Correspondence was received from the Lower Thames Valley Conservation Authority which indicated no objection and advised that a small portion of the subject property is located in an area with a Highly Vulnerable Aquifer as identified in the Source Water Protection Plan. The proposed amendment would change the zoning of lands lying on the east side of McPherson Road north of Pioneer Line, being part of Lot A, Concession Vlll,from the Agricultural(Al)Zone to the Special Agricultural (A2)Zone and to a'site-specific' Agricultural(A1-#)Zone. The amendment would also fulfill a condition imposed by the County of Elgin Land Division Committee in granting Application for Consent E 88113 to dispose the surplus farm dwelling situated on the lands. The lands proposed to be rezoned Special Agricultural(A2) comprise an area of 8,330 square metres(2.1 acres), a frontage of 86.9 metres(285 ft)and a depth of 108.8 metres(357 ft). The parcel is occupied by a single unit dwelling, detached garage and shed. No change in use is proposed.The lot would.satisfy the minimum lot area, maximum lot area and minimum lot frontage requirements (4,000 sq m, 1.0 ha and 50 m respectively) of the A2 zone.All other requirements are capable of being satisfied. No change in use is proposed.The lot would satisfy the minimum lot area, maximum lot area and minimum lot frontage requirements(4,000 sq m, 1.0 ha and 50 m respectively) of the A2 zone.All other requirements are capable of being satisfied. Permitted uses of the A2 zone include a single unit detached dwelling, bed and breakfast establishment, agricultural use as an accessory use, and an accessory use. Water which has passed through the microstrainers is pumped to one of four(4) membrane filtration racks each rated at 75 L/s net capacity.The filtration racks also consist of individual flow and turbidity meters.The SCADA system is programmed so that there is an automatic shutdown when turbidity from the individual filter racks exceed 0.3 NTU for 600 seconds (10 minutes). There is a backwash and secondary recovery system in place which consists of one(1) 17m' reverse filtrate recovery tank,two(2) reverse filtrate(backwash)pumps, two (2) reverse filtrate recovery (backwash recovery)pumps and two (2) reverse filtrate recovery strainer(strainer backwash recovery)together with appropriate valving and piping. Sodium hypochlorite solution addition for primary and secondary disinfection occurs upstream of the treated water reservoir for primary disinfection and downstream of the high-lift pumps for secondary disinfection residual maintenance. Sodium hypochlorite for primary disinfection is applied by one of two (2)chemical metering pumps, each rated at 150L/hr prior to entering one of two(2)2,276m' above grade glass fused steel storage tanks.Trim sodium hypochlorite addition is applied by one of two (2)chemical metering pumps, each rated at 60L/hr. The flow measuring devices for the West Elgin Drinking Water system were verified/calibrated in April and May 2013. * The owner Was in compliance with the conditions associated with maximum flow rate or the rated capacity conditions in the Permit and Licence or Approval Issued under Part V of the SDWA. As specified within the Municipal Drinking Water Licence(Licence No. 043-101, Issue No. 2) Schedule C (System-Specific Conditions), the Rated Capacity, or maximum daily volume of treated water that flows from the treatment subsystem to the distribution system is 12,160 cubic metres per day for the West Elgin Drinking Water System and 1,600 cubic metres per day for the Iona Interconnect. The Rated Capacity was not exceeded for the inspection period from December 1, 2012 to December 31, 2013. * Records of flows and any capacity exceedances were made in accordance with the Permit and Licence or Approval issued under Part V of the SDWA. The OCWA Facility Work Order Summary from December 1, 2012 to December 31, 2013 provides the work order number, equipment identification/description, activity description and scheduling/completion dates as well as comments of activity upon its completion. TREATMENT PROCg.S MO ITORINg. * Primary disinfection chlorine monitoring was being conducted at a location approved by Permit, Licence or,Approval Issued under Part V of the SDWA,or at/near a location where the intended CT had just been achieved. * Operators were aware of the operational criteria necessary to achieve primary disinfection within the drinking water system. The West Elgin Water Treatment Plant SCADA system has a CT Calculator which provides real time CT calculations. OCWA operators monitor this information daily. It also contains a feature that allows operators to input data to calculate CT and make any changes to the parameter, if required. In addition,the operators calculate CT for the worst case scenario for the month. After reviewing the monthly reports, they select worst case parameters which include highest pH, highest flow, lowest storage tank level, lowest chlorine residual and lowest temperature. They use a worksheet to assist them in calculating CT. This exercise increases the operators awareness of the operational criteria necessary to achieve primary disinfection within the drinking water system. * Continuous monitoring of each filter effluent line was being performed for turbidity. * The secondary disinfectant residual was measured as required for the distribution system. The process wastewater from the water treatment process is collected in a concrete settling tank at the rear of the plant. Gravity overflow from the settling tank allows the effluent to discharge into a constructed wetland prior to discharge into a municipal drain. * The process wastewater discharge quality and discharge monitoring program complied requirements established in the Permit and Licence or Approval issued under Part V of the SDWA. The Corporation of the Municipality of West Elgin instituted a backflow prevention by-law initially in 2002 (By-Law 2002-62). The by-law was amended on a few occasions since its initial creation. The current by-law is designated as By-Law 2009-66 and includes an implementation schedule based on the degree of hazard. Records pertinent to the by-law are maintained at the West Elgin Municipal Office in Rodney. * The owner had a program or maintained a schedule for routine cleanout, inspection and maintenance of reservoirs and elevated storage tanks within the distribution system. * Existing parts of the distribution system that were taken out of service for inspection, repair or other activities that may lead to contamination,and all new parts of the distribution system that came in contact with drinking water,were disinfected in accordance with Schedule B, Condition 2.3 of the Drinking Water Works Permit. * The owner had implemented a program for the flushing of watermains as per industry standards. The operating authority flushes watermains in the spring and fall. In addition, the operational staff maintain records for 12 auto-flushers strategically installed throughout the distribution system. The auto-flushers are inspected regularly and calibrated as required for water flow to maintain adequate chlorine residual within the distribution system. * Records confirmed that disinfectant residuals were routinely checked at the extremities and dead ends of the distribution system. * A program was in place for inspecting and exercising valves. * There was a program in place for inspecting and operating hydrants. The operating authority inspects and operates hydrants twice per year typically in the spring and fall. * There was a by-law or policy in place limiting access to hydrants. There is no bylaw in place at the present however the Municipality only allows under rare circumstances a contractor to connect to a hydrant and only with a backflow preventer and a water meter. * The owner has not undertaken efforts to identify,quantify and reduce sources of apparent water loss. No formal leak detection program is in place for the West Elgin distribution system. Leaks are usually reported by residents based on observations of excess water volume rising rapidly to the surface or from reports by the water treatment plant operations staff of excess flow through a meter, a reduction in water pressure or rapid drops in the water tank elevations. * The distribution system pressure was monitored to alert the operator of conditions which may have lead to loss of pressure below the value under which the system is designed to operate. OCWA monitors pressure at the Iona interconnect, two(2)forcemains at Eagle and water tower storage facilities in Rodney, West Lorne and at the water treatment plant through the SCADA system. The West Elgin DWS is categorized as a Large Municipal Residential Drinking Water System. The West Elgin DWS is made up of the West Elgin Water Treatment Plant and Distribution System. The Distribution System was operated by the West Elgin Water Department until May 1,2013. At this time the Ontario Clean Water Agency began operating the entire West Elgin DWS. The West Elgin DWS operated in accordance with the Municipal Drinking Water Licence 043-101(issue 2: June 4,2010), Drinking Water Works Permit 043-201(Issue 2:June 4,2010)and Permit to Take Water 0515-8L9GX7 (issued September 1,2011). This report was prepared by The Ontario Clean Water Agency on behalf of the Municipality of West Elgin and must be supplied to the West Elgin Municipal Council by March 31, 2014. SECTION 2: Compliance The West Elgin DWS was operated and maintained in such a manner that treated water supplied to the consumers serviced by the system satisfied Ontario Drinking Water Quality Standards. However,some of the regulatory requirements were not met as identified in the MOE inspection Report. The routine inspection was conducted on February 11,2013 by the MOE and no Ministry of the Environment Provincial Officer's Orders were issued. There were 12 non-compliances with regulatory requirements identified in the inspection report. Eleven of the twelve were for the West Elgin Distribution system;the last one was for the West Elgin WTP. The overall inspection rating was 88.95% for the entire West Elgin Drinking Water System. The non-compliance with regulatory requirements and actions required for the West Elgin DWS as appeared in the Inspection Report was: 1. Records did not indicate that the treatment equipment was operated in a manner that achieved the design capabilities required under Ontario Regulation 170103 or a Permit, Licence or Approval issued under Part V of the SDWA at all times that water was being supplied to consumers. On August 31, 2012,the West Elgin Treatment Plant experienced raw water quality issues at the plant due to heavy organic loading from a Lake Erie thermal inversion (overturn). As a consequence of the event, membrane filtrate appeared colored and caused elevated turbidity readings above the regulatory threshold.The operating authority reported the turbidity exceedance to Ministry of the Environment(MOE) Spills Action Centre (SAC) (Adverse Water Quality Incident(AWQI)#108285).There was a similar occurrence on September 9, 2012 that also caused the turbidity to exceed the regulatory threshold (AWQI#108358). The addition of sodium hypochlorite and hydrogen peroxide downstream from the membrane filters and membrane effluent turbidimeters intensified the yellow color in the drinking water causing the aesthetics of the water to West Elgin Drinking Water System Annual Summary Page 1 of 8 deteriorate.The operating authorities applied operational strategies(flushing)to manage the situation in the distribution system. Under the direction of the Elgin St.Thomas Public Health Unit and in consultation with the MOE London Office, additional microbiological monitoring was undertaken within the distribution system. Other corrective action to eliminate the colored water from the system included replacing the water in the storage tanks at the water treatment plant by applying an overflow procedure. As a result of the incidents described above,the treatment process did not meet criterion specified in the Procedures for Disinfection of Drinking Water in Ontario for Membrane Filtration(s. 3.4.6)for the month of September, 2012. The membrane filtration process must meet the performance criterion for filtered water turbidity of less than or equal to 0.1 NTU in 99%of the measurements each month.When OCWA determined that the criterion was not met,The MOE SAC was notified. This resulted in the issuance of an Adverse Water Quality Incident(AWQI#108723)on October 1, 2012. Actions)Required: The author of this report recommends that the owner and operating authority investigate the incident to determine if additional corrective and preventive actions, other than those implemented during the events, should be considered that are appropriate for the magnitude of the problem and the impacts on the treatment process.The corrective and preventive action that may be considered could include the addition of treatment . equipment or processes as well as operational procedures to manage the situation in the future. 2. Logs for the drinking water subsystem(s)did not contain the required information. An operator-in-charge (OIC)or a person authorized by an OIC shall record the following information in the logs or other record-keeping mechanisms in respect of each operating shift: 1.The date,the time of day the shift began and ended and the number or designation of the shift. 2. The names of all operators on duty during the shift. 3.Any departures from normal operating procedures that occurred during the shift and the time they occurred. 4.Any special instructions that were given during the shift to depart from normal operating procedures and the person who gave the instructions. 5.Any unusual or abnormal conditions that were observed in the subsystem during the shift, any action that was taken and any conclusions drawn from the observations.6. Any equipment that was taken out of service or ceased to operate during the shift and any action taken to maintain or repair equipment during the shift. (0. Reg. 128104, s. 27 (5)). During the inspection, it was observed that on multiple occasions there were no entries in the West Elgin distribution system logbook maintained at the Rodney Tower that show an individual was assigned the duties of an OIC. It is verified that the owner and operating authority did not maintain a schedule to designate an OIC for the distribution system. It was also observed that information pertaining to the watermain construction in late May through to early August of 2012 was not recorded in the logbook as per 0. Reg. 128104 s. 27(5). Action(s) Required: Since this issue was brought to the attention of owner and operating authority, a number of changes have been instituted by the municipality to correct and mitigate issues arising from log entries by staff operating the West Elgin distribution system.According to the owner and operating authority, the following changes have been initiated: -procedural changes to the DWQMS Operational Plan for scheduling and assigning staff for Overall Responsible Operator(ORO)and Operator-In-Charge (OIC)duties, West Elgin Drinking Water System Annual Summary Page 2 of 8 -administrative procedures for scheduling and assigning ORO responsibilities, -on-the-job staff training to review logbook record-keeping requirements as per 0. Reg. 128104 s. 27, and -monthly meetings between the Municipal Administrator/Treasurer and operational staff to review water management issues within the West Elgin Water Supply System. A review of the effectiveness of the above corrective actions will occur during the 2014 MOE inspection. 3. The record system did not allow the reader to unambiguously identify the person who made the logbook entry. A person who makes an entry in a log or other record-keeping mechanism shall do so in a manner that permits the person to be unambiguously identified as the maker of the entry(0. Reg. 128104 s. 27. (4)). There were entries made in the West Elgin distribution system logbook maintained at the Rodney Tower that does not identify the maker of the entry. More specifically,these incidents occurred on August 30, September 4, 7, 12, 20, October 15, 24, 31, November 7, Action(s) Required: According to the owner and operating authority, training for the West Elgin distribution system operational staff on the requirements specified in 0. Reg. 128104 s. 27 have been completed.As referenced in another section of this report,the owner now meets regularly with operational staff to review activities and issues related to the operation of the system. A review of the effectiveness of the above corrective actions will occur during the 2014 MOE inspection. 4. Entries in the logbook were not always made by appropriate and authorized personnel. No person shall make an entry in a log or other record-keeping mechanism unless the person is an overall responsible operator, an operator-in-charge or is authorized to make an entry by the owner,the operating authority, the overall responsible operator or an operator-in-charge(0. Reg. 128104, s.27 (3)). An individual without a valid operators licence signed the logbook as an operator and/or an Overall Responsible Operator(ORO)on June 7, July 16, 31 and August 20,21 of 2012. Action(s) Required: The owner and operating authority shall ensure that recording-keeping entries into West Elgin distribution logbooks maintained at the Rodney Tower are made by individuals authorized to do so under 0. Reg.128/04 s. 27. A review of the effectiveness of the above corrective actions will occur during the 2014 MOE inspection. 6. For every required operational test and every required sample, a record was not made of the date,time,location,name of the person conducting the test and result of the test. The owner and the operating authority for the drinking water system shall ensure that,for every sample required by 0. Reg. 170103, a record is made of the date and time the West Elgin Drinking Water System Annual Summary Page 3 of 8 sample was taken,the location where the sample was taken and the name of the person who took the sample (0. Reg. 170103 Schedule 6 s. 6-10 (1)2.) The operating authority did not record the times for chorine residual testing as per 0. Reg. 170/03 Schedule 7 s.7-2. (3). Action(s)Required: The owner and operating authority for the distribution system shall record the time for very sample collected and tested under 0. Reg. 170103 as prescribed under 0. Reg. 170103 Schedule 6 s. 6-10 (1) Compliance with this requirement will be assessed during the 2014 Ministry of the Environment drinking water inspection. 6. The overall responsible operator had not been designated for each subsystem. The owner or operating authority of a municipal residential subsystem shall designate an Overall Responsible Operator(ORO) of the subsystem who holds a certificate for that type of subsystem of the same class or higher class for the subsystem (0. Reg. 128104 s. 23 (l)). During the inspection, it was observed that on multiple occasions there were no entries in the West Elgin distribution system logbook maintained at the Rodney Tower that show an individual was assigned the duties of an ORO. More specifically,the logbook did not indicate an individual assigned the duties and responsibilities of ORO during 2012 for the following dates: January 27, February 3,20, March 15-16,April 11-13, May 25, 31,June 1-3,7-10, 16, 23,24, 29, 30,July 1, 5, 7, 8, 14, 15-31,August 1-21, 22-26. It is verified that the owner and operating authority did not maintain a schedule to designate an ORO for the distribution system. System logbook records show an individual made an entry in the system logbook as an ORO that was not a certified operator. Based on logbook entries,the individual acted as the ORO with an expired licence on July 16 and August 20 and 21. The licence expired on May 31, 2012. During the time period between June 1, 2012 to August 26,2012,the individual acted on behalf of water department for the municipality and: -communicate information to the Ontario Clean Water Agency(OCWA)staff that allowed the municipal staff to undertake activities to manage operations within the distribution system, and -communicated with the Ministry of the Environment staff as a representative of the municipal drinking water system during the management of an adverse water quality incident(AWQI#106829) and the selection of an accreditation body(June 25-29, 2012). Action(s) Required: The owner and operating authority for the West Elgin distribution system shall ensure that following: -every operator employed in the subsystem holds a certificate applicable to that type of subsystem (O.Reg. 128104 s.22. (a)), and -an overall responsible operator is designated for the subsystem holds a certificate for that type of subsystem and that it is the same class as, or higher than,the class of that subsystem (0. Reg. 128104 s.23. (1)). According to the owner and operating authority, administrative and procedural changes have been instituted to continually improve the management of the human resources for the water system. These are summarized in other areas of this report.The Ministry will verify compliance with O. Reg. 128104 s.23(1)during the 2014 inspection. West Elgin Drinking Water System Annual Summary Page 4 of 8 7. Operators In charge had not been designated for all subsystems which comprised the drinking water-system. The owner or operating authority of a subsystem or a person authorized by the owner or operating authority shall designate one or more operators as operators-in-charge(OIC)of the subsystem (0. Reg. 128104 s. 25. (1)), During the inspection, it was observed that on multiple occasions there were no entries in the West Elgin distribution system logbook maintained at the Rodney Tower that show an individual acted as, or was assigned the duties of an OIC. More specifically,the logbook did not indicate an individual assigned the duties and responsibilities of OiC during 2012 for the following dates: February 28, March 9, 29,April 5, 18, 19,25,27,June 2-9, 11, 12, 14, 15, 17, 18-22, 25, 28, 30,July 1-7, 9, 10, 12, 13, 27,August 3, 5, 22, 23 and 25. It is verified that the owner or operating authority did not maintain a schedule to designate an OIC for the distribution system. Action(s) Required: The owner and operating authority of the West Elgin distribution system or person authorized by the owner or operating authority of the West Elgin distribution system shall designate one or more operators as Operators-In-Charge(OlC)of the subsystem (0. Reg. 128104 s. 25. (1)). The owner and operating authority or person authorized by the owner of operating authority shall ensure that records are maintained of the amount of time each operator works as an OIC (0. Reg. 128104 s. 25 (2)). According to the owner and operating authority, administrative and procedural changes have been instituted to continually improve the management of the human resources for the water system. These are summarized in other areas of this report. Compliance with 0. Reg. 128104 s. 25 (1)and (2)will be reviewed in the 2014 Ministry of the Environment water inspection. 8. All operators did not possess the required certification. The owner or operating authority of a subsystem shall ensure that every operator employed in the subsystem hold a certificate applicable to that type of system (0. Reg. 128104 s.22. (a)), An operator employed by the municipality that acts as the Overall Responsible Operator (ORO)for the distribution system operated without an operators licence from June 1, 2012 to August 27, 2012.The owner and operating authority notified the Ministry of the Environment London Office of this situation on November 27,2012. The owner and operating authority informed the Ministry that the individual was relieved of operator duties pending renewal of the operator certificate. They also notified the Ministry that an operator with the required qualifications was designated as the Overall Responsible Operator since August 28, 2012, Action(s) Required: The owner and operating authority of the distribution system shall ensure that every operator employed in the subsystem: -holds a certificate applicable to that type of subsystem (O. Reg. 128104 s.22. (a)), or -holds a certificate applicable to that subsystem, in the case of an operator who holds a conditional certificate issued or renewed under 0. Reg. 128104 s. 10 (0. Reg. 128104 s. 22. (b).The Ministry shall verify that operators meet certification requirements during the 2014 inspection. West Elgin Drinking Water System Annual Summary Page 5 of 8 9. An adequately licenced operator was not designated to act in place of the overall responsible operator when the overall responsible operator was unable to act. The owner or operating authority of a municipal residential subsystem shall designate an Overall Responsible Operator(ORO)of the subsystem who holds a certificate for that type of subsystem of the same class or higher class for the subsystem (0. Reg. 128104 s. 23(l)). As reviewed and stated previously in this report, it was observed that on multiple occasions there were no entries in the West Elgin distribution system logbook maintained at the Rodney Tower that show an individual was assigned the duties of an ORO. It is verified that the owner and operating authority did not maintain a schedule to designate an ORO for the distribution system.Therefore,the identity of the ORO for those occasions cannot be determined. Action(s) Required: The owner and operating authority shall take action to ensure an adequately licensed operator for the West Elgin distribution system is designated to act in place of the Overall Responsible Operator as per O.Reg. 128104 s. 23 (1). The actions taken by the owner and operating authority will be reviewed during the next annual Ministry of the Environment drinking water system inspection. 10. All sampling requirements for lead prescribed by schedule 15.1 of O. Reg. 170103 were not met. The owner did not meet the sampling requirement for Column 3 (Number of Sampliing Points in Plumbing that Serves Private Residences)as prescribed in O. Reg. 170103 Schedule 15.1 s. 15.1-5. (3) (a).The owner collected and tested samples from 19 residences instead of the required 20.The Ministry of the Environment was notified of the error by the owner. No further action to correct the situation is required. The owner was advised through the inspection process to submit the Schedule 15.1 results to the Ministry of the Environment using the form specified in 0. Reg. 170103 Schedule 15.1 s. 15.1-9. (8.1). Action(s)Required: The owner and operating authority for the West Elgin distribution system has satisfied the requirements specified by the Ministry of the Environment with respect the O. Reg. 170103 Schedule 15.1-9. (6.1). No further action is required.. 11. All changes to the system registration information were not provided within ten (10) days of the change. During a review of the Drinking Water Information System profile, it was observed that Drinking Water System Owner Information was not correctly identified.When brought to the attention of the owner, updated information was submitted to the Ministry of the Environment. Action(s) Required: The owner for the West Elgin Drinking Water System has updated information for the Drinking Water Information System profile that identifies Drinking Water System Owner Information as per O. Reg. 170103 s. 10.1 (3). No further action is required. West Elgin Drinking Water System Annual Summary Page 6 of 8 12. The following instance(s)of non-compliance were also noted during the inspection: During the review of the Rodney Tower storage tank data and operator logbook entries, it was found that the storage facility was unable to maintain sufficient free chlorine residuals (above 0.20 mg/L)on numerous occasions during the summer months of 2012 to ensure secondary disinfection levels as prescribed in the"Procedure for Disinfection of Drinking Water in Ontario".The Procedure states that the recommended optimum target for free chlorine concentration in the distribution system is 0.20 mg/L. Irregular and wide fluctuations in the chlorine levels were also observed at the Rodney Tower throughout the inspection period. In accordance with 0. Reg. 170103 Schedule 1- 5,the owner must ensure the following conditions have been met regarding secondary disinfection: "The owner of a drinking water system shall ensure provision of, (a)water treatment equipment that is designed to be capable of secondary disinfection using chlorination or chloramination in accordance with the Ministry's Procedure for Disinfection of Drinking Water in Ontario and that is designed to be capable of achieving, at all locations within the distribution system, (i)a free chlorine residual of 0.2 milligrams per litre, if the drinking water system provides chlorination and does not provide chloramination, or(ii) a combined chlorine residual of 1.0 milligrams per litre, if the drinking water system provides chloramination; or(b) other water treatment equipment that, in the Director's opinion, is designed to be capable of providing secondary disinfection that is equivalent to or better than the secondary disinfection provided by the equipment described in clause (a) Action(s)Required: To ensure that the free chlorine residual is maintained(>0.02 mg/L) in water contained in, and from the Rodney Tower,the Owner shall forthwith retain the services of a qualified individual to assess the West Elgin Water Supply System design capabilities to meet with the secondary disinfection requirements as per O. Reg. 170103 Schedule 1-5.A comprehensive investigation and review must be completed to address operational challenges (secondary disinfection chlorination decay)to ensure that a persistent secondary disinfection residual can be maintained to reduce the potential of microbial contamination within the distribution system. Findings from the above assessment should be implemented to improve the general operating requirements and reduce any limitations to ensure secondary disinfection of the West Elgin Water Supply System can be met.The Owner shall provide a summary report of the findings and evaluation to author of this report by April 30,2013, SECTION 3: Corrective Action The non-compliances identified in the MOE Inspection Report for the West Elgin DWS were all addressed as follows. 1. Corrective actions were taken at the Water Treatment Plant in order to try and manage should a coloured water event occur again. This has included regular sampling for manganese and iron of the raw and treated water;colour,taste and odour inspections; monitoring of dissolved oxygen of the raw water during a possible event. The Tri-county Management Committee has requested a report from OCWA Engineering Services to review the 2012 event and make recommendations on treatment options. 2. Corrective action was taken immediately by the owner to address non-compliances 2-9 will be evaluated by the MOE in the 2014 inspection. West Elgin Drinking Water System Annual Summary Page 7 of 8 _I 3. There were no required actions for the missed lead plumbing sample because notification was made at the time of the incident. 4. The Drinking Water Information System was updated by the owner as soon as it was brought to their attention and no further actions were required by the MOE. - S. Stantec was hired to assess the Rodney Tower operation and provide recommendations to maintain a free chlorine residual of 0.2mg/L In the distribution system. The report was forwarded to the MOE on April 30, 2013 to address the non-compliance. Considerations for implementation of the recommendations will be made upon receiving capital costs from the engineers. SECTION 4: Summary and Discussion of Quantity of Water Supplied In accordance with Schedule 22-2(3)find a summary and discussion of the quantity of water supplied . during the reporting period compared to the rated capacity specified in the MDWL, DWWP and Permit to Take Water,including monthly average and maximum daily flows. Attached as Appendix A,find a summary of the raw flows including total,average,and maximum daily flows,and peak flow rates for the reporting period. As well,a comparison of flows to the Permit to Take Water limits is provided. The Permit to Take Water(PTTW)specifies flow rates and total water takings permitted. For the West Elgin DWS the maximum flow rate limit is 9,400L/min. The total daily water taking is 13,500m3/day. There were no PTTW exceedances in 2013. The West Elgin DWS is at 29%capacity of the total water taking limit,which is down 2.7%from last year. Attached as Appendix 8,find a summary of treated water flows including total,average, and maximum daily flows for the reporting period. As well,a comparison of flows to the Municipal Drinking Water Licence(MDWL)rated capacities is provided. The rated capacity of the plant is 12,160m3/day of treated water as specified in the MDWL.The daily average flow for the reporting period was 3,620m3/day, which is an 8.6%decrease from 2012. The maximum daily flow for the reporting period was 5,667m3/day which corresponds to a 17.4%decrease from 2012. The plant is operating at 30%of its rated capacity,down from 2012 by 2.6%. Attached as Appendix C,find a summary of flows including total,average, and maximum daily flows for the reporting period for the Iona Interconnection. The Iona Interconnection rated capacity is 1,6000/day as specified in the MDWL. The daily average flow for the reporting period was 404m3/day, which corresponds to a 0.7%increase from the previous year. The average daily flow is controlled by the SCADA programming in attempts to meet the agreement with Southwold to take 400m3/day. The West Elgin DWS is capable of meeting its current uses for the system. It is operating at well below the limits set out in the Permit to Take Water and the design capacity for the plant. Collection System The collection system maintenance is carried out by the Municipality of West Elgin. It contains gravity sewers that lead to the Main Pumping Station located on Furnival Road. The pumping station is operated by OCWA. It contains a wet well with two submersible pumps that pump to the treatment plant. Backup power is supplied by an onsite generator. Plant Description The Rodney Wastewater Treatment Plant is an extended aeration facility which consists of: extended aeration,settling, UV disinfection (seasonal), phosphorus removal,and filtration. The extended aeration process is designed to remove carbonaceous and nitrogenous organic compounds(BBD). Aluminum Sulphate is used for phosphorus removal. After the clarifier the effluent is filtered and seasonally disinfected using ultraviolet light,then discharged to Sixteen Mile Creek. Sludge is directed to the lagoon for storage and settling. Decant liquid off the lagoon is returned to the influent of the plant. Process Details • Wastewater is directed into the sewage lift station from the Village of Rodney by gravity.Wastewater is pumped from the sewage lift station located near the junction of Furnival Road and King Street by force main into a reinforced concrete splitter chamber, provided with a mechanical rake bar screen. • The secondary treatment system consists of two aeration basins,one reinforced concrete clarifier tank and two return activated sludge pumps. • The phosphorous removal system consists of one 30,000 L fiber reinforced tank with spills containment equipped with 2 diaphragm type metering pumps(1 duty and 1 standby). • Three mechanical aerators in each aeration tank provide oxygen at a low pressure in the aeration tanks. • The tertiary treatment system consists of four(4) continuous back wash 2 metre deep bed,granular single media sand filtration units housed in the filter building. Hydrogen peroxide is introduced for filter cleaning when necessary. • The disinfection system consists of a ultra-violet(UV)unit through which the effluent is discharged seasonally. • A concrete V-notch weir flow measuring chamber is installed between the clarifier and the filter building. • Operations are controlled by a programmable logic controller(PLC).A data logging computer system with local monitoring capability is used to monitor,trend,and record select process parameters. • Laboratory space is also located at the WWTP to allow for basic laboratory analyses to be conducted by the plant operator. • Process control is monitored by SCADA at the West Lorne Wastewater Treatment Facility. Page 1 of 11 Section 2; Monitoring Data Sample Collection and Testing All samples are collected and tested as per the requirements of the Environmental Compliance Approval. Raw sewage is sampled bi-weekly and tested for BOD5i total suspended solids,total phosphorus, and total Kjeldahl nitrogen. The raw samples are collected as 24 hour composite samples. Final effluent is sampled bi-weekly and tested for BOD5j total suspended solids,total phosphorus,free ammonia nitrogen,total Kjeldahl nitrogen,nitrite,nitrate,pH and alkalinity. Samples are collected using an automatic composite sampler and collected over a twenty-four hour period. Grab samples for dissolved oxygen and temperature are collected bi-weekly. A grab sample for E.coli is sampled bi-weekly during the disinfection period from April 15 to October 15. In-house tests are conducted on a weekly basis on the final effluent, raw influent and the mixed liquor suspended solids at the plant to check plant performance and to make any operational changes required. In 2013,all chemical and microbiological sample analyses were conducted by SGS Lakefield Research. Temperature,pH and dissolved oxygen were conducted by staff at the treatment plant. The receiving stream temperature is performed at Sixteen Mile Creek. Flows Detailed monthly flow information is summarized in Appendix A.The total flow treated in 2013 was157,336m',which corresponds to a 3%increase from 2012raw flows. The annual average daily flow for the reporting period was 4310/day,or 73%of the plant's rated design capacity of 590m3/day(see Chart 1). The design average daily flow for the plant was exceeded 29 times during the year,compared to 12 times in 2012. The hydraulic peak flow of 2,190m3/day for the plant was not exceeded 2013. Chart 1. The mechanical surface aerators in the aeration tanks lowers the temperature of the contents further. Adjustments to the mixed liquor Page 8 of 11 suspended solids the plant was able to remain in compliance during these cold periods. The cold temperatures formed ice on the clarifier which caused the clarifier sweeper arm to break. During the repairs the aeration flow was diverted to the lagoons instead of the clarifier. Section 4: Maintenance Regular scheduled monthly preventative maintenance is assigned and monitored using the Workplace Management System (WMS) program. The following is a summary of maintenance performed other than WMS work orders: -replaced spring on clarifier sweeper arm -repair clarifier sweeper arm -replaced RAS pump -replaced clarifier motor -replaced aeration motors for aerators Z,3,5,6 Section 6: Effluent guality Assurance Effluent quality assurance is evaluated by monitoring parameters and changes throughout the plant processes. The operators monitor the aeration tank by performing weekly tests on the mixed liquor. These tests include dissolved oxygen,pH,temperature, settling tests,Mixed Liquor Suspended Solids(MLSS),and Mixed Liquor Volatile Suspended Solids(MLVSS). As well, monitoring of the alum dosages,wasting volumes and Return Activated Sludge Suspended Solids is completed. Data collected from these tests provide information to the operator to make the appropriate adjustments in the treatment process and take corrective actions before the plant reaches its effluent limits. Section 6: Calibration and Maintenance Regular scheduled monthly preventative maintenance is assigned and monitored using the Workplace Management System program. Annual maintenance on the generator was completed in February by Albert's Generator Services. Flowmetrix Technical Services Inc.performed the annual calibration on the flow meter in May. In house meters for pH and dissolved oxygen are calibrated by OCWA operators as per manufacturer's instructions. A possible cause of the exceedance was due to aigae build up. All monthly average loading objectives were met The annual average flow for 2013 was 431m3/d,which is below the design flow of 590m3/d. However,there were 29 instances where the design flow was exceeded,this is up from 12 in 2012.However,there was more rain events that caused the higher flows in 2013 than in 2012. Section 8: Biosolids The lagoon is used for sludge digestion and storage as per the Environmental ComplianceApproval.The waste activated sludge process transfers to the lagoon. The sludge is allowed to settle at the bottom of the lagoon and the liquid is pumped back to the head of the plant for treatment. There is some sludge build up at the discharge pipe from the plant to the lagoon. This has been put on the capital list for its removal in 2014. Section 9: Community Complaints No community complaints with regards to plant operations were received in 2013. Page 10 of 11 Section 10: Bypasses, Spills, and Abnormal Discharges There were no by-pass events for the Rodney WWTP during 2013. The Rodney Wastewater Treatment Plant can direct raw sewage from the pump station to the lagoon when there is a power failure of long duration. The pump station has back up power, however,the treatment plant does not have any back up power. The wastewater treatment plant was operated under Environmental Compliance Approval 3-0042-90-938 dated November 8,1993 with amendments July 6,1994 and September 24, 1998. Collection System As of May 2013,the collection system maintenance is carried out by the Ontario Clean Water Agency. It contains gravity sewers that lead to the Main Pumping Station located on Marsh Line. It contains a wet well with three submersible pumps that pump to the treatment plant. There is a receptacle for a portable generator should the need arise for backup power. In emergencies, the wetwell contains an overflow pipe that discharges to the West Lorne Lagoon. Plant Description The West Lorne Wastewater Treatment Plant is an extended aeration facility which consists of: grit removal and screening,extended aeration,settling,phosphorus removal,filtration and UV disinfection(seasonal). The extended aeration process is designed to remove carbonaceous and nitrogenous organic compounds (BOD). Aluminum Sulphate is used for phosphorus removal. After the clarifier the effluent is seasonally disinfected using ultraviolet light,then discharged to Zoller Drain. Zoller Drain is connected to Brock's Creek and then from there it goes to Lake Erie. Sludge is directed to the lagoon for storage and settling. Decant liquid off the lagoon is returned to the influent of the plant for treatment. Process Details • Wastewater is directed into the sewage lift station from the Village of West Lorne by gravity.Wastewater is then pumped from the sewage lift station located on Mash Line into a reinforced concrete inlet channel, provided with a mechanical rake bar screen. • The secondary treatment system consists of two trains each consisting of: aeration tank,clarifier tank,and two return activated sludge pumps. • The phosphorous removal system consists of one 15,OOOL plastic tank with 2 diaphragm type metering pumps 1 duty and 1 standby. • Lime system for pH and alkalinity control (currently not in use) • The objective of the system is to remove organics,total Kjeldahl nitrogen (TKN), phosphorous and ammonia-nitrogen. • Two rotary lobe blowers one duty and one standby supply low pressure air to the aeration tanks. • The tertiary treatment system consists of three continuous back wash, up flow,deep bed,granular single media sand filtration units housed in the filter building.The disinfection system consists of a ultra-violet(UV) unit through which the effluent is discharged. • Operations are controlled by a programmable logic controller(PLC).A data logging computer system with local monitoring capability • Laboratory space is also located at the WWTP to allow for basic laboratory analyses to be conducted by the plant operator Page 1 of 13 Section 2: Monitorine Data Sample Collection and Testing All samples are collected and tested as per the requirements of the Environmental Compliance Approval. Raw sewage is sampled bi-weekly and tested for BOD5i total suspended solids,total phosphorus, total Kjeldahl nitrogen,and alkalinity. The raw samples are collected as 24 hour composite samples. Final effluent is sampled bi-weekly and tested for BOD5,total suspended solids,total phosphorus,free ammonia nitrogen,total Kjeldahl nitrogen, nitrite,nitrate,pH and alkalinity. Samples are collected using an automatic composite sampler and collected over a 24 hour period. A grab sample of temperature and dissolved oxygen is collected bi-weekly. A grab sample for E.coil is sampled bi-weekly during the disinfection period from April 15 to October 15. In-house tests are conducted on a weekly basis on the final effluent, raw influent and the mixed liquor suspended solids at the plant to check plant performance and to make any operational changes as required. In 2013,all chemical and microbiological sample analyses were conducted by SGS Lakefield Research. Temperature,pH and dissolved oxygen were conducted by operators at the treatment plant. The receiving stream temperature is monitored. Flows Detailed monthly flow information is summarized in Appendix A. The total flow treated in 2012 was 206,843.2m3,which corresponds to a 14%increase from 2012 raw flows,see Chart 1. This increase in flow in 2013 is attributed to higher precipitation received in 2013 compared to 2012. The annual average daily flow in 2013 was 566.7m3/day,or 63%of the plant's rated design capacity of 900m3/day. Page 2 of 13 Chart 1. The hydraulic peak flow of 2,7000/day for the plant was not exceeded in 2013,refer to Chart 2. Chart 2. The average concentration of BOD5 has decreased 4.8% from 2012,see Chart 3. The average BOD$loading to the plant was 60.6kg/d for 2013. Refer to Appendix A for detailed analytical data. Chart 3. E.Coll is monitored only during the disinfection season which is from April 15`h to October 15th. There was one limit exceedance in April for the E.Coll,this was reported to the MOE. Refer to Table 1 for a list of monthly average effluent limits. Chart 12. The monthly geometric mean exceeded the 200cfu/100mL limit in April with a geometric mean of 210cfu/100mL. The system was thoroughly cleaned and no further issue. This non-compliance was reported to the MOE with no further action required. Section 3: Oneratina Problems and Corrective Actions The UV System required a lot of maintenance and part replacements in 2013,mainly due to age. It has been recommended for replacement/upgrade in 2015. The SCADA system had issues in 2013 and is obsolete,an upgrade will be considered for 2014. The sand filters continue to be an ongoing issue. They will be going through an overhaul over the next few years to make the necessary upgrades for operation. Despite these issues,the plant operated very well in 2013 with only one non-compliance. Section 4: Maintenance Regular scheduled monthly preventative maintenance is assigned and monitored using the Workplace Management System (WMS) program. The following is a summary of maintenance performed other than WMS work orders: -repaired RAS Pump P108 -repaired effluent hydrants -replaced 8 quartz sleeves on UV system -repaired Pump#1 at Pump Station Section 5: Effluent Quality Assurance Effluent quality assurance is evaluated by monitoring parameters and changes throughout the plant processes. The operators monitor the aeration tank by performing weekly tests on the mixed liquor. These tests include dissolved oxygen, pH,temperature,settling tests, Mixed Liquor Suspended Solids(MLSS),and Mixed Liquor Volatile Suspended Solids(MLVSS). As well, monitoring of the alum dosages,wasting volumes and Return Activated Sludge suspended solids is completed. Data collected from these tests provide information to the operator to make the appropriate adjustments in the treatment process and take corrective actions before the plant reaches its effluent limits. Page 10 of 13 Section G: Calibration and Maintenance Regular scheduled monthly preventative maintenance is assigned and monitored using the Workplace Management System program. Annual maintenance on the generator was completed in June by Albert's Generator Service. Flow Metrix Technical Services Inc. performed the annual calibration on the flow meter in April, in house meters for pH and dissolved oxygen are calibrated by OCWA operators as per manufacturer's instructions. Three of the four objectives that were exceeded were for suspended solids in June,September and October. These objectives were all attributed to algae growth on the clarifiers and poor performance of the filters. The fourth objective exceedance was for the monthly geometric mean concentration of E.coil in April,this resulted in a limit exceedance as well. There were no monthly average loading effluent objectives exceeded in the 2013. The annual average flow for 2013 was 567m3/d,which is below the design flow of 900m3/d. However,there were 24 instances where the daily design flow was exceeded compared to 6 instances in 2012. These were all due to infiltration into the collection system when there was snow melt and rain. Page 12 of 13 Section 8: Biosolids The lagoon is used for sludge digestion and storage as per the Environmental Compliance Approval. The waste activated sludge is transferred to the lagoon. The sludge settles on the bottom of the lagoon and the liquid is pumped to the head of the plant for treatment. The lagoon has ample storage for the sludge and will not require cleanout in the coming year. Section 9: Community Complaints There was no community complaints received in 2013. Section 10:_ Bypasses, Spills, and Abnormal Discharaes There was no by-pass,spill or abnormal discharge events for the West Lorne WWTP or for the Pumping Station during 2013. Section 11: Summary Overall the West Lorne Wastewater Treatment Plant provided effective treatment in 2013. No alterations to the system have been made in 2013. RENT The Municipality agrees to pay to Four Counties as rent the sure of One Dollar 01.40)in advance annually,on the date of this Agreement and on each anniversary date during the term of this Lease Agreement; including any Renewal Term, plus applicable taxes. 3. SERVILUS The Municipality shall use the Vehicle primarily to operate and maintain the following services(collectively the"Services"): saa_n=as+�u:� -2- (a) a transportation service benefiting the Clients, including without limitation, the operation of a patient transfer service between Four Counties and the Patients' homes within the Service Area;and (b) a transportation service for the purpose of assisting members of the general public resident in the Service Area to attend medical and other health-related appointments: 4, OUAMTY OF THE SEBMCES The Municipality shall perform the Services at fill times... (a) in good'fahth,in full compliance with all applicable laws; (b) in a conscientious and professional manner to the best of its shill and knowledge, with the competence of professionals providing similar services;and (c) In a manner that ensures the safety of the passengers in the Vehicle to the best of its ability at all times. 5. TERM AND PURCHASE OP-TION The term of this Lease Agreement shall be for a period of Five (5) years Comtnencrng,on the date of this Lease Agreement (the "initial Term"):; At the end of the lnttal Terra and any subsequent Renewal Tenor (as defined below),the Municipality may it iis'opoon: (a) renew this Lease Agreement on the some terms and conditions for an additional term of one(1)year(a"Renewal Term");or (b) choose to purchase the Vehicle at the then current fair market value as determined in the current Canadian Black BaakO(the"Purchase Option")at the time. 6. TERII+I(INMQN Either party may terminate this Lease Agreement upon six(6)months' written notice Upon the occurrence of an event of'default under this Lease Agreement I'll,remains utnesolved to the satisfaction Of the non-dcfauldng.party for a period of ton , (10)days after written notice of the event of default was received by the defaulting party, the neon-defaulting party may terminate this Lease Agreement without further notice. 7. A CEPTANCE The Municipality acknowledges that it has inspected the.Vehicle and accepts tits Vehicle as being in a:good state of repair. The Municipality acknowledges that Four Counties makes no warranties, either express or impfhed, as to any matter whatsoever, including without,limiting the generality of the foregoing, the condition of the Vehicle nor its merchantability nor its fitness for any particular purpose. 8. i?WNERSHIP Title to and ownership of ti a Vehicle shall at all times be and remain in the named To Counties,and the Municipality shall have no property rights in or to the Vehicle,except theAght to use and operate the Vehicle in accordance with the terms of this Lease Agreement. 4. OPERATING CdSTS The Municipality shall pay all operating costs whatsoever of or relatin -to the Vehicle,including without limiting the generality of the foregoing,the cost of fuel,oil,insurance, licences,registration fees and motor vehicle inspection fees,where l _3. applicable. The Municipality is responsible for any remuneration and benefits payable to its employees and independent contractors, including.the driver(s) of the Vehicle, who are employed or contracted by the Municipality in relation to the provision of the Servt under this Lease Agreement. Io, 'REPAIRS The Municipality shall:maintain and keep the Vehicle in good condition and repair in accordance.with the standard of tho transportation industry catecing.to seniors, and to the satisfaction of Four Counties. Vie Municipality further covenants that, as component parts of the Vehicle either wear out or became otherwise inoperative, it will replace the same with either parts which are approved by the manufacturer of the Vehicle or such sgbstitene pens as Four Coutties rosy from to time permit. 11. INSIPACTI N Four Counties shall have the right to inspect the Vehicle, upon no less than 24 hour's prior notice, at all reasonable times during the tern of this Lease Agreement. 12 ALTERATION The Municipality:shall not alter or add or allow any other person to alter or add to the Vehicle in any way without.the prior written approval of Four Counties, Any. alterations, or additions to the Vehicle which arc approved by Four Counties."shall become and remain the.property of Four Counties. The Municipality shall affix on the Vehicle arty labels or insiiitias supplied by Roux Counties, The Municipality shall not permit any advertising to,bo posted`on.the exterioror the interior of"Vehicle without:the consent of Four Counties. 13. ORQS, The Municipality shall keep for the Vehicle and deliver to Four Counties as specified or upon toque st the fallowing records: (a) the monthly mileage for the Vehicle; (b) a passenger manifest indicating the number of passengers utilizing the Services each month and the reason for their use;and (c} a record of any mechanical repeira performed on the Vehicle. 14. IPR, VAG The Municipality acknowledges that the passengers of the Vehicle may be patients`of Four Counties. The Municipality shall respect the privacy of the passengers and shall keep any personal information it receives relating to the passengers confidential. Tie Municipality shall not disclose any information relating to the passengers, including the names.of the passengers, except to Four Counties, unless otherwise.permitted or required by law. LOSS QXR&MME The Municipality assumes and shall bear the entire risk of loss or damage to the Vehicle. No loss or damage to the Vehicle or any part thereof shall affect ,j -4- or impair any of the obligations of the Municipality hereunder,and this Lease Agreement shall ccntinue,in full force and effect notwithstanding such loss or damage to the Vehicle. The,,Municipality shall insure the Vehicle according to the laws in force and eftect in the Frovince of lintatio as the lessee:and shall name:Four Counties as the registered owner and lessor of the Vehicle. The Municipality shall.punotually pay its insurance premiums when due in respect of any policies of insurance.require. and to be purchased.by it by law and shall provide.Four Counties with copies of ccivficates of such insurance policies. In - the event of loss or damage of any hind whatsoever to,the Vehicle,the Murucip ty shall immediately report such loss or damage to the insurance company and Four Counties. 17, RISK OF OPERATION The Municipality assumes and shall bear the entire risk of the operatian ofihe VeWdic and the provision of the Services,including,.without limitation: (a) the safety of the Vehicle; (a) the safety of the passerigers of the Vehicle; (c) ensuring the quality of the driver(s)of the Vehicle, including ensuring that any driver holds a valid driver's licence of the appropriate class issued by the Province of 6nmdb and (d) any de riage or injury to other individuals and/or property; and shall obWn the appropriate insurance coverage in accordance with applicable law in respect ofsame. is. SURRENDER Upon the termination of this Lease Agreement without exercising the Ftrrchasc;Optiaa, the Municipality shall ifii n d�ately return the Vehicle to.Four Counties in'good cotrd<Uon and repair,°otxlirtary wear and tear resulting from the proper use of the Vehicle.excepted, and the.Munic�pal�ty shall, at its cost, return the Vehicle to Four Counties at a destination designated by Four Couttics, end if the Municipality fails to deliver the Vehicle within one'(:f) week from the•.termination of this Lease Agreement, Four Counties:shall have the right to enter upon the premises where the Vehicle is located, and take possession of and reruave it at the Municipality's expense,all without legal process and at the Muntespality's. cost. The; Municipality covenants that; upon termination of this lease or upon surrender.of the Vehicle f©r any other re$son; (a) The Vehicle shall be in-good:condition and repair (b) The records for mechanical repairs listed in Section 13 of this Lease Agreement shall accompany the Vehicle;and (c) The Municipality shall main_tain insurance coverage in accordance with the provisions of Sections 16 and 17 herein during the period of time that the Vehicle is-being transferred to Four Counties,notwithstanding that this Lease Agreement may 1�i teiminated. 19. LIENS AND!CUARGES The Municipality shall, at all times, peep the Vehicle free from all kvias, liens and encumbrances whatsoever and shall pay all licence fees, -3- mgistratian.fees and assessments, charges and taxes, which may be now or hereafter imposed directly upon the`leasing,posmession or use of the Vehicle. If the Municipality fails to;pay any srich levies, liens, encumbrances, assessments, aharges or taxes, lioeir Coithdoi maY pay the same and in such event the costs thereof, together with interest calculated monthly at a rate equivalent to`the.prime rate estWishid by the`Canadian Imperial Batik of Commerce on the first day of each month, plus two (2 0)percent per annum, shall'forthwith be due and.payable by the Municipality to Four Counties.Non- payment of such casts by the Municipality to Four Counties immediately upon demand by Four`Counties shell be deemed to be a default under this Lease Agreement. 20, ASST NMENTt„_3UB LEASE. The Mounicipality shall not transfer, deliver up possess pn it. or sublet the Vehicle, and the Munlelpality's interest in this Lease Agreement shall not be assignable.by the Muncipallty without prior written consent of Four Counties; but nothing,in this Lease Agreement shall prevent Four Counties from assigning,pledging,martgng,transferring or otherwise disposing,either in whale or in part,Four Counies'rights in the Vehicle or this Lease Agreement. 21. INDEMNIFICATION The Municipality shall Indemnify Four Counties against and hold,Four Comities hainless from any and all claims,actions,suits, proceedings,costs, expenses, darnii a"d liabilities including the costs.arising out of,connected with or resulting from the possession, operation or use of the Vehicle or the provision,of the Services;includiij sny personal injury or death or damage to property occasioned by'the operation or use of the said Vehicle and/or the provision ofthe Services during the term. 22. We were directed to inform you closer to the actual date and time of event in writing for your knowledge as you maintain the area . We wish to exchange vows at approx. 3 pm Sat dune the 14th on the grass portion of beach area to the left or south side after crossing over the bridge . We would like to set up approx 90- 100 chairs and a,*ee standing arch at the site, by the tree. We would also like to hand tie some bow type decorations on the bridge which would not cause any damage afterwards whatsoever if that would be permitted. We would like to know of any other things that we may need to know or be aware of as we plan our day.As we understand there could be construction going on at the Marina with the Sea Side Development starting up this summer do you know if that will in deed be an issue or if there be a problem with access for quests that day to and from event site ? We understand that it is a public beach and we cannot or would not deny access but would like to put up a sign by gate at entrance to area to inform public of such an event happening that day so they are aware and may choose to act accordingly at time of ceremony to avoid situations , embarrassment or be caught in pictures without knowledge or consent.
