July 21, 1998 Minutes COUNTY COUNCIL Tuesday, July 21 st, 1998 The Elgin County Council met this day at the Administration Building, at 9:02 AM., in accordance with adjournment, with all members present except Councillors Rock and Stewart. The Warden in the Chair. Moved by Councillor VanBrenk Seconded by Councillor Walters THAT the minutes of the meeting held on June 23rd, 1998 be adopted. - Carried. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF - None. Moved by Councillor Wilson Seconded by Councillor McPhail THAT we go into Committee Of The Whole. - Carried. REPORTS OF STAFF Lower-Tier Maintenance Fall '97 - ManaQer. EnQineerinQ Services Mr. Watters noted that the Implementation Committee had recommended that materials only would be paid for by the County for work performed on County Roads in the Fall '97. Council directed that discussion on costs for labour and equipment be deferred to the next Council meeting. Moved by Councillor van Kasteren Seconded by Councillor Walters THAT the invoices for 'materials only' from the Lower-Tier Municipalities for maintenance on County Roads for Fall '97 be approved for payment. - Carried. Roof Repairs - County Administration BuildinQ - ManaQer. EnQineerinQ Services The Homes Building Services Supervisor and a reputable inspector had inspected the Administration Building roof and recommended that the entire roof be replaced. Mr. Watters indicated an ad had been placed requesting prices to have the roof replaced and tenders received. Council noted that a flat roof was not desirable and asked Mr. Watters to look into the approximate cost of changing from the existing flat roof to a steel truss type roof. Mr. Watters will report back later in the meeting. Moved by Councillor Walters Seconded by Councillor Wilson THAT all roof areas of the County Administration Building be priced for replacement, as this would be the most cost effective. - Carried. County Council 2 July 21, 1998 EIQin Middlesex Sanitation - ManaQer. EnQineerinQ Services Moved by Councillor Habkirk Seconded by Councillor McPhail THAT the Warden and the County Administrator/Clerk be authorized and directed to sign a lease agreement with Elgin-Middlesex Sanitation, for Room #6-3, in the County Administration Building, for a two (2) year period at the rate of $7.00 per square foot. - Carried. Ontario EnQlish Catholic Teachers' Association Lease Renewal - ManaQer EnQineerinQ Services Mr. Watters recommended to Council that due to the amalgamation of the school boards, which has affected the tenancy of the various teachers' federations in the Administration Building, the County agree to a short term lease of nine months with the Ontario English Catholic Teachers' Association. Moved by Councillor VanBrenk Seconded by Councillor Walters THAT the Warden and County Administrator/Clerk be authorized and directed to sign a Lease Agreement with the Ontario English Catholic Teachers' Association, for Rooms #232 and #234, in the County Administration Building, for a nine-month period at the rate of $14.00 per square foot. - Carried. Roof Replacement - Administration BuildinQ - ManaQer. EnQineerinQ Services As indicated previously, the entire roof of the Administration Building requires replacement and prices were received from two companies. This matter was deferred until later in the meeting when Mr. Watters has checked on costs for alternate roof styles. BridQe Repairs (Contract No. 1998-01) - ManaQer. EnQineerinQ Services Mr. Watters advised that various bridges throughout the County require minor repairs. Moved by Councillor VanBrenk Seconded by Councillor Habkirk THAT we accept the low tender from Owen King Limited at their tendered price of $21 ,507.00 (GST included) to repair Meeks, Fulton, Vienna, Garton, and Elm Street Bridges; THAT we authorize the Manager of Engineering Services to proceed with this contract. - Carried. Roadway Information SiQnaQe (Contract No. 1998-10) - ManaQer. EnQineerinQ Services Mr. Watters reported to Council that the wording on County information signs requires changes to reflect the new road names at County/County intersections. Two bids were received. Moved by Councilor Wilson Seconded by Councillor Walters THAT we accept the low tender from Doug Bergman Enterprises Incorporated at their price of $9,340.88 (GST included) to provide County roadway information signage; and, THAT we authorize the Manager of Engineering Services to proceed with this contract. - Carried. County Council 3 July 21, 1998 Manufacture and Delivery of Roadwav Sh:maQe (Contract No. 1998-11) - ManaQer. EnQineerinQ Services Mr. Watters noted that roadway signs (i.e. stop signs, yield signs etc.) are replaced on a ten- year rotational basis. Roadway signage in Central Elgin would be replaced this year. Moved by Councillor van Kasteren Seconded by Councillor McPhail THAT we accept the low tender from Canadian Roadway Products at their price of $17,642.28 (GST included) for the manufacture and delivery of roadway signage; and THAT we authorize the Manager of Engineering Services to proceed with this contract. - Carried. After acceptance of the tender for manufacture and delivery of roadway signage from Canadian Roadway Products, written proof was not provided that they were a Certified 3M installer and, therefore, did not meet tender specifications. The tender was subsequently awarded to Doug Bergman Enterprises Incorporated in the amount of $21 ,601.92, taxes included. Roadwav SiQnaQe (Contract No. 1998-12) - ManaQer. EnQineerinQ Services Council questioned that replacement of signs should be part of road maintenance and requested prices be obtained from the lower-tier municipalities to install this signage. Mr. Watters will request prices from the lower-tier next year, as it was agreed that it would be improper this year, due to the fact that we are already aware of the prices from the private sector. Mr. Watters was directed to take the installation issue to next Road Superintendents' meeting for discussion and report back. A change to the County's Purchasing Policy to allow for lower-tier municipalities to quote on County requirements will be considered later. Council noted that minutes from the Road Superintendents' meetings are not being circulated. Mr. Watters will forward these minutes with Council mailings. Moved by Councillor Walters Seconded by Councillor McPhail THAT we accept the low tender from ADDA Construction at their tendered price of $16,050.00 (GST included) for installation of roadway signage; and THAT we authorize the Manager of Engineering Services to proceed with this contract. - Carried. Co-Cp PurchasinQ - Treasurer Mrs. Veger informed Council that, due to restructuring of agencies within our current co-op purchasing association, discussions have been ongoing regarding amalgamations of the three neighbouring purchasing groups. Moved by Councillor Habkirk Seconded by Councillor Wilson THAT, the County of Elgin join the Elgin/Middlesex/Oxford Purchasing Co-Operative effective September 1, 1998. - Carried. Council took a short break at 9:55 AM. and reconvened at 10: 18 AM. County Council 4 July 21, 1998 1998 Tax Rates - Treasurer Mrs. Veger reported that legislation for 1998 Tax Rates requires the County to make certain decisions concerning assessment. The County Treasurer and the Treasurers of the Lower-Tier municipalities met and made joint recommendations on taxation issues. Council noted that residential tax increases should be mitigated and would like taxes phased-in across classes if possible. The Treasurer indicated that her understanding is that "Phase-Ins" must remain within a specific class and cannot cross classes. Council was also concerned that deferred taxes for low income seniors and low income persons with disabilities will have to be picked up by the rest of the residents in the municipality, and questioned that if a deferral by-law is passed, will that lock in the decision? The Treasurer will look into this and noted that there are very stringent qualifications for this class and it is available on one property per ratepayer only; the first $200 of new assessment is paid by the taxpayer and the balance owing is deferred. Council indicated that the numbers covered by this would most likely be minimal. The report was deferred to later in the meeting when the Treasurer has the legislation available to answer Council's questions. The Emergency Measures Co-Ordinator attended at 10:30 AM. Mrs. Veger advised Council of the Commercial and Industrial Education Tax Requisitions, reviewed the table outlining tax ratios, and noted that the Province did not provide collection dates. Mr. Kent Murray, Municipal Advisor, informed the Treasurer that it is a requisition to the Upper Tier and we are required to collect the necessary dollars. Moved by Councillor Walters Seconded by Councillor VanBrenk THAT, for the 1998 taxation year, the County set the education tax rates for the commercial and industrial classes based on the requisition from the Minister of Finance; and, THAT the County determine the education levy amount to each lower-tier based on those tax rates; and, THAT the County determine the pipeline class education levy to each lower-tier based on the tax rate set by the Province; and, THAT the report from the County Treasurer dated July 20, 1998 entitled "Commercial & Industrial Education Tax Requisition" be approved for implementation; and further, THAT the necessary by-law be prepared. - Carried. Homes for Seniors Moved by Councillor Habkirk Seconded by Councillor VanBrenk THAT the Warden and County Administrator/Clerk be authorized to sign the Annual Reconciliation Report (Community Support Services) 1997/98 and the 1998/99 Legal Agreement Schedule 1 - Budget, and Schedule 2 - Service Plan for Community Support Services. - Carried. SprinQfield Library Lease - ManaQer. Library Services Council passed a resolution in October 1997 to expand the square footage in the Springfield Library. Ms. Bishop noted that various items in the standard lease have been amended and that she will be reporting in September on leases for all Branch Libraries County Council 5 July 21, 1998 Moved by Councillor van Kasteren Seconded by Councillor McPhail THAT the Warden and the County Administrator/Clerk be authorized to sign the Standard Elgin County Branch Library lease renewal agreement with the Township of Malahide, for the Springfield Library, with the lease expiry date of December 31, 1999. - Carried. Purchase of Health Unit BuildinQ - County Administrator/Clerk The negotiations for the purchase of the Elgin-St. Thomas Health Unit Building have been completed and the County owns the facilities at 99 Edward Street as of July 9, 1998. Moved by Councillor Walters Seconded by Councillor VanBrenk THAT the Report from the County Administrator/Clerk dated July 10, 1998 confirming the purchase of the Health Unit Building, as previously directed by Council, be approved and the Treasurer be authorized to finance the transaction. - Carried. Performance Evaluation - County Administrator/Clerk The policy that sets the guidelines for the Performance Evaluation of the County Administrator/ Clerk should be reviewed due to change of the Council complement. Moved by Councillor Wilson Seconded by Councillor McPhail THAT the whole of Council be responsible for the Performance Evaluation of the County Administrator/Clerk. - Carried. Municipal AddressinQ Guidelines - Private Mobile Home Parks - EmerQency Measures Co-Ordinator As directed by Council, the Civic Addressing Committee reviewed the policy with regard to addressing of private trailer/mobile home parks. It was noted that a unit identifier could be assigned to each trailer if the municipality deems it advisable (i.e. 12345 -1; 12345-2; 12345-3 etc. John Wise Line), however, only one municipal address is assigned to the park. It was also noted that private lanes could be numbered in the same manner. David Hughes, Director of Social Services, County of Grey, with a resolution concerning the Ministry of Health assuming its' share of legal liabilities resulting from provincial downloading to municipalities. County Council 6 July 21, 1998 2. Ross Snetsinger, Chair, Rail Ways to the Future Committee, with a pamphlet and letter to local M.P.P.'s concerning rail service renewal in Ontario and asking for Council's support for a Rail Renewal Task Force and a Rail Policy. 3. Donald N. Leitch, Co-Ordinator of Planning and Development, Municipality of Central Elgin, with a Draft Restructuring Proposal Boundary Adjustment between Central Elgin and Southwold. 4. Association of Municipalities of Ontario, with a Request for Nominations for the 1998-99 AMO Board of Directors, a copy of the Rules of Procedure for Nominations and the Association's By-Law No.1. 5. Erika MacKenzie, Appointments Adviser, Ministry of Municipal Affairs and Housing, with regard to the representative position on the Elgin and St. Thomas Housing Authority Board, previously held by Mr. Philip Dell, and a request for a replacement nominee to fill the vacant position with someone from the St. Thomas area. 6. Mayor Mark Harrison, Township of Norwich, requesting a financial donation from the County towards the Township of Norwich Disaster Relief Fund to aid residents who experienced substantial damage from the severe windstorm/tornado on June 2nd, 1998. 7. Brenda Clark, Acting Assistant to the Clerk, County of Simcoe, with resolution concerning the effects Bill 99 will have on the volunteer firefighters in the Province of Ontario. 8. Michele P. Gouett, Environmental Services Co-Ordinator, County of Simcoe, with a report from the County of Simcoe's Environmental Services Committee with regard to #2 high density polyethylene containers. 9. M.R. Bragg, Director of Public Health and Planning, County of Oxford, with copy of a model Nutrient Management By-Law and offering legal opinion in return for financial support by the County. 10. James G. Wilson, Clerk-Treasurer, County of Perth, with a resolution asking the Ontario Government to amend the Motor Vehicle Directive as it pertains to Ontario Works, and ownership of vehicles by two-parent families in rural communities required to participate in the program. 11. Bryan D. Hall, General Manager/Secretary Treasurer, Kettle Creek Conservation Authority, requesting a financial contribution from County Council towards the cost of publication of the reference book "Elginature". The following recommendation was adopted respecting Correspondence Item #2: Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT the Corporation of the County of Elgin supports the initiatives of the "Rail Ways To The Future" Committee's commitment to preserve, renew and protect the rail services in our municipalities; and further, County Council 7 July 21, 1998 THAT we request the Minister of Transportation to establish a Rail Renewal Task Force and a Rail Policy. - Carried. The following recommendation was adopted respecting Correspondence Item #3: Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT the Corporation of the County of Elgin supports and endorses the Draft Restructuring Proposal to provide for an adjustment of the municipal boundary between the Township of Southwold and the Municipality of Central Elgin. - Carried. The following recommendation was adopted respecting Correspondence Item #5: Moved by Councillor VanBrenk Seconded by Councillor McPhail THAT the Corporation of the County of Elgin nominate Mr. Donald H. Page to serve on the Elgin and St. Thomas Housing Authority Board as a County representative, for the term January 1, 1998 to December 31, 1999. - Carried. The following recommendation was adopted respecting Correspondence Item #6: Moved by Councillor VanBrenk Seconded by Councillor Wilson THAT the Council for the Corporation of the County of Elgin donate $3,500.00 to the Township of Norwich Disaster Relief Fund, to help defray the costs associated with the devastating storm recently experienced in the Township. - Carried. Warden Clutterbuck has agreed to discuss funding efforts by Township of Norwich with the Warden of Oxford, who is also the Mayor of the Township of Norwich. The following recommendation was adopted respecting Correspondence Item #7: Moved by Councillor van Kasteren Seconded by Councillor Wilson THAT the Council of the Corporation of the County of Elgin supports the resolution from Simcoe County Council calling for the retroactive reinstatement of the compensation benefits previously provided to volunteer fire fighters. - Carried Unanimously. Baker, Manager, Regulatory Proceedings, Union Gas, advising that an application has been filed with the Ontario Energy Board for an order fixing new rates to be effective January 1, 1999. 2. The Honourable AI Leach, Minister of Municipal Affairs and Housing, announcing the extension of the Shoreline Property Assistance Program to March 31, 1999, along with a copy of the program outline. 3. Dave Mason, Chair, Port Burwell Marine Museum Advisory Committee, requesting permission to sell copies of the new County map. 4. Mayor van Kasteren and Randy Millard, C.AO/Clerk, Township of Malahide, expressing appreciation to the County for the help provided by Personnel Administrator and Staff, during the Township's recent first union contract negotiations. County Council 9 July 21, 1998 10. The Honourable Elizabeth Witmer, Minister of Health, advising of the approval for the County to act as the municipal service manager for land ambulance for the County and City of St. Thomas. The Minister also advised that approval has not been given at this time, to the County to provide public health services to the County and City. 11. The Honourable John Manley, Minister of Industry, with News Release which summarizes the "Automotive Competitiveness Review: A Report on the Canadian Automotive Industry". 12. Michael Power, President, Association of Municipalities of Ontario, with an update on the restructuring of the Association and his announcement of running for re-election as President. 13. Peter Jackson, Regional Director, Southwestern Region, Ministry of Transportation, regarding MTO Contract 98-03 - Highway 3 Bridge Reconstruction and compensation to the County due to maintenance resulting from additional traffic on the designated detour. 14. Eugene Zakreski, Vice-President, Marketing and Development, Ministry of Economic Development, Trade and Tourism, regarding a new initiative "The Ontario Tourism Event Marketing Partnership Program". 15. The Honourable Ernie Eves, Minister of Finance, informing the County that the request for the 30 day extension to August 14, 1998, to consider whether to adopt new business classes for the municipality, has been granted. 16. Marilyn D. Fleck, Acting Business Administrator, Elgin-St. Thomas Health Unit, re: the Elgin-St. Thomas Health Unit 1997 Audited Statements and Settlement. 17. George Zegarac, Director (A), Environmental Assessment Branch, Ministry of the Environment, re: changes taking effect at the Ministry of the Environment. Correspondence Item #13 concerning bridge reconstruction funding was discussed by Council. Staff will pursue funding for Highway #3 bridge reconstruction and report back to Council at a later date. Councillor Walters indicated that he was disappointed that stop lights at County Roads #36 and #45 had been removed already and that he had a request from ratepayers that the light at John Wise Line and Quaker Road become permanent. Mr. Watters indicated that a meeting will be held with the Ministry of Transportation tomorrow, to consider assessment of road deterioration and the traffic light issue will also be discussed. The Road Superintendent for Central Elgin will also attend. Mr. Watters will report in September on the costs of providing stop lights with a view to a possible cost share basis. Moved by Councillor Habkirk Seconded by Councillor Walters THAT Correspondence Items #1-17 be received and filed. - Carried. 1998 Tax Rates - Continued - Treasurer Mrs. Veger reported back to Council that she had spoken with Roger Moyer from the Ministry of Municipal Affairs, who advised that relief to seniors, deferral or cancellation, can be changed at Council's discretion. The Phase-In program has to be funded within the class; increases in one class cannot be funded from another class. Moved by Councillor Walters Seconded by Councillor McPhail THAT, for the 1998 property taxation year, the County set the tax ratios at the same level as the transition ratios determined by the Ministry of Finance, for the County of Elgin; and, THAT the optional large industrial class become a property class within the County of Elgin; and, County Council 10 July 21, 1998 THAT tax relief, in the form of cancellation, be offered to low income seniors and persons with disabilities; and, THAT the report from the County Treasurer dated July 13,1998 entitled "1998 Tax Rates" be approved for implementation. - Carried. Council recessed at 12:08 P.M. and reconvened at 1 :04 P.M. Roof Replacement at the Administration BuildinQ - ManaQer. EnQineerinQ Services Mr. Watters indicated that the contractor will provide a two-year guarantee on the roof. Telephone calls revealed that if the roof style were changed from flat to steel truss, it would be approximately four or five times the cost of repairing the existing roof. Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT we accept the low tender from Northern Roofing at their price of $154,657.80 (GST included) to replace the roof of the Administration Building; with $80,000.00 coming from the Reserve for Building and $74,647.80 from the Reserve for Water Line, as well as fees for the inspection of the roof by the consultant; and, THAT the Warden and County Administrator/Clerk be authorized to sign the contract. - Carried. CLOSED SESSION Moved by Councillor VanBrenk Seconded by Councillor McPhail THAT we proceed "In-Camera" to discuss property matters. - Carried. Warden Clutterbuck appointed Councillor Walters as Chairman of the Committee Of The Whole for the In-Camera portion. Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT the Corporation of the County of Elgin advise the Board of Health of the County's ownership of the Health Unit Building, effective July 9, 1998, and that all rental cheques be forwarded to the County of Elgin. - Carried. Councillor Habkirk presented an amalgamated services dispute resolution process, which would better inform both County and City Councils of the actions of the new amalgamated services, for Council's consideration. County Council 11 July 21, 1998 Moved by Councillor Habkirk Seconded by Councillor Walters THAT the Mayor and two Aldermen from the City of St.Thomas, and the Warden and two Councillors from the County of Elgin, receive agendas and minutes from all amalgamated services and meet on a monthly basis to review and comment or request clarification from committees on their actions, in order to provide for a dispute resolution process to be built into the Consolidation Plan; and further THAT both Councils have their respective Administrators, or designates, in attendance as support staff. - Carried. OTHER BUSINESS Statements/InQuiries By Members Councillor Walters requested that the Manager, Engineering Services, look into the night setback of the air conditioning units in the Council Chambers. Councillor Walters advised Council that Bruce Smith, M.P.P., recently announced that Chatham-Kent had received $10 M from the Province towards their restructuring process and feels the County of Elgin should get more than what was granted towards our restructuring efforts. Several Councillors will be meeting with Mr. Smith in the near future on other issues, and will ask him why the County of Elgin did not get a larger grant and if the citizens of Elgin have been treated fairly, considering the Chatham-Kent funding.
