Mr. Halwa noted he has not completed a review of comments received. He is trying to prevent the perception in the by-law that the municipality has responsibility for wetlands. It was noted that mapping changes for wetlands does not require an amendment to the zoning by-law. The requested amendments were deferred to May 28th to allow Mr. Halwa to complete his review and that no further comments will be entertained from the provincial agencies. RES. Grading and dragging of gravel roads continued throughout April to eliminate potholes and repair frost damage. "Half Load" season ended on April 3& and lack of significant rainfall has helped firm up soft spots and leave gravel roads in good condition. 2. Winter equipment was removed, washed, oiled and stored for summer. 3. Mobile Sweeping of London completed the spring cleaning of all curbs and gutters in Rodney, West Lorne and outlying areas. 4. Public Works operators constructed a large gravel pad for the new recycling depot at our municipal landfill. 5. Topsoil was stripped at Kearns pit in preparation for this year's "B" gravel production and rehabilitation of areas where gravel had already been removed was started. 6. Chainsawlchipper training was provided to the second half of our public works operators (first half was completed in 2014). 7. The Recreation department has hired two Parks Maintenance Staff and all of the summer maintenance activities are under way. 2. Preparations are still on-going for the construction of the Pavilion in Miller Park as soon as we can get on the ground. 3. The repairs at the pool are coming along. The ground water is proving to be more of an issue than was originally thought. The building permit has been applied for, and hopefully by this session of council the new floor will have been installed. 4. Preparations are underway for the installation, acquiring estimates for the installation of acoustic panels at the Rec Centre. 5. The Pool mechanically is ready to go,the pump has been rebuilt and re installed. We are currently acquiring estimates for the roof replacement. 6. During this the netting is scheduled to be installed behind the soccer fields 7. The benches have been re-installed on the sidewalks in West Lorne. 8. 1 have a meeting scheduled with the West Lorne Kiwanis and West Lorne Horticultural society this Friday regarding possible improvements to Krebsz Park. The Municipality of West Elgin TO: COUNCIL OF THE MUNICIPALITY OF WEST ELGIN FROM: Jeff Slater, Recreation Superintendent CEMC DATE: May 14 2015 SUBJECT: Miller Park Light Tower RECOMMENDATION: That Council approve the replacement of the right field light tower in Miller Park and maintain the current level of services for 2015, and that consideration is given to replacing the entire lighting system in 2016. To effect the single tower replacement will require approximately 4-6 weeks. INTRODUCTION 1 DISCUSSION: On or about April 20 2015 the right field light tower in Miller Park was discovered lying on the ground. The weather/wind knocked down the tower sometime during the night of April 19. Currently we have three nights of baseball diamond use that require the lights, Monday, Wednesday, and Thursday. All current users of the baseball diamond have been advised of the situation either in person, via e-mail or telephone. All of the current users have agreed to start their games at 7 pm until the situation is repaired. The approximate cost to replace the single tower is$ 11,500.00. If all of the light towers are replaced the individual cost per tower goes down,the approximate cost for the entire lighting system is $ 60,000.00. Obviously this is an unexpected and non-budgeted for expense. The entire lighting system cannot be used as the system is designed to have all of the towers and lights operating, and to operate them incomplete would certainly increase the Municipalities liability. The other consideration for the municipality is that all of the towers are the same age, is there a question of structural integrity with the remaining towers. INTRODUCTION; The Recreation Department has replaced the 12 'tandem axle and would like to declare that trailer as surplus equipment. Also the Recreation Department has in the past used a container, 8 feet high,by 20 feet long, and 8 feet wide to store seasonal equipment. The equipment that we have stored in this container in the past oxidises (rusts) very badly, and any other equipment that we store in this container gets mouldy and wet. We are not currently storing anything in this unit. The container does not leak, it is simply too humid on the inside. During the summer moister runs down the inside of the walls. This is the same container that the fair board used previously, and also complained about. The equipment was replaced with the Hurst E-Draulic extrication equipment and declaring them surplus provides the opportunity to sell the used equipment. Rodney Fire Chief Administrator Treasurer V4Puoe T J lR Q V � 2 � The Municipality of West Elgin TO: COUNCIL OF THE MUNICIPALITY OF WEST ELGIN FROM: Jeff Slater, Rodney Fire Chief DATE: May 14 2015 SUBJECT: Surplus Extrication Equipment RECOMMENDATION: That Council approve the sale of the used Hurst Extrication Equipment to Norris Point Volunteer Fire Department for the purchase price of$ 650.00, with the understanding that the tools are sold in "as is " condition and that any repairs, testing, or certifications that may be required are the responsibility of the Norris Point Fire Department. Further that the Norris Point Fire Department be responsible for the freight 1 shipping costs to have the equipment shipped to their location. INTRODUCTION: Norris Point is a rural Volunteer Fire Department servicing some 70 Ian of highway in Newfoundland. To date they do not have any extrication tools available in a timely manner. INTRODUCTION: WDO has approved Product Care Association's plan for Paints and Coatings. Previously paints were included in the agreement with Stewardship Ontario. DISCUSSION: Effective June 1, 2015 Product Care Association (PCA) Industry Stewardship Plan (ISP) for paints and coatings comes into effect. As a result, an agreement is required with PCA and replaces the portion of the existing agreement with Stewardship Ontario for paints. Further, the collection will now include all aerosol paints and non-pesticide marine coatings that will be collected at our Household Hazardous Waste Day Event. PCA has notified all service providers, including Hotz Environmental, of the changes to the program. PCA will pay the municipality a rate of$1,100.00 per tonne of approved materials plus applicable taxes. This is the same as under the Stewardship Ontario agreement. The Municipality of West Capital Plan of $2,094,343.35 of which $1,476,923.35 will be funded from property taxes & grants and $617,420.00 from user paid departments (Rodney and West Lorne Wastewater Plants and the Port Glasgow Trailer Park). No Long-Term borrowing will be used to complete the 2015 Capital Plan, as funding will be from 2015 budget and accumulated reserves set aside for Capital Projects from past years. The proposed increase in Water Rates of 3% effective July 1, 2015 for the increase in Wholesale cost of water. A preliminary plan was submitted to the MOECC on February 20, 2013. As discussed in the 2014 Annual Site Monitoring and Operations Report and during the Council Meeting on April 9, 2015, now that the final CAZ purchase to the east has been confirmed, a Final Trigger Mechanism and Contingency Plan can be prepared and submitted to the MOECC. Assessments of data moving forward should be compared to either the preliminary Plan (\VESA, 2013) or a newly revised plan. Assi nment 11.1 K2 Wind may not assign this Agreement without the written consent of ACW, which shall not be unreasonably withheld, except that no consent shall be required (i) for K2 Wind to assign this Agreement to an affiliated or successor entity, or to a buyer of all or part of K2 Wind's interest in the Wind Project, provided that all payments due under this Agreement have been satisfied and the assignee agrees in writing to assume and fulfill all of the covenants, agreements, terms and provisions and to abide by all limitations set forth in this Agreement, or(ii) for purposes of securing indebtedness or other obligations respecting the Electrical Infrastructure or the Wind Project, provided that if the Secured Party realizes on the security and further assigns this Agreement, the assignee agrees in writing to assume and fulfill all of the covenants, agreements,terms and provisions and to abide by all limitations set forth in this Agreement. ACW acknowledges that a change in control of K2 Wind shall not be considered an assignment by K2 Wind of this Agreement or of any of K2 Wind's rights and obligations under this Agreement. 11.2 For greater certainty, K2 Wind shall be entitled to assign this Agreement and all of its — rights thereunder without the consent of ACW to K2 Wind's lenders ("Secured Parties" or"Secured Party" as applicable) as security for K2 Wind's obligations to such Secured Parties which shall be further entitled to assign this Agreement and K2 Wind's rights thereunder in connection with an enforcement of their security. ACW hereby agrees to execute and deliver an Acknowledgement and Consent Agreement in favour of any applicable Secured Party or assignee thereof, in the form attached as Schedule B, or as may otherwise be agreed. 11.3 K2 Wind shall be entitled, with the written consent of ACW, which may not be unreasonably withheld or conditioned, to assign this Agreement to a transferee of the Wind Project other than an affiliated or successor company,and K2 Wind shall thereupon be released from any and all obligations under this Agreement from and after the date of such assignment, provided that such assignee has agreed in writing with ACW, in a form acceptable to the assignee and ACW both acting reasonably, to be bound by the provisions of this Agreement from and after the date of the assignment. 12. Default 12.1 If a Party shall commit a breach of or omit to comply with any of the provisions of this Agreement (the "Defaulting Party"), the other Party (the"Complainant") may give the Defaulting Party notice in writing specifying the breach complained of and indicating the intention of the Complainant to terminate this Agreement unless the Defaulting Party shall have remedied the breach within the period mentioned in the notice, which period shall be not less than sixty(60 clays). If the Defaulting Party shall have within such notice period commenced to remedy the breach and has diligently pursued the remedying thereof, the Defaulting Party shall be allowed one hundred and fifty (150) days after the expiry of the original notice period to remedy the breach.
