September 12, 2000 Minutes COUNTY COUNCIL Tuesday, September 12, 2000 The Elgin County Council met this day at the Administration Building, at 9:06 AM., in accordance with adjournment, with all members in attendance. Warden McPhail in the Chair. Moved by Councillor VanBrenk Seconded by Councillor Walters THAT the minutes of the meeting held on July 25,2000 be adopted. - Carried. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF - None. DELEGATIONS Mr. Chester Hinatsu, Director of Ontario Works, and Mr. Bob McNorgan, Local Implementation Manager, were present at 9:00 AM. and presented, by Power Point, "A Service Delivery Model for Ontario Works". Mr. McNorgan outlined the changes being implemented by the Provincial Government in Social Assistance Reform. The new "Service Delivery Model" began in January 1998 with an implementation date of December 2001. The technology and program are designed for standardized use by all Ontario Works personnel with the overall goal of reducing duplicate payments and getting people off welfare as soon as possible. Council confirmed that "Elgin" will appear in the Ontario Works name and Mr. Hinatsu will inform the Province to ensure this information is included in the Provincial Database. Mr. McNorgan asked Councillors to contact him directly with any problems or concern with the changes. Mr. Hinatsu informed Council that the new location for Ontario Works is 423 Talbot Street and the building should be ready for occupancy in March. Councillor VanBrenk discussed the concerns of the child care providers in Port Burwell and Dutton, in regard to the continued operation of the facility because of low numbers attending. Mr. Hinatsu said that his department is offering as much support as possible and continues to hope that the centres can remain open, however, numbers are low and a concern. Councillor VanBrenk and Mr. Hinatsu will meet at a later date to discuss the situation. County Council - 2 - September 12, 2000 COUNCIL AND STAFF REPORTS Thames Valley District Health Council - Councillor Habkirk Councillor Habkirk highlighted the report, commenting on various aspects that the Health Council dealt with over the past year. He advised that a meeting was scheduled today to discuss local planning. Moved by Councillor Rock Seconded by Councillor Walters THAT the annual report of the Thames Valley District Health Council be received and filed. - Carried. Application for Minor Exception Lot 23. Conc. 3. Malahide - Weed InspectorlTree Commissioner The Weed InspectorlTree Commissioner attended at 10:28 AM. and reported there were no objections to the clearing from neighbours and the applicant has agreed to make a contribution to the CCCA for the planting of acreage as per the County's No Net Loss Policy. Moved by Councillor Habkirk Seconded by Councillor Wilson THAT the Application for Minor Exception to the Trees Act from Mr. Lankhuijzen, Lot 23, Conc. 3, Township of Malahide, to clear approximately 2 acres of the remaining isolated bush, be approved. - Carried. Application for Minor Exception Lot 4. Con. 5. South of A. DuttonlDunwich - Weed InspectorlTree Commissioner Mr. Geurts reported that he has not received a response from one neighbouring landowner. The applicant will comply with the County's "No Net Loss Policy", and Mr. Geurts requested approval of the application upon receipt of an affirmative response from the landowner. Moved by Councillor Habkirk Seconded by Councillor VanBrenk THAT the report from the Tree Commissioner "Application for Minor Exception Lot 4, Con. 5, South of A, Duttonl Dunwich" be deferred to the next Council meeting, pending response from a neighbouring property owner. - Carried. The Weed InspectorlTree Commissioner reported that a logger is working in the County that is less than reputable and is in the north Dutton area. If Councillors are aware of loggers in the area, they should remind constituents to get three quotes, to obtain money up front, and to make sure applications are made. They can also contact the Tree Commissioner if desired. Mr. Geurts has issued a press release regarding what to do if a landowner wants bush cleared. Mr. Geurts left at 10:36 AM. AQriculture Display Room - Director of Financial Services Mrs. Veger asked Mrs. Linda Louwagie-Neyens, Manager, Elgin County Pioneer Museum, to address Council. Mrs. Louwagie-Neyens indicated that the Elgin Federation of Agriculture and Elgin County Pioneer Museum have met on several occasions and presented the proposed option to change the "cloak room" into an agricultural display room, at a cost of approximately $4,500.00. Mr. Paul Mistele was also in attendance and outlined the process that precipitated the request. County Council - 3 - September 12, 2000 Councillor Wilson suggested the amount requested be changed to $5,000.00 to cover any unforeseen circumstances, and the Director of Financial Services indicated the funding could be found in the Mill Rate Stabilization Reserve. Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT the request by the Elgin Federation of Agriculture and the Elgin County Pioneer Museum to convert the cloak room at the County Administration Building into an agricultural display room be approved; and, THAT the County agree to fund the cost of construction up to a total of $5,000.00 to be allocated from the Mill Rate Stabilization Reserve. - Carried. DELEGATION Mr. Paul Mistele, Mr. John Lyle, Ms. Donna Lunn and Mr. Ken McCallum attended at 10:40 AM. to present a response to the proposed legislation on Nutrient Management. Mr. Mistele outlined the process the Farm Animal Coalition of Elgin undertook to prepare the document presented to Council entitled "Position Paper on Proposed Standards for Agricultural Operations in Ontario Act". Mr. Mistele indicated that farm operations require 240 days of storage for manure before it can be released. Councillor Wilson requested amendments to: Item 1 - field by field basis - needs clarification and may be too broad a definition Item 3 - minimum of 9 metres is too close and should be in compliance with Section 8 of the Environmental Protection Act - 15 or 20 metres Item 16 - boreholes around the perimeter to test leakage should be mandatory Councillor Habkirk questioned the availability of financial assistance and incentives to put the requirements in place. Mr. Mistele said that these are issues that need to be addressed in order to have the requirements in place within the five-year implementation period. He was uncertain about funding availability. Councillors requested Mr. Mistele to provide additional information to all municipalities regarding this issue. Moved by Councillor VanBrenk Seconded by Councillor Clutterbuck THAT the Council of the County of Elgin support and endorse The Farm Animal Coalition of Elgin's August 29, 2000 position paper on "Proposed Standards for Agricultural Operations in Ontario Act", as amended; and, THAT Council, express its concern over the use of an omnibus bill which could amend or introduce new standards through regulation without further consultation; and further, THAT the Ministry of Agriculture and Food be encouraged to develop a financial assistance program to help farming operations come into compliance over the 5-year transition period; and, THAT Council's position be forwarded to the Minister of Agriculture and Food and the local M.P.P. - Carried Unanimously. Warden McPhail suggested the formation of an Ad Hoc Committee to meet with the Elgin Federation of Agriculture to gather input on agricultural matters. Council consensus was that the Committee that meets on drainage issues could also handle agricultural matters and meetings could be held at the Administration Building as needed. County Council - 4 - September 12, 2000 Warden McPhail commended the Delegation for their efforts and the attendees left at 11 :20 AM. Council took a break at 11 :20 AM. and reconvened at 11 :34 AM. Warden McPhail advised that the Elgin Agricultural Impact Study would be presented today at 1 :00 P.M., at the Outdoor Farm Show, where the Minister of Agriculture, as well as the three Federations of Agricultural would be attending. Warden McPhail wished to be present, as the Wardens from most of the Counties would be attending. Council consensus was that the Warden should attend and Deputy Warden Wilson assumed the Chair. Warden McPhail left Chambers at 11:41 AM. DELEGATION Mr. Charles Fitzsimmons, Facilitator, Ms. Nancy Lawrence, Elgin Community Care Access Centre, Mr. Harry Hoover, St. Thomas Ambulance Service, Ms. Laurel Hevenor-Vallance, VON, and Mr. John Roberts, City of St. Thomas, attended at 11:40 AM. to address Council on the STEPS program. The volunteer-based services that transport patients to appointments in London for dialysis treatments, etc., are declining and a serious situation has arisen in supplying these patients with transportation to life-saving procedures. Currently the users and municipalities fund STEPS and attempts have been made to request funding from other agencies. The VON is willing to take over co-ordination of STEPS if the County agrees to provide assistance and financial support. St. Thomas-EIQin Patient Shuttle (STEPS) - EmerQency Services Co-Ordinator Ms. Dunn reported that ambulance service does not appear to have been impacted even with the STEPS program in place. Councillor Clutterbuck requested the report be amended to include that the volunteer and health services sectors seek out alternative funding. Councillors noted that a deadline is needed for all agencies to decide the service and funding issues. Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT in order to meet the Provincial Service Standards, the St. Thomas Elgin-General Hospital Ambulance Service be authorized and permitted to add an additional ambulance, staffed 8 hours per day, 5 days a week, commencing on January 1, 2001, at an approximate yearly cost of $130,000.00; and, THAT the Ministry of Health be requested to fund 50% of this requirement to meet its own standards; and, THAT the funding in the maximum amount of $22,800.00 (County share) be approved, from the Mill Rate Stabilization Reserve, to continue the STEPS program until December 31, 2000, subject to a review of the administrative costs by County staff; and further, THAT the City of St. Thomas and participants of the STEPS program be advised that financial support from the County for this service will be phased out by December 31, 2000, and the program should investigate the potential of having the volunteer and health services sectors seek out alternative funding models and community support for their initiatives; and, THAT the report from the EMC dated September 5, 2000 be approved as amended. - Carried Unanimously. Speed Reduction on SprinQwater Road - ManaQer of EnQineerinQ Services Moved by Councillor Walters Seconded by Councillor van Kasteren THAT the County of Elgin Speed Zone By-Law be amended to reflect changes to the following reduced speed zones: ~ 60km/h on Springwater Road from the north property limit of Highway #3 to a point 906m to the north (Orwell) ~ 60km/h on Springwater Road from 185m north of the north property limit of Blanche Street to a point 220m south of the northern property limit of the Blanche Street (Kingsmill). - Carried. Capital Road Improvements on Plank Road (County Road #19) Straffordville - ManaQer of EnQineerinQ Services Moved by Councillor Rock Seconded by Councillor VanBrenk THAT the County of Elgin complete the resurfacing and storm drainage on Plank Road (County Road #19) in Straffordville; and, THAT the Manager of Engineering Services be authorized to utilize the remaining funds in the Highway Transfer Reserve, in addition to any efficiencies realized from this year's budget, with the balance of the expenditure to be taken from the Mill Rate Stabilization Reserve; and, THAT Cyril J. Demeyere Limited be retained to provide the engineering services for the design and inspection of the storm sewer and road profile and any other engineering that may be required; and, THAT the present contract between the Municipality of Bayham and Omega Construction be extended to include the above project. - Carried. Sunset Road and John Wise Line Intersection Reconstruction - ManaQer of EnQineerinQ Services Council consensus was that this project be considered for the 2001 budget. Moved by Councillor Walters Seconded by Councillor van Kasteren THAT the Intersection Reconstruction of Sunset Drive and John Wise Line for the tendered price of $238,878.04 be postponed at this time; and, THAT the funds intended for this project be used to complete road restoration works in the Village of Straffordville in the Municipality of Bayham as proposed. - Carried. County Council - 7 - September 12, 2000 Councillor Wilson asked when the report for Lyons Line would be presented at Council. The Manager of Engineering Services reported that he has sent a letter to Ashwarren in regard to the products used on this construction site and requested information be made available to the County prior to September 26, 2000. Ashwarren is aware of the problems. If the surface drains are made larger, problems will occur downstream and will require a drainage engineer to look at this situation and report as soon as possible. The work may not be completed until next year. Mock Evacuation of Terrace LodQe to Test the Home's EmerQency Plan The exercise involved volunteers, police, fire, ambulance services and staff. The training test was successful and emphasized where shortfalls need to be addressed. Councillor Wilson noted that an access road around the perimeter of the building would have allowed for emergency vehicles to gain better access and should be considered when constructing the new Home. Moved by Councillor Habkirk Seconded by Councillor van Kasteren THAT at the request of Mr. Ross Snetsinger, Rail Ways to the Future Committee, the Provincial Minister of Transportation be advised that the Corporation of the County of Elgin supports the establishment of a Provincial 'Rail Renewal Task Force', and that the Federal Minister of Transportation also be so advised of this support; and, THAT at the request of Mr. Ross Snetsinger, Rail Ways to the Future Committee, the Minister of Finance be advised that the Corporation of the County of Elgin supports the request for the Province to negotiate with railway companies operating in Ontario, the exchange of property tax liability on their rail rights-of-way corridors on the condition that the railways will pass title of any rail line they abandon or have abandoned, to the Province andlor the local municipality at no cost. The rights-of-way should include all existing rail infrastructure. The proposal would reserve these rights-of-way for return to rail use when required, and could be used for other purposes such as nature trails, in the interim. - Carried. Councillor Habkirk in reference to Correspondence Item #20 noted that $45M had been allocated for deficiencies in plumbing or electrical concerns and after speaking with the Minister, the problems in Aylmer were fixed within the next few days. He recommended that municipalities should get their Housing Authority to look after problems right away. County Council - 11 - September 12, 2000 OTHER BUSINESS StatementllnQuiries by Members Councillor Habkirk reminded Council of the meeting at the Middlesex County Building on September 20,2000 from 9:00 AM. to 11 :00 AM., with the Minister of Municipal Affairs and Housing. Councillor Walters resigned as Mayor of the Municipality of Central Elgin effective September 15, 2000, with regrets, due to his candidacy for the Alliance Party. Councillor Walters commended Council and staff for their method of operation and team atmosphere that he enjoyed during his term on Council. Moved by Councillor VanBrenk Seconded by Councillor Stewart THAT we accept, with regrets, the resignation of Councillor Bill Walters from Elgin County Council to attend to his duties as the nominee for the Alliance Party. - Carried. County Council - 12 - September 12, 2000 The Chief Administrative Officer advised that, in consultation with Warden McPhail, only one County Council Meeting is required for October and would be on October 24, 2000. Councillor Habkirk noted that Councillor Rock will be attending recruitment meetings for doctors on September 2ih and 28th. The County Administrator announced that the County was holding two rooms for the ACRO convention if anyone needed one.
