October 23, 2001 Minutes COUNTY OF ELGIN Tuesday, October 23,2001 The Elgin County Council met this day at the Administration Building, at 9:05 AM. in accordance with adjournment, with all members in attendance except Councillor Stewart (ill). Warden McPhail in the Chair. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF- None. Moved by Councillor Rock Seconded by Councillor Crevits THAT the minutes of the meetings held on September 25 and October 5, 2001 be adopted. - Carried. Moved by Councillor VanBrenk Seconded by Councillor Mcintyre THAT we do now move into Committee Of The Whole Council. - Carried. The Chief Administrative Officer introduced Mr. Mark Hoffman, the County's new IT Manager and provided background on his credentials. Warden McPhail welcomed Mr. Hoffman and invited him to lunch. Warden McPhail informed Council that Councillor Stewart has just been released from hospital and will return to meetings once he is feeling better. STAFF REPORTS Application for Minor Exception - EIQin County Tree Commissioner The Elgin County Tree Commissioner reported that neighbours and the local conservation authority were contacted and had no objections to the application by Mr. & Mrs. Schipper to clear .62 hectares of trees at Lot 111, Conc. 7, Bayham. Moved by Councillor Habkirk Seconded by Councillor Faulds THAT the Application for Minor Exception to the Trees Act from Mr. & Mrs. Harry Schipper, Lot 111, Concession 7, Municipality of Bayham, to clear approximately 0.62 hectares of woodland be approved; and, THAT in order to maintain the integrity of the County's "No Net Loss Policy" 1050 trees be replanted or an equivalent donation be made to the LPRCA - Carried. Kettle Creek Conservation Authority - Carolinian Forest and the New EIQin Manor landscapinQ Plan - Director of Homes and Seniors Services The Director of Homes and Seniors Services and the Elgin County Tree Commissioner reviewed the previous direction by Council to investigate developing a Carolinian forested area at the new Elgin Manor in partnership with the KCCA, and presented a plan for Council's consideration. County Council 2 October 23,2001 Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT the Director of Homes and Seniors Services be authorized to proceed with the Carolinian Forest Project for Elgin Manor; and, THAT the funds for the project (approximately $6,000) be provided through the Elgin Manor donation account. - Carried. A.O.R.S. MeetinQs Attendance - Technical Services Officer The County Technical Services Officer has been selected to sit as a member of the Board of Directors of the Association of Ontario Road Supervisors and noted he will utilize the County vehicle as much as possible to attend meetings of the Board. Moved by Councillor VanBrenk Seconded by Councillor Rock THAT the Technical Services Officer be given permission to attend a maximum of six meetings annually for the Association of Ontario Road Supervisors Board of Directors and associated committees representing the Elgin County Road Supervisor's Association Recommendation. - Carried. Union Road Reconstruction Update #2 - Technical Services Officer Council had given staff permission to proceed with the work if the lowest bidder was chosen and report costs at a later date. Staff noted that damages to a large section of a four-foot reinforced concrete pipe must be repaired and will require additional work not included in the original contract. Council cautioned that this should have been added to the contract and having the work done on a time and materials basis may produce a more costly result. Moved by Councillor Crevits Seconded by Councillor Wilson THAT TCG Asphalt and Construction Inc. be awarded Contract No. 6200-01-08, Union Road Reconstruction, for their submitted tender price of $448,032.81 including G.S.T. - Carried. Renovation Policy for County Administration BuildinQ - ManaQer of EnQineerinQ Services The Manager of Engineering Services outlined for Council areas of the present Renovation Policy that should be revised in order to make the County Building more competitive in the rental market. Moved by Councillor Habkirk Seconded by Councillor Mcintyre THAT the attached Renovation Policy for the County Administration Building dated October 1, 2001 be approved. - Carried. Vehicle WeiQht Restrictions Over County BridQes - ManaQer of EnQineerinQ Services The Manager of Engineering Services reported that bridge inspections are done on weight restricted structures every two years as per the Ontario Highway Bridge Design Code. County Council 3 October 23,2001 Moved by Councillor Rock Seconded by Councillor Wilson THAT no vehicle or any class thereof, whether empty or loaded, shall be operated over any bridge designated in Schedules No.1 and No.2, with a weight in excess of the weight limit prescribed in said schedule; and, THAT the necessary by-law be prepared and become effective until November 14, 2003; and, THAT By-Law No. 99-32 be repealed. - Carried. Access Road - Terrace lodQe - ManaQer of EnQineerinQ Service The Manager of Engineering Services reported that tenders have been received for the installation of the Terrace Lodge access road and water line. Moved by Councillor VanBrenk Seconded by Councillor Wilson THAT Birnam Excavating Ltd. be awarded Contract No. 5920-01-02, Terrace Lodge Access Road and new water service, for their submitted price of $151 ,478.53 including G.S.T.; and, THAT the Warden and the Chief Administrative Officer be directed and authorized to sign the contract. - Carried. Museum Report - Director of Financial Services The Director of Financial Services highlighted the annual report on activities at the Pioneer Museum. Councillor Faulds reported that the City of St. Thomas has cleaned up the grounds and a local high school has posted a request on the bulletin board for volunteers to help keep the gardens tidy. Warden McPhail will send a letter to the Museum staff and volunteers thanking them for their extra efforts advanced during the recent restoration after the Museum fire and invite them to a Council lunch in recognition of their dedication. Moved by Councillor VanBrenk Seconded by Councillor Mcintyre THAT the annual report on the activities of the Elgin County Pioneer Museum be received and filed. - Carried. Terrace lodQe EmerQency Generator - Director of Homes and Seniors Services The Director of Homes reported that the present generator is 25 years old and needs to be replaced and upgraded to encompass entire building operations. Council discussed the need to provide a shelter to protect the generator from the elements and directed staff to look into the use of natural gas to power the generator. The trade-in value versus sale of the existing generator was also questioned and staff will investigate. Moved by Councillor Wilson Seconded by Councillor VanBrenk THAT staff be directed to proceed immediately with replacing the existing 175 kW indoor generator at Terrace Lodge with a new outdoor 500 kW generator at an estimated cost of $150,000.00; and, THAT any surplus funds be transferred from the Homes 2001 operational budget to the Terrace Lodge generator replacement; and, County Council 4 October 23,2001 THAT, if required, the remainder could be allocated from the proposed 2002 Capital Budget. Provincial Town Criers' Competition - ManaQer of Library Services The Manager of Library Services reported that meetings have been held and plans are underway for events at the 2002 competition. Moved by Councillor VanBrenk Second by Councillor Faulds THAT the report entitled "Provincial Town Criers' Competition" presented by the Manager of Library Services, dated October 3, 2001, be received and filed. - Carried. Broadband Task Force - ManaQer of Library Services Moved by Councillor Mcintyre Seconded by Councillor Habkirk THAT County Council send a letter on behalf of the Library to the appropriate Federal and Provincial Government departments indicating the support of the Federal Government's recently released report titled "The National Broadband Task Force". - Carried. Warden and Council Remuneration By-laws - Deputy Clerk The Deputy Clerk indicated Council had approved the remuneration method previously and by-laws should be adopted. The Director of Human Resources noted that the inflation rate for September was 3.1 % and 2002 stipends would increase by this amount. Moved by Councillor Rock Seconded by Councillor Crevits THAT By-Laws No. 98-4 and 98-5 be repealed and the necessary by-laws be prepared to include the following wording in Clause 2: "THAT the Warden's/Councillors' remuneration shall be adjusted automatically based on the provincial rate of inflation as determined in September each year." - Carried Tariff of Fees for land Division Consent Application - Deputy Clerk The fees the County charges for Consent Applications are low compared to other municipalities and currently do not meet the needs of the department. The Deputy Clerk also pointed out that due to a decrease in the number of applications being received, the budget for Land Division would most likely result in a shortfall at year-end unless numbers increase substantially. The Secretary-Treasurer's hours have been temporarily reduced to three days per week from five due to the decreased workload. County Council 5 October 23,2001 Moved by Councillor VanBrenk Seconded by Councillor Mcintyre THAT the Tariff of Fees for processing Land Severance Applications be amended as follows: a) Increase fees for Applications for Consent from $300.00 to $500.00 to reflect added administrative costs associated with processing the applications. b) All other associated fees shall remain the same as those contained in the present fee structure; and, THAT the necessary by-law be prepared. - Carried. MeetinQ with Town of Aylmer's Finance Committee - Chief Administrative Officer The Chief Administrative Officer reported that the letter to the Town of Aylmer may have caused confusion and has verbalized the full intent in this report. The C.AO. advised that staff from the County Departments should be present at the PowerPoint presentation to provide support and background information. Moved by Councillor Rock Seconded by Councillor VanBrenk THAT the report from the Chief Administrative Officer dated October 19th, 2001, entitled "Meeting With The Town of Aylmer's Finance Committee" be approved and sent to the Town of Aylmer with an invitation to meet with County Council and Officials at the County Administration Building at a mutually agreeable date and time in the future. - Carried. Procedural By-law - Other Business - Chief Administrative Officer The Chief Administrative Officer discussed the concern that introducing new business under the section entitled "Other Business" could lead to indelicate situations where Council has to vote on something without proper research. Moved by Councillor VanBrenk Seconded by Councillor Mcintyre THAT the report entitled "Procedural By-Law - Other Business" presented the Chief Administrative Officer, dated October 19, 2001, be received and filed. - Carried. CORRESPONDENCE Items for Consideration 1. Ann Mulvale, President, Association of Municipalities of Ontario, with a resolution calling for the Federal government to commit itself to higher levels of funding for public infrastructure; and AMO Member Communication ALERT, "AMO Asks Municipal Councils to Support Infrastructure Funding Strategy" request for support of the President of AMO's resolution. 2. Marilyn Carrie, Campaign Co-ordinator, YMCA St. Thomas-Elgin, with an invitation to a supervised HARD Hat tour through the construction site of the renovation and expansion of the facility. 3. Corporation of the County of Hastings, the Cities of Quinte West and Belleville, with a resolution asking that the Province increase the daily rate allotted to medical directors of long-term care facilities and provide subsidy for Doctors working in geriatric care. County Council 6 October 23,2001 4. Dan Sullivan, Clerk-Administrator, Municipality of Arran-Elderslie, with a resolution petitioning the Ontario Government to immediately provide reliable confirmation of OST AR funding levels to meet the new Ontario Drinking Water Regulations. 5. Municipality of Chatham-Kent, with a resolution asking for financial relief from the Ontario Ministry of Energy Science & Technology due to the economic implications to industry in Ontario in the form of significant increases in energy costs resulting from the debt of the Ontario Hydro. 6. Jack Layton, President, Federation of Canadian Municipalities, requesting Council to forward a resolution of support encouraging the provincial ministers to support the funding of an Affordable Housing program for low income households and to involve local municipal governments in the design and implementation of such programs. 7. Peter Hume, Chair Municipal Property Assessment Corporation Board of Directors, with information regarding the new governance framework of the Ontario Property Assessment Corporation and their availability to make Council presentations. The following recommendation was adopted respecting Correspondence Item #1 : Moved by Councillor Habkirk Seconded by Councillor Wilson WHEREAS public infrastructure is the backbone of a successful, dynamic economy; and, WHEREAS Federal and Provincial financial support is essential for public infrastructure upgrades, replacement and expansion; and, WHEREAS the current slowing of the economy combined with the tragic events of September 11, 2001 have created substantial uncertainty in the Canadian economy, particularly in Ontario; and, WHEREAS the Corporation of the County of Elgin welcomes the Ontario Government's renewed commitment towards supporting public infrastructure with its recent announcement of financial assistance for public transit and roads and bridges; and, WHEREAS the current Federal share of the Infrastructure Canada Program in Ontario is significantly less than that of the Province and municipalities; THEREFORE BE IT RESOLVED THAT the Corporation of the County of Elgin calls on the Federal Government to follow the Ontario Government's lead and commit itself to a higher level of funding for public infrastructure; and, THEREFORE BE IT RESOLVED THAT the Corporation of the County of Elgin calls on both the Federal and Provincial Governments to speed up the existing infrastructure funding process under the Canada-Ontario Infrastructure Program (COIP) and SuperBuild in order to provide a much needed economic stimulus in the face of the current economic downturn; and, FURTHER THAT the Corporation of the County of Elgin supports the call from the Association of Municipalities of Ontario for the Federal and Ontario Governments to return to a straightforward 1/3-1/3-1/3 funding formula for COIP and SuperBuild funded projects. - Carried. County Council 7 October 23,2001 Moved by Councillor Habkirk Seconded by Councillor VanBrenk THAT the Council of the County of Elgin supports the County of Hastings' resolution requesting the Ontario Government to increase the daily rate allotted to Medical Directors at long-term care facilities and provide subsidy for Doctors working in geriatric care. - Carried. The following recommendation was adopted respecting Correspondence Item #4. Councillor Mcintyre reported that he had attended a recent stakeholder meeting with Minister Flaherty and raised several questions about OST AR, which the Minister did not answer; however it was a good round table discussion. The following recommendation was adopted respecting Correspondence Item #5. Moved by Councillor Habkirk Seconded by Councillor Rock THAT the Council of the County of Elgin supports the Municipality of Chatham-Kent's resolution asking the Ontario Ministry of Energy, Science and Technology to consider the economic impact it would have on local business and residential customers by passing on to them the increase approved to pay down the stranded debt of the former Ontario Hydro. - Carried. The following recommendation was adopted respecting Correspondence Item #6. Moved by Councillor Habkirk Seconded by Councillor Crevits THAT the Council of the County of Elgin requests that the Province provide and fund programs for low income households, to devote significant new funds to this program and to involve municipal governments in designing and implementing the program locally. - Carried. AMO Member Communication ALERT - Ontario Municipalities Set to Get New Municipal Act. Moved by Councillor Habkirk Seconded by Councillor Rock THAT Correspondence Items #1-20 be received and filed. - Carried. Referring to Correspondence Item #19 on land ambulance funding, Councillor Habkirk noted that in the letter it mentions consulting with LAISC, however, he noted that meetings have been limited and a lack of communication exists. It would be beneficial to recall the committee to get this item on the front burner. Warden McPhail stated that as a result of ACRO, items are being forwarded to the Minister regarding arbitrated settlements and double-digit increases. The Western Ontario Wardens' Association sent a letter to the Minister in May and provided a copy to the Parliamentary Assistant, who assured action would be taken on the letter and we are awaiting a reply. OTHER BUSINESS Statements/InQuiries By Members Councillor Rock advised Council that the "9-11 Fallen Heroes Fund" fundraising committee has raised approximately $68,000 in the Elgin/St. Thomas area and a formal letter of appreciation to the County will be forthcoming. Moved by Councillor Rock Seconded by Councillor Wilson THAT senior staff be directed to meet with St. Thomas-Elgin General Hospital staff to discuss overages in the cost of operating the ambulance service in 2001; and THAT the Council strongly suggests the Hospital cover the expected overages through efficiencies prior to the end of the year. - Carried. The Manager of Engineering Services advised that Road #19, south of Jackson Line, in the Municipality of Bayham, had to be closed and a detour route put in place due to the collapse of a culvert.
