By-Law No. 06-13
BEING A BY-LAW TO AUTHORIZE THE DIRECTOR OF ENGINEERING SERVICES
TO TEMPORARILY CLOSE COUNTY ROADS FOR CONSTRUCTION PURPOSES AND
TO ESTABLISH LOWER SPEED RATES IN CONSTRUCTION ZONES ON ROADS
WITHIN THE COUNTY OF ELGIN ROAD SYSTEM
WHEREAS pursuant to Section 42 of the Municipal Act, 2001, S.O. 2001, c.25, a
municipality may pass by-laws delegating authority to an employee of the municipality,
subject to any conditions which the municipality may impose, the power to close a highway
temporarily for any purpose specified in the by-law; and
WHEREAS pursuant to Section 128(8.1) of the Highway Traffic Act, RS.O. 1990, C
H.8, a person appointed by a municipality may designate a highway or portion of a
highway under the municipality's jurisdiction as a construction zone, and every
construction zone designated shall be marked by signs in accordance with the regulations
and,
WHEREAS a person authorized under Section 128(8.1) of the Highway Traffic Act,
RS.O. 1990, C H.8, may set a lower rate of speed for motor vehicles driven in the
designated construction zone than is otherwise provided, and the speed limit shall not
become effective until the highway or portion of it affected is signed in accordance with the
Highway Traffic Act and regulations.

NOW THEREFORE
enacts as follows
1. THAT the authorization be and is hereby granted to the Director of Engineering
Services to temporarily close County Roads for construction purposes
2. THAT authorization be and is hereby granted to the Director of Engineering
Services to designate construction zones and to reduce speed limits within that zone within
the County of Elgin Road System.
3. THAT designation of construction zones and reduced speed limits shall not become
effective until the highway or portion of it is signed in accordance with the Highway Traffic
Act and applicable Regulations.
