COUNTY COUNCIL
Tuesday, January 23, 2001
The Elgin County Council met this day at the Administration Building, at 9:10 AM., in
accordance with adjournment, with all members in attendance except Councillors Rock
and VanBrenk.

THAT the minutes of the meeting held on December 12 and 14, 2000 be adopted.

DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF -
None.
DELEGATIONS
Mayor Peter Ostojic, Roy Main, City Administrator, and Roy Lyons, Fire Chief, and Bob
Barber, Deputy Fire Chief, City of St. Thomas, attended at 9: 1 0 AM. to thank Council,
Lower-Tier municipalities and staff for their assistance in helping to prepare the Memorial
Arena for the funeral of Captain Redman. The spirit and co-operation extended was
greatly appreciated and support efforts will not be forgotten. Mayor Ostojic extended his
Council's willingness to discuss common issues and requested that the two Councils meet
on a regular basis throughout the year and offered to have City Council hold the first joint
meeting. Warden McPhail thanked Mayor Ostojic for his kind words and expressed
Council's sympathy for the loss of one of their emergency service personnel. Discussion
on the City's request would be carried out later in the day. The delegation left at 9: 16
AM.
Ms. Cathy Obright, Heart and Stroke Foundation of Ontario, attended at 9:16 AM. to
outline their campaign for 2001 and requested Council and employee participation in their
"Paint the Town Red" fundraising program by purchasing tickets to the Chili Cookoff on
February 5th along with other activities. She indicated that Elgin County contributes more
per capita than many larger municipalities. The Warden thanked the delegation for
attending and Ms. Obright left at 9:22 AM.

Year 2000 Summary EIQin County Tree By-Law No. 87-6 - Tree CommissionerlWeed
Inspector
Mr. Bryan Hall attended in Mr. Geurts absence (teaching course). Mr. Hall noted this has
been a record year in which a larger than usual number of applications have been
received. Warden McPhail noted that the Tree Commissioner has been very proactive in
protecting the County's tree cover.

Weed Inspector
Mr. Bryan Hall noted that neighbours have no objection nor does the Conservation
Authority to this exception to the policy. The applicant has indicated replanting will take
place.

OPP PolicinQ Invoices - Director of Financial Services
Invoices have been received for policing services since July 1 and, as the Police Services
Board has not been formed to date, the Management Board Secretariat has agreed to
waive interest penalties and requested payment of the outstanding invoices. The Director
projected the costs owing by the Lower-Tier municipalities for 2000 and presented them
for consideration.

THAT the OPP Policing Invoices be prorated based on the 1999 actual incidents
breakdown as provided by the Ontario Provincial Police; and,
THAT a reconciliation be prepared once the 2000 actual incidents breakdown has been
provided by the OPP; and,
THAT this method continue until the Police Services Board has been established.

HiQhway #3 PlanninQ Study - Technical Services Officer
The Technical Services Officer indicated that meetings have been held between staff,
MTO and Lower-Tier municipalities involved, to discuss highway improvements. Mr.
Dutchak noted that property designated as a potential highway improvement location
cannot be developed because the entire parcel is barred from any action on it even if only
one corner is designated. Central Elgin has indicated that there is a great potential for
growth along these locations and potential revenue is being lost. The Technical Services
Officer noted it would take approximately two years to complete the study. Council
consensus was that many questions need to be answered by the MTO and that the City of
St. Thomas involvement should be explored before proceeding with a study.

THAT the Ministry of Transportation of Ontario be requested to fund 50% of the Highway
#3 Planning Study; and,
THAT staff be directed to convene a meeting with the benefiting municipalities, including
the City of St. Thomas, to determine a cost-sharing formula for the remaining 50% of the
cost of the study; and further,
THAT the MTO be requested to confirm in writing their willingness to move up the date of
construction upon completion of the study.

DELEGATION
Mr. Harry Mezenberg, West Elgin Health Care Facility, attended at 10:12 AM., to present
a Capital Development Proposal. The delegation requested Council's consideration to
help fund the new facility in the amount of $50,000 in 2001 and $50,000 in 2002, towards
land acquisition and servicing of the lot and building. Various agencies have indicated
they may be interested in renting space in the new facility to better serve the west end of
the County. The delegation is expecting consideration for capital funding by the Ministry
of Health in February or March 2001. Councillors indicated taxpayers in other
municipalities have expended considerable money within their own municipality for health
centres and discussion with the West Elgin community should be accelerated. Warden
McPhail commended the delegation for their efforts and indicated that Council would
consider the request during their budget deliberations. The delegation left at 10:26 AM.

budget deliberations.

Plank Road (County Road #19) and Calton Line (County Road #45) Intersection
Safety Improvements - Technical Services Officer
The Technical Services Officer indicated that skewed roadways are quite a problem and
reconfiguration of the roadway should alleviate the sight concerns. Once the roadway is
reconfigured, the flashing beacon would be removed. Council discussed the possibility of
the installation of a cement island, a reduction in the speed limit and removal of trees to
help reduce the potential of a collision at the corner.

THAT the intersection of County Road #19 (Plank Road) and County Road #45 (Calton
Line) in the Municipality of Bayham be reconstructed to create a perpendicular
configuration to upgrade the intersection to current design standards in an attempt to
reduce potential collisions; and,
THAT the existing intersection control beacon be removed upon completion of the project;
and,
THAT the work be completed in conjunction with the reconstruction of County Road #45
currently proposed in the 5 year capital budget; and,

THAT the local municipality remove the trees on the west side of Plank Road north of the
intersection to facilitate greater sight distance.

Councillor Wilson requested that staff be directed to review the 5-Year Plan and accelerate
the project's placement. The reconstruction of Calton Line will be at a substantial cost and
safety improvements could be moved further into the 5-Year Plan.

THAT the report on intersection safety improvements on Plank Road be deferred and staff
be requested to review the 5-Year Capital Plan and recommend moving the intersection
improvements ahead in the timetable, with a complete discussion of the impact this will
have on other projects scheduled within the Plan.

Road 4 EnQineerinQ Services ReQuest For Proposals - ManaQer of EnQineerinQ
Services
The Manager of Engineering Services indicated that the reconstruction of Road 4 is
extensive and staff are recommending that the project be completed over four years.

THAT Earth Tech (Canada) Inc. complete the detailed design for the Sunset Road
Reconstruction Project at an estimated cost of $60,000; and,
THAT Earth Tech (Canada) Inc. tender, inspect and administer the reconstruction of
Sunset Road when that work is scheduled by Council; and,
THAT the funds for the detailed design be allocated from the 2001 Engineering Services
Capital Budget.

Telecommunications EQuipment for the EmerQency Operations Centre - EmerQency
Measures Co-Ordinator
Mr. Roy Lyons, St. Thomas Fire Chief, attended and explained that the antennae would
be installed on the roof of the Administration Building and equipment kept here in the
Emergency Operations Centre. Chief Lyons reported that Spectrum Communications
maintains the current telecommunications equipment and it would be advisable to
continue with them. The City of St. Thomas has put the money in the 2000 budget and
will be requested to reconfirm their funding of the equipment. Council instructed staff to
consult with OPP Staff Sergeant Cox prior to going ahead with purchase and the report
will be deferred until Sergeant Cox has reviewed the project.

POA AQreements - Local Side AQreement and Memorandum of UnderstandinQ -

THAT the Warden and the Chief Administrative Officer be authorized to sign the
Memorandum of Understanding and the Local Side Agreement with the Ministry of the
Attorney General for the transfer of Provincial Offences Act responsibilities to the County
of Elgin.

Plank Road Reconstruction in Straffordville and Eden - Technical Services Officer
The Technical Services Officer reported that the Township of Bayham has selected a
sanitary services contractor and additional roadwork could be carried out this year.

THAT the County of Elgin complete the road reconstruction project of Plank Road (County
Road #19) Straffordville in 2001 for an estimated cost of $475,000; and,
THAT the County of Elgin complete the road reconstruction of Plank Road (County Road
#19) in Eden for the price of $500,000 as submitted by tender from Classic Excavating
Inc., in conjunction with the Municipality of Bayham's sanitary sewer project; and,
THAT these projects be funded from the Engineering Services 2001 Capital Budget.

WellinQton Road Intersection Reconstructions at Ford Road and McBain Line -
Technical Services Officer
Reconstruction of the intersections is necessary for development of property in the area.

THAT the Engineering Services Department be directed to advertise for Consulting
Services for survey, design, administration and inspection of the intersection of Wellington
Road at Ford Road and at Wellington Road and McBain Line; and,
THAT these costs be funded under the Year 2001 Engineering Services Capital Budget.

Sanitary Services for the Administration BuildinQ - ManaQer of EnQineerinQ Services
The Manager of Engineering Services reported that the Province will discontinue
providing services to the Administration Building within the next three years. Council
discussed various methods of becoming self-sufficient and providing services to the
Administration Building. Council directed the report be amended to include investigation
of a small package treatment plant during discussions.

THAT the Municipality of Central Elgin be requested to undertake a Class Environmental
Assessment for the provision for sanitary sewer servicing for the Administration Building
and report back to the County of Elgin on the cost sharing formula and the time frame for
the discontinuance through the existing Ontario Psychiatric Hospital system; and further,
THAT the Warden and Chief Administrative Officer be authorized to sign the agreement
with the Chair of the Management Board of Cabinet regarding the three-year sewage
agreement.

Ontario Superbuild Sports. Culture and Tourism Partnership - ManaQer of
EnQineerinQ Services
The Manager of Engineering Services reported that the Museum requires health and
safety upgrades to the building in order to fit within the mandate of the Superbuild
Program. Councillor Faulds requested the report include investigation of the basement
under the 1848 section of the building.

THAT the Warden and Chief Administrative Officer be directed and authorized to sign the
following resolution for Round 1 for the SuperBuild initiative:
WHEREAS the Council of the Corporation of the County of Elgin (the "Municipality") has
received and considered the Government of Ontario SuperBuild Corporation Sports,
Culture and Tourism Partnerships ("SCTP") initiative Round 1 Application Guidebook (the
"Guidebook"). and
, ,
WHEREAS Council has assessed its capital priorities against the SCTP initiative Round 1
application requirements as set out in the Guidebook and intends to submit a letter of
intent for qualifying the Elgin County Pioneer Museum project (the "Project") for funding
under Round 1 of the SCTP initiative; and,
WHEREAS Council confirms that the Municipality is compliant or in the process of gaining
compliance with the new Ministry of Environment Drinking Water Protection Regulation,
Ontario Regulation 459/00 made August 9, 2000 ("DWPR"); and,
WHEREAS Council considers the Project to be its highest sport, recreational, cultural or
tourism infrastructure priority for the Municipality; and further,
THAT Council will determine its level of participation (financial), if any, once the
contribution formula has been announced.

KinQ GeorQe Lift BridQe in Port Stanley - ManaQer of EnQineerinQ Services
The Manager of Engineering Services advised that the report done in 1997 is outdated
and should be performed at least every two years to comply with the Bridge Code.

THAT Burgess Engineering Incorporated complete the structural, mechanical and
electrical inspection of the King George Lift, that will ensure compliance with the Bridge
Code, at the quoted price of $22,500 plus G.S.T.; and,

THAT the Municipality of Central Elgin be requested to fund 50% of the total cost of the
King George Lift Bridge inspection report commissioned by the County of Elgin; and,
THAT the remaining 50% of the total cost to create the report be funded by the 2001

The Manager of Engineering Services reported that local road superintendents have
reviewed the agreement and changes have been incorporated into the document. The
agreement has been forwarded to the County Solicitor for finalization

The Manager of Engineering Services reported that the raised ripple island should not
interfere with winter road maintenance and would be tried as a test project.
