COUNTY COUNCIL
Tuesday, July 27, 1999
The Elgin County Council met this day at the Administration Building, at 9:00 AM., in
accordance with adjournment, with all members present except Councillor Walters.

THAT the minutes of the meeting held on June 22, 1999 be adopted.

DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF -
None.
PRESENTATIONS
Councillor McPhail and Warden VanBrenk presented certificates and pins to Homes'
personnel that successfully completed the Certified Food Care Worker program through
the Health Unit and asked the representatives in attendance to convey congratulations on
behalf of the County to all the recipients. Warden VanBrenk and the Director of Homes
and Seniors Services presented a small token of proper food handling to Councillor
McPhail, in the form of a hairnet.
The Director of Financial Services introduced J.D. Huether, who was hired as the
County's Acting Deputy Treasurer on July 5, 1999.

COUNCIL APPOINTEE REPORT
Mr. Ron Bradfield and Mr. Ross Greer were in attendance to present the annual
Tillsonburg District Memorial Hospital Progress Report. Mr. Bradfield noted that the
Hospital had received the highest award possible on their Facilities Accreditation.
Councillor Wilson commended the Hospital on their efforts for maintaining an outstanding
Accreditation record. Warden VanBrenk thanked the delegation for attending and they
left at 9:26 AM.

STAFF REPORTS
Financial Report on Maintenance by Lower Tiers - ManaQer of EnQineerinQ Services
Councillor Habkirk noted that reports are still not being received on a timely basis and he
will find out why his municipality has not submitted theirs. Council previously agreed that

municipalities would send in their maintenance reports monthly to the Manager of
Engineering Services who would summarize and report quarterly. Councillors questioned
if the Manager has taken steps to remind the municipalities to send them in. The
Manager indicated he has phoned, faxed and written letters to the lower-tier to remind
them. Councillor McPhail questioned the value of the report and if the work justifies the
result? The consensus of Council was that this reporting method is necessary and is a
valuable tool that helps the municipality track expenditures and establish patterns for
budget purposes.

Written Report on Maintenance by Lower Tiers - ManaQer of EnQineerinQ Services
Councillors questioned why items, such as hours and number of employees utilized, are
reported differently and emphasized the need for a standardized method of reporting.
The Manager indicated municipalities use a standard form for reporting, but enter the
numbers differently. The Manager was directed to investigate the variations in numbers of
hours worked for winter control. The Chief Administrative Officer reviewed the process
Council decided last year for allocation of funding for County Road maintenance and that
most municipalities will maximize their allocation. Councillors noted that their individual
municipalities are submitting correct figures and if others are not, the process is flawed.
Councillors will discuss County Road maintenance with their local Road Superintendents
and ensure that all expenditure data is reported on a monthly basis.

THAT the County of Elgin has no objection to the Township of Malahide closing the road
allowance between Gore Concession and Concession 5 in Lot 11, more specifically, Part
#2, Registered Plan #11 R-7074; and,
THAT the County of Elgin has no objection to the Municipality of Dutton/Dunwich closing
the road allowance known as Alan Street, situated between Lots 41, 48 and 49 and Lots
42, 47 and 50, on Plan 171, in the former Municipality of Dutton.

AM., Saturday August 28,1999, for the purposes of a 2nd Annual Watermelon Fest; and
further,
THAT safety requirements are to be met to the satisfaction of the Manager of Engineering
Services.

Contracts for Government Drain #1 and Planesview Culvert - ManaQer of

The Manager noted the Planesview Culvert would be dealt with later in the meeting.

THAT the Warden and Chief Administrative Officer, under the recommendation of the
Manager of Engineering Services, be authorized and directed to sign the contract for the
replacement of Government Drain #1 Bridge with the company whose price is the lowest
tendered and report to County Council at the September 14th meeting.

Development on the "Lands of Dalewood" (Ron McNeil Line and HiQhbury Avenue) -
ManaQer of EnQineerinQ Services
Councillor Habkirk questioned why it should be the County's responsibility and not the
City's to pay ongoing maintenance and hydro on the lights, when this project does not
benefit County residents. The Chief Administrative Officer indicated that although we
cannot charge for maintenance through development charges, staff will pursue and
negotiate, by way of a letter of understanding, with the City to pay such costs.

THAT the County of Elgin approve the proposed development on the Lands of Dalewood
according to the following terms and conditions:
1) That intersection improvements be made at Burwell Road and Ron McNeil Line on the
approval of the Manager of Engineering Services; and completed by January 1, 2000.
2) That traffic signals be installed at Burwell Road on the approval of the Manager of
Engineer Services; and be completed by January 1, 2002.
3) That the developer "up front" the costs of the Impact Study.
4) That the County be reimbursed for all necessary expenses associated with these
improvements.
5) That the Warden and C.AO. be authorized to sign the necessary agreement with the
City of St. Thomas to recover approved costs.

Recycle Asphalt Product (RAP) from HiQhway #401 between Union Road and
HiQhway #4 - ManaQer of EnQineerinQ Services
The Manager noted this is a good price at about 25% of gravel cost. He further noted that
a thin layer of gravel is put on top of the recycled product to ease grading efforts.

THAT the Manager of Engineering Services be authorized to sign an agreement with
Dufferin Construction Limited at the price of $3.00 per tonne (estimated quantity of 6,000
tonnes) for the supply of recycled asphalt products from Highway #401 between Union
Road and Highway #4; and,
THAT the County will rent the Township of Southwold grader(s) for spreading of the RAP
product; and,
THAT the Manager of Engineering Services be authorized to use Walmsley Bros. Ltd. to
supply (estimated quantity of 5,000 tonnes), haul, spread, compact and use of dust
suppressant for an additional 100 millimeters of Granular 'A', Contract No. 1999-01; and
further,
THAT all monies shall come from the Highway Transfer Reserve.

1998 LonQ Term Care Facility Annual Reports - Director of Homes and Senior

THAT the Warden and the Chief Administrative Officer be authorized to sign the 1998
Long Term Care Facility Annual Reports for submission to the Ministry of Health.

EIQin County EmerQency Operation Centre - EmerQency Measures Co-Ordinator
The Co-Ordinator highlighted advantages in acquiring a back up generator to operate the
entire County Administration Building in the event of an emergency, such as elimination of
$4,000 battery packs that are replaced every 4 years, continuous operation of lighting,
heating, water flow, computers, etc. Councillor Habkirk questioned the cost when only
$45,000 was budgetted for. Councillor Clutterbuck explained that the pricing received for
budget purposes was for a smaller generator that would cover only a few rooms of the
building, and this is a higher output generator that would operate the entire building.
Councillor Habkirk requested the Committee to investigate environmental aspects of a
generator, such as storage of diesel fuel on site. Councillor Wilson requested that staff
get additional information to ensure the tender includes a completely weatherproof and
secure site to house the generator. The Co-Ordinator will consult with Councillor Wilson
for input on the weatherproof issue and also names of firms to send the tender to.
Councillor Rock suggested the tender include a natural gas type generator, however, staff
pointed out that this type would not be as reliable as diesel.

THAT staff proceed with the tendering process for a generator to be used in the event of
an emergency which will operate the entire County Administration Building.

ChanQes to Fire Protection and Prevention Act. 1997 - EmerQency Services Co-
Ordinator
The Co-Ordinator had surveyed lower-tier volunteer fire departments for their input on the
added facility investigation responsibilities handed down by the Province, and indicated
the various departments had differing views. It was noted that not all volunteer fire
departments had responded, either verbally or in writing, and Councillor Wilson requested
to have the responses received related to each municipality. The Co-Ordinator was
directed to supply the information requested.

Frozen Assessment Roll - Cut-Off Date - Director of Financial Services
The Director noted the Lower-Tier Treasurers are very concerned with getting their tax
billings out. A meeting had been held and a July 31, 1999 cut-off date for the frozen
assessment roll was recommended.

WHEREAS the Province of Ontario, through Bill 79, imposed 10-5-5 Capping Legislation
on the Municipalities of Ontario; and,
WHEREAS Municipalities are required to compare 1998 assessments to adjusted 1997
assessments, referred to as the Frozen Assessment Roll, in order to determine capping
percentages and to finalize the 1998 property tax billings; and,
WHEREAS the Ontario Property Assessment Corporation has not yet updated the
majority of changes to its assessment rolls; and,
WHEREAS Municipal staff will not request the final Frozen Assessment Roll listing until
the majority of changes are recorded in order to minimize the chance of error; and,
WHEREAS Municipalities require the final figures to calculate and issue local tax notices;
and,
WHEREAS the inability of Municipalities to issue final tax notices has already resulted in
a significant revenue shortfall; and,
WHEREAS Municipalities have not collected the school portion of 1999 property taxes on
the capped classes; and,
WHEREAS Municipalities have been legislated to repay the two school tax remittances
made on their behalf by the Province;
NOW THEREFORE BE IT RESOLVED THAT the Minister of Finance be petitioned to
allow Municipalities to defer the commercial and industrial portion from the July 31 S\ 1999
School Board remittances being paid to the Minister of Finance to help defray the revenue
deficit to Municipalities; and,
THAT copies of the resolution be forwarded to the Western Warden's Association, all
local M.P.P.s, the Premier of Ontario, the Minister of Municipal Affairs and Housing, AMO,
and all lower-tier municipalities in Elgin County for endorsement.

hold until such time as there is a resolution to the financial cost of its new growth to its

Concerning Correspondence Item #5, Councillors noted that harbour usage extends far
beyond Central Elgin and Elgin County in regard to shipping etc. Council consensus was
that the consultants be invited to a meeting to update Council on the harbour issues.
Councillor Habkirk pointed out that Federal Government still owns the harbour and should
be invited also.

THAT the Corporation of the County of Elgin request the Municipality of Central Elgin to
invite Messrs. Knights and Conway from Dillon Consulting to a meeting on September 14,
1999 at 9:00 AM., to present a report to County Council on the findings of the Port
Stanley Harbour Divestiture; and,
THAT a Federal representative also be invited to attend said meeting.

Concerning Correspondence Item #6, the St. Thomas-Elgin Tourist Association has
approached Central Elgin to discuss their concerns and will work in conjunction with the
County's Manager of Engineering Services before signage is installed. Councillors noted
that the signage is not worded well, is difficult to see, and the proliferation of signs on the
highways is becoming a concern. Councillor Habkirk enquired if private businesses being
displayed on the signs are paying for their portion. Councillor Clutterbuck will discuss
these items at the next St. Thomas-Elgin Tourist Association meeting.

Concerning Correspondence Item #9, the Manager of Engineering Services noted that he
could study Central Elgin's request and report back in September. He further indicated
that a comprehensive report on all County intersections is being worked on. Councillors
indicated that each intersection should be looked at on its own merit and the report should
come back as soon as possible. Council consensus was to proceed with Central Elgin's
request on a 50% cost share basis between the County and the municipality.
