February 13, 2001 Minutes COUNTY COUNCIL Tuesday, February 13, 2001 The Elgin County Council met this day at the Administration Building, at 9:07 AM., in accordance with adjournment, with all members in attendance. Warden McPhail in the Chair. Moved by Councillor Mcintyre Seconded by Councillor Habkirk THAT the minutes of the meeting held on January 23, 2001 be adopted. - Carried. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF- None. DELEGATIONS Ms. Dorothy Wilson of the Children's Safety Village, attended at 9: 15 AM. and highlighted the programs the organization offers, such as traffic, fire and bicycle safety, and 9-1-1 instruction to reduce injuries to children. The facility, which is scheduled to open in mid April, is located in London near Fanshawe Village. The delegation indicated the Village needs $300,000 to be debt-free and requested funding from the County. Corporate donors would fund ongoing maintenance. Warden McPhail thanked the delegation for attending and indicated the request would be considered during the 2001 budget deliberations. The delegation left at 9:30 AM. Ms. Susan McConnell of the Kettle Creek Conservation Authority attended at 9:30 AM., to promote interest in the "Communities in Bloom Competition". Councillors were handed an information package and asked to take it back to their lower-tier municipalities for discussion. Ms. McConnell offered to appear before any organization that is interested in participating. The delegation left at 9:35 AM. COUNCIL AND STAFF REPORTS Tree CommissionerlWeed Inspector Mr. Bryan Hall, Kettle Creek Conservation Authority, attended at 9:36 AM. and advised that Hugh Geurts, County Tree Commissioner and Weed Inspector, has taken a position with the Ministry of the Environment, and an ad has been placed to fill the vacancy. Application for Minor Exception Lot 4. Conc. 5. South of A. Dutton/Dunwich Mr. Hall presented a resubmission of an application by Mr. Egbert Verbrugge to clear 8-12 acres of bush (4 acres applies to the County By-Law) and noted that the landowner has agreed to make a contribution to the Lower Thames Valley Conservation Authority to replace the trees that will be cleared. Mr. Verbrugge supplied a confidential drainage assessment, which concluded that this clearing would have minimal impact on future runoff. The Chief Administrative Officer advised that an opinion had been received from County Council 2 February 13, 2001 the County Solicitor recommending a save harmless agreement be signed in favour of the County to offset any potential liability issues. Moved by Councillor Crevits Seconded by Councillor Habkirk THAT the Application for Minor Exception to the Trees Act from Mr. Egbert Verbrugge, Lot 4, Concession 5, South of A, Municipality of Dutton/Dunwich, to clear approximately 4 acres of bush that apply to the County Tree By-Law, be approved subject to the following conditions: THAT Mr. Verbrugge make a contribution to a local conservation/heritage association to ensure an equivalent acreage of forest is planted as per the County's No Net Loss Policy; and THAT Mr. Verbrugge prepare and execute a save harmless/indemnity agreement in favour of the County of Elgin, at his cost and in a form approved by the County Solicitor. - Carried. Mr. Hall was requested to report to a future meeting how many acres of trees have been cleared and where the replanting occurred. Mr. Hall left at 9:41 AM. Capital BudQet - Software - Director of Financial Services Moved by Councillor VanBrenk Seconded by Councillor Faulds THAT, as an add-on to our current accounting software, a job costing module for capital budgeting be purchased at the total quoted price of $4,980.65; and, THAT the purchase be expensed to the Information Technologies Reserve account. - Carried. Write-Offs and Supplementals - Director of Financial Services The Director of Financial Services explained that in 2000 many write-offs were received in significant amounts, mostly due to Current Value Assessments and Provincial caps, and this increase would follow through to the lower-tier and school boards. The Director advised that we might receive additional write-offs prior to closing out the 2000 Budget. County Roads Maintenance Payments - Director of Financial Services Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT the payment schedule to the Lower-Tier Municipalities for County Road maintenance change to 12.5% of the total allocation for each payment due January 31, February 28, March 31, and April 30, and 25% of the total allocation for each payment due September 30 and December 15. - Carried. County Council 3 February 13, 2001 Three-Year Computer Plan and IT Audit - ManaQer of Library Services. Director of Financial Services. Director of Human Resources. and Chief Administrative Officer The report explained that the County is much more involved in automation and a plan should be formulated for future needs. Moved by Councillor Rock Seconded by Councillor Wilson THAT LGS Group Incorporated be awarded the contract for the preparation of a Systems Audit and Three-Year Computer Plan for the County of Elgin at a total cost not to exceed $33,725.00 including all expenses and GST; and, THAT the funds for the study be allocated from the Computer Reserve Account. - Carried. Council took a break at 10:01 AM. and reconvened at 10:19 AM. DELEGATION Mr. Charles Knapp, Consultant, Places to Retire Inc. attended at 10: 19 AM. to solicit interest in the publication "Places to Retire in Canada" which has a circulation of 100,000 copies. Mr. Knapp handed out copies of the magazine and indicated the deadline for partnership is March 2, 2001 for interested parties. The County representative on the Elgin Tourist Association agreed to take this matter to their next meeting and requested Mr. Knapp to attend. The delegation left at 10:34 AM. Appeal to the Workplace Safety and Insurance Board to Transfer Homes for the AQed to Schedule Two from Schedule One - Director of Human Resources The Director of Human Resources outlined the process which began in 1997 when an appeal was launched by Heath Lambert Benefits Consulting, on behalf of the County of Elgin and other municipalities, against the denial by the WSIB to transfer Homes for the Aged into Schedule Two. Potential savings should be realized this year if the County pays the Provisional Special Assessment before February 28,2001, as well as in future years. Mr. Don Timmins attended and answered questions from Council. Moved by Councillor VanBrenk Seconded by Councillor Faulds THAT the Corporation of the County of Elgin, accept the opportunity, without prejudice or precedent, to transfer the Homes for the Aged from Schedule One to Schedule Two; and, THAT it pay to the Workplace Safety and Insurance Board the required Provisional Special Assessment estimated at $115,826.63; and, THAT this money be taken from the Workplace Safety and Insurance Board reserves previously set aside; and, THAT Heath Lambert Benefits Consulting continue to pursue the possibility of retroactivity to 1998 for Rate Group 851, being the date that rate groups 845, 817-2 and 817-3 were transferred to Schedule Two. - Carried. January 1. 2001 Renewal - Excess Indemnity for the County of EIQin CoveraQe by the American Re-Insurance Company - Director of Human Resources Moved by Councillor Rock Seconded by Councillor Habkirk THAT the 2001 renewal rates for coverage by American Re-Insurance Company for Excess Indemnity be adopted as follows: Premium deposit for the year 2001, based on the following estimates of assessable earnings of $8,755,287 is: $2,331,688 x 0.044% per $100.00 = $1,026.00 $6,423,599 x 0.149% per $100.00 = $9,571.00 Ontario Sales Tax = $ 847.76 and, THAT the funds for the above coverage be taken from the WSIB reserve; and, THAT this policy comes into effect January 1,2001 through January 1,2002. - Carried. Proposed AmendinQ By-Law 01-05 to the Road ConsolidatinQ By-Law No. 99-17 - ManaQer of EnQineerinQ Services Moved by Councillor VanBrenk Seconded by Councillor Stewart THAT By-Law No. 99-17 to the Elgin County Road System be amended and the necessary amending by-law be prepared. - Carried. New Format for Corporate Business Cards - Deputy Clerk The Deputy Clerk presented a proposed new format for corporate business cards and indicated the report should be amended by replacing the last paragraph to indicate staff would order from the lowest-priced source. Moved by Councillor Habkirk Seconded by Councillor Mcintyre THAT all corporate business cards be ordered in a standard format on off-white business card stock with the County Crest in colour and text in black ink; and, THAT the business cards be replenished upon depletion of existing supplies; and, THAT staff be authorized to order from the lowest-priced source. - Carried. Telecommunications EQuipment for the EmerQency Operations Centre - EmerQency Measures Co-Ordinator and CommandinQ Staff SerQeant Cox. EIQin County OPP Staff Sergeant Cox attended to answer questions from Council concerning communications equipment. Councillors had concerns regarding the best placement of antennae, radio communications problems, and the City's participation in sharing the cost of this project. Moved by Councillor Rock Seconded by Councillor Faulds THAT County Council utilize the Government approved JEPP funding in the amount of $12,887.10; and, THAT County Council approve funding in the 2001 budget, in the amount of $10,267.74 to purchase a base radio communications system for the Joint County/City Emergency Operations Center; subject to confirmation of the City of St. Thomas for its share of the project costs; and, THAT $3,000.00 be set aside in the annual budget for maintenance and licensing fees for the base, the cost of which to be shared by the City of St. Thomas and the County; and, THAT all municipal councils be entitled to utilize the base radio communications in the event of a local emergency; and, County Council 6 February 13, 2001 THAT the Central Ambulance Communications Centre be permitted to utilize the base radio designated to Ambulance in the unlikely event that the London Central Ambulance Communications Centre is not operable; and further, THAT the Central Elgin Fire Chief be able to utilize the antennae on a daily basis, subject to the understanding that the antennae will be disengaged from his system in an Elgin or St. Thomas emergency. - Carried. Rare Scott-Sefton Collection of PhotoQraphs - ManaQer of Library Services Mr. Ken Verrell attended at 11: 15 AM. to answer questions from Council regarding a request for an interest free loan to produce a hard cover book of Scott-Sefton photographs. Moved by Councillor VanBrenk Seconded by Councillor Habkirk THAT County Council approve an interest-free loan not to exceed $30,000 to the Elgin County Library, on behalf of the Elgin Photographic Heritage Society, for the production of a book of rare pictures from the Scott-Sefton collection of Elgin's past heritage; and, THAT County Council authorize the Manager of Library Services to commence the tender procedure for the production of the book on behalf of the Elgin Photographic Heritage Society; and, THAT the Elgin Photographic Heritage Society pay back the interest free loan to the County over a three-year period ending December 2004, through the sale of the books; and, THAT the County set these funds aside in the 2001 budget. - Carried. DELEGATION Commanding Staff Sergeant Cox, Sergeant Chris Gheyson, and Constable Dennis Harwood attended at 11 :15 AM. to present the Elgin County O.P.P. 2001 Business Plan outlining the Mission Statement and Goals the O.P.P. would provide to the residents of Elgin County. Constable Harwood handed out the Business Plan and Staff Sergeant Cox requested that Council review the document and let him know how the O.P.P. can improve their service to the County and its residents. Warden McPhail thanked the delegation for attending, for their assistance at the recent tragic fire in St. Thomas, and invited them to lunch with Council. Space Needs Study/Library/Archives - ManaQer of Library Services Moved by Councillor Rock Seconded by Councillor Wilson THAT the Manager of Library Services be authorized to recruit a firm to conduct a Space Needs Study for the possible relocation of the Library Services Department to the Social Services space, and the Library storage area in the basement, south end of the County County Council 7 February 13, 2001 Administration Building directly below the Social Services space for the possible development of an Archives; and, THAT the Space Needs Study not exceed $10,000; and, THAT staff report to Council with the proposed floor plans and estimated construction costs for Council's consideration; and, THAT the amount be included in the Year 2001 Capital Budget. - Carried. 2002 SeSQuicentennial of the County of EIQin (150 Years Since Incorporation as a VillaQe) - ManaQer of Library Services Moved by Councillor Wilson Seconded by Councillor Stewart THAT County Council authorize the Manager of Library Services to proceed with the tender procedure for production of an atlas to commemorate the 2002 Sesquicentennial of the County of Elgin for a cost not to exceed $45,000; and, THAT the atlases be sold at a cost of $75.00 each with all revenue to go back to the County of Elgin; and, THAT the cost of the project be included in the 2001 budget. - Carried. Surplus Furniture - Terrace LodQe - Director of Homes and Senior Services The Director of Homes and Senior Services reported that only one bid was received in response to the advertisement for a portion of the dining room tables and chairs. The balance would be included in the County auction. Moved by Councillor Stewart Seconded by Councillor Mcintyre THAT the Director of Homes and Senior Services be authorized to accept the bid of $120.00 for six tables and 24 chairs from Harley Underhill for the surplus dining room furniture at Terrace Lodge. - Carried. Statement of Convention Expenses; Statement of Remuneration and Expenses for EIQin County Council; Statement of Remuneration and Expenses for Outside Boards - Director of Financial Services Moved by Councillor VanBrenk Seconded by Councillor Crevits THAT the "Director of Financial Services Statement of Convention Expenses", "Treasurer's Statement of Remuneration and Expenses for Elgin County Council" and "Treasurer's Statement of Remuneration and Expenses for Outside Boards" presented by the Director of Financial Services be received and filed. - Carried. Council recessed at 12:01 P.M. and reconvened at 1 :05 P.M. County Council 8 February 13, 2001 Mr. Steve Peters M.P.P. Elgin-Middlesex-London, and Ms. Susan Pollack (representing Mr. Gar Knutson, M.P.), attended at 1 :05 P.M., at the invitation of Council. Mr. Peters answered questions from Council, some of which were Lakeshore erosion, reassessment of the farming community, OSTAR funding for waterline on Sunset Drive, tobacco legislation (nitrosamine issue), and 401 accidents and detours. Mr. Peters indicated his office could provide names and addresses where municipalities could write to express their concerns for availability of subsidies regarding recent tobacco legislation. Staff will provide correspondence and material on the Lakeshore erosion and 401 detours to Mr. Peters and Mr. Knutson. Mr. Peters indicated he would forward Council's concerns to the various Ministers involved. Warden McPhail thanked Mr. Peters and Ms. Pollack for attending and indicated the invitation is open to Mr. Knutson to attend another meeting for a round table discussion. David Hartley, Road Superintendent, Township of Malahide, requesting the County Engineering Services Department assistance with re-inspection of their bridge and culvert appraisals. 2. Lloyd Perrin, Director of Physical Services, Municipality of Central Elgin, requesting the County Engineering Services Department to complete bi-annual inspection of bridges and culverts. 3. Marjory Morden, Town Clerk, Town of Caledon, with resolutions: 1) requesting development of protocol for joint capital projects involving Boards and Trustees with Town staff and Council members; 2) requesting involvement by the Province to fund through the Ministry of Food and Rural Affairs the Environmental Farm Plan. 4. Richard Allaire, City Clerk, City of Cornwall, with a resolution requesting the Minister of Health modify the Provincial Funding Formula to ensure equal funding to all Ontario residents for medical services. 5. Correspondence Items #1 and 2: The Manager of Engineering Services explained that as Justin Lawrence is leaving employment with the County, current staff would be unable to assist the Municipalities of Malahide and Central Elgin with this work. Staff was authorized and directed to issue an RFP for bridge and culvert appraisals on a County-wide basis. County Council 9 February 13, 2001 The following recommendation was adopted respecting Correspondence Item #3 part 2. Moved by Councillor VanBrenk Seconded by Councillor Faulds THAT the Corporation of the County of Elgin supports the resolution of the Town of Caledon to lobby the Provincial Government to provide funding for the Environmental Farm Plan; and, THAT the Federal Government be lobbied to reconsider extending the funding beyond the first quarter of the year 2001 for this program. - Carried. The following recommendation was adopted respecting Correspondence Item #4. Moved by Councillor VanBrenk Seconded by Councillor Faulds THAT the Corporation of the County of Elgin supports the resolution of the City of Cornwall requesting the Ministry of Health to modify the Provincial funding formula so that all Ontario residents receive the same level of medical services without additional financial burden. - Carried. The following recommendation was adopted respecting Correspondence Item #5. Moved by Councillor Habkirk Seconded by Councillor VanBrenk THAT the Corporation of the County of Elgin supports the resolution of the Town of Aylmer requesting the Province to review and reconsider legislation empowering District School Boards with the ability to establish Education Development Charges. - Carried Unanimously. Moved by Councillor VanBrenk Seconded by Councillor Mcintyre THAT the Corporation of the County of Elgin contribute, on behalf of its constituent Municipalities, 325 County Pins and maps to the Royal Canadian Legion, for their "Community Goodwill Packages" to be given out at the 2001 Spring Convention. - Carried. The Director of Homes and Senior Services requested that a letter be forwarded to the Royal Canadian Legion thanking them for their assistance in the past. OTHER BUSINESS Statements/InQuiries by Members Councillor Wilson indicated there would be three new inductees to the Agricultural Hall of Fame and that there will be a dedication ceremony on February 23rd for the new Elgin Agricultural Heritage Room. Letters of recognition from the Warden will be forwarded to all inductees. County Council 11 February 13, 2001 Councillor Wilson advised that Councillor Rock and he were appointed to the Police Services Board, and Community Representative, K. Wayne Ward. The appointees requested consideration be given for County staff to provide administrative advice and assistance to the new Board. Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT County staff be authorized to provide administrative assistance and advice to the Police Services Board during the formative stages of the Board's mandate. - Carried. Warden McPhail advised Mr. Terry Marquardt from the Ontario Ground Water Association had attended meetings and provided advice at information seminars concerning the security of water resources across the County. Council instructed staff to issue a $2000 donation to the Ontario Ground Water Association in recognition of the assistance provided by Mr. Marquardt. Moved by Councillor VanBrenk Seconded by Councillor Mcintyre THAT County Council make a contribution of $2,000 to the Ontario Ground Water Association to help defray the expenses of Mr. Terry Marquardt who attended meetings to discuss the security of water resources. - Carried.
