December 14, 2004 Minutes COUNTY COUNCIL Tuesday, December 14, 2004 The Elgin County Council met this day at the Administration Building, 450 Sunset Drive, St. Thomas at 7:00 P.M., as required by by-law, with all members present. The Chief Administrative Officer called the meeting to order and welcomed all in attendance to the Annual Warden's Election. ELECTION OF WARDEN The Chief Administrative Officer asked that members of Council wishing to run for the Office of Warden to please stand. Councillor's Acre and Mcintyre offered their candidacy for the position of Elgin County Warden for 2005. Each candidate was then given an opportunity to address Council in alphabetical order. BALLOTING PROCEDURES Ballots were cast and counted in the Warden's Chambers, in the presence of Mr. Don Lemon of Raven & Shaw, County Auditors. RESULTS The Chief Administrative Officer announced that the Warden of Elgin County for 2005 is James Mcintyre, Mayor of the Township of Southwold. Warden Mcintyre took the Declaration of Office and Oath of Allegiance, administered by the Chief Administrative Officer. The Warden left the room, was gowned and re-entered the Council Chambers, where he was officially presented with the Chain of Office, the Lord Elgin Watch and the Gavel of Office, by Immediate Past Warden Dave Rock. Warden Mcintyre delivered his Inaugural Address to Council, thanked them for their support, and outlined the items of interest and importance for consideration in 2005. Moved by Councillor Faulds Seconded by Councillor Hofhuis THAT the ballots used for the election of the 2005 Warden be destroyed. REPORTS ReQistered Nurse Preseptorship - Director of Human Resources Moved by Councillor Faulds Seconded by Councillor Wilson THAT the Directors of Homes and Senior Services and the Director of Human Resources be authorized to sign an agreement with Universities for students to carry out their consolidation in Elgin County Homes for the Aged; and, THAT staff prepare a letter of recognition signed by the Warden to present to those who complete their preseptorship with the County Homes. - Carried. County Council 3 December 16, 2004 Volunteer Policy - Director of Human Resources The Director of Human Resources explained that this policy is a matter of due diligence, to protect our Residents in our Homes for Seniors and patrons who use our Libraries, Archives and other public facilities. Council discussed concerns with the background checks and infringement on privacy, the time involved in getting the check done, and the impact this process may have in recruiting volunteers. The Director of Homes for Elgin Manor pointed out that effective January 1, 2005, the Homes would have no choice but to complete background checks as set out in Ministry legislation. Council asked staff to provide more information on the legislation and report back to a future meeting. Moved by Councillor Hofhuis Seconded by Councillor Rock THAT Human Resources Policy 3.80 "Volunteer Policy" be approved for immediate implementation; and, THAT the current volunteers be "Grandfathered" and not required to have a criminal check completed. - Carried. Excess Indemnity Insurance. Occupational Accident Insurance - Director of Human Resources Council noted that costs continue to rise even though the County has reduced the coverage and the Director explained this was because of claims exposure. Moved by Councillor Rock Seconded by Councillor Faulds THAT the 2005 rates for Excess Indemnity coverage and Occupational Accident coverage in the amount of $57,926 be approved. - Carried. Mid-Year Grant ReQuests and Solicitations for Sponsorship - Chief Administrative Officer The Chief Administrative Officer explained concerns with the current policy to Council. Moved by Councillor Wilson Seconded by Councillor Warwick THAT staff be directed to survey other municipalities and review policies on grants to outside organizations, and report back to Council on a recommended policy for Elgin County, prior to budget deliberations. - Carried. EIQin Group O.P.P. Contract - Chief Administrative Officer The Chief Administrative Officer requested Council's direction regarding appointments to the Elgin Group Police Services Board (EGPSB). Discussion commenced regarding a permanent appointment of one Municipality to the EGPSB based on percentage paid to the OPP contract and that the issue of Board structure should be addressed to ensure fair representation. Council consensus was that the matter should be dealt with by the EGPSB. Moved by Councillor Rock Seconded by Councillor Hofhuis THAT the matter of a permanent appointment to the Elgin Group Police Services Board (EGPSB) from the Municipality based on highest percentage paid to the OPP contract be referred to the EGPSB for consideration. - Carried. Moved by Councillor Rock Seconded by Councillor Hofhuis THAT the report entitled "Budget Comparison October 31,2004" dated November 26, 2004 from the Director of Financial Services be received and filed. - Carried. Thames EMS Proiected Contracts - Director of Financial Services The Director noted that the County has an agreement with Middlesex County for funding cross border ambulance service and Council commended staff for their efforts in the partnering relationship between Elgin and Middlesex. Council discussed whether the Township of Bayham area has sufficient coverage; the shortfall of Provincial funding as County Council 5 December 16, 2004 costs will continue to rise as people want more services; and the lack of funding for ambulance and volunteer fire department response calls on Highway 401. The County of Middlesex is pressuring the Ministry of Health concerning these funding issues and Council noted Elgin County should support the Middlesex initiative. Moved by Councillor Baldwin Seconded by Councillor Warwick THAT the Council for the County of Elgin request that the Ministry of Health address the funding shortfall to the Municipalities of Ontario for the provision of Land Ambulance services; and, THAT the Ministry of Health recognize the need to increase the funding to meet the continuing increase of costs for the provision of services; and, THAT this resolution be forwarded to Steve Peters, M.P.P. and AM.O., for support of this Issue. - Carried Unanimously. KinQ GeorQe Lift BridQe Electrical and Mechanical Rehabilitation - Director of EnQineerinQ Services The Director of Engineering Services advised Council that the work on the Bridge should be completed by March 2005. Council asked if it was possible to automate the bridge to eliminate the need for staffing and the Director of Engineering Services advised that current technology could not eliminate the need for staffing. Moved by Councillor Rock Seconded by Councillor Vowel THAT the Warden and the Chief Administrative Officer be authorized and directed to sign a contract with Comstock Canada in the amount of $324,245 for the King George Lift Bridge Electrical and Mechanical Rehabilitation Contract No. 6290-04-05; and further, THAT $400,000 for the King George Lift Bridge Electrical and Mechanical Rehabilitation be pre-approved to be included within the 2005 Capital Budget. - Carried. County Council 6 December 16, 2004 Lakeshore Line Class EA Completion. Municipality of Bayham - Director of EnQineerinQ Services Moved by Councillor Hofhuis Seconded by Councillor Faulds THAT the report "Lakeshore Line Class EA Completion, Municipality of Bayham" dated November 24,2004, from the Director of Engineering Services, be received and filed. - Carried. Road Network Study - Director of EnQineerinQ Services Council discussed the structure of local versus County Roads; the reallocation of responsibility for certain roads to the Lower-Tier; and cost impacts. Moved by Councillor Rock Seconded by Councillor Hofhuis THAT the report "Road Network Study" dated November 30,2004, from the Director of Engineering Services, be received and filed. - Carried. ReQuest to Fund Sidewalk on John Street - ManaQer of Road Infrastructure The Manager of Road Infrastructure advised Council of the current and past practice regarding allocation of funding for sidewalk installation by the County. Discussion followed concerning sidewalks installed in Port Stanley on Carlow Road by the County; and the intent of the reserve fund set up for infrastructure in the Progress and John Street area in Aylmer. Moved by Councillor Rock Seconded by Councillor Faulds THAT the request from the Town of Aylmer to allocate funding for a sidewalk installation project on John Street be respectfully denied; however, THAT the uncommitted funds remaining in the reserve (approximately $65,000) be released to the Town of Aylmer for use in the area approximating County roads for development within the Town's limits. - Carried Unanimously. Rumble Strip Policy Amendment - ManaQer of Road Infrastructure The Manager of Road Infrastructure responded to Council's questions concerning the liability to the County if the rumble strips are removed or the sound dampened, noting that this will not affect exposure or premiums. Moved by Councillor Hofhuis Seconded by Councillor Acre THAT the existing Rumble Strip Policy be amended to include the following clause: "Upon written request, staff may grant a municipality approval to dampen the sound created by rumble strips that do not meet the policy criteria, at the requesting municipality's cost". - Carried. SprinQwater Dam and Spillway - Director of EnQineerinQ Services Moved by Councillor Faulds Seconded by Councillor Vowel THAT a letter be forwarded to the Catfish Creek Conservation Authority to thank them for securing 50% funding for projects that assist the County of Elgin with road infrastructure; and, County Council 7 December 16, 2004 THAT the County of Elgin contribute 25% (to a maximum amount of $12,000) of the costs for the stability improvements, deck testing and additional riprap embankment protection on the Springwater Dam and Spillway; and further, THAT these funds be allocated from the Bridge Replacement Reserve. - Carried. Detour of HiQhway #3 Onto County of EIQin Roads for Construction - Director of EnQineerinQ Services Moved by Council Rock Seconded by Council Vowel THAT the Ministry of Transportation be notified that County Roads No. 35, 36 and 45 can be utilized for a temporary detour route for the reconstruction of Highway #3 from St. Thomas to Aylmer. - Carried. Local Health InteQration Networks Update - Director of Senior Services. EIQin Manor The Director of Senior Services for Elgin Manor advised that Elgin County would be included in the Southwest Health Integration Network, which would include three District Health Councils in the area. Council discussed concerns that the program is being hurried with Elgin County getting lost in the shuffle and this should not be allowed to happen without making the County of Elgin's concerns known. Moved by Councillor Baldwin Seconded by Councillor Wilson THAT the report "Local Health Integration Networks Update" dated December 1,2004, presented by the Director of Senior Services, Elgin Manor, be received and filed. - Carried. Auxiliary Donation - Director of Senior Services. Terrace LodQe Council suggested a letter or plaque be presented to the Auxiliary thanking them for the donation of the television to the Residents of Terrace Lodge. Moved by Councillor Wilson Seconded by Councillor Faulds THAT Council recognize the generous donation of a new television from the Terrace Lodge Auxiliary by way of a letter and presentation from the Warden. - Carried. CORRESPONDENCE Correspondence for Consideration 1. Township of South Algonquin, with a resolution requesting the Ontario Government to recognize the impact of the current municipal property assessment system of Current Value Assessment on property owners. 2. a) P.J. Leack, City Clerk, City of St. Thomas, with the nomination of Lorraine Vallee- Moczulski to the Elgin County Pioneer Museum Board. b) Madeline Jenkins, Secretary, Elgin County Women's Institute, with the nominations of Joan Mansell and Luella Monteith as representatives on the Elgin County Pioneer Museum Board. David Ryan, Mayor, City of Pickering, requesting a financial contribution from municipalities throughout Ontario to raise funds to purchase a Victoria Cross medal from an estate for donation to the Canada War Museum. 4. Joseph G. Pavelka, Chief Administrative Officer, Municipality of Chatham-Kent, with a resolution concerning the collection of POA revenues outside Chatham-Kent. 5. J.D. Leach, City Clerk, City of Vaughan, with a resolution requesting the government to clarify its position on the Ontario Health Premium as an increase to individual provincial income tax. 6. Lynda White, Warden, County of Wellington, requesting that the County of Elgin lobby its M.P.P. on the subject of permanent, transportation infrastructure funding. 7. The following recommendation was adopted respecting Correspondence Item #8: Moved by Councillor Rock Seconded by Councillor Wilson THAT Elgin County Council strongly objects to the further removal of health services from Elgin County to London and requests an update on the status of the promised Forensics Unit on the Campus; and further, THAT information be provided on the number of patients being served, the number of employees still employed and the planned utilization of the current facility now and in the future; and, THAT this resolution be forwarded to the M.P.P., the City of St. Thomas and Lower Tier Municipalities in the County of Elgin for their support. - Carried Unanimously. County Council 11 December 16, 2004 Moved by Councillor Faulds Seconded by Councillor Hofhuis THAT staff is directed to recruit for a contract Registered Dietician for the Homes for Seniors. - Carried. Moved by Councillor Rock Seconded by Councillor Warwick THAT the County's lease at 445-449 Talbot Street in St. Thomas be terminated, pending sixty days notice; and THAT the Elgin County Pioneer Museum be relocated to 32 Talbot Street in St. Thomas by the end of February 2005, with additional artifacts and records being stored in the basement of Elgin Manor, with expenses drawn from existing funds for Museum improvements to an upset limit of $12,000; and THAT public hours for the Pioneer Museum be modified to three days per week effective January 15\ 2005, with the understanding that the Museum Assistant will continue to provide temporary, full-time services at the discretion of the Director of Library Services; and THAT final authority for the disposal or return of artifacts deemed to be beyond the Pioneer Museum's mandate rest with the Manager of Archives; and THAT renovations to the 4th Floor of the Elgin County Administration Building proceed in 2005 as the future location for a County Museum pending the success of the County's re- positioned funding application under the former SuperBuild program, with the County contribution being $240,000; and THAT staff is directed to include $155,000 in the 2005 capital budget to cover the remaining balance of this obligation; and further THAT the services of Dr. Christine Castle be retained to act as facilitator for a meeting with the Elgin County Pioneer Museum, the Elgin Military Museum and the Elgin County Railway Museum, in January 2005 to determine the future mandate and services of a County Museum for Council's consideration, with an upset limit of $2000 drawn from existing funds for Museum improvements. - Carried. Moved by Councillor Wilson Seconded by Councillor Rock THAT Elgin County Council supports the development of a Senior Citizen Apartment complex on land adjacent to the Bobier Villa as proposed by the Dutton and District Lion's Club; and, THAT the County of Elgin declares said lands as surplus to its needs; and, THAT said lands be sold to the Municipality of Dutton/Dunwich for a nominal fee; and, THAT all costs associated with the land transaction (legal, survey etc.) be borne by the developer; and the County be included in the planning of the complex including but not limited to determining the exact location of the development in connection with Bobier Villa. - Carried.
