1030 a.m. - New Comprehensive Zoning By-la
Mr. Halwa reported that the suggestions of the Ministry of Municipal Affairs,
Natural Resources and Lower Thames Valley Conservation Authority have been
incorporated into the by-law. He is concerned how the requirements for setbacks
of trailers will work. Ms. James also is concerned how this will evolve. Ms.

James also noted that the shoreline management study is not completed yet,
Setbacks will be reviewed again once this study is completed.
11:00 a.m.—Gary Blazak—Update on Seaside Waterfronts&Lighthouse
developments
Mr. Blazak reported on three projects.
1. Seaside Waterfronts on Lot 6: The municipal Class EA is proceeding.
Ministry of Natural Resources has requested more natural heritage study now
that the preferred option has been identified. This work is now complete and
the report will be submitted to MNR. The Ministry of Environment is now the
lead agency. Once the Environmental Impact Study is accepted,will proceed
to Phase 3 which is the detailed design. The draft plan will be revised to show
the blocks for servicing. A new draft plan of condominium will then be
submitted to the County of Elgin.
2. Commercial severance on Lot 6. This application is no longer being pursued
as it was considered as piecemeal development by the Ministry of
Environment which is contrary to the Environmental Assessment Act.
3. Lighthouse condominium proposal on Lot 5. The proposal is for 8 lots on the
bluff at the south end of the property. An application has been submitted to
the County of Elgin. These lands are not subject to the secondary plan for
Port Glasgow but are subject to the lakeshore requirements of the Official
Plan. The Conservation Authority has raised concerns relating to the
regulated area next to the shoreline. An engineering study has been
completed and building envelopes have been identified. The plan showed
steps to the lake, which have been deleted as requested by the Conservation
Authority. Concern was also raised about the hazard lands (ravine)in relation
to the location of the proposed road. The road is located outside of the
hazard lands. The Ministry of Environment has recommended a servicing
options report be prepared by the municipality and Mr. Blazak is requesting
the municipality to undertake this report. Further, he is requesting the public
meeting for this development be scheduled once the servicing options report
is completed.
11:30 a.m.—Michelle Horst RealTerm Ener gy-streetlights
Also in attendance: Public Works Superintendent
Ms. Hjorst gave an overview of the program noting that 65%energy saving can
be achieved. A GIS audit of our streetlight system is completed and this
information is used for the design to RP8 standards.A report is submitted to
Council. Council has the option not to proceed; however,the cost to complete
the audit will have to be paid. If approved, they will submit an incentive
application to ISO which will cover 20%of the project casts. They will use
existing poles and arms. The Administrator/Treasurer noted West Elgin has 400
streetlights, capital expenditure of$204,000, and net cost of$165,000 with a
return of 4.1 years. Decorative lights and arms are more expensive and can be
installed at a later date.

Discussion on this by-law was deferred from the April 23`d meeting. The Deputy
Mayor noted that she felt that a fencing by-law is needed in the villages.
Councillor Wolf noted that fencing should be for practical purposes, not a barrier.
After discussion, it was decided that councillor would submit comments in writing
to the Clerk by June 111h and a further report will be prepared.

The Mayor called the meeting to order at 9:30 a.m.
Mr. Smith presented a PowerPoint presentation that provided an overview of the
Elgincentives Community Improvement Plan. The County has prepared a county-wide
framework for community improvement planning for the county. The next step is for
each lower tier municipality to formalize their agreement with the county plan. The
County will administer the CIP in partnership with local municipalities and provide
funding for financial incentive programs. An Implementation Committee will be
delegated the role of reviewing and approving financial incentive programs, market
Elgincentives and monitor results. The project areas include an agricultural sub-area,
settlement sub-area and lakeshore/tourism corridor priority areas.
The floor was opened for questions:
Councillor Leatham noted that this will help existing businesses. Mr. Smith noted that
they can improve their physical assets.
Mr. Reiss asked if there is an allowance for carry-over of funds as this year the program
won't start until the fall. Mr. Smith reported this would be up to County Council.
Mr. Halwa enquired about Port Glasgow. Mr. Evans noted that Port Glasgow is located
in the priority lakeshore area where enhanced grants will be available.
The Mayor asked how this plan meshes with our CIP. Mr. Smith noted that the two
plans are separate. Mr. Evans reported that the County didn't want to duplicate the
local plans. Their focus is on agriculture, lakeshore, tourism corridors which are similar
throughout the county. It will apply to existing businesses, not new buildings.

Mr. Trickey noted he had no knowledge of community improvement plans. More
advertising is appropriate. Mr. Smith noted that their marketing plan includes more
advertising.
Ms. James presented her report. Notice of the public meeting for the Official Plan
Amendment was advertised in the West Elgin Chronicle on May 7,2015 as well as on
the municipal website. The purpose of the Official Plan Amendment is to add policies to
Section 3.6 Community Improvement to recognize the Elgincentives Community
Improvement Plan in West Elgin. By-laws are required to designate the project area
and adopt the CIP document. The Ministry of Municipal Affairs and Housing have
requested more time to complete their review. An extension has been provided to June
19t . She therefore recommends only two readings of the by-law to adopt the plan.
The Mayor asked if there are any issues with the Ministry. Mr Evans reported that
MMAH knows what the County is trying to do and have provided comments on the
proposed official plan amendments. The County is hoping only comments of a technical
n atu re.

The Administrator reported that he forwarded the details of this program to the Yacht
Club as docks were listed as an eligible category. He was thinking about the pier
project but the timeline to complete is March 31, 2018 which is tight. The Yacht Club
are undertaking a dock project to reduce the liability risk and improve the appearance.
The Yacht Club are requesting that Council support this project in an application for a
grant under this program.

Monthly report for June, 2015
DISCUSSION:
1. "B" gravel production has started at Kearns pit in preparation for
scheduled road construction projects this summer. This is done using
one public works operator, one municipal loader and a screening plant
which is rented from Johnston Bros. Ltd.
2. Stumps left from winter/spring tree removal were ground in May. Crews
removed the grindings, added topsoil and seeded.
3. A trailer mounted vacuum system was rented for the month of May
from Vermeer Canada. Crews utilized the unit for cleaning basins,
bridge washing operations, sign post installation, culvert/tile repair and
utility locates. This allowed us to utilize municipal operators, as
opposed to hiring outside contractors, and worked quite well.
4. All gravel shoulders were graded in May and a berm removal operation
was carried out along Furnival Road (south of Talbot Line) to widen
shoulders in this location.
5. Grading of gravel roads was limited in May due to dry weather and
overall good road condition. Application of maintenance gravel and
dust suppressant is underway with graders/drags preparing roads for
both operations.
6. Lee Gosnell and Chad Yokom attended OGRA's annual Guelph Road
School which was held on May 4-6
7. Additional items carried out by Public Works staff in May were tile drain
repair at Old Boys Park, site preparation for new pavilion at Miller Park,
pothole patching, sidewalk inspections and litter pickup.

problem with hopes that West Elgin residents can help identify the
offending person/s
BACKGROUND:
On 3 separate occasions in recent weeks, Public Works staff has been called
upon to clean up large piles of garbage which have been dumped along area
roadways (see attached photos).
Section 180 of the Highway Traffic Act clearly states;
Every person who throws or deposits or causes to be deposited any glass,
nails, tacks or scraps of metal or any rubbish, refuse, waste or litter upon, along
or adjacent to a highway, except in receptacles provided for the purpose, is guilty
of the offence of littering the highway. R.S.O. 1990, c. H.8, s. 180.
DISCUSSION:
Dumping of waste materials on and/or near the roadway causes;
• A safety hazard for motorists and pedestrians
• Environmental concerns depending on type of material
• Aesthetically unpleasing roadsides for surrounding residents
• Added Municipal costs and resources needed for cleanup
All three cases are very similar in nature. The suspect vehicle (presumably a
small truck/trailer) has pulled just off the roads edge and dumped a substantial
amount of mixed garbage. The majority of items found are building materials and
contents such as wood, shingles, toilets, mattresses, etc...as well as old tires and
paint pails. These types of items could normally be associated with property
clean-up and building demolition or renovation.

INTRODUCTION:
1. The sand ring has been sprayed and will be tilled up this week in
preparation for installation of the fencing.
2. The Recreation Department working in conjunction with the West Lorne
Optimists held the first combined bicycle rodeo on June 6 2015 at the
West Elgin Health Centre Parking Lot and West Lorne Fire Hall. There
was representation from the St. Thomas Elgin Ambulance Service,
Wilsons Towing, the Pool and Day Camp Staff, as well as the West Lorne
Fire Department.
3. The base has been installed for the pavilion in Miller Park.
4. Arrangements have been made to have the new light tower installed in
Miller Park.
5. The beach water testing has resumed and the beach Risk Assessment
has been scheduled for June 25th 2015.
6. An update for the Pool will be available. The pool repairs are coming
along very well, we did have to install a dewatering well at the west end
of the pool in an attempt to control the ground water.

The Rodney Tower was taken out of service May 251h for cleaning and an internal inspection.
The system was pressurized from the West Lorne Standpipe and the highlift pumps at the Tri-
County Water Treatment Plant. There were low pressure complaints due to valves at tower
not holding, which was resolved on the 26th of May. Tower was super chlorinated following
AWWA standards, samples were obtained prior to bring the Tower back online the first week of
June.
SECTION 2: INSPECTIONS
FIRST QUARTER:
JANUARY:
There were no MOL or MOECC inspections for January. The MOECC routine inspection is
scheduled in February.
FEBRUARY:
There were no MOL inspections for February. The MOECC routine inspection was conducted on
February 24th, 2015 by Stephen Dunn.
MARCH:
The MOECC inspector Stephen Dunn was back on site to complete inspection of Rodney Tower
and West Lorne Standpipe on March 1gth. The inspection report was received on March 31St
with an inspection rating of 100%. There were no non-compliances identified and two
recommended actions. The first recommendation was to undertake a comprehensive leak
detection program if the future water loss is high. The second recommendation was for
putting a screen on the overflow pipe at the Rodney Tower. This was completed when it was
identified as an issue.

The internal audit of the QEMS is being conducted by Maegan Garber of OCWA.

scheduled for July.

Flow for the first quarter has decreased by 15.6%compared to the first quarter of 2014. Due to the
cold weather the plant treatment process was inhibited. All effluent sampling and results did meet
compliance requirements identified in the Environmental Compliance Approval (ECA). However,the
objectives for effluent BOD5 in February and March did not meet those identified in the ECA.
SECOND QUARTER:
Flow is down 15.1%compared to flows in 2014. Sampling and results met the Environmental
Compliance Approval requirements.

In 2012 Council supported an application under the FIT 3 program for a rooftop
solar project at 24232 Silver Clay Line. The buildings have been built to
accommodate rooftop solar panels. The applicants were not successful and are
submitting a new application under the FIT 4 program. The project capacity has
been changed as required by Hydro One Networks as well as the applicant
name.

THAT municipal support shall be given for microFit and FIT rooftop solar projects, on
a case by case basis, subject to written confirmation from an engineer regarding the
capability of the structure
THAT for microFit projects the applicants shall retain a planner to provide zoning
opinion;
THAT for FIT projects our planning consultant shall provide a zoning opinion.
INTRODUCTION:
Correspondence received from RMS Mini Storage and KODRAZS for Council
support of a rooftop solar project and request from KREBS for zoning certificate
for non-roof top solar project.

DISCUSSION:
A number of issues have been raised by staff regarding the granting of municipal
council support and providing zoning information: .
1. Blanket Council support (for a twelve month period for rooftop solar, ground
mount solar, bioenergy, on-shore wind):
As noted above, extra points are given to a FIT project, if Council passes a
resolution in support of the project (see Attachments #1 and #2). While Council
may be in support of green energy, it should have the opportunity to review each
FIT project before providing support.
2. Need for an engineering report for microFit projects on existing and new
buildings:
An engineering report is required for FIT roof top solar projects. This
requirement should apply to microFit projects as well to ensure the buildings
have sufficient usable surface area and are suitable to support the solar system
(with modifications, if necessary). This is not only for the safety of the property
owners but firefighters as well.
3. Requirement for a building permit under microFit and Fit programs:
A building permit will erasure that the buildings are suitable for the program. A
permit is not required to install the solar panels but any work on the building
requires a permit. An engineering report would form part of the building permit
application.
4. Fire suppression
There are a number of issues that concern fire fighters--
• Solar PV system cannot be switched off. The inverters will remain "live" as
long as they are exposed to a source of light.
• Electric shock if the fire fighters come in contact with damaged panels or
energized exposed wiring during fire fighting or ventilation operations
• Power cables and PV panes pose trip and slip hazards for roof operations
• PV panels 1 battery storage areas exposed to fire can produce toxic and
carcinogenic combustion products
• Additional weight to roof, which may pose a structural concern
• Lack of knowledge of location of buildings that have roof top solar panels
5. Planning issues
Under the Green Energy Act, no planning approvals are required for solar
projects. However, an opinion (by a professional planner) or certificate (by a
Chief Building Official, Clerk, etc) is required to be completed by the municipality.
This relates to the existing zoning on the property.
For non-rooftop solar projects under microFit these projects are probably
relatively small and probably unobtrusive. For projects greater than 10KW, the
issue of visual impact should be considered as well as setbacks and future
development in area or on the remaining lands that might be compromised by
the proposed project.
At the very least the following steps should be followed when evaluating these
projects:
1. check size, scale and location of proposed non-roof top solar facility
2. confirm zoning of subject lands and neighbouring lands
3. review proposed setbacks and location of existing buildings and structures
4. confirm existing land use of subject lands
5. check any future pending uses of the remaining lands, on the subject
lands and neighbouring lands.
However, the prescribed forms only reference the existing zoning not any other
planning matters as noted above. Some planners at the municipal level are
refusing to give their opinions and are instead instructing applicants to retain their
own planner from the private sector to give the opinion. Our Planner is
suggesting that the municipality review and provide zoning opinion on FIT
projects and that the applicants hire a private consultant for microFit projects.

RECOMMENDATION:
THAT Council approves the hiring of Spriet Associates to design new accessible
stairs from the Trailer Park to the beach front: AND further provide possibilities of
allowing golf carts/larger items access to section of the beach in front of the trailer
park.
INTRODUCTION:
As part of the Port Glasgow Trailer Park Review, concern was raised with the
current condition of the stairs and the ramp going to the beach in front of the
trailer park.
DISCUSSION:
The municipality arranged for an inspection of the stairs and ramp to the beach
by K.J. Mcllmurray, P. Eng., OAA of Spriet Associates on April 15, 2015 and he
provided the attached letter. The municipality followed the recommendation to
block off the existing ramp and barricade the existing stairs. It was also
recommended that new stairs should be designed and constructed east of the
existing stairs in the location of the existing ramp.
Spriet Associates have provided an upset limit of$5,000 to design stairs and
access to the beach area in front of the Port Glasgow Trailer Park.
The Port Glasgow Trailer Park Liaison Committee has requested Council to get
the new stairs engineered and look at the possibility of providing golf cart access
to the beach area.

In accordance with your request, on Wednesday April 15, 2.015 we inspected the above
noted ramp and stairs that provide'access to the beach and the following is a summary of my
findings:and recommendations:
• the stairs are in an advanced state of decay and are unsafe to use.;
• the dimensions of the rise and run do not comply with the Ontario Building Cade;
• the wooden hand rails and guard rails are also non-compliant and present safety
problems;
the ramp roadway is:unsafe for use because of its steep grade and should not be used.
It is my recommendation to block off the existing ramp with pre-cast concrete blocks and
barricade the existing stairs. New stairs should be designed and constructed east of the
existing stairs in the location of the existing ramp.
The new stairs must comply with the current Ontario Building Code in all respects, To
design the new stairs the location will require a detailed survey.

Description: Hydro One Rates
RESOLUTION:
WHEREAS the cost of hydro has doubled and in some cases more than doubled in the past five years;and
WHEREAS the costs of electricity In the Province of Ontario is forcing businesses to consider leaving the
area; and
WHEREAS many families are having difficulty keeping up with their monthly payments; and
WHEREAS the Province's Long Term Energy Plan anticipates that consumers will face hydro rates that will
rise by 42%over the next five (5)years; and
WHEREAS it is essential that the residents and businesses of the Township of Greater Madawaska to have
access to affordable hydro to thrive and prosper; and
WHEREAS Council urges Provincial relief to Ontario Hydro One Customers to reflect the means of rural
residents to reasonably access hydro through a review of Provincial policies and their agencies that set
Ontario rates for electricity, distribution charges, debt retirement, global adjustments costs and carbon taxes.
Council requests, that this review would include consultation with rural and urban municipalities; and
WHEREAS Council reminds Rural municipalities to advocate the investigation by the Ontario Ombudsman
regarding the major systemic issues identified by complaints Involving overcharging of hydro, an explanation
of line items on billing and, resolve of related matters; and
WHEREAS it is imperative that the Province of Ontario review their energy policies and utilize The Rural and
Northern Lens advocated by the Rural Ontario Municipal Association to evaluate and assess the needs of
rural municipalities so that they can succeed and thrive. Many rural municipalities have a population of 50%
or more seniors on fixed incomes who are struggling to keep warm in low population density communities
with colder temperatures that do not benefit from the heat retention in condominium residences and whom
are challenged by geography and climate scales.

Our core sectors of economic development in our region, lumber mills and farming, are often under-
employed and are subject to rates that are higher than other provinces due to impact of high delivery
charges and global adjustment fees (that can be up to 2.5 times higher than the actual hydro used)and
threaten the sustainabliity of families and agro-food sectors in rural Ontario; and
WHEREAS all municipalities that have a significant amount of citizens moving Into the seasonal residences,
that they are encouraged to inform those residents to seek relief from seasonal hydro rates through direct
communication of such to their electrical utility provider;
WHEREAS all municipalities should be encouraged to monitor,through specific data categories,smart
meter electrical fires and/or smart meter malfunctions that have resulted in explosions, and further to better
assess their impact and the potential need of CSA approved meters employing codes and standards used -
globally by regulators and Industry to facilitate safer and more sustainable products:
NOW THEREFORE BE IT RESOLVED THAT the Township of Greater Madawaska call on Premier Wynne
and the Province of Ontario to take immediate action to prevent these and any other rate increase from
being implemented; and
THAT Premier Wynne and the Province of Ontario be encouraged to do something to bring these rates
down to a reasonable level and to do so as quickly,as possible; and
THAT this motion be circulated to all Ontario municipalities for support.

The following recommendation was adopted unanimously by the Elgin Group Police
Services Board at its special meeting held on May 14t", 2015:
THAT the Elgin Group Police Services Board be maintained for reasons of
efficiency and potential cost savings; and,
THAT a six year contract with the Ontario Provincial Police be recommended
for ondorzernont and excoution by the participating munioipalitio'.) with the
understanding that the contract may be terminated by any or all participating
municipalities with one year written notice as described in Section 27 of the
contract.
- Carried Unanimously.
As you are aware from previous discussions and correspondence, the new six month
contract with the OPP expires on June 3 0 th, 2015, If a new contract is not executed by
this expiry date, then all participating municipalities will still be policed by the OPP but will
be without a contract - commonly referred to as a Section 5.1 service (no Police Services
Board). The main implication of reverting to a non-contract municipality is the loss of
grants which would be automatic.
This short-term contract was purposely established to allow time to determine if grants for
Police Services Boards were going to continue. At the time of the writing of this memo, a
definitive answer on the status of these grants (worth more than $140,000) has not been
randorod by the Miniatry.
However, what is certain is that these grants will definitely not continue if the Board
dissolves or if a smaller group of municipalities decides to form a smaller Board. The
current arrangement involving six municipalities provides a critical mass and qualifies the
amp fnr the rurrPnt grants. Any mduntion in the qi7P of the group jeopardi7PS Plioihility.

Moreover, the PSB does create efficiencies and potential cost savings by having one Board
instead of two or more and because the County provides all of the administrative support for
the Board for a modest fee of$9.200 per annum. The Commander too can spend more time
on police work if helshe is meeting with one Board instead of many. Accordingly, the Elgin
Group Police Services Board recommends that the current Board remain as constituted.

As for the contract itself, the Board suggests that a new, six year term be approved with the
.knowledge that any municipality can "opt out' of the contract with one year written notice. In
essence, the contract, aitnougn set Tor a six year term, is really evaluated in one year
increments.

soon as they have been received.

Dear Ms. Bryant:
The Ontario government's plan to sell 60 per cent of Hydro One,the provincial electricity
transmission utility, has far-reaching implications for every citizen and municipality in the province.
On behalf of Keep Hydro Public, a broad-based coalition created to stop the sell-off, I am writing to
encourage your municipality to add its voice to the many others that are already telling the
provincial government to change course and keep Hydro One in public hands.
By now I am sure council members will have heard the many arguments against the sale:
• Selling the majority of shares in Hydro One will take control of this vital asset away from the
people in Ontario and put it in the hands of private investors, including foreign investors
who may not even care whether we have reliable, affordable electricity.
• Privatization will increase electricity prices for residential,business, and government
customers alike.
• Under the plan proposed by the government, oversight of Hydro One by independent
officers of the legislature would end.The Auditor General and the Financial Accountability
Officer would no longer be able to scrutinize the utility's books or its operations; consumers
would no longer be able to appeal to the Ombudsman when problems arise; citizens would
not be able to access information about Hydro One through the Freedom of Information
and Protection of Privacy Act; salaries of top Hydro One officials would no longer be made
public under the Public Sector Salary Disclosure Act;the Integrity Commissioner would not
be able to review expenses of Hydro One officials; and Hydro One would no longer be
subject to the French Language Services Act. In other words,transparency and public
accountability would end. Ontarians would truly be "in the dark"with respect to Hydro One
operations.

• Privatization will provide government with a short-term cash injection that will soon be
spent in exchange for giving up a steady, long-term source of revenue that pays for public
services we all depend on.The cost to Ontarians will be hundreds of millions of dollars per
year.
Perhaps more significant than these strong arguments is the simple fact that the provincial
government has no mandate from the people of Ontario to make a sale of this magnitude. (This
may explain why the government chose to put the Hydro One sale inside its 2015-16 Budget bill and
push it through the legislature with minimal opportunity for public input.)
It is crystal clear that the people of Ontario do not support the sale of any part of Hydro One.
Published opinion polls show opponents of the sale outnumbering supporters by a three-try-ore
margin. Editorial opinion is similarly opposed. If democracy means anything, we must stop this sale.
At this time, Keep Hydro Public is asking municipal councils,from the largest to the smallest,to pass
a resolution opposing the sale or partial sale of Hydro One and to communicate that opposition to
the government, area MPPs,and the Association of Municipalities of Ontario. Included with this
letter you will find a draft resolution which municipal councils are,of course,free to use and modify
as they see fit.
Your assistance in putting this issue on the agenda of your council as soon as possible is greatly
appreciated;we would also appreciate hearing back from your municipality if and when council
takes action on this matter.

FOR THE PROVISION OF POLICE;SERVICES FOR THE

WHEREAS under Section 10 of the Police Services Act, R.S.O. 1990,c.P.15,the Minister of
Community Safety and Correctional Services may enter into an agreement with the council
of a municipality or jointly with the councils of two or more municipalities for the provision of
police services for the municipality or municipalities by the Ontario Provincial Police;
AND WHEREAS under Section 4(1)of the Police Services Act, R.S.O. 1990,c.P.15,
municipalities are required to provide adequate and effective police services in accordance
with its needs;
AND WHEREAS the Corporation of the Municipality of West Elgin,the Corporation of the
Municipality of Bayham,the Corporation of the Municipality of the Township of Southwold,
the Corporation of the Municipality of Central Elgin,the Corporation of the Municipality of
Dutton/Dunwich and the Corporation of the Municipality of the Township of Malahide
(herein after collectively called the Elgin Group )seek to enter into a single agreement for
the provision of Police Services by the Ontario Provincial Police;
NOW THEREFORE the Council of the Corporation of the Municipality of
enacts as follows:
1. The Mayor and the Clerk are hereby authorized, on behalf of the Corporation of the
Municipality/Township of to enter into and
execute under its corporate seal an agreement for the provision of Police Services with
the Minister of Community Safety and Correctional Services of Ontario.
2. The Police Services agreement with the Minister of Community Safety and Correctional
Services of Ontario shall also be authorized by the five other Municipalities, being the
other members of the Elgin Group.
3. The Police Services agreement will commence on the 1 st day of July 2015 and will
conclude on the 30M day of June 2021.
4. A copy of said agreement shall remain attached to and form part of this by-law.
5. This By-law shall come into force and effect upon the final passing thereof.

(Herein after collectively called the "Elgin Group")
OF THE SECOND PART
RECITALS:
(a) Under s. 4(1) of the Police Services Act, R.S.O. 1990, c. P.15, as am., the Elgin Group is
required to provide adequate and effective police services in accordance with its needs;
(b) Under s. 5 of the Police Services Act, the Elgin Group's responsibility for providing police
services may be discharged by entering into an Agreement with the Solicitor General under
s. 10 of the Act;
(c) Pursuant to Order-in-Council 49712004, the powers assigned to the Solicitor General in
law, including those set out in the Police Services Act, have been transferred to the
Minister of Community Safety and Correctional Services; therefore, all references to the
Minister of Community Safety and Correctional Services shall be deemed to include the
powers previously exercised by the Solicitor General;
(d) The Elgin Group has expressed its intent to provide police services, in pursuance of its
responsibilities under s. 5 of the Police Services Act, by means of this Agreement, as
evidenced by by-laws, number dated Municipality of West
Elgin, by-law number ,dated Municipality of Bayham,

by-law number ,dated Township of Southwold, by-law
number dated Municipality of Central Elgin, by-law
number ,dated Municipality of Dutton/Dunwich, by-law
number ,dated Township of Malahide, copies of which are
attached as Schedule "A;
(e) This Agreement reflects the intent of the parties to provide an adequate and effective level
of police services for the Elgin Group as set out in the "Contract Policing Proposal," dated
May 22°a 2015 (attached as Schedule "B");
NOW THEREFORE, in consideration of the premises and covenants herein, the parties agree
as follows:
1. The parties warrant that the recitals are true.
Definitions
2. In this Agreement:
(a) "Annual Billing Statement" means a statement prepared by Ontario and submitted to
the Board for review and to the Elgin Group for review and approval which contains:
(i) the Elgin Group's police costs for the year following the year in which the
statement is prepared, based on, among other items, an estimate of salary, benefit
and overtime costs; and
(ii) a reconciliation of actual salary, benefit and overtime costs to those billed for the
preceding year.
(b) "Board" means EIgin Group Police Services Board.
(c) "Commissioner" means the Commissioner of the O.P.P.
(d) "Detachment Commander" means the O.P.P. officer in charge of Elgin County
Detachment.
General Provisions
3. Ontario shall provide adequate and effective police services in accordance with the needs
of the Elgin Group in compliance with the terms and conditions of the Agreement. The
Elgin Group shall pay Ontario for the police services provided under this Agreement in
accordance with this Agreement.

4. The Commissioner shall ensure that the Detachment Commander responds appropriately to
the Board's objectives and priorities for police services, developed after consultation with
the Detachment Commander, pursuant to s. 10(9)(b) of the Police Services Act.
S. The Commissioner shall cause the Detachment Commander or his or her designate to
report to the Board at mutually agreed upon intervals in accordance with the Police
Services Act regarding the provision of police services in and for the Elgin Group. The
O.P.P. will, determine the information to be contained in the reports and the format in
which they will be provided.
6. (a) For the purposes of s. 10(6) of the Police Services Act, the O.P.P. shall provide
police services to the Elgin Group, including the enforcement of mutually agreed
upon by-laws. The parties shall annually review this part of the Agreement with a
view to revising or updating the list of by-laws requiring O.P.P. enforcement.
(b) Municipal Building Code violations overseen by the Elgin Group's building code
inspector and those by-laws related to animal control will not form part of this
Agreement.
Service Levels
7. (a) Ontario shall cause the Commissioner to assign police officers and other persons to
duties relating to the police services in and for the Elgin Group so as to provide the
Elgin Group adequate and effective policing services.
(b) In the event that the Elgin Group requests services dedicated specifically to the Elgin
Group, it shall be responsible for all costs associated with those dedicated resources.
Liability of Ontario
8. The ORP. shall be liable for any damages that may arise as a result of any negligent acts
or omissions of its members in the performance of this Agreement.
Provincial Services Usage
9. The O.P.P. as legislated by the Police Services Act, must be capable of providing
provincial level response that can be mobilized for emergencies, disaster or specialized
needs. The O.P.P. may meet this requirement by deploying resources that normally would
be assigned to the Detachment that serves the Elgin Group. The ORP. shall ensure that in
the event resources are deployed to a situation requiring provincial level response,
appropriate resources remain available to the Detachment to provide adequate and effective
policing to the Elgin Group. The use of O.P.P. officers in cases where there is a provincial
obligation to respond will be accounted for as part of the billing model.

Eauinment and Facilities
10. Ontario shall supply or cause to be supplied at Ontario's cost all vehicles and equipment
reasonably necessary and appropriate for the use of the O.P.P. in providing police services
under this Agreement.
11. The parties will enter into negotiations concerning the provision and payment of
appropriate buildings and rental agreements, including, but not limited to, location,
leasehold improvements, and capital costs where applicable.
Adeguagj Standards Regulation
12. The O.P.P. shall undertake and be responsible for ensuring that all mandatory standards of
adequate and effective police services as required by Ontario Regulation 3199 under the
Police Services Act are met and maintained.
13. The Detachment Commander shall provide the Board with reasonable documentation, as
agreed upon between the Board and the O.P.P., to allow the Board to evaluate the services
and satisfy itself that adequate and effective standards and policies are in place.
14. It shall be the responsibility of the Board to monitor the delivery of police services to
ensure that the provisions of the Ontario Regulation 3199 under the Police Services Act are
satisfied on an ongoing basis.
Cost of Police Services
15. (a) On or before October Ist in each year, Ontario shall prepare and deliver to the Board
for review and to the Elgin Group for review and approval, the Annual Billing
Statement for the following year, together with sufficient documentation and
information reasonably necessary to explain and support the billing.
(b) The Elgin Group shall review the Annual Billing Statement upon receipt and, within
90 days of such receipt, shall approve the Annual Billing Statement or deliver to
Ontario a request to review the Annual Billing Statement.
16. (a) In the event that the Elgin Group fails to approve or request a review of the Annual
Billing Statement within 90 days of receipt, the Elgin Group shall be deemed to have
approved the Annual Billing Statement.
(b) In the event that the Elgin Group requests a review of the Annual Billing Statement
as provided in this paragraph, the Annual Billing Statement shall be approved or
amended and approved in accordance with Section 17.
17. Where the Elgin Group has delivered to Ontario a request to review the Annual Billing
Statement, Ontario shall carry it out expeditiously, and Ontario shall cooperate to permit

such a review to be carried out. If the parties are unable to agree on the Annual Billing
Statement, either party may submit the matter to the dispute resolution mechanisms set out
in paragraphs 22 and 23, In the event that the Elgin Group delivers a request to review to
Ontario, the Annual Billing Statement shall be deemed to apply during the period of
review.
18. The Elgin Group shall make monthly installment payments to Ontario no later than the end
of the month following the month for which payment is being made, each one being one
twelfth of the Annual Billing Statement for that year. Any amounts which have become
due and owing shall bear interest at the rate set by the Minister of Finance from time to
time.
19. Ontario shall keep all records, statements of account, invoices and any other such
documents necessary to support the Annual Billing Statement, and all such records shall be
kept for a period of seven years. Ontario shall permit the Elgin Group, upon notice to
Ontario, to examine all such records and books of account and conduct a review of the
Annual Billing Statement.
20. Upon the approval or deemed approval of the Annual Billing Statement, as provided in this
Agreement, adjustments shall be made in the amounts paid by the Elgin Group by
installment so that (i) the total amount paid in respect of the preceding year is equal to the
amount shown on the approved Annual Billing Statement and (ii) the installments for the
year following the year in which the statement is prepared are each equal to one twelfth of
the approved Annual Billing Statement. Any amounts payable by one party to the other
shall be paid to the appropriate party in the remaining monthly billings for the year
following the year in which the statement is prepared.
21. The parties agree that sections 132 and 133 of the Police Services Act will be applied as if
the Elgin County Detachment of the O.P.P. was a municipal police force, and as if the
Detachment Commander was a Chief of Police.
Dispute Resolution Mechanisms
22. (a) The provisions of this paragraph apply in the event of a dispute between the Elgin
Group and Ontario concerning financial and related issues arising out of the
interpretation, application, administration, or alleged violation of this Agreement
("Financial Disputes") or between the Board and the O.P.P. concerning policing
issues arising out of the interpretation, application, administration, or alleged
violation of this Agreement("Policing Disputes").
(b) In the event that a dispute arises, the Detachment Commander, or representative, and
the Elgin Group or the Board, as the case may be, or their representative, shall meet
within 30 days of such dispute arising and use all best good faith efforts to resolve
the dispute.

(c) If the dispute remains unresolved, the Regional Commander, or representative, and
the Elgin Group or the Board, as the case may be, or representative, shall meet and
use all best good faith efforts to resolve the dispute.
(d) If the dispute remains unresolved, the Commissioner, or Deputy Commissioner, and
the Elgin Group or the Board, as the case may be, or representative, shall meet and
use all best good faith efforts to resolve the dispute.
(e) If a Financial Dispute remains unresolved, the issue may be referred to mediation by
either party, and each party shall use all best good faith efforts to resolve the dispute.
23. (a) Financial Disputes that cannot be resolved through any of the methods described
within paragraph 22, may be referred to and settled by binding arbitration. The
provisions of the Arbitration Act, 1991 shall apply to any such arbitration, unless
otherwise indicated below:
i) The language of the arbitration shall be English.
ii) The place of the arbitration shall be in Elgin County.
iii) Each party agrees that the arbitration shall be conducted in a summary manner
to ensure a full hearing in a cost effective and efficient manner.
iv) Each party shall make prompt full disclosure to the other and, subject to the
availability of an arbitrator the arbitration shall be commenced within 30 days
of the conclusion of the meeting with the Commissioner, or the mediator, if
applicable.
V) Each party shall be responsible for its own legal expenses and for an equal
share of the fees and expenses of the arbitration and any other related
expenses. Section 54 of the Arbitration Act shall not apply;the arbitrator shall
have no right to make an award relating to costs.
vi) The parties shall have no right of appeal to a final decision of an arbitrator.
(b) Policing Disputes shall not be subject to mediation or arbitration.
(c) Neither party shall be entitled to proceed to mediation or arbitration until all of the
meetings referred to in paragraphs 22 have been held, and each party undertakes to
exert all best good faith efforts to resolve the dispute in those meetings.
(d) Mediations or arbitrations of disputes conducted under this Agreement shall remain
closed to the public. All parties to any dispute shall keep all details, admissions or
communications made in the course of the dispute resolution process strictly
confidential, nor shall such information be admissible in any legal proceeding, except
as follows:
i) on consent of all parties;
ii) as may be ordered by a court of competent jurisdiction;
iii) the final decision of the arbitrator may be released.

(e) Each of the meetings outlined in paragraph 22 shall be commenced no earlier than 15
days, and concluded no more than 30 days, from the conclusion of the prior stage
unless the parties otherwise agree.
(f) Notwithstanding any of the above provisions, nothing in this Agreement shall be
construed so as to give the Elgin Group or the Board the right to alter any policy of
the O.P.P. or the Ministry. Nothing in this Agreement shall be construed so as to
give the Elgin Group or the Board, the right to supercede or vary the duties and
obligations of the Solicitor General pursuant to s. 3(2) of the Police Services Act, or
of the Commissioner pursuant to s. 17 and s, 41 of the Police Services Act, and
further, the rights of the Elgin Group and the Board pursuant to the Agreement are
subject to the Elgin Group's obligations under s. 4 of the Police Services Act.
Detachment Commander Selection
24. The Detachment Commander shall be selected from a short-listed pool of candidates as
determined by the O.P.P. in accordance with its relevant provincial policies. Following
the formulation of the short-list, a joint committee consisting of Board members and
persons nominated by the Commissioner, shall select the successful candidate in
accordance with the process set out in the OPP's provincial policies.
Notice
25. Any notice, statement, invoice or account to be delivered or given by any of the below
listed groups to any other of them shall be delivered to all other groups in writing and sent
by mail addressed to those groups at their respective address as listed below, or sent by fax
transmission to the fax number listed below. Any notice, statement, invoice or account
sent by mail shall be deemed to be received on the third day following the date of mailing
unless shown to the contrary and if sent by fax shall be deemed to be received on the date
of transmission. Any group may change its address and fax number by giving notice
provided herein:

Commencement and Termination of Agreement
26. Notwithstanding the date upon which this Agreement is signed, the term of this Agreement
shall commence on the 0 day of July 2015, and shall conclude on the 30th day of June
2021,
27. Either party to this Agreement may terminate this Agreement upon one year written notice
of termination to the other party, in which case this Agreement shall terminate one year
following the delivery of such notice. Should a notice to terminate be given, the Elgin
Group shall continue to be obligated to pay for the cost of providing police services under
this contract to and including the date of such termination and Ontario shall continue to be
responsible to provide the services outlined in this Agreement.
28. Should the Elgin Group's designated responsibility to provide policing under the Police
Services Act be changed, either by statute or government interpretation, the Elgin Group
maintains its right upon being so informed to give written notice of its intention to
terminate this Agreement forthwith.
Entire Agreement
29. This Agreement and the schedules attached constitute the entire Agreement between the
parties, and there are no representations, warranties, collateral agreements or conditions
affecting this Agreement or the relationship of the parties or supported hereby other than as
expressed herein in writing. Any amendment to this Agreement must be in writing, duly
executed by the parties.

Correctional Services has personally signed this Agreement to be effective as of the date set out

Executive Summary
The Ontario Provincial Police (OPP) has over 100 years of experience in providing effective
community-based policing and protection throughout Ontario. The OPP has provided municipal
police services under contract for over 60 years and currently maintains contracts with over 140
communities across Ontario.
The Elgin Group requested a costing for OPP municipal policing. This proposal is based on the
Elgin Group paying an amount equal to the sum of the Elgin Group's allocated portion of the
OPP's total municipal policing base and calls for service costs and the costs for overtime,
cleaninglcaretaker, accommodation, court security and offender transport as applicable. Where
a municipality chooses to receive police services from the OPP pursuant to a contract, the OPP
will provide the level of police services required to provide adequate and effective policing,
including providing the services set out in Regulation 3199, Adequacy and Effectiveness of
Police Services under the Police Services Act.
This proposal reflects the integrated policing concept, incorporating a police services contract
for the Elgin Group with OPP highway patrol services and provincial responsibilities under one
administration. The Elgin County OPP Detachment will remain as the
Administration/Operations Centre. The resources will be deployed to the municipality from this
facility.
The Elgin County Detachment Commander will be responsible to oversee all aspects of service
delivery. The detachment management including Staff Sergeant and Sergeant/ Platoon
Leaders as applicable would provide assistance and supervision to members of the Elgin
County Detachment.
In order to provide a location for the police and public to interact, and to facilitate the delivery of
police services in a community, the OPP encourages the establishment of Community Policing
Offices (CPOs). Where such offices exist they are usually equipped with telephone and
computer capabilities for use by officers assigned to the municipality. Any decision on the
establishment of a CPO in the Elgin County rests entirely with township council and any
associated costs will be the responsibility of the Elgin Group. It is recommended that any CPO
located within the group be maintained.
In consultation with the Police Services Board it is the intent that all existing community service
programs and community policing committees will be maintained.
Any new community service program considered may be implemented after consultation with
the Elgin Group Council, the Elgin Group Police Services Board and the Elgin County
Detachment Commander.
When a municipality chooses to receive police services from the OPP under contract, the OPP
will ensure that the municipality receives adequate and effective police services in accordance
with the Police Services Act and regulations. The shared infrastructure of the OPP broadens
local access to resources, expertise, solutions, training and management without duplicating
services. The Elgin Group will continue to benefit as additional staff are readily available from
within the Elgin County OPP Detachment as well as neighboring detachments and regions,
should the need arise.

The Elgin Group will be required to establish a Police Services Board, as mandated by Section
10 of the Police Services Act that will generally determine objectives and priorities for police
services within the community, after consultation with the Detachment Commander. The
Commissioner is committed to ensuring that the Detachment Commander of the Elgin
County OPP Detachment responds appropriately to the Board's advice and priorities in a
manner consistent with the Board's identified concerns, expectations and needs.
It is long-standing OPP policy and practice to be accountable to the communities we serve. The
Commander of the Elgin County OPP detachment, or designee, will report to the Police
Services Board on a regular basis, as per the direction of the Board. The OPP is experienced in
being accountable to the municipalities we serve. With over 100 Contracts currently in place
and future contracts pending, there is great emphasis placed on OPP accountability to Police
Services Boards.
The OPP is required to provide provincial level emergency response that can be mobilized in
times of emergency, disaster or a specialized investigative need. The OPP meets such
emergent needs, on an on-call, as-needed basis, by deploying small numbers of officers from
multiple locations and assignments, both provincial and municipal. During such times, the OPP
is responsible to ensure that appropriate resources remain in place to make certain the
municipality receives adequate and effective police services in accordance with the Police
Services Act and regulations. The use of OPP officers in cases where there is a provincial
obligation to respond will be accounted for as part of the billing model.
If the Elgin Group chooses to accept an OPP contract for its policing service, the Elgin County
OPP Detachment will assign resources, focusing on meeting the Elgin Group's unique policing
needs.
Value for the Elgin Group;
• Assurance of adequacy and effectiveness of police services;
• Dedication to resolving community issues through local involvement and community
policing committees;
• Availability of additional staffing support from neighboring detachments, regional
headquarters and general headquarters;
• Seamless access to a comprehensive infrastructure and specialized services; and
• Assists the Detachment Commander in determining the local policing priorities and
objectives through the Elgin Group Police Services Board.
Based on, among other things, an estimate of salary and benefit costs, the policing cost
for 2015 associated with this proposal is $6,110,621. The annual billing statement is set
out in the attachment to this proposal.

Additional Notes to the "OPP Annual Billing Statement":
• The Annual Billing Statement for this group contract is based on the sum of the total of
the cost estimates determined for the Township of Southwold, Municipality of Bayham,
Municipality of West Elgin, Municipality of Central Elgin, Municipality of Dutton/Dunwich,
and the Township of Malahide.
• The Annual Billing Statement is determined based on the new OPP billing model
effective January 1, 2015.
• The Annual Billing Statement is a statement of 2015 costs based on an estimate of
salary, benefits and overtime costs. Salary, benefits and overtime costs are estimates
and are subject to a final year end adjustment.
• As a result of the implementation of the new OPP billing model municipal policing costs
are subject to Phase-in Adjustments for the calendar years 2015 to 2019. The 2015
phase-in adjustment is dependent on the final 2014 cost. Phase-in adjustments are
subject to change and are based on an annual determination:
• If the municipality is subject to an increase between the final 2014 cost and the
2015 cost, the increase will be capped to a maximum of $40 increase per
property. The capped increase of $40 plus the growth factor per property cost
will be applicable for each subsequent year until the full cost is realized.
• The growth factor is a set per property cost for all municipalities dependent upon
general increases in salary, benefits, support costs and other direct operating
expenditures.
• If the municipality is subject to a decrease between the final 2014 cost and the
2015 cost it will be limited to the per property reduction limit applicable to the
year.
• The per property reduction limit is an annual per property amount determined for
all municipalities. The per property reduction limit is subject to change each year
based upon the determination of the funding required to offset the capped
increases for all municipalities.
• The phase-in adjustment for this group contract estimate is based on the total of the
phase-in adjustments for each of the municipalities under the contract, i.e. the Township
of Southwold, Municipality of Bayham, Municipality of West Elgin, Municipality of Central
Elgin, Municipality of Dutton/Dunwich, and the Township of Malahide.
• For calculation of the Phase-in Adjustment for 2015 the following costs were removed from the
Final Reconciled 2014 Costs:

The St.Thomas-Elgin Local Immigration Partnership (STELIP)is a collaborative community
initiative funded by Citizenship and Immigration Canada(CIC)to strengthen the role of local
government, agencies, stakeholders, and service provider organizations in serving and
integrating immigrants in St.Thomas and the County of Elgin.
On behalf of the St.Thomas-Elgin Local Immigration Partnership initiative,I would like to
request a motion to support the "Welcoming,Caring, and Inclusive"Community Sign initiative.
This project is one way that the Municipality of West Elgin can collaborate with STELIP,
acknowledge the work of the municipality to be inclusive, and commit to continue to build
Welcoming, Caring, and Inclusive communities.
The 30"x 30" steel signs can be displayed on community service club boards throughout the
municipality and will be provided by STELIP. We hope that the signs and community
commitment can be presented at a public ceremony scheduled in the community,for example,
Canada Day.
The continued success of STELIP will be determined by the level of collaboration and
commitment that will occur across sectors and our different levels of government.

This session of the West Elgin Arena Board was called to order at 9:30 am with the following
members present: ,foe Seman, Ian Fleck, Jim Hathaway, Johnathan Wolf, Alphonse Willie, and
Recreation Superintendent Jeff Slater.

1. Concession Operation: The Recreation Superintendent reported that the changes
were made to the Agreement and the agreement was returned to the Concession

1. Arena Tour: The Recreation Superintendent took the Arena Board on a guided tour
of the facility indicating the safety devices in the compressor room and various other
amenities within the facility.
2. Brine Leak: The recreation Superintendent indicated to the Arena Board where
there is a brine leak in the arena floor. He also indicated that it has been scheduled
to be repaired well in advance of the upcoming season.
3. Refrigeration System Upgrade: In a continuous effort to reduce our operating costs
the Recreation Superintendent indicated that as part of the refrigeration expense for
2015 we will be installing a soft start starter on the brine pump, as well as having the
brine pump cycle with the thermostat.
