April 25, 2000 Minutes COUNTY COUNCIL Tuesday, April 25,2000 The Elgin County Council met this day at the Administration Building, 450 Sunset Drive, St. Thomas, at 9:04 AM., in accordance with adjournment, with all members in attendance. Warden McPhail in the Chair. Moved by Councillor Walters Seconded by Councillor Habkirk THAT the minutes of the meeting held on April 11 ,2000 be adopted. - Carried. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF - None. Moved by Councillor Rock Seconded by Councillor Wilson THAT we do now move into Committee of the Whole Council. - Carried. REPORTS OF STAFF Councillor Habkirk requested that the Manager of Engineering Services Reports #2, 6, 7 and 10 be deferred to a Special Council meeting for consideration. Moved by Councillor Habkirk Seconded by Councillor Clutterbuck THAT the Manager of Engineering Services Reports #2, 6, 7 and 10 be deferred for consideration at a Special Council meeting. - Carried. Council consensus was to hold the Special Council meeting on May 16, 2000 in the afternoon, to consider these reports. Contract Employees' Continuous Service - Director of Human Resources Moved by Councillor Clutterbuck Seconded Councillor van Kasteren THAT the hire date of a contract position shall be used to determine the length of service, for all policies relating to continuity of service, for all contract employees offered regular employment, and the report dated February 14, 2000 from the Human Resources Officer be approved. - Carried. EIQin County 4-H Association - ManaQer of EnQineerinQ Services The Elgin County 4-H Association is requesting office space in the Administration Building due to the closure of the OMAFRA office where they were previously situated. The Association has indicated they would be happy to work with the Elgin Agriculture Centre and share office space currently being used by the Centre. Council consensus was that the Manager of Engineering Services report to Council if any other groups affiliated with the Elgin Federation of Agriculture contact him requesting space in the Building. County Council 2 April 25,2000 Moved by Councillor VanBrenk Seconded by Councillor Rock THAT the Elgin County 4-H Association work with the Elgin Agricultural Centre to accommodate their office needs. - Carried. County of EIQin SiQns - ManaQer of EnQineerinQ Services Council discussed manufacturing the signage, outlined in the report, in a different colour, such as implemented for the school zone signs, and consensus was to leave it a blue colour. Councillor Habkirk noted that not all signs need replacing and tabs could be placed on the bottom of current signage. The Manager of Engineering Services will take this into consideration when ordering the signs. County Road 54 Extension (Brownsville Road to Ron McNeil Line) - ManaQer of EnQineerinQ Services Moved by Councillor Wilson Seconded by Councillor Walters THAT the County of Elgin and the County of Oxford assume Pigram Road/Line from the south property line of Ron McNeil to the south property line of Brownsville Road; and further, THAT Schedule 'A' to By-Law 99-17 be amended. - Carried Unanimously. County Council 3 April 25,2000 Road Closure - Municipality of Central EIQin - ManaQer of EnQineerinQ Services Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT the County of Elgin has no objection to the Municipality of Central Elgin closing and stopping up a portion of the Townline Road Allowance between Lot 19, Concession 11, Municipality of Central Elgin, and Lot 24, Concession 11, Township of Malahide, designated as Part #2 on Reference Plan #11 R-2026. - Carried. 2000 Proposed BudQet - Director of Financial Services Council reviewed the changes made at the previous County Council meeting. The Chief Administrative Officer indicated that escalation of the Health Unit lease payments has not been included in the Budget and that the clause is effective May 1, 2000. Since the County has not received a signed lease to date, Council consensus was to implement the escalation clause. Moved by Councillor Habkirk Seconded by Councillor Rock THAT, due to the absence of a signed lease agreement between the County of Elgin and the Elgin-St. Thomas Health Unit, the County implement the Escalation Clause effective May 1,2000. - Carried. Moved by Councillor van Kasteren Seconded by Councillor Habkirk THAT the year 2000 budget estimates for the Health Unit be adjusted to account for the escalation in lease payments and the Board of Health be advised that the County does not approve the Board's estimates without this adjustment. - Carried. The Director of Financial Services noted the 2000 budget increase would be 2.4% with these changes. Councillor Clutterbuck spoke to the correspondence from the St. Thomas-Elgin Tourist Association Signage Committee, requesting $8,000.00 for tourism signage for 2000. Councillor Habkirk again noted that the signage at the entrance to communities should include the local areas on the signs. Councillor Clutterbuck will take this recommendation to the Association for consideration. Council consensus was that the St. Thomas-Elgin Tourist Association address Council to detail the type, location and method of installation of this signage, and the Association consult with the Manager of Engineering Services and lower-tier municipalities for input prior to appearing before Council. Moved by Councillor VanBrenk Seconded by Councillor Wilson THAT the St. Thomas-Elgin Tourist Association appear as a delegation at the May 16, 2000 Council meeting to detail a comprehensive plan on the type, cost, erection site, method of installation, and location municipality by municipality, of the tourism signage proposed for 2000 and beyond. - Carried. County Council 4 April 25,2000 Moved by Councillor Rock Seconded by Councillor Clutterbuck THAT the 2000 County Composite Budget in the amount of $13,333,844.00 resulting in an increase of 2.4% be approved and the report from the Director of Financial Services be amended accordingly. - Carried. Council took a break at 10:00 AM. and reconvened at 10: 12 AM. 1999 Year End CRF Surplus - Director of Financial Services Moved by Councillor VanBrenk Seconded by Councillor Stewart THAT the 1999 year end CRF surplus, $241,000.00, as calculated by the Province of Ontario be utilized as follows: . an allowance of $140,000.00 surplus be made available to reduce the 2000 budget; and, . a reserve for archives in the amount of $107,045.00 be set aside to be expended in 2000/2001 to organize and set-up a County Archives; and, THAT the Minister of Finance and the Minister of Municipal Affairs and Housing receive a copy of this report and recommendation. - Carried. Delivery of Government Information Project - ManaQer of Library Services Moved by Councillor Habkirk Seconded by Councillor Wilson THAT the Manager of Library Services be authorized to submit a proposal to Human Resources Development Canada for funding in the amount of approximately $95,000.00 for the continuance of the Government Information Network, Phase II of the project; and, THAT there be no financial cost to the County; and, THAT if the application is approved, a detailed implementation plan be presented to Council. - Carried. Community Access Grant Application - ManaQer of Library Services Moved by Councillor Clutterbuck Seconded by Councillor Rock THAT the report from the Manager of Library Services entitled "Community Access Grant Application" be received and filed. - Carried. Community Reinvestment Funds - Lower Tier Municipalities - Director of Financial Services The Director of Financial Services noted that Provincial calculations of CRF are done in an unfair manner when based on the previous year's actuals, instead of current year actuals. Council directed a letter be forwarded to the Province advising that the County is unhappy with the method of calculation used for the Community Reinvestment Funds, and copied to AMO, local M.P.P., O.S.U.M., and all lower-tier municipalities. County Council 5 April 25,2000 Moved by Councillor Walters Seconded by Councillor van Kasteren THAT the County of Elgin urge the Province to revisit the Community Reinvestment Fund (CRF) calculation as it relates to policing; and, THAT the Province provide a CRF based on current year estimates, not on previous year's actuals and that the program be reconciled at year end; and, THAT the Warden present our concerns to the Western Wardens Association; and, THAT a copy be forwarded AM.O., local M.P.P., O.S.U.M., and Lower-Tier municipalities requesting their support. - Carried Unanimously. Provincial Offences Act (POA) - Chief Administrative Officer The Chief Administrative Officer noted that a resolution from supporting municipalities, as well as the City of St. Thomas, is required before June 17, 2000, to request responsibility for POA Moved by Councillor VanBrenk Seconded by Councillor Wilson THAT the County of Elgin, all lower-tier municipalities and the separated City of St. Thomas be requested to pass resolutions according to the Ministry of the Attorney General's sample format and in keeping with the following principles: 1) The County of Elgin will assume responsibility from the Ministry of the Attorney General for court administration and Provincial Offences Act enforcement functions presently carried out by the Attorney General. 2) The County of Elgin will retain POA revenues to cover operating expenses and a 10% administration fee calculated on the net revenue owed to municipalities, and allocate the remaining revenues to the municipalities based on the net revenue per incident in each municipality. 3) The County of Elgin will submit a single submission to the Ministry of the Attorney General for the court service area of Elgin and St. Thomas. 4) The lower-tier municipalities and the City of St. Thomas will support the objectives of the Memorandum of Understanding and the Local Side Agreement to be entered into between the County of Elgin and the Attorney General of Ontario to transfer responsibility under Bill 1 08, the Streamlining of Administration of Provincial Offences Act, 1997. WHEREAS, the County of Elgin (the proposed Municipal Partner) has made a proposal and demonstrated its commitment to enter into a Memorandum of Understanding (MOU) with the Attorney General of Ontario (the Attorney General) to assume justice responsibilities under the Provincial Offences Act (POA); and, WHEREAS, the Serviced Municipalities within the Elgin-St. Thomas court service area approve the selection of the County of Elgin (proposed Municipal Partner) to participate in the transfer of court administration and prosecution responsibilities in respect of the Provincial Offences as set out in the Streamlining of Administration of Provincial Offences Act, 1998 (Bill 1 08) for the court service area; and, WHEREAS, the Serviced Municipality acknowledges and agrees that the proposed Municipal Partner will be responsible for the obligations set out in the MOU, the schedules to the MOU and the Local Side Agreement (LSA) and will be the agent for the Serviced Municipality for purposes of providing POA functions to municipalities within the court County Council 6 April 25,2000 service area as set out in the agreement between the proposed Municipal Partner and the Attorney General; and, WHEREAS, the Serviced Municipality agrees that the proposed Municipal Partner, as its agent in respect of the Elgin-St. Thomas court service area will be entitled to recover its costs, as set out in Schedule A attached; and, WHEREAS, the Serviced Municipality and the proposed Municipal Partner agree that net revenues collected by the proposed Municipal Partner will be shared on a basis as set out in Schedule B attached; and, WHEREAS, the Serviced Municipality and the proposed Municipal Partner agree that in the event of a dispute arising between them, the dispute resolution process as set out in Schedule C attached, shall be followed; NOW THEREFORE BE IT RESOLVED THAT: 1. The proposed Municipal Partner and the Attorney General be advised that the Serviced Municipalities approve of the responsibility, cost and revenue sharing arrangements and the local dispute resolution process for the POA transfer in accordance with the information provided by the proposed Municipal Partner dated April 25th, 2000. 2. The County of Elgin (proposed Municipal Partner) be authorized to continue negotiations with the Attorney General to become the Municipal Partner for the transfer of responsibilities under the POA. Schedules Schedule A: The costs that the proposed Municipal Partner is entitled to recover Schedule B: The basis on which the net revenue will be shared with the Serviced Municipality(ies) Schedule C: The dispute resolution process to be followed - Carried. OPP Contract and By-Law Enforcement - Chief Administrative Officer The Chief Administrative Officer indicated that at a recent Administrators' meeting, the local Treasurers felt it would be more practical for the County to invoice municipalities for policing rather than issuing a Special Upper-Tier Levy. This would require each municipality re-considering its original motion, which stated that a Special Upper-Tier Levy would be used to finance the activity. Moved by Councillor VanBrenk Seconded by Councillor van Kasteren THAT the Chief Administrative Officer be instructed to forward the resolutions passed by the six participating municipalities to the Attorney General, as they were endorsed. - Carried. County Council 7 April 25,2000 By-Law Enforcement Moved by Councillor Wilson Seconded by Councillor Rock THAT a By-law Enforcement Task Force be established consisting of representatives from the six participating municipalities, the County and the OPP; and, THAT the County's Emergency Measures Co-ordinator organize the activities of the Task Force. - Carried. Warden McPhail reported to Council that a meeting had been held with the Minister of Health regarding governance of the Elgin-St. Thomas Health Board of Health. He indicated that the Minister was looking favourably on the County's application. Although reports through the press indicate that the City of St. Thomas is reconsidering their position, we have received no correspondence from the City. A signed agreement, reaffirmed by both parties, still stands. The Minister indicated it would be helpful if the County and the City again reaffirm their position, due to some public opposition. Council consensus was to forward a letter to the City outlining the items contained in the application. Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT an open letter be forwarded to the City of St. Thomas stating the County's position in regard to the application for governance of the Elgin-St. Thomas Board of Health and explaining the rationale behind the agreement to consolidate services. - Carried. CORRESPONDENCE Items for Consideration 1. The Honourable Helen Johns, Ministry of Citizenship, Culture and Recreation, with nomination forms and information for the Community Action Award, which recognizes individuals that endeavour to improve the lives of persons with disabilities. 2. Doug Parks, Clerk, Municipality of Centre Hastings, with a resolution regarding the wording in the Ontario Water Resources Act, Ontario Regulation 285/99, regarding permits issued for the taking of large quantities of water from a municipality without advising the municipality or relevant conservation authorities of the issue of such a permit. 3. Lynn Davis, Development Co-Ordinator, The Lung Association, with a request for sponsorship or the donation of a prize for their 1 st Annual Golf Tournament on May 4, 2000 and an invitation to participate in the Tournament. 4. Town of Aylmer, with 1) a resolution requesting John Street be excluded from the County's Connecting Link program and be exempt from the financing of the proposed Connecting Link Program 2) that the County Engineer report to the lower-tier municipalities prior to assuming bridge structures greater than 3.0 meters. 5.
