COUNTY COUNCIL
Tuesday, January 25, 2005
The Elgin County Council met this day at the Administration Building, at 9:04 AM. in
accordance with adjournment, with all members present except Councillor Rock.
Warden Mcintyre in the Chair.
Warden Mcintyre requested that Councillors stand for a Moment of Silence to reflect on
the people that died and the devastation caused by the recent Tsunami disaster in Asia.
Warden Mcintyre extended Council's deepest sympathies to Mrs. Linda Veger, Director of
Financial Services, in the recent loss of her father.
Councillor Warwick noted that an amendment was required to the In-Camera portion of the
December 16, 2004 Minutes on page 11 dealing with the Museum Accommodation/
Stakeholder Meeting. The last paragraph of the resolution should be amended to include
"other public museums in Elgin County".

REPORTS
Policy Amendment 1.10 Application - Director of Human Resources
Councillors discussed that Council's responsibility for hiring of employees is for the Chief
Administrative Officer only and another venue should be found rather than this policy to
meet the nepotism legislation. Wording should indicate that Councillors or their families
should not be related to the Chief Administrative Officer. The Chief Administrative Officer
noted that Council is occassionally involved in the hiring of Directors, therefore the policy
should recognize this fact.

their quoted price of $6,496.00 for 2005 and $6,692.00 for 2006 (plus GST).

THAT Johnson Controls be awarded the contract for the Building Automation Services for
HVAC Systems for the Administration Building, Terrace Lodge and Elgin Manor, effective
January 1,2005 to December 31,2007 at their quoted price of $7,790.67 for 2005,
$8,025.00 for 2006, and $8,265.75 for 2007 (GST included); and,
THAT the Warden and the Chief Administrative Officer be authorized to execute a three-
year Service Agreement effective January 1,2005 to December 31,2007 with Johnson
Controls for the Building Automation Services for the HVAC Systems.

Capital Proiects BudQet Summary 2004 - Financial Analyst and Director of
EnQineerinQ Services
The Financial Analyst noted that the 4th quarter GST rebate would be applied to 2004 once
known and the surplus could remain in Capital Projects budgets or allocated elsewhere,
upon direction by Council.

THAT a report regarding the additional 2004 GST expected amounts be presented to
Council after the actuals have been determined; and,
THAT the outline of 2004 Completed and Reduced Projects that are ready to be closed
(Appendix B) be approved as presented; and,
THAT the outline of 2004 Carryforward Projects (Appendix C) be approved as presented;
and,
THAT the 2004 surplus of $338,777.64 be added to project 9000-01 "Carryover from
Closed Projects" for future consideration.

Mayor's Task Force on Rural School Issues - Chief Administrative Officer
The Chief Administrative Officer presented terms of reference to be used when
considering rural school issues. Councillors noted the wording for the Terms of Reference
was prepared to be specific to the mandate of the task force to focus on issues that would
not be perceived as taking over someone else's responsibility.

Endorsement of Best Practices under the National Guide for Sustainable Municipal
Infrastructures - Director of EnQineerinQ Services
The Director of Engineering Services assured Council that the adoption of these standards
would not commit the County to additional expenditures.

The Ambulance and Emergency Management Co-Ordinator defined Code 3 and 4 calls for
Council's information.

Archives 2004 Annual Report - ManaQer of Archives and Director of Library Services
The Archivist thanked Council for their support of Archives activities over the past year and
advised that the Archives' services are becoming better known and patron numbers are
increasing. Council congratulated the Manager of Archives on a very successful year and the
professionalism in the performance of his duties. Increased spacing requirements of up to 1500
sq. ft. for the Archives was discussed and would be reviewed in the design phase when Museum
renovations are carried out on the 4th floor. The Archivist responded to questions from Council,
noting that a donations box has been placed on the reference desk and users would be
encouraged for donations to the Archives, especially on-line users.

Ontario Trillium Foundation -Small Community Libraries - Director of Library
Services
The Director of Library Services advised that County Libraries are unique in that municipalities
own the buildings and the County provides the library service. Only one grant is available per
Municipality and the County cannot apply for a grant if the Municipality applies.

Trillium Foundation, the Director of Library Services be authorized and directed to

EnhancinQ Quality of Life for Alzheimer's' Residents at Terrace LodQe - Director of
EnQineerinQ Services and Director of Senior Services. Terrace LodQe
Staff noted that the funds have been included for consideration in the 2005 capital budget
and that in 8-10 years time, a long-term solution may be required for Terrace Lodge.

Staff noted the increase in CMI is partly a result of concentrated documentation and an
automated GoldCare System should produce improved documentation and may provide
for increased funding in 2005.

The Human Resources Director noted an arbitration matter is ongoing regarding the
Ontario Health Premium legislation. The Chief Administrative Officer noted a meeting was
held with the Hon. Sorbara, Minister of Finance, who indicated that he felt the matter was
drawing to a close.

OTHER BUSINESS
Statements/InQuiries by Members
Councillor Hofhuis announced that a newly formed Elgin Rowing Committee would be
forwarding letters shortly requesting endorsement of their activities by Councils in order to
qualify for a Trillium Foundation grant.
Councillor Wilson spoke to concerns regarding volunteer fire fighters being stopped at
emergency road closures by the OPP and read a motion to be forwarded to the Elgin Group
Police Services Board for support. Liability and recognition issues need to be clarified and the
fire chiefs and Staff Sergeant Cox of the OPP are looking into legislation issues. Council
requested Warden Mcintyre raise this matter at the Western Ontario Wardens and Eastern
Ontario Wardens joint meeting at the ROMAlOGRA Conference in February.

THAT the Elgin Group Police Services Board be encouraged to solicit a change to the
applicable legislation to enable the Ontario Provincial Police to permit emergency services
personnel to access roadways that have been closed to traffic; and,
THAT copies of this resolution be sent to local municipalities, the Western Wardens and
Eastern Warden's Associations and the local M.P.P. for support.

Councillor Baldwin asked that any municipalities who may be considering authorizing their
Clerks to conduct marriage services at the lower-tier municipal offices as authorized by
recent legislation to contact him.

DELEGATIONS
Mr. Bryce Sibbick, Regional Manager, Frank Cowan Company Limited, attended at 11:48
AM. to present the County's 2005 Insurance Renewal. Mr. Sibbick noted that the
County's insurance premium has increased by approximately 1.1 % over 2004 rates and
advised that Council could consider increasing the deductible to $25,000, which would
result in a premium reduction of $10,298. Council discussed with Mr. Sibbick the

implications and liability of volunteer fire fighters responding in their personal vehicle to an
emergency and not being allowed by the OPP to use a road that has been closed due to
the emergency. Mr. Sibbick advised that the volunteers personal insurance would apply in
the event of an accident and the municipality's insurance would only cover the excess
amount. As well, the volunteers are still governed by the Highway Traffic Act and charges
could occur if the volunteers were speeding etc. The Warden thanked the delegation for
the presentation and invited Mr. Sibbick to lunch with Council.

THAT the County's Comprehensive Insurance Program for 2005 be renewed with the
Frank Cowan Company Ltd. in the amount of $182,035 plus applicable taxes.

The Chief Administrative Officer provided an overview of the budget process, noting this
was the beginning of the review and no decisions would be required for today. The overall
budget presently sits at a 5.44% increase over 2004.
CAPITAL BUDGET
Council reviewed the 2005 Proposed Capital Budget department by department.
Council requested information on the following for the meeting on February 15th, 2005:
The outstanding financing debt for Elgin Manor, two ambulance stations, the Health
Unit purchase and when these debts would be retired
The Interest rate for borrowing for these projects - is it a variable rate or fixed - how
would a rate increase affect our finances
Payments to MPAC - does the County pay for MPAC alone or do municipalities pay also
Staff expressed concern that a building condition study has not been carried out at the
Elgin-St. Thomas Health Unit, even though it had been suggested. The County members
on the Health Unit Board will raise the issue of including the facilities study in the Health
Unit budget at a future meeting. Staff noted that the study is a good planning and financial
tool that may help predict and plan for future costs and repairs. Moreover, maintaining the
building in good repair will serve the County well when the Health Unit lease expires.
