15-07COUNTY OF ELGIN By-Law No. 15-07 "BEING A BY- LAW TO AUTHORIZE STAFF TO ENTER INTO A THREE YEAR CONTRACT WITH LIFELABS FOR THE PROVISION OF LABORATORY SERVICES IN ELGIN COUNTY LONG TERM CARE FACILITIES" WHEREAS Section 5(3) of the Municipal Act, S.O. 2001, Chapter 25 as amended grants municipal power to exercise its capacity, rights, powers and privileges by by-law; and, WHEREAS Section 8(1) of said Act confers broad authority to municipalities to govern its affairs as it considers appropriate; and, WHEREAS Section 9 of said Act confers upon a Municipality the rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act: and, WHEREAS Elgin County is engaged in the provision of long term residential health care and support services to residents residing in three long term care facilities, through funding received from the Ministry of Health and Long Term Care for the Province of Ontario; and, WHEREAS in order to provide such long term residential health care and support services, Elgin County wishes to contract for certain services to be provided to its residents; and, WHEREAS LifeLabs shall provide laboratory services to the residents of the facility and the facility shall pay LifeLabs fees for services performed. NOW THEREFORE the Municipal Council of the Corporation of the County of Elgin enacts as follows: 1. THAT staff be authorized to sign a three year contract effective January 1, 2015 through December 31, 2017 with LifeLabs to provide laboratory services in Elgin County long term care facilities, according to specified terms contained in the agreement for services.
