vehicle to be parked there overnight. Moved by Councillor Habkirk Seconded by Councillor VanBrenk THAT the appropriate Personnel Policy be amended to permit storage of the County vehicle off site at the County Garage. - Carried. RestrictinQ of WeiQht Loads on County Roads - ManaQer. EnQineerinQ Services Mr. Watters reported that high-float roads carry traffic that is detrimental to the road during Spring thaw conditions. These roads are 100% County cost and a policy should be considered to restrict weight loads during the Spring. Council noted that essential service vehicles using these roads had not been considered, which resulted in the following motion: Moved by Councillor VanBrenk Seconded by Councillor McPhail THAT the report on Restricting of Weight of Loads to be carried on County Roads be referred back to the Manager, Engineering Services, for further research, and a revised report be brought back to the next Council meeting. - Carried. Lawn Maintenance - County Administration BuildinQ - ManaQer. EnQineerinQ Services Mr. Watters advised Council that the lawn maintenance contract for the County Administration Building had expired and quotes would be obtained, as per the County's Purchasing Policy. Moved by Councillor Walters Seconded by Councillor Stewart THAT the County's Purchasing Policy be followed to arrange for services for Lawn Maintenance. - Carried County Council - 4 - January 27, 1998 Councillor McPhail informed Council that there is an organization of landowners who's objective is to get the best agreement between them and the Lake Erie Pipeline Project. The cost to join GAPLO is $100.00 and it was felt that the County would lend credibility to the organization (GAPLO). The Manager, Engineering Services, will purchase a membership and attend meetings in February, reporting back to County Council. Monthly Operations and Automation Report - ManaQer. Library Services Ms. Bishop provided highlights from the report and requested direction from Council regarding reporting of the Library operations. Council indicated they were pleased with the current reporting practices. Ms. Bishop pointed out that reorganization has had impact on borrowing statistics. Moved by Councillor Van Kasteren Seconded by Councillor Walters THAT the Monthly Operations Report and Automation Report for the County Library be received and filed. - Carried. Library Van - ManaQer. Library Services Ms. Bishop indicated the County received $6,766.00 for sale of the Library Step Van and requested that the proceeds be used for vehicle maintenance and other operating costs. Moved by Councillor McPhail Seconded by Councillor Stewart THAT the money received from the sale of the 1990 Ford Step Van ($6,766.00) and license plate refund ($56.65) be set aside in a Library reserve account, and be brought forward in the 1998 proposed Library budget. - Carried. Councillor Walters informed Council that the St. Thomas Public Library is using the option of Development Charges to assist with the purchase of new books in City Library. He suggested that perhaps this is an option that the County could look into. The Treasurer will investigate this and report back. Council took short break at 10:30 AM. and re-convened at 10:42 AM. MeetinQ Dates for Preparation of 1998 BudQet - Treasurer Mrs. Veger reviewed the meeting dates presented in her report and advised Council that the budget may not be finished by March 31 st deadline. Moved by Councillor Walters Seconded by Councillor van Kasteren THAT the report from the County Treasurer establishing the dates for review and approval of the 1998 County budget be approved for implementation. - Carried. E.M.A. Dinner - Treasurer Mrs. Veger presented background information on the E.M.A Annual Dinner for Council and requested the nomination of a Councillor to introduced Past Warden attendees. County Council - 5 - January 27, 1998 Moved by Councillor VanBrenk Seconded by Councillor Walters THAT Councillor Walters carry out introductions of the Past Wardens at the Elgin Municipal Association Annual Dinner. - Carried. Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT staff be authorized to include $500.00 in the 1998 Warden's budget to cover the cost of tickets for Past Wardens to the Elgin Municipal Association Annual Dinner Meeting, March 4, 1998. - Carried. Conventions - Treasurer The Treasurer presented her report on Conventions which outlined the current policy for attendance by County Councillors. Council directed item #8 of the report be increased to $1,500.00 from $1,100.00 for Councillor expenses; item #4 be increased to $5,000.00 from $4,000.00; and mileage reimbursement increased to $.30 per kilometre from $.28. Moved by Councillor Walters Seconded by Councillor McPhail THAT the Treasurer's Report on Conventions be adopted, as amended. - Carried. Pay EQuity Act & SalarylWaQe Administration - Personnel Administrator The Personnel Administrator provided a history for the new Council on the Pay Equity Act and the effects on the Salary Administration Policy. Moved by Councillor Habkirk Seconded by Councillor Wilson THAT to ensure we are complying with the spirit and intent of the Pay Equity Act and following the norm for Salary Administration, Policy 4.90 be amended to reflect the term "red circling" and it be understood that any position affected by "red circling" would remain at the current rate until the employee leaves the job or the salary range catches up to the incumbents rate of pay through wages or cost of living increases. - Carried. Moratorium on Job Evaluations - Personnel Administrator Moved by Councillor VanBrenk Seconded by Councillor Walters THAT the moratorium on job evaluations be lifted and staff be directed to evaluate positions in accordance with Personnel Policy 4.90 to ensure positions are assessed appropriately based on current duties and responsibilities. - Carried. Non-Union Job Evaluation Committee - Personnel Administrator Discussion with regard to the Personnel Administrator's report on Non Union Job Evaluation Committee concluded that an appeal process should be determined and a "champion" from County Council - 6 - January 27, 1998 each department should not be involved, since employees may change from time to time and continuity could not be guaranteed. Moved by Councillor Habkirk Seconded by Councillor Stewart THAT the Salary Administration Policy 4.90 be amended to reflect the composition of the Job Evaluation Committee to consist of the Warden and/or Administrator/Clerk, the Department Head or Manager and the Personnel Administrator. - Carried. Records ManaQement-Job Creation Partnership - Personnel Administrator The Records Management report outlined the resources available through Human Resources Canada to help with the cataloguing of County department files. The establishment of a Corporate Records Management Program has no intention of creating any new jobs and the current timelines for staff assistance cannot be extended beyond time allotments. Moved by Councillor VanBrenk Seconded by Councillor McPhail THAT the County of Elgin be authorized to apply to Human Resources Development Canada for up to three Records Clerks; and further That the County of Elgin be authorized to submit $425.22 to the Workplace Safety and Insurance Board (formerly WCB) to cover the assessment costs of these workers' earnings ($32,214.00 payable by Human Resources Development Canada). - Carried. Warden Clutterbuck introduced Karen Dunn, the County's Emergency Measurers Co-Ordinator to Council. EIQin/St. Thomas 9-1-1 SteerinQ. Civic AddressinQ. and Promotion Committees - EmerQency Measures Co-Ordinator The Co-Ordinator highlighted areas of concern and provided an overview for the new Council of the activities the Committees have been involved with over the past few months. The issue of signage for vacant properties and the options available were discussed. Moved by Councillor Wilson Seconded by Councillor Walters THAT the Elgin County Civic Addressing Guidelines be amended to include addressing for vacant properties with the understanding that the lower-tier will be responsible to measure, order and install the applicable signage; and further That the cutover for implementation of 9-1-1 in Elgin County not be delayed in order to accommodate numbering of vacant properties. - Carried. Moved by Councillor Van Kasteren Seconded by Councillor Habkirk THAT the report from the Emergency Measures Co-Ordinator regarding activities of the Elgin/ St. Thomas 9-1-1 Steering, Civic Addressing, and Promotion Committees be received and filed. - Carried. County Council - 7 - January 27, 1998 EmerQency Measures Committee - EmerQency Measures Co-Ordinator The Emergency Measures Co-Ordinator advised Council that the Plan is progressing well and the Committee is striving to complete as much as possible, as time is a very critical factor. The Administrator/Clerk advised Council that the Co-Ordinator's contract expires March 31 st and staff will be requesting a contract extension. Moved by Councillor VanBrenk Seconded by Councillor Walters THAT the report on the activities of the Emergency Measures Committee be received and filed. - Carried. 1998 Municipal Directory - Deputy Clerk The Deputy Clerk handed out various examples of directories for Council's consideration. Some Councillors would prefer the "card style" and others would like to have "month-at-a- glance" calendar pages, however, it was felt that this style would be too late for 1998. Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT 300 copies of the Elgin County Directory with "month-at-a-glance" setup be ordered. - Defeated. Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT 200 "card style" directories be ordered for 1998 and that "month-at-a-glance" be ordered for 1999. - Carried. Council authorized Staff to obtain three quotes on the card style and proceed with the lowest quote. Deputy Warden - County Administrator/Clerk The Administrator/Clerk reported that due to the number of meetings and engagements the Warden is expected to attend each year, the issue of a Deputy Warden was referred to the 1998 County Council by the County Implementation Committee. The Warden commented on the short notice for some engagements and that having representation from the municipality involved would perhaps be more advantageous. Councillors who appear on behalf of the Warden will be paid mileage. Moved by Councillor VanBrenk Seconded by Councillor Wilson THAT the position of Deputy Warden be established and that staff prepare a schedule which would rotate the position to all eight members of County Council on a monthly basis. - Carried. Community Transportation Proposal - County Administrator/Clerk The Administrator/Clerk's report on the Elgin-St. Thomas Community Transportation Proposal provided Council with highlights on the proposal to be submitted to the CTAP for Provincial funding. The Ministry of Transportation along with the Ministries of Health, Education, Community and Social Services, and Citizenship and Culture and Recreation are all jointly involved and the funding is time limited to September 1998. A letter will be sent explaining that support is being given on the understanding all County CT AP initiatives are considered. County Council - 8 - January 27, 1998 Moved by Councillor Habkirk Seconded by Councillor Walters THAT the Council of the Corporation of the County of Elgin support and endorse the Elgin-St. Thomas Community Transportation Proposal and provide a $5,000.00 contribution to the project, to be obtained from the 1997 Road's budget surplus. - Carried. Ms. Betteanne M. Cadman, Clerk, Township of Delhi, with a motion concerning freedom of choice and tobacco smoking in privately owned businesses. 3. Mr. Frances Aird, Clerk Administrator, Township of Hope, with a resolution concerning the distribution of revenue from the Gasoline Tax to municipalities to maintain road standards. 4. Mr. Peter Stechenreiter, Area Manager, Ministry of Community and Social Services, offering Ministry assistance to municipalities during the transition of provincial social assistance programs to the municipal level. 6. Municipality of Central Elqin; 1) Requesting the County to pay vacation time owed to former County Road employees prior to January 1, 1998. 2) Requesting the assistance of the County Personnel Administrator with union contract negotiations in 1998 for the Municipality. 3) Requesting a proposal from the County to set up and maintain a Health and Safety program for inside and outside workers for the newly formed Municipality. Township of Malahide; 1) Requesting the County to pay vacation time owed to former County Road employees. 2) Requesting assistance of the County Administrator/Clerk and County Personnel Administrator with union certification and first collective agreement negotiations. 7. Mr. Richard J. Chowen, with an invoice for services from October 1 - December 31, 1997. 8. J. A Murray, Clerk-Administrator, County of Huron, with a motion to petition the province for additional funding due to the closure of chronic and psychiatric facilities. 9. Association of Municipalities of Ontario Member Communication ALERT, "Provincial Government Calls On Municipalities To Assist Their Eastern Ontario TWINS''', with information concerning twinned municipality direct support. County Council - 9 - January 27, 1998 10. Mr. Mason Bailey, Reeve, Village of Blyth, requesting Council's support of the Village of Blyth's resolution for fair and equitable taxation for property owners. 11. Mrs. Judy Kay, Clerk-Treasurer, Township of Colborne, with a resolution requesting the provincial government to provide resources to investigate the contamination of ground water by E-Coli bacteria, the deteriorating quality of the lakes and health risks to the community. 12. Reeve Dave Mack, Township of Elizabeth, requesting financial assistance for the Ice storm devastated area. 13. Mayor William F. Bell, The Town of Richmond Hill, with a resolution inviting communities not affected by the January ice-storm to provide assistance to those communities who were devastated by the storm. The following recommendation was adopted with respect to Correspondence Item #2: Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT we support the resolution from the Township of Delhi requesting the Province of Ontario to amend or revise the Regulatory Tobacco Act, to allow municipalities within the tobacco producing counties to determine the appropriate level of policing of the regulatory "No Smoking" protocol and the enforcement. - Carried. The following recommendation was adopted with respect to Correspondence Item #3: Moved by Councillor Habkirk Seconded by Councillor Stewart THAT the Council for the County of Elgin supports the Township of Hope's request that their resolution for fair distribution of the gasoline tax, be included on the agenda in the 1998 Resolution package at the OGRA Conference. - Carried. The following recommendation was adopted with respect to Correspondence Item #4: Moved by Councillor Habkirk Seconded by Councillor Wilson THAT Councillor Bill Walters represent the Council for the County of Elgin as the Official Voting Delegate at the AM.O. Special Meeting to be held on February 6th, 1998. - Carried. Moved by Councillor Walters Seconded by Councillor van Kasteren THAT Correspondence Item #5 be received and filed. - Carried. County Council - 10- January 27, 1998 The following recommendation was adopted with respect to Correspondence Item #6: Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT the County remit any and all unpaid vacation entitlements to former County employees hired by Elgin municipalities during the restructuring exercise. - Carried. County Council supports the assistance requested in Correspondence Item #6 providing it does not create additional cost to the County. If additional costs are incurred, such as the need for staff to assist Mr. Underhill, the offer will be revisited in the future. Moved by Councillor Stewart Seconded by Councillor VanBrenk THAT the County Personnel Administrator be authorized and directed to negotiate the first collective agreements for the municipalities of Central Elgin and Malahide, with the understanding that all clerical functions, office supplies, photocopying and document preparation will be the responsibility of the affected municipalities. - Carried. Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT the County's Health and Safety Co-Ordinator be authorized and directed to help review and/or establish a Health and Safety Program and provide ongoing training, for lower-tier municipalities who request assistance. - Carried. Chowen in the amount of $9,362.50 for services rendered from October I to December 31, 1997 be paid. - Carried. County Council - 11 - January 27, 1998 The following recommendation was adopted with respect to Correspondence Item #11 : Moved by Councillor Walters Seconded by Councillor van Kasteren THAT the Council for the Corporation of the County of Elgin supports the Township of Colborne's request to the Province of Ontario to provide adequate resources through the Ministry of the Environment and Energy to deal with contamination of water issues on a timely basis. - Carried. Millard, C.AO.lClerk, Township of Malahide, with a resolution in support of extending the January 15th, 1998 deadline regarding delegation of responsibilities to establishing tax transition ratios. 3. Leitch, Transition Board Secretary, Transition Board for the Municipality of Central Elgin, with a resolution confirming that the Municipality will enlist the services of the County of Elgin Weed Inspector. 4. The Honourable John C. Snobelen, Minister, Ministry of Natural Resources, regarding the proposed marina in Port Bruce. 5. The Honourable Tony Clement, Minister, Ministry of Transportation, regarding the County's resolution to increase roadside cutting. 6. Mr. Graham P. Brand, Director, Ministry of Health, acknowledging the County's decision concerning the funding and administering of land ambulance services in the municipality. 8.
