COUNTY COUNCIL
Tuesday, September 28, 1999
The Elgin County Council met this day at the Administration Building, at 9:05 AM., in
accordance with adjournment, with all members present except Councillors Habkirk and
Rock, who sent their regrets.
Warden VanBrenk in the Chair.
Warden VanBrenk welcomed Councillor van Kasteren back to Council after his recent
illness.

NOTICE OF MOTION

That the following motion be presented for discussion:
THAT the Council of the Corporation of the County of Elgin expedite the review of the
speed limit and rumble strip policy specifically as it applies to the intersection of Fairview
Avenue and Sparta Line.
- Carried.
Councillor Walters requested that Council reconsider its decision regarding the rumble
strips due to the fact that the report on speed zones will not be presented for about a
year. He further requested that the speed limit be reduced to 50 km at the intersection of
Fairview Avenue and Sparta Line. The Manager of Engineering Services indicated that it
would not be in the best interests of safety to change the speed zone for this intersection,
as speed limits are not adhered to and increased enforcement by the police will work only
temporarily until their presence is discontinued. Councillors noted the rumble strip noise
is annoying and suggested that the depth of the strips could be reduced, and perhaps the
decibel level at the site could be investigated. The Manager of Engineering Services
reported that staff are investigating a type of audible warning signal for urban areas that
will be less disruptive and are experimenting to determine how to reduce noise levels.

dampening material to mitigate the effects of sound amplification on rumble strips at the

PETITIONS AND DELEGATIONS
Mr. Ross Whalls attended from the Port Stanley Community Policing Committee at 9:20
AM., to request an all way stop be erected at the intersection of Warren Street and
Carlow Road. Speeders are a great concern, due to the location of the school and arena,
and farm vehicles and trucks entering and exiting the grain elevators in the area. Mr.
Whalls noted that the Committee's request had been turned down in the past, but felt that
the heavy usage and poor visibility caused by trucks parked in ends of driveways
warrants four way stops at this intersection. Council consensus was that four way stops
could be tried at this intersection as a pilot project.

THAT given the specific traffic patterns and geometric design of the intersection of Carlow
Road and Warren Street, an exception to the policy be made and a four way stop be
erected at the intersection, and that it be reviewed in six months' time.

Warden VanBrenk thanked the delegation for their presentation and Mr. Whalls left at
9:42 AM.
Mr. Peter North attended at 9:43 AM. to update Council on the activities of the Office of
Community Sports and Recreation Development. Mr. North noted that if the County
considered bidding on winter or summer games, to contact his office for details. One of
the issues municipalities face with recreational programs, is that there is no Provincial
capital assistance available, which makes it very difficult to provide good opportunities for
citizens. He requested that Councillors talk with their recreation personnel and advise
him of the challenges their municipalities face in regard to recreation programs. Warden
VanBrenk noted that the County is not involved with recreation activities and indicated
that Councillors would consider his comments. Warden VanBrenk thanked the delegation
for attending and Mr. North left at 10:03 AM.
Council took a short break and reconvened at 10: 18 AM.
DRAINAGE CLASSIFICATION UPDATE
The following were in attendance:
Department of Fisheries and Oceans - Pierre Pacquette, Communications; Christine

Ontario.
Ontario Ministry of Agriculture, Food and Rural Affairs - Syd Vanderveen, Drainage Co-
Ordinator.
Conservation Authorities - Kim Smale, Catfish Creek; Christine Depuydt, Catfish Creek;
Jeff Brick, Upper Thames River, Co-Chair Drain Classification Committee; Val Welsh,
Lower Thames Valley; Bill Baskerville, Long Point Region; Jim McCoomb, Kettle Creek;
Crystal Ethier, Kettle Creek; Bryan Hall, Kettle Creek.
Warden VanBrenk welcomed the delegation and Mr. Bryan Hall introduced those in
attendance. Mr. Hall reviewed the recommendation in the report from the Chief
Administrative Officer, and said the group was in agreement with parts of it. Mr. Hall

handed out a letter from the Township of North Dorchester agreeing with the
classifications assigned to their affected municipal drains, as well as an outline of
Conservation Authorities' involvement with the drain classification project.
Representatives from each of the agencies spoke regarding the issues. The group
emphasized that their role is to facilitate and streamline the process and are concerned
only with drains affected by the draft guidelines, and that there is flexibility in the
document according to the circumstance. The Chief Administrative Officer noted that this
flexibility is not written into the guidelines and once a draft document has been adopted, it
usually becomes law. Councillors were very concerned that although consultation
meetings had been held, they had not been forwarded the document and could not,
therefore, comment on it. Representatives of the Department of Fisheries and Oceans
indicated that since all parties had not been circulated, the deadline for comments of
October 31 would be extended, and a letter forwarded to each municipality advising of the
extension.

GIVEN the assurances from representatives of the Department of Fisheries and Oceans,
that the consultation process will be extended until all classifications have been
completed;
THAT Mr. Paul Courey be instructed to prepare a response to the Draft Agricultural Drainage
Maintenance Guidelines on behalf of the County of Elgin which would include but not be
limited to the following amendments:
THAT artificially constructed drains not be subject to regulation/guidelines;
THAT municipal drainage superintendents be empowered in the guidelines to decide
application of the guidelines according to local circumstances; and,
THAT the guidelines be amended to state that least-cost or no cost mitigation measures
be applied wherever possible.

STAFF REPORTS
County Woodlot Harvest StrateQY - EIQin County Tree Commissioner
The Tree Commissioner indicated that plantation harvest experts are well respected
throughout the logging community. Their presence on site to keep an eye on the logging
of the woodlot would be beneficial to ensure the County derives all revenue from the
operation and to act as arbitrators for disputes.

$770.40 for the retention of plantation harvest experts for the proposed winter thinning of
the County Woodlot; and,

Ontario Bethel Park Bible Camp Society - EIQin County Tree Commissioner
This request for a Minor Exception to the Tree By-Law was originally heard on October
27, 1998 and Council had placed conditions on the potential clearing. These conditions
have now all been met and the clearing can proceed.

submitted September 14, 1999, from Ontario Bethel Park Bible Camp Society, Lot 4,

Sf. Thomas-EIQin General Hospital - Warden Van Brenk
Warden VanBrenk advised that a four-member committee has been struck to bring
recommendations forward to help alleviate the long waits for emergency treatment and
the extreme shortage of doctors. Councillor McPhail noted that Mr. Nicks, Administrator
for the Elgin-St. Thomas Health Unit, has some expertise in that process and the
committee may want to ask for his assistance.

THAT staff be directed to investigate the possibility of temporary storage of the Archives
of Alma College until a permanent site is selected according to the following conditions:
Temporary maximum storage shall be for a 1 year term from date of storage;
All materials must be removed from the building on or before the 1 year term expires;
The Alumnae shall be solely responsible for transporting all materials to and from the
building;
The County shall not be liable for any damages to the collection;
The County will supply the Alumnae with 1 key to the storage area.

Community Millennium Events - Director of Homes and Senior Services

THAT in observance of the Year 2000 Millennium, the Elgin Manor House of Industry
stone dated 1875, along with commemorative plaques currently housed at Elgin Manor,
be incorporated into a heritage wall in the new Elgin Manor facility to celebrate and
preserve the heritage of Elgin Manor.

Councillor McPhail asked the Director of Homes and Seniors Services if there was
unused funding available from the Millennium Events that could be channelled to the
Archives project. The Director will investigate funding sources and report to Council.
CaterinQ Service Provided by Homes' Staff - Director of Homes and Senior Services
Restructuring within the Homes has decreased staff and time commitments are such that
staff are not available to provide catering for Council meals.

THAT the two retiring Food Service Supervisors from the Homes receive remuneration in
the amount of $40.00 each from the County for providing luncheons to Council; and,

preparationlstaff costs for other groups accessing the services.

PolicinQ Costs - Chief Administrative Officer
The O.P.P. requires that Elgin's lower-tier municipalities pass, by resolution, their
authorization for the County to request costing for police services. Councillors were
concerned that if we leave the exclusion of the Town of Aylmer in the resolution, would
this be construed that Aylmer did not have a chance to receive costing. The Chief
Administrative Officer noted that the resolution would be circulated to all municipalities
and the Town of Aylmer can opt to be included if they wish.

constituent municipalities to pass a resolution accepting in principle a costing proposal for

Councillor Wilson noted that Correspondence #21 indicates that Provincial funding for
Health Units is 50% and emphasized that it is 50% of 1997 funding. Council consensus
was to refer this letter to the Health Unit for advice on how best to proceed.

Warden VanBrenk attended a Cabinet in Session Reception and spoke with the Ministers
in attendance about issues of County concern. He also had attended the recent Plowing
Match and had participated in the Warden's plowing contest.
The Deputy Clerk advised Councillors that if they wished to invite guests to the Warden's
Banquet, tickets are available for $15.00 each. The response date is October 29, 1999.
Councillor van Kasteren thanked Council and staff for flowers sent to him during his
recent illness.

Council took a short break at 2:34 P.M. and reconvened at 2:49 P.M.
Councillor McPhail noted that the Trillium Fund, which provides funding towards municipal
recreational projects, sets standards so high it cannot be reached and service clubs are
becoming apprehensive about getting involved in fundraising for a project and being
turned down.
Recreational Facilities - deferred from the morning discussion with Mr. Peter North.

THAT given the tremendous need and interest in pursuing new and upgraded recreational
facilities thought the Province and the limited municipal funding available, the Minister of

County of Elgin Administration Building, and after comparing these proposals to current
cleaning costs using County forces, the County of Elgin contract the custodiallcleaning
requirements to Double M&M (1995) Incorporated for the annual sum of $49,088.93; and,
THAT this proposal be for a period of three years.

THAT the Corporation of the County of Elgin inform Transport Canada of its interest in
and willingness to explore the future of the Port Stanley Harbour with all affected parties;
and,
THAT, since the economic impact of the harbour affects industry and business on a
regional or county-wide basis, the County of Elgin agrees to retain Dillon Consulting
Limited to develop a Municipal Action Plan and Strategy for the Port Stanley Harbour to
be funded by the County within prescribed limits; and,
THAT the Port Stanley Harbour Divestiture Committee be invited to advise County
Council on matters affecting these discussions at appropriate junctures.
