MINUTES OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN WEST ELGIN COUNCIL CHAMBERS DECEMBER 4,2014 MEMBERS PRESENT: Mayor Bernie Wiehle, Deputy Mayor Mary Bodnar Councillors: Joe Seman, Jonathan Wolf, Richard Leatham STAFF PRESENT: Scott Gawley Administrator/Treasurer Norma Bryant Clerk Lee Gosnell Road Superintendent Jeff Slater Recreation Superintendent Heather James Planner The Administrator/Treasurer opened the sixth Inaugural Session of the Municipality of West Elgin at 11:00 a.m. and welcomed everyone to the first meeting of the newly elected members of the Council of the Municipality of West Elgin. He advised that the first item on the agenda was the Declaration of Office. SUBJECT: DECLARATION OF OFFICE AND OATH OF ALLEGIANCE All members of Council made their Declarations of Office. SUBJECT: INAUGURAL BLESSING Reverend Robert Shaw gave the inaugural blessing and a brief inspirational blessing. SUBJECT: COUNCILLOR REMARKS Deputy Mayor Bodnar thanked family and friends for their support in the past 11 years. She thanked administration staff for their patience and is appreciative of the hard work of all staff. Council has challenges with working with less grants. Council needs to looks at the Streetscape and Community Improvement Plans to go forward. Seaside is a reality. We should be proud of our community. Councillor Leatham thanked staff for their hard work. As a Council we need to work as a team to achieve positive results for community. Councillor Wolf is looking forward to working with new faces and renewing with other. He is thankful to be involved in this capacity. Councillor Seman thanks his family,the voters and Barbara for their support. We need to pull together for the community. Mayor Wiehle stated it was an honour and privilege to serve as Mayor. He thanked his father for instilling in him a sense of duty. He has high hopes Council will make good decisions. Challenges are opportunities. Our staff are great. Senior staff were introduced. December 18, 2014 .....Page 2 of 11 DELEGATION 1:30 p.m. Wendi Dupuis--Blue Flag Accreditation Ms. Dupuis reported that the deadline to submit the application for accreditation for Blue Flag beach is January 23`d. Port Glasgow beach is an approved candidate beach. She is suggesting a community committee be set up to complete the application. The Yacht Club is applying to be a blue flag marina, of - which there are only 4 in Canada. Once Port Glasgow becomes a Blue Flag beach a permanent committee has to be set up. One aspect of the designation is environment education, perhaps the Nature Club could help. RES. Weather conditions in December proved to be much better than the month before. Spot salting was required once due to frost, but all in all, road conditions remained favourable through the holiday season and into 2015. 2. Winter shift for public works operators began on December 1St. This includes an early morning shift starting at 3am as well as an afternoon shift, which finishes at 10:30pm (in addition to the regular day shift). This schedule provides excellent coverage for monitoring weather and road conditions 3. Crews took advantage of mild air early in the month to work on drain repairs and re-hab operations at Kearns pit. 4. Annual sign reflectivity checks are being completed by the afternoon shift operator when weather permits. These must be completed at night, when the signs are dry. 5. Removal of dead trees began on county roads late in the month. Frost in the ground is beneficial to avoid marking lawns and ditches during cutting operations. Dead and fallen tree removal will be the main operation for crews over the next few months (weather pending). INTRODUCTION: Upon review of regulatory signage in Rodney, it was determined that the 3-way intersection of Second and Harper was uncontrolled (lack of STOP or YIELD signage). DISCUSSION: The purpose of the STOP sign is to clearly assign right-of-way between vehicles approaching an intersection from different directions. The STOP sign requires the driver to stop the vehicle before entering the intersection, yield to any traffic in or approaching the intersection and then proceed when safe to do so. Although this area is mainly residential and posted speeds are low, a STOP sign will assist in the allocation of right-of way to traffic travelling on Harper Street through this intersection. There is strong evidence of a direct link between poverty, poor health and food security. People who are food insecure are unable to afford the healthy food that they and their families need. Children who experience multiple episodes of hunger over time are more likely to develop chronic conditions. Adults who are food insecure are more likely to have poorer physical, mental, and social health and suffer from multiple chronic conditions including depression, diabetes, heart disease and hypertension. Food insecurity is an important social and public health problem. As is mandated for all Health Units across the province, Elgin St. Thomas Public Health conducts the Nutritious Food Basket (NFB) survey annually. The NFB survey is a tool used to monitor the affordability and accessibility of food by relating the cost of healthy eating to individual and family incomes. The 2014 NFB results reveal the cost for healthy eating has increased 3.9% over the last year,raising the weekly cost to feed a family of four in Elgin St. Thomas to $192.40. The results show that if this family of four is living on social assistance, they would require an estimated 84% of their income to pay for food and rent alone. Low-income households as depicted by this scenario have no choice but to redirect money set aside for food to pay for other non-discretionary expenses such as utilities, child care, transportation, and medical costs. The NFB results continue to demonstrate year after year, based on local household income/expense scenarios, a healthy diet is out of reach for many families and individuals in our community. Accompanying this letter are two handouts that illustrate the reality of food insecurity in Elgin-St. Thomas, specifically highlighting the scenarios for a family of four and for a single male, both receiving social assistance. This allows the activities to continue while managing the risk such that the activity is no longer a significant threat to the drinking water source. For future activities that would create a new significant risk, generally the approach was to prohibit this activity in those vulnerable areas where it would be a significant threat. Whenever possible, where other agencies have mechanisms in place that adequately address the significant threats, these mechanisms were used to reduce duplication. If additional policies were needed, these were developed to complement existing mechanisms. Any misunderstanding of the policy or matters, not covered by this particular policy,shall be submitted to the General Manager/Secretary- Treasurer for clarification. Changes in the policies may be made from time to time at the discretion of the Personnel& Finance/Executive Committee and/or the Board of Directors,and such changes will be made known to the employees before they become effective. Any exceptional cases,matters in dispute or doubt will be dealt with by the Personnel&Finance/ Executive Committee. The General Manager/Secretary-Treasurer is hereby authorized to revise and update this document to keep it current. Suggestions by employees regarding these policies are welcome. The words his/her are used interchangeably in this document. Department Supervisors are those supervisors responsible for Water Management, Land Management and Community Relations departments. The lower Thames Valley Conservation Authority will hereinafter be referred to as`the Authority'. 1 2 POLICY 2.1 LEGISLATIVE FRAMEWORK Section 21(m.1)of the Conservation Authorities Act provides for the establishment and collection of fees for the following services,where the service is not supported through provincial grant funding: • Conservation Authorities Act Section 28 permit fees • Plan Review • Response to legal, real estate and public inquiries • Extension Services(e.g.technical advice/implementation of erosion control measures,forest management/tree planting,wildlife/fisheries habitat management, management of forests/recreational land owned by others,technical studies) • Community relations/information/education services(e.g.,tours,presentations,workshops, demonstrations,special events) • Sale of products(e.g.reports,maps, photographs) • Any services under other legislation authorized under agreement with the lead ministry 2.2 BASIS This Fee Policy&Schedule has been prepared in conformity with the Conservation Authorities Act and the Policies and Procedures for the Charging of Conservation Authority Fees,established by the Ministry of Natural Resources. The Fee Schedule is based on the user-pay principle.The fees and revenues generated are designed to assist with recovering the costs associated with administering and delivering the services on a program basis.Fees take into account estimated staff time,travel, and material costs to provide the service,but do not exceed the cost of the service. 2.3 PROCESS AND PUBLIC NOTIFICATION This Fee Policy&Schedule has been established by the Lower Thames Valley Conservation Authority (LTVCA) Board of Directors following consultation with local municipalities and other stakeholders. Consultation includes at a minimum,direct mail-out to key stakeholders(e.g.,municipalities), posting the notice of development and any future revisions to the Fee Policy&Schedule on the LTVCA website, and posting a notice in the LTVCA administrative office. 2.4 IMPLEMENTATION It is the objective of the LTVCA to provide an effective and efficient delivery of services.To achieve this objective: • Land use proposals will be reviewed in a timely fashion, • Comments on applications under the Planning Act will be provided in time for the legislated public meeting or hearing, • Permit applications under the Conservation Authorities Act will be generally processed within time-lines outlined in MNR's May 2010"Policies and Procedures for Conservation Authority Plan Review and Permitting Activities" (30 days after receipt of complete applications for minor applications/90 days for major applications). 2 • Fees will not exceed the costs to deliver the service. Exemptions to the application of these fees include: • Non-profit conservation groups contributing to the protection and restoration of the natural environment,such as Ducks Unlimited (DU), Mature Conservancy of Canada(NCC),Ontario Federation of Anglers and Hunters(OFAH)for permit applications,Planning Act applications, inquiries,and site assessments; • Applications submitted by landowners undertaking work for the creation of habitat/watershed /water quality improvement projects i.e.water quality retention ponds; 2.5 APPEAL PROCESS The fee appeal process will be based on the principles of fairness,opportunity,and notification.Any deviation from this Policy requires the approval of the Board of Directors or the Personnel&Finance/ Executive Committee.The appellant must submit in writing to the General Manager/Secretary-Treasurer the reasons for the appeal.The written request will also identify the need and desire to present the appeal before the Personnel&Finance/Executive Committee. once heard,the appeal will be dismissed or upheld through a resolution passed by the Personnel&Finance/Executive Committee. The appellant will be notified accordingly of the Committee's decision. 2.6 DATE OF EFFECT The Fee Policy&Schedule becomes effective as of the date of LTVCA Board of Directors approval 2.7 TRANSITION The establishment of this Fee Policy&Schedule supersedes and replaces all previous fee policies and/or schedules.The Policy also applies to proposals not previously invoiced,such as draft approved plans of subdivision which predated any fee schedule. 2.8 REVIEW PROCESS The Fee Policy and Schedules will be reviewed annually by LTVCA staff to monitor effectiveness and amended by the Board of Directors as deemed appropriate.
