10:30 a.m.—West Ei in Nature Club—Pilot Roadside Vegetation Management
Proiect
In attendance: Stan Caveney, members of West Elgin Nature Club, Public Works
Superintendent
Mr. Caveney gave an overview of the pilot project in 2014 and encourages that
the practise be continued. Some farmers along Gray Line feel different on how
March 12,2015 .....Page 2 of 8
roadside would be maintained;the Nature Club will work with these landowners.
He also suggest that the municipality consider extending the program along the
side roads that feed into Gray Line. The committee will meet again and discuss
signs,timing, extension,etc. and report back to Council.

Ms. Jarmchuk presented a PowerPoint presentation reviewing legislation and
case law and effects on municipal insurance. Although the government is not
going ahead with legislation to reform joint&several liabilities, she is pleased that
OGRA is continuing the discussions. She also reviewed the West Elgin
insurance coverage.

RECOMMENDATION:
THAT Council approves the Closing of Main Street in West Lorne on May 30 2015
between the hours of 10:00 am and 2:00 pm from Graham Road to Argyle Street to
facilitate the Bicycle Rodeo,Mini Safety Day.
INTRODUCTION:
The Optimist Club of West Lorne and the West Elgin Recreation Committee are
hoping to host the annual Optimist Bicycle Rodeo and mini Safety Day at the West
Elgin Health Centre.The Optimists have secured the use of the Health Centre
Parking lot,and hope to utilize the West Lorne Fire department lot as well as have
them provide a demonstration of some kind. In the interest of Public Safety it would
be beneficial to close that portion of main Street Closed.
The event also includes a small display from the EMS crews, Parks and Recreation as
well as the YWCA and the Library.

SUBJECT: Voter List Management Services
RECOMMENDATION:
THAT a by-law to authorize the signing of a Voter List Management Services
Agreement with Comprint Systems Inc. (DataFix) be brought forward.
INTRODUCTION:
VoterView is an internet-based application designed to provide municipal election
officials with an electronic view of their electoral information including the ability
to make corrections to the list, to access various voter counts needed for
electoral planning, and the capability to provide an electronic copy of all changes
to the Municipal Property Assessment Corporation. The municipality has been
using this service since 2006.
DISCUSSION:
The agreement identifies and confirms the service levels and support technology
requirements of VoterVlew Application.
The ability to review and amend voter information during the four-year period
prior to the election is valuable. VoterView helps in producing a more accurate
voters list and in reviewing addresses that are needed for information/letters to
voters. We have the ability to compare the voter information provided by MPAC
in July and September with our database. Once the Voters List is complete (in
September of an election year), Datafix has forwarded this information to
Intelivote who provides the electronic voting system.
Datafix provides training through on-line webinars and user guides on their
website. Further, support is provided by their staff via a-mails and telephone.
The contract is $4,100 plus taxes for the four-year period (last contract was
$3,400.00). This can be paid over the four year period, commencing in 2015.

5UBJ: New Comprehensive Zoning By-law—Wetland Issue--Ministry concerns
The Ministry of Natural Resources and Forests (MNRF), through the Ministry of Municipal
Affairs and Housing (MMAH) has reiterated its concerns with the approach we have taken in the
proposed new comprehensive zoning by-law to the protection of wetlands. MNRF has stated the
proposed by-law does not meet the intent of the Official Plan to protect these natural heritage
features and recommends that the by-law be revised to include a wetland zone and regulations.
to prohibit development and site alteration.
We considered the concerns and suggestions raised by MNRF when they were first brought to
our attention in July of 2014.
Essentially, what MNRF is requesting the Municipality to do is to incorporate a Wetland Zone
into the new proposed by-law and impose restrictive measures on land use and development
within them. We have resisted this approach (for a number of reasons) in favour of showing
wetlands instead as supplementary information on the Zone Maps (sometimes referred to as an
overlay) and have established an approach whereby the Municipality would defer matters
related to land use and development in and adjacent to wetlands to the Lower Thames Valley
Conservation Authority. Conservation authorities across Ontario were given the authority to
regulate development in wetlands by the Province in 2006. The County Planner concurs with
our approach.
As an alternative to a wetland zone, MMAH has just recently suggested the Municipality include
text in the proposed By-law to regulate development and site alteration in wetlands and to
regulate development on adjacent lands depending on the findings of an environmental impact
study paid for by the proponent i.e. the land owner. It is our considered opinion that MMAH is
requesting the Municipality to make revisions to the by-law which are beyond the statutory
authority of the Municipality to do so.
In summary, based on our review, we do not believe any changes are warranted to the
approach adopted in the proposed new by-law whereby wetlands are identified but not actually
zoned on the zone maps and a reference included in the bylaw that any applications for building
permits in theses areas would be referred to the Lower Thames Valley Conservation Authority.
This approach was similar to the approach taken in the current comprehensive zoning by-law

covering the former Township of Aldborough although since 2006, the Conservation Authority
has the legal authority to actually prohibit development and site alteration in wetlands in its area
of jurisdiction.
As a consequence of MNRFIMMAH again raising the issue, we met with Ms. Norma Bryant and
Ms. Heather James on 16 March 2015 to review our approach and to discuss any possible
changes to the proposed by-law in an attempt to placate the Province without compromising the
zoning by-law or assuming powers in he by-law beyond what the Planning Act authorizes
municipalities in the exercise of zoning. We identified three basic scenarios:
1) comply with all recommended changes
11) offer some changes without compromising the approach adopted
111) reject all recommended changes.
With the spirit of cooperation in mind, we have drafted the following text for possible inclusion in
the Zoning By-law. it would be inserted on the Zone Legend page following page 95 and
immediately before the zone maps.
Wetlands — Provincially significant Wetlands and local significantly wetlands have been
identified on the Zone Maps. In these areas, the Province has mandated that development and
site alteration (as defined below) not be permitted. On adjacent lands, also identified on the
Zone Maps, development or site alteration(as defined below) may only be permitted if an
environmental impact study, commissioned by and paid for by the proponent, demonstrates
there will be no negative impact on the wetland. The Lower Thames Valley Conservation
Authority has jurisdiction in the Municipality of West Elgin over the approval of any proposed
development or site alteration in or adjacent to an identified provincially significant or locally
significant wetland.
Development means the creation of a new lot, a change in land use, or the construction of buildings
and structures requiring approval under the Planning Act.
Site Alteration means activities, such as grading, excavation and the placement of fill that would
change the landform and natural vegetative characteristics of a site.
Obviously, if the Municipality complies with the revisions being suggested by MNRF and MMAH,
there is unlikely to be any appeal lodged by the Province; particularly if the revision includes
adoption of a wetland zone. Any thing less raises the prospect of an appeal. We have not been
able to ascertain from MMAH the likelihood of an appeal but are endeavouring to do so. In any
event, we believe our case to be sufficiently strong to with stand an appeal to the Ontario
Municipal Board which, in all probability, would be limited in expense to the Municipality.
The Lower Thames Valley Conservation Authority has raised a concern that the by-law does not
include a minimum setback for trailers from the top—of—bank of Lake Erie or from a ravine. We
have reminded the Authority that these are regulated areas that it has jurisdiction over. if it
wishes to suggest what the minimum setbacks should be, we would recommend to Council that
the setbacks be prescribed in the by-law. We are awaiting further instructions from the Authority.

The Authority also raised an issue with what it thought was a 30m minimum setback in the
proposed by-law for dwellings from the top-of-bank of the Lake Erie shoreline. When it was
apprised that the 30 m setback only applied to the seasonal dwelling of Lou Nirta which the -
Authority ultimately approved, the issue seems to be resolved.

SUBJECT: FINAL REVISION TO NEW COMPREHENSIVE ZONING BY-LAW
RECOMMENDATION;
THAT Council of the Municipality of West Elgin APPROVE the revisions to the proposed
Municipality of West Elgin Comprehensive Zoning By-law.
UPDATE:
At the public meeting on February 26, 2015, Council directed Ted Halwa to further
revise the proposed new comprehensive zoning by-law. The request for revision was
the result of comments received in writing and made orally at the public meeting by
Wendie Dupuis, Dave and Nancy Kopriva, Valerie Brannas and Ed Rachidi.
For Lots 8 and 9, Concession 14 (maps 77 & 78), the property owned by Lakewood
Trailer Estates c/o Wendie Dupuis, the zoning on the property has been changed from
Lakeshore Development (LD) to Lakeshore Residential (LR). Ms. Dupuis met with me to
discuss this proposed revision and it was further confirmed through email. Ms. Dupuis
has been notified of this revision and has no further concerns.
For Part Lot 13, Concession 14, owned by Dave and Nancy .Kopriva (map 78), the
zoning on the property has been changed from Lakeshore Development (LD) to
Lakeshore Residential (LR). Mr. and Mrs. Kopriva have been notified of this revision
and have no further concerns.
For Part Lot 15, Concession 14, owned partially by Valerie Brannas, the property will
remain zoned Lakeshore Development (LD) as proposed. Ms. Brannas met with myself
following the public meeting on February 26, 2015 and it was explained to her the
present lots and existing uses are permitted. However, should a building permit be
required, the following needs to be addressed: frontage on a public road, Lower
Thames Valley Conservation Authority concerns be met and Development Regulation
permit be issued from the Authority as the lots are below the Conservation Authority
regulatory line and the County wide shoreline management study. Ms. Brannas stated
at our meeting she had no further concerns.
For Lots 3 and 4 Block 0 Plan 68 (263 Graham Street), owned by K & M Petro Services
Inc. c/o Ed Rachidi, the property is proposed to be zoned site-specific Residential First
Density (R1-5). For the R1-5 zone, the proposed permitted uses were car wash; gas

bar; and variety store. In the current zoning by-law, Village of West Lorne Zoning By-
law, the site-specific zone Residential First Density (R1) permits a gas bar; retail store;
retail store, variety; and restaurant. Retail store and restaurant as permitted uses were
omitted in error for the proposed zoning by-law. The permitted uses have been added to
the proposed R1-5 zone. Mr. Rachidi is aware of this revision for this property.

SUBJECT: PROPOSED CONSENT APPLICATION FOR SEASIDE WATERFRONTS
INC.
RECOMMENDATION:
THAT Council of the Municipality of West Elgin recommend APPROVAL to the Land
Division Committee of the County of Elgin for Consent application E5115 provided the
following conditions are included:
a) That a Zoning By-law Amendment is in force and effect for the proposed
severed parcel;
b) That a Development Agreement has been entered into between the owner
and the Municipality for the proposed severed parcel to address interim
sanitary servicing; and,
c) That Site Plan Approval, including the signing of an Agreement has been
obtained from the Municipality for the proposed severed parcel.
BACKGROUND:
An application for proposed severance was submitted to the Municipality by Seaside
Waterfronts Inc. c/o Kirkness Consulting Inc. (Laverne Kirkness). The applicant is
requesting the severance of a 4.54 hectare (1.33 acre) parcel of land, legally described
as Part Lot 6, Concession 14, on the east side of Havens Lake Road, in the geographic
Township of Aldborough, in Port Glasgow, as shown on the attached Key Map in
Appendix `A'. The proposed severed lands are zoned Agricultural with Exception (A1-
20) and Agricultural (Al) in the Township of Aldborough Zoning By-law No. 89-8 and to
be zoned Lakeshore Development (LD). The proposed severed parcel is designated
Lakeshore Area with a portion of the parcel subject to Woodlands and Hazardous Lands
overlay and Lower Thames Valley Conservation Authority Regulatory Line in the
Municipality of West Elgin Official Plan. The purpose of the severance is to permit the
establishment of a commercial development.
The proposed severed lands have an area of 0.54 hectares (1.33 acre) and a frontage
of approximately 92.13 metres (302.26 ft.) along Havens Lake Road. The proposed
severed lands are currently vacant. Seaside Waterfronts Inc. intends to develop the
commercial block in three phases (see Appendix 'B' for site plan). The initial two phases
will consist of a 3 storey building with a ground floor area of 485.0 sq. m. (5,220.50 sq.
ft.). The ground floor of Phase 1 will include a restaurant, which will include an outdoor
patio, providing a total of 75 seats. Phase 1 would be serviced with municipal water
supply and interim private sanitary services, in the form of a holding tank. Phase 2.will
provide for the creation of retail commercial and office space on the ground floor and
residential apartments and hotel accommodations on the second and third storeys.
Phase 2 and Phase 3 will not proceed until full municipal services become available,
dependent upon the concurrent Municipal Class Environmental Assessment. Phase 3
will entail either an extension to the northerly portion of the building or a second
separate multi-level commercial building.
The proposed retained lands have an area of 9.68 hectare (23.92 acre) and has
frontage along Havens Lake Road. The proposed retained lands will be future
residential. Agricultural, lakeshore residential and seasonal travel trailer uses surround
the subject lands. The location of the subject lands are on the attached Key Map in
Appendix 'A'.
The following have been submitted as part of this proposed severance application:
Planning justification report, Kirkness Consulting Inc., 2015;
Comprehensive Servicing Strategy, and Engineering Servicing Plans,
Scoterra Consulting Group, 2013;
Phase I Site Plan, Ron Koudys Landscape Architect, 2013;
Environmental Impact Study, BioLogic Incorporated, 2015 ;
• Geotechnical Evaluation of Slope Stability Letter, Bedell Engineering Inc., 2013
• Archaeological Assessment, Phase I and II, Mayer Heritage Consultants Inc.;
and,
Lower Thames Valley Conservation Authority Development Regulated Area letter
of approval for application, 2014.
DISCUSSION:
Municipal Engineer's Review
Chris Lierman, P. Eng. of Spriet Associates Engineers & Architects has reviewed the
comprehensive servicing strategy, which includes the engineering service plans. Mr.
Lierman has commented that the overall submitted design information appears to
adequately permit the severance; however, additional information on several matters as
identified in his attached letter in Appendix 'C' related to formal approval of the design
drawings is required.
Provincial Polley Statement
Under Section 3(5) of the Planning Act, the Municipality "shall be consistent. with'
matters of provincial interest as set out in the Provincial Policy Statements (PPS).
Section 1.1.1 Heathy Liveable and Safe Communities, Section 1.1.3 Settlement Areas,
Section 1.6.6 Sewage, Water and Stormwater, Section 2.1 Natural Heritage, Section 2.6
Cultural Heritage and Archaeology and Section 3.1 Natural Hazard policies were
reviewed.
Comment: Section 1.1.1 healthy liveable and safe communities require development to
occur in a manner that is sustainable for the long-term, with efficient use of
infrastructure and resources and does not compromise the environment and public
health and safety. The proposed severance meets Section 1.1.1.
Section 1.1.3 Settlement Areas states the focus of growth and development is to occur
in settlement areas such as urban areas and rural settlement areas. The subject lands
are located within the Lakeshore Area of the Municipality of West Elgin Official Plan
which is designated for commercial and residential development. The proposed
severance meets Section 1.1.3. --
Section 1.6.6 Sewage, Water and Stormwater states full municipal services are the
preferred form of servicing for settlement areas. Scoterra Consulting Group has
prepared a comprehensive servicing strategy. The proposed Phase 1 commercial
parcel will be serviced by municipal water, with a private water services connection from
the existing municipal watermain located within Havens Lake Road. Interim sanitary
service will be in the form of a temporary sewage holding tank with off-site haulage to
the Rodney Sewage Treatment Plan. Interim sanitary servicing is ,required until a
permanent wastewater servicing solution is established in connection with the larger
residential Seaside Development, which is contingent upon completion of a Municipal
Class Environmental Assessment, currently in process with the Seaside residential draft
plan approvals. Stormwater runoff resulting from the commercial entrance and parking
area will be directed to an oil/grit separator unit with greater than 80% suspended solids
removal. There will also be a bioswale to provide for surface and sub-surface
attenuation of stormwater runoff, prior to controlled release to the receiving watercourse
east of Havens Lake Road. The proposed severance meets Section 1.6.6.
Section 2.1 Natural Heritage, particularly Section 2.1.5 states development and site
alteration shall not be permitted significant woodlands unless it has been demonstrated
that there will be no negative impacts on the natural features or their ecological
functions. An Environmental Impact Study (E.I.S.) was prepared by Biologic
Incorporated (Environmental Planners). The E.I.S. demonstrated there will be no
negative impact to the woodlands, which occupies a portion of the subject lands. The
E.I.S. will be required to be reviewed by Lower Thames Valley Conservation Authority.
Based upon the submitted E.I.S., the proposed severance meets Section 2.1,
particularly Section 2.1.5.
Section 2.6 Cultural Heritage and Archaeology states that development and site
alteration shall not be permitted on lands containing archaeological resources or areas
of archaeological potential unless significant archaeological resources have been
conserved. A Phase I and II archaeological assessment has been prepared by Mayer
Heritage Consultants Inc. and no concerns were raised. The proposed severance meets
Section 2.6.
Lastly, Section 3.1 Natural Hazards states development shall generally be directed
outside of hazardous lands adjacent to the shorelines of the Great Lakes — St.
Lawrence River System, which is impacted by erosion hazards. A Geotechnical Slope
Stability Study has been prepared by Phil Bedell, P. Eng. of Bedell Engineering Inc.
(formerly of Golder and Associates Ltd.). The geotechnical slope stability evaluation is
further to extensive geotechnical investigations of the site previously undertaken by
Golder and Associates Ltd. and LVM Inc.. It is stated in the geotechnical slope stability
study the slope's safety and stability will not be compromised by the proposed location
of Phase 1 and future Phase 2 commercial buildings. The proposed severance meets
Section 3.1.
Conclusion: Upon review of the applicable PPS policies, the proposed severance
application is consistent with the PPS.
County of Elgin Official Plan
The subject lands are designated Agricultural Area with Woodlands and Hazardous
Lands overlays. Section C2.2 Agricultural Area - Location recognizes there are lands
outside of settlement areas that have been designated for non-agricultural development
by the lower tier Official Plans and therefore, are deemed not be within the prime
agricultural area and are instead subject to the applicable policies of this Plan and the
policies of the lower tier Official Plan.
Section E1.2.3.1 General Development Policies — General Criteria permit the severance
of a new lot for any purpose provided the lot to be retained and the lot to be severed
provided the criteria for lot creation have been met.
Comment: The subject lands are designated Agricultural Area, however, they are
designated Lakeshore Area in the Municipality of West Elgin Official Plan. It is my
understanding the County intends to correct this discrepancy during the 5 year review of
the County Official Plan. In the interim, the subject lands have been reviewed under
Section C2.2 and meet the policy criteria.
The proposed severed and retained parcels have frontage on Havens Lake Road,
which is currently a seasonal municipal road. The Municipality is prepared to maintain
the road on a year-round basis once Seaside is ready to begin construction on the
proposed severed parcel and the appropriate arrangements between Seaside and the
Municipality for such maintenance have been made. It is not anticipated the proposed
commercial development will create a traffic hazard for Havens Lake Road or for the
Municipality on the whole.
The proposed severed and retained lots have the appropriate frontage and lot area for
their intended uses. A Zoning By-law Amendment is required to rezone the proposed
severed parcel from Agricultural with Exception (A1-20) to Tourist Commercial with
Exception (C3-1) in the Township of Aldborough Zoning By-law and to site-specific
Tourist Commercial (TC-1) in the proposed Municipality of West Elgin Zoning By-law to
permit a reduced front yard depth, increased maximum building height, and decreased
off-street parking spaces.
A comprehensive servicing strategy has been prepared to meet the short-term and
long-term servicing needs for the development. A Development Agreement will be
required to be entered into between the owner and the Municipality for the interim
servicing strategy of a holding tank for sanitary servicing.
Site Plan Approval, including the signing of an Agreement by the owner will be required.
The Agreement will include lot grading and lot drainage plans to ensure there will not be
negative impacts on drainage patterns in the area resulting from stormwater
management, a landscaping plan, off-street parking and loading area plans, lighting and
other site development issues raised during this process.
The retained parcel will continue to be used for agricultural uses.
The E.I.S. prepared for the proposed commercial development demonstrates there will
be no negative impact on the significant features and function of the woodlands.
The geotechnical slope, prepared by Bedell Engineering Inc. concludes the slope's
safety and stability will not be compromised by the proposed location of Phase 1 and
future Phase 2 commercial buildings.
The lands severed and retained parcels are designated Lakeshore in the Municipality of
West Elgin. Commercial uses, particularly tourist retail and service establishments and
agricultural uses are permitted.
The proposed severed and retained parcels meet the severance policy of Section
E1.2.3.1.
Conclusion: Upon review of the applicable Official Plan policies, the proposed
severance application conforms to the County of Elgin Official Plan.
Municipality of West Elgin Official Plan
The subject lands are designated as Lakeshore Area with Woodlands and Hazardous
Lands overlays in the Municipality of West Elgin Official Plan. The Lakeshore Area
policies permit tourist retail and service establishments and agriculture as a secondary
use.
Section 3.3.7 Natural Heritage — Woodlands, ANSI's and Valleylands states
development is permitted where it has been demonstrated that there will be no negative
impact on the natural feature or on its ecological functions.
Section 10.4 Consents permits the creation of lots by severance provided the severance
criteria are met.
Comment: A Zoning By-law Amendment is required to rezone the proposed severed
parcel from Agricultural with Exception (A1-20) to Tourist Commercial with Exception
(C3-1) in the Township of Aldborough Zoning By-law and to site-specific Tourist
Commercial (TC-1) in the proposed Municipality of West Elgin Zoning Bylaw to permit a
reduced front yard depth, increased maximum building height, and decreased off-street
parking spaces.
The proposed severed and retained parcels are affected by the Woodlands and
Hazardous Lands overlay. Given that there are no buildings to remain on the proposed
retained parcel and no proposed development in the Woodlands, it is anticipated there
will be no negative impacts to the Woodlands as a result of the severance. The
proposed retained parcel meets Section 3.3.7.
The proposed severed and retained parcels meet the policies of Section 10.4 for lot
creation.
Conclusion: Upon review of the applicable Official Plan policies, the proposed
severance application conforms to the Municipality of West Elgin Official Plan.
Municipality of West Elgin - Pork G_laggow Secondary Plan
The subject lands are also part of the Port Glasgow Secondary Plan, which designates
the proposed severed parcel as Commercial. The Commercial designation permits
commercial uses such as retail, service and hospitality uses which provide services for
permanent and seasonal residents and the recreational day users and tourist visitors of
Port Glasgow. Residential uses are permitted in the upper floors of a commercial
building. Mixed uses, with commercial use occurring on the ground floor and residential
use occurring on the upper floors of a building or at the rear of a ground floor
commercial use is permitted.
Comment: The proposed severed parcel will include a restaurant, retail stores,
residential apartments and hotel accommodations, which is permitted in the Commercial
designation.
Conclusion: Upon review of the applicable Secondary Plan policies, the proposed
severance application conforms to the Municipality of West Elgin — Port Glasgow
Secondary Plan.
TownshiR of Aldborou h Zoning-By-law 89-8
The subject lands are zoned Agricultural with Exception (A1-20) and Agricultural (A1). A
Zoning By-law Amendment is required to rezone the proposed severed parcel from
Agricultural with Exception (A1-20) to Tourist Commercial with Exception (C3-1) to
permit a reduced front yard depth, increased maximum building height, and decreased
off-street parking spaces. The balance of the property, the proposed retained parcel will
be 9.679 hectares (23.92 acres) in area and is required to be rezoned to permit a
minimum lot area of 9.6 hectares (23.72 acres).
Proposed Municipality of West Elgin Zoning B -law
In the proposed Municipality of West Elgin Zoning By-law, the subject lands are
proposed to be zoned Lakeshore Development (LD). Municipal Council will be adopting
the proposed zoning by-law in the very near future and depending upon the timing and
subject to any appeals to the Ontario Municipal Board for the zoning by-law, the
Township of Aldborough Zoning By-law and the Municipality of West Elgin Zoning By-
law may be amended simultaneously.
Other Issues/Matters
The proposed severed parcel is within the regulated area due to their proximity to the
Lake Erie shoreline, pursuant to Ontario Regulation 152106 (under 0. Reg. 97104) made
under section 28 of the Conservation Authorities Act. Seaside's submission of an
Application for Development, Interference with Wetlands and Alterations to Shorelines
and Watercourses pursuant to Ontario Regulation (0. Reg.) 152106, for phase 1 and
future phase 2 of a 0.51 hectare (slightly smaller land area) commercial development
was made in November 2013 and has received approval from the Executive Committee.

We hereby confirm receipt of the first submission Design Drawing set (Sheets No. SS1 -
SS.3) related to a proposed commercial property development within the proposed Seaside
Waterfronts Development, as prepared by Sco-Terra Consulting Group Limited.
We understand that the proponent wishes to have the severance application for this
commercial property presented to Municipality of West Elgin Council at the upcoming meeting on
March 26, 2015. We have completed Our review of the submission design package and offer the
following Comments:
Overall,the submitted design drawing set appears adequate to allow approval for the
proposed severance application.
However, it is noted that numerous detailed design issues have not been received, or
require clarification,in order to formally approve the design from a.peer review perspective. Such
information includes the following:
* Detailed Stormwater Management (SWM) calculations must be provided in terms of pre versus
post-development flows and the related SWM retention within the site. Orifice design calculations
will need to be included in the SWM report and shown on the drawings. This report shall also
include details into the proposed Stormwater Bioswaie specifically related to proposed design
parameters and groundwater infiltration.
*We note the proposed "Oil and Grit" separator within the proposed parking lot. Provide
supporting documentation into the proposed Stormceptor STC 3001 Unit.
*Additional existing and proposed elevations will be required to provide verification of the
proposed grading and drainage patterns within and adjacent to the proposed site.
* Confirm if a Landscape Plan will be provided related to naturalization purposes.
*We understand that the Class Environmental Assessment (Class EA) is not yet completed for the
overall Seaside Development. As such, we will ultimately request confirmation that all elements of
this proposed commercial development have been designed in accordance with the approved
Class EA, once formally approved.

*Show "ticks" at all existing and proposed elevations to show the location for all noted elevations.
This will allow a more thorough understanding and review of the proposed elevations and grading
within and adjacent to the site.
*We recommend that the entire project site perimeter be provided with silt fence during
construction.Add a Note to this effect on the drawings accordingly.
* Provide additional details into the link between the proposed Bioswale and 3:1 ditch located
along the southerly limit of the site.
* Finished floor elevations do not match from SS-1 to SS-3. Revise accordingly.
Confirm how the "overall"Seaside subdivision design and concept is affected by this proposed
Commercial property. Similarly, please confirm if and how any "ultimate" servicing from exterior
(upstream) lands within the overall development will be distributed through this property. We note
from other related design documentation from the overall development that the sanitary sewer
from upstream lands may be aligned and outlet through this commercial property. Please confirm
that there are no anticipated conflicts.
*We have not reviewed the submission in terms of zoning, bylaw, setback issues, etc, as they are
to be reviewed by the Municipality of West Elgin.

SUBJECT: PROPOSED CONSENT APPLICATION FOR LAKEVIEW ALDBOROUGH
BLUFFS INC. CIO ALLAN MURRAY
RECOMMENDATION:
THAT Council of the Municipality of West Elgin recommend APPROVAL to the Land
Division Committee of the County of Elgin for the proposed Consent application
provided the following conditions are included:
a) That a Zoning By-law Amendment is in force and effect for the proposed
severed parcel;
b) That septic system review for the severed lands has been completed; and,
c) That Municipal drain re-apportionments (if required) have occurred.
BACKGROUND:
An application for proposed severance was submitted to the Municipality by Lakeview
Aldborough Bluffs Inc. c/o Allan Murray. The applicant is requesting the severance of a
0.68 hectare (1.68 acre) piece of land, legal description as Part Lot 4, Concession 14,
on the south side of Gray Line, in the geographic Township of Aldborough, and known
,municipally as 21707 Gray Line (as shown on the attached Key Map). The purpose of
the severance is to permit the severance of a residential parcel.
The proposed severed lands are zoned Agricultural (Al) Zone in the Township of
Aldborough Zoning By-law No. 89-8 and designated Lakeshore Area with Woodlands
overlay and Lower Thames Valley Conservation Authority Regulatory Line in the
Municipality of West Elgin Official Plan. The proposed severed lands have an area of
0.68 hectares (1.68 acre) and a frontage of approximately 60.6 metres (198.83 ft.) along
Gray Line. The proposed severed lands will contain a house, detached shed, private
well and private septic system.
The proposed retained lands have an area of 29.95 hectare (74.0 acre) and has
frontage along Gray Line. The proposed retained lands will be vacant. In 2013, a
severance application was approved by County of Elgin Land Division Committee to
permit the severance of a parcel of land from the proposed retained lands for a lot
addition for South Part Lot 4, Concession 14 to provide frontage to the property to
facilitate residential development; however, the severance has expired. There is still a
right-of-way easement, along the west lot line of the proposed retained lands to provide
access to South Part Lot 4, Concession 14, which is in effect. The right-of-way
easement is 10.06 metres (33.02 ft.) in width and 509.78 metres (1,672.5 ft.) in length.
Agricultural, lakeshore residential and seasonal travel trailer uses surround the subject
lands. The location of the subject lands are on the attached Key Map.
DISCUSSION:
Provincial Policy Statement
Under Section 3(5) of the Planning Act, the Municipality "shall be consistent with"
matters of provincial interest as set out in the Provincial Policy Statements
(PPS).Settlement Areas, Sewage and Water, Natural Heritage, and Cultural Heritage
and Archaeology policies were reviewed and no concerns were evident.
Conclusion: Upon review of the applicable PPS policies, the proposed severance
application is consistent with the PPS.
County of Elgin Official Plan
The subject lands are designated Agricultural Area with Woodlands overlay. Section
C2.2 Agricultural Area - Location recognizes there are lands outside of settlement areas
that have been designated for non-agricultural development by the lower tier Official
Plans and therefore, are deemed not be within the prime agricultural area and are
instead subject to the applicable policies of this Plan and the policies of the lower tier
Official Plan.
Section D1.2.3 Natural Heritage — Development and Site Alteration Development states
development and site alteration is not permitted in significant woodlands unless it has
been demonstrated that there will be no negative impacts on the natural features or
their ecological functions.
Section E1.2.3.1 General Development Policies — General Criteria permit the severance
of a new lot for any purpose provided the lot to be retained and the lot to be severed
provided the criteria for lot creation have been met.
Comment: The subject lands are designated Agricultural Area, however, they are
designated Lakeshore Area in the Municipality of West Elgin Official Plan. It is my
understanding the County intends to correct this discrepancy during the 5 year review of

Agricultural (Al) Zone and used for agricultural uses. .

On behalf of the Elgin County Plowmen's Association, we wish to thank the Municipality
of West Elgin for the previous grants which you have provided for our Elgin County
Plowing Match. This year our Match will take place on September 5th at a farm in Elgin
County yet to be determined.
We are requesting a grant of$200 from the Municipality of West Elgin to assist us to
carry on with the Elgin Match. As well, your grant will assist us to support our thriving 4-
H plowing club. As an affiliate of the Ontario Plowmen's Association, our mandate is to
showcase agriculture and country living in Elgin County. Through the plowing
competition and displays at our annual Elgin County Match we provide education,
information and entertainment to the spectators who attend from Elgin and surrounding
counties.

Re: $44,500 request for Capital Expenditure Grant for 2015
As a follow up of our recent conversation, this communication will act
as Beattie Haven's request for a 2015 West Elgin Capital Expenditure
grant.
As identified in our 2014 request, replacement of our aged boiler
system remains our major concern. We are very thankful that the
existing system carried us through this frigid winter season without
incident and with thoughts that we could have a repeat in coming
seasons, we would feel much more confidence by replacing the system
now. The lowest quote we have received is for $49,482. Beattie Haven
is able to fund 10% of the project from our donation fund. The grant
would enable replacing existing 3 gas boilers with 2 high efficiency gas
boilers with 10 year warranty, as well as 1 high efficiency water heater.
West Elgin council has been very supportive of BEATTIE HAVEN in
years past and the 40 full and part time employees, the 30ish families
of resident and board members are very appreciative for your support
of this valuable asset in our community. We thank you in advance for
our consideration of this request.

application deadline for the Premier's Award for Agri-Food Innovation
Excellence program and to encourage you to share this information.
The Premier's Award for Agri-Food Innovation Excellence program was
created to recognize and foster the spirit of innovation that thrives in
Ontario's agricultural sector. It encourages the development of rural
communities, farms, agri-food processors and agri-food organizations by
adding value to existing products, creating jobs and driving economic
growth.
Each year the program recognizes up to 45 innovations across the
province. Award.recipients will receive $5,000, a plaque, gate sign and
various promotional materials. In addition, there will be a Premier's Award
valued at $75,000, a Minister's Award valued at $50,000 and three
Leaders in Innovation Awards valued at $25,000 each.
Primary producers, processors and agri-food organizations are invited to
submit applications. Details on eligibility, innovation categories,

Dear Mayor Wiehle,
I understand the fiscal challenges that municipalities are facing and that your tax dollars have to be used
effectively. That's one of the reasons I was so disappointed to learn that some social housing providers
are being forced to pay more than they should for services.
As you know, provincial legislation makes it mandatory for affordable housing providers to purchase gas
and insurance through the Housing Services Corporation (HSC). A number of municipalities have found
that they are paying more for gas than if they were to purchase it through other sources.As well, many
providers are paying HSC an opt out fee (2.5%of the premium) in order to be allowed to purchase less
expensive insurance that provides equal or better coverage.
I believe that affordable housing providers should be allowed to purchase these items at the best
possible price—whether it is directly,jointly with the municipality, through Local Authority Services, or
through HSC. I also have concerns about recent spending at the HSC, including frequent international
travel and money transferred to subsidiaries and other for-profit companies.
To save municipalities money and ensure affordable housing dollars are used effectively I recently
introduced the Housing Services Corporation Accountability Act. If passed, this Act will:
• Save affordable housing providers money on natural gas and insurance by removing the
mandatory requirement to purchase them through the Housing Service Corporation;
• Restore accountability by requiring HSC to report salaries over$100,000 as municipalities and
government agencies do;and
• Give the Provincial Auditor the authority to audit the HSC without requiring a Minister's request.
I ask for your support for this bill to ensure that affordable housing dollars can provide the maximum
benefit to help those who need it most. In case it is helpful I have enclosed a sample resolution of
support.

Housing Services Corporation Accountability Act, 2015
EXPLANATORY NOTE
The Bill amends the Housing Services Act, 2011 in the following ways:
1. Section 150 is amended to permit the Auditor General to audit the accounts of
the Housing Services Corporation and of each of its subsidaries.
2. Section 151 is amended so that members of the Housing Services Corporation
such as service managers and local housing corporations are not required to
participate in any of the Corporation's programs or activities.
The Bill also amends the Public Sector Salary Disclosure Act, 1996 to specify that the
Housing Services Corporation and each of its subsidiaries are employers for the purposes
of the Act.
An Act to amend the Housing Services Act, 2011 and the
Public Sector Salary Disclosure Act, 1996
Her Majesty, by and with the advice and consent of the Legislative Assembly of the
Province of Ontario, enacts as follows:
HOUSING SERVICES ACT,2011
1. (1) Section 150 of the Housing Services Act, 2011 is amended by adding the
following subsections:
Auditor General
(2) The Auditor General appointed under the Auditor General Act may audit the
accounts of the Corporation and of each of its subsidiaries.
Access to records and information
(3) When the Auditor General conducts an audit under subsection (2), the
Corporation and its subsidiaries shall give the Auditor General and employees of the
Auditor General access to all records and other information required to conduct the audit.

(2) Section 151 of the Act is repealed and the following substituted:
Member participation not required
151. Members of the Corporation such as service managers and local housing
corporations are not required to participate in any of the Corporation's programs or
activities described in section 124.
PUBLIC SECTOR SALARY DISCLOSURE ACT,1996
2. (1) The definition of"employer" in subsection 2(1) of the Public Sector
Salary Disclosure Act, 1996 is amended by striking out"and" at the end of clause
(b), by adding "and" at the end of clause (c) and by adding the following clause:
(d) the Housing Services Corporation and each of its subsidiaries;
(2) Subsection 2 (1) of the Act is amended by adding the following definition:
"Housing Services Corporation" has the same meaning as in the Housing Services Act,
2011;
COMMENCEMENT AND SHORT TITLE
Commencement
3. This Act comes into force on the day it receives Royal Assent.
Short title
4. The short title of this Act is the Housing Services Corporation Accountability
Act, 2015.
Sample resolution for Municipal Council
WHEREAS social housing providers in Ontario are currently required to purchase natural gas
and insurance through the Housing Services Corporation (HSC) or pay a fee to purchase
elsewhere; and
WHEREAS social housing providers should have the right to obtain natural gas and insurance at
the lowest cost to provide value to those in need of affordable housing and all taxpayers; and
WHEREAS the HSC should be subject the same level of accountability and oversight as
government agencies;
THEREFORE BE IT resolved that the Council of(name of municipality) supports the Housing
Services Corporation Accountability Act introduced by Oxford MPP Ernie Hardeman which
would remove the mandatory requirement for social housing providers to purchase gas and
insurance through the HSC, require HSC to report salaries over$100,000, and give the
Provincial Auditor General the authority to audit HSC.
