presentation highlighted a proposed 59%general levy increase for West Elgin to
the Lower Thames Valley Conservation Authority. A lack of Landowner

Stewardship Services in the eastern part of the Watershed as well as an
increased amount of legislated responsibilities placed on Conservation
Authorities were noted as reasons for the increase. Council gave direction to
receive staff input on how the Conservation Authorities Act impacts municipal
operations.

SUBJECT: Munroe Street Paving
RECOMMENDATION:
THAT Council approves the quote of$16,950.00 (plus applicable tax) from D.
Peters Paving of Springfield Ontario for the completion of paving on Munroe
Street (east end) in West Lorne.
INTRODUCTION:
The 2015 capital budget included $22,500.00 for the extension of Munroe Street
in West Lorne in front of Heritage Homes. This included pulverizing the existing
base, completing required drainage work and new asphalt.
DISCUSSION:
West Elgin public works requested quotes from three local contractors in early
September. D. Peters Paving submitted a quote of $16,950.00 followed by DEL-
KO co. ltd with a price of$18,120.00 and nothing submitted by third contractor.
The quoted price from Peters Paving includes the following;
Add gravel and fine grade where needed
Compact existing sub-base prior to paving
Install 1.5 inches of HL4 asphalt base and compact
Install 1.5 inches of HL3 surface asphalt and compact
Note — only virgin asphalt to be used
D. Peters Paving has completed projects for West Elgin in previous years with
good results and also do work for Elgin County on a regular basis.

SUBJECT: Lower Thames Conservation Authority Levy Increase
RECOMMENDATION:
THAT Council does not support the proposed increased levy of $60,924 (an
increase from $38,072 for West Elgin), OR
THAT Council does not support the proposed increased budget of$218,859 but
does support the move to use a ratio of current value assessment in determining
each municipality's share. AND that the "greening partnership" contribution by
Chatham-Kent be excluded from the calculations. OR
THAT Council supports the proposed increased budget of $218,859 to be shared
by each municipality based on current value assessment.
INTRODUCTION:
The LTVCA Board of Directors has supported a preliminary budget for 2016
which created three new positions and that the increase of$218,859 be financed
by a targeted levy of$218,859 on nine municipalities (excluding Chatham-Kent).
BACKGROUND:
One of the core responsibilities of the LTVCA is flood risk management which is
accomplished through a combination of planning, regulation and operation of
flood control infrastructure. To adequately fulfil this responsibility more staff
resources are being proposed.
Secondly, land stewardship in Chatham-Kent is being funded by a special levy
"greening partnership". LTVCA is unable to provide similar land stewardship
programs to the eastern portion of their jurisdiction (London, western portions of
Elgin and Middlesex Counties). Chatham-Kent contributes $380,000 each year
for the "greening partnership".
LTVCA is suggesting that the nine municipalities (other than Chatham-Kent) fund
the additional levy requirements as Chatham-Kent provides additional funding
under the "greening partnership".
DISCUSSION:
The concept of having nine instead of ten municipalities sharing in the increased
levy does not make sense. All municipalities will benefit from these positions.
It was Chatham-Kent's choice to enact a "greening partnership" and pay for this
land stewardship program. Should the other municipalities wish to enact a land
stewardship program they should pay for the program?
Table 1, attached, provides a break-down of municipal levies by municipality,
without the "greening partnership". This table adds the new expenses of
$218,859 to the total budget and allocates the share using percentage of current
value assessment (CVA). This brings West Elgin share from $8.12 to $11.32 per
capita.
Table 2, attached: provides a break-down of municipal levies by municipality,
including $308,000 contribution for "greening partnership". The last two columns
show the proposed levy as proposed by LTVCA. West Elgin's share increases to
$12.99 per capita.
To treat all municipalities equally, staff believe that all municipalities should share
in the increased levy. Further, to be equitable, the levy should be based on
current value assessment. For West Elgin this would mean an increase from
$8.12 to $11.32 (less than the proposed $12.99). For Chatham-Kent, this would
mean an increase from 14.73 which includes the
"greening partnership") to

RECOMMENDATION:
THAT Council provides the following comments on the Conservation Authorities
Act review:
1. The responsibilities of conservation authorities have expanded to include
other legislation such as the Planning Act, Clean Water Act. The province
should provide funding for these responsibilities so that all conservation
authorities have the necessary resources to hire the required staff.
2. All conservation authorities should provide technical advice on matters
relating development applications adjacent to wetlands, watercourses, valley
lands. This would include the peer review of Environmental Impact Studies.
INTRODUCTION:
The province has posted a "Discussion Paper-- Conservation Authorities Act—A
review of the roles, responsibilities, funding and governance of conservation
authorities under the Conservation Authorities Act"on the Environmental Bill of
Rights Registry. Deadline for comments is October 19, 2015.
BACKGROUND:
Council received a report from Lower Thames Conservation on the discussion
paper at the meeting held on September 10, 2015. The Clerk attended a
discussion session on September 8th at the London Public Library.
DISCUSSION:
The discussion paper proposes the following issues be focused on:
• Governance
• Funding
• Roles and Responsibilities.
At the meeting on September 8th both small and large municipalities were
represented. Concerns raised were inconsistency between different conservation
authorities in dealing with such items as drainage matters; dealing with two or
more conservation authorities in one municipality; need for definition of core
responsibilities of conservation authorities; new involvement with ministries such
as Ministry of Environment and Energy regarding source water protection and
Ministry of Municipal Affairs regarding the Provincial Policy Statement. A
summary of the issues/concerns raised will be provided to the Ministry of Natural
Resources and Forestry as input into the discussion on the paper.
How does LTVCA affect municipal operations?
In order to provide comments on the review of the Conservation Authorities Act,
we should focus on municipal operations.
We are fortunate in West Elgin that flooding along the Thames River valley is
managed through the Conservation Authority (CA) watershed management
program. With the passage of the Provincial Policy Statement under the
Planning Act and the "Development, Interference with Wetlands and Alteration to
Shorelines and Watercourses" regulation under the Conservation Authorities Act,
the CAs are tasked with matters relating to wetlands, watercourse setbacks,
valley land hazards.
The CA approval is required for such projects as:
• Municipal drain construction
• Road construction adjacent to wetlands and municipal drains (e.g.
replacement of a culvert)
• Building permits
• Planning applications for lands under and adjacent to their regulated area
Further, with the requirement for an environmental impact study for development
on wetlands a technical review of the study is necessary. Some CAs provide this
expertise for a fee. LTVCA does not and this becomes a challenge for West
Elgin.
Comments on Conservation Authorities Act Review
The role of the CAs has expanded in recent years to include matters relating to
other legislation including Planning Act (PPS), Clean Water Act (source water
protection). Therefore their mandate has changed with no change in provincial
funding. Also, the CAs are responsible to the MMRF which is peculiar when their
responsibilities go beyond MNRF mandate. Due to the expanded role of CAs,
the provincial government should provide funding for all CAs to deliver these
expanded roles.
West Elgin, being a small municipality in the watershed, relies on LTVCA to
provide technical advice. This should be expanded to include the review of
technical reports relating to wetlands, an issue under the Planning Act. There
should be consistency between all CAs.
As noted above, there are a number of municipal operations that require
approvals from the LTVCA for projects. A good relationship with the LTVCA is
important to complete projects that are important for the residents of West Elgin.

BACKGROUND:
The proposed amendment to the Zoning By-law are for lands legally known as Part Lot
A, Concession 3 (being Parts 2 to 6 on 11 R6267), in the former Township of
Aldborough, now the Municipality of West Elgin. The proposed by-law will remove the
Holding (H) symbol from the above noted lands.
DISCUSSION:
The subject lands are currently zoned Hamlet Residential Holding (HR-H) in the
Municipality of West Elgin Zoning By-law 2015-36. The Holding (H) symbol was applied
to the subject lands as a condition of severance for file numbers E21/15 and E22/15 as
they were vacant and required adequate drainage and a lot grading plan to
accommodate residential use. A legal drainage outlet for the proposed lots has been
installed and a drainage report has been adopted by Council. Lastly, a lot grading plan
has been prepared to the satisfaction of the Municipality.

Re. Municipal Confinement of Dogs and Cats in Elgin County
Under The Communicable Disease Regulation
The goal of the Rabies Prevention and Control Program implemented by Elgin St
Thomas Public Health is to prevent the occurrence of rabies in humans.
One strategy used by the Health Unit to achieve this goal is to observe all cats and
dogs, which have bitten or scratched a Duman for a period of ten days. A healthy
animal at the end of ten days verifies that the animal did not transfer rabies at the time
of the incident and the administration of a series of post exposure treatment is not
required for the victim.
In most instances, the dog or cat can be observed and confined by the person who
owns or has care or custody of the animal. Occasionally, however, there are instances
when the animal may not be confined by the owner. Stray animals, animals that are
exhibiting symptoms of illness or animals belonging to owners who are unlikely to
confine their cat or dog have to be confined at a pound or veterinary hospital.
The cost of confining the animal at a pound or veterinary hospital under these
circumstances is a municipal responsibility, as per the Ontario Communicable Disease
Regulation 557 established under the Health Protection and Promotion Act as noted
below:
A medical officer of health who is of the opinion that a dog or cat may be rabid
shall cause the dog or cat to be confined and isolated for at least ten days from all
animals and persons, except the person caring for the dog or cat,
(a) at the place of residence of the person caring for the dog or cat, if the dog or
cat is free from symptoms of any disease; or
(b) in a pound or veterinary hospital at the expense of the municipality in
which the person caring for the dog or cat resides if the dog or cat
exhibits symptoms of any disease or if, in the opinion of the medical
officer of health, the person is unlikely to confine and isolate the dog or
cat. R.R.Q. 9990, Reg. 557, s. 3 (2).

been considered before confinement at the expense of a municipality is required.

new"Wandering Alert"system. This prevents residents with a tendency to wander outside the building from

RE: Drainage Act Petitions for 11900 Graham Road, West Lorne
To the Mayor and Councilors of the Municipality of West Elgin,
I am writing this letter to clarify the position of the Lower Thames Vailey Conservation
Authority (LTVCA) regarding three Petitions under the Drainage Act submitted to the
Municipality of West Elgin by Mr. John Watterworth. The three petitions are intended to
improve the outlet for drainage of his property at 11900 Graham Road through the installation
of three road crossings into the Axford Extension Drain, the Branch A of the McDonald Drain
and the Graham Street Drain.
As you are aware, the Drainage Act outlines a process by which a proponent may petition a
municipality to create or improve a municipal drain, while the Conservation Authorities Act
provides for a review process to ensure that a proposed development or alteration to a
watercourse or wetland does not create or aggravate natural hazard related conditions,
Therefore, before any actual construction on a municipal drain can occur, approval from the
local Conservation Authority is required. (On a related issue, the Provincial Policy Statement
provides direction to the municipalities regarding the protection of natural heritage, and is not
a delegated responsibility to the Conservation Authorities.)
The LTVCA has laid charges against Mr, Watterworth under Ontario Regulation 152/05 of the
Conservation Authorities Act. The charges themselves relate to drainage activities occurring at
11900 Graham Road and involve the Provincially Significant Wetland (PSW) on the property
that has components in all three of the drainage basins described in the Engineer's Reports for
the above noted Drains. One of the activities deemed contrary to the legislation is the
installation of an agricultural tile drain by Mr. Watterworth that cuts across all three drainage
basins. The process of installing that tile drain destroyed a portion of PSW and that tile
continues to have an adverse effect on the remaining PSW. It is unclear what impact, if any,
this additional drainage may be having on the existing municipal drains. Should Mr.
Watterworth be found guilty of charges, the LTVCA will be asking for the restoration of the PSW
and removal of the tile drain.

The LTVCA deems it premature to approve any of the three Drainage Act Petitions while there
are charges before the courts related to drainage activities on the property. The LTVCA does
not want to prejudice the case with any approvals for improved/additional drainage on the
property. Nor does the LTVCA want to, in any way,tie the hands of the Justice of the Peace
from determining the most suitable restoration option. A trial for the case is currently
scheduled for the last week in January and the first week in February, 2016. After the trial is
over and the Justice of the Peace has made a ruling,the LTVCA will at that time review the
Petitions and Engineer's Reports in light of the court's ruling to determine what activities can be
allowed to proceed or what modifications to the proposals may be required.
The LTVCA would like to thank you for your understanding and patience in the matter and looks
forward to working with your Drainage Superintendent and the assigned Drainage Engineer to
ensure this process goes as smoothly as possible.

Subject: Thames-Sydenham and Region Source Protection Plan Approval
Today we received word that the Minister of Environment and Climate Change has approved the Thames-
Sydenham and Region Source Protection Plan. As the minister has indicated,this Plan meets the requirements
of the Clean Water Act for the protection of drinking water sources in the region. This plan, in concert with the
Source Protection Plans of the neighbouring Source Protection Areas, provides protection for current and future
drinking water sources in Southwestern Ontario and the health and safety of its residents. The Source
Protection Plan is not only a compilation of policies, it is the culmination of a process that has used a science-
based approach as its foundation for identifying vulnerable areas and the risks posed to municipal drinking
water systems,

updated Assessment Reports are posted on www.sourcewater rotection.on.ca. Copies of the approved plan
and assessment reports on DVD will be ready shortly and may be obtained by contacting Deb Kirk

In support of the approved Source Protection Plan, updated Assessment Reports for the Lower Thames Valley,
St Clair Region and Upper Thames River Source Protection Areas have also been approved, These Assessment
Reports identify and assess the vulnerable areas within which the policies of the Source Protection Plan will be
implemented.

The Thames-Sydenham and Region Source Protection Plan will take effect December 31, 2015. It will be
important that municipalities,the province and other implementing bodies are ready for the implementation of
the Source Protection Plan by its effective date. It is especially important that municipalities with significant
drinking water threats, and therefore responsibilities under Part IV of the Clean Water Act, are prepared to
implement those responsibilities. Other responsibilities, such as conformity updates to Official Plans come into
effect later (as identified in the Source Protection Plan).

Recently,the Ministry of Natural Resources and Forestry posted Wetland Conservation in Ontario:A Discussion Paper on
Ontario's Environmental Registry(www.ebr.goy.on.ca, ER posting number 012-4464).The purpose of the Discussion Paper
is to seek input on challenges,opportunities, ideas and actions related to wetland conservation in Ontario,with a view to
developing a Strategic Plan for Ontario's Wetlands.The Strategic Plan will identify a provincial vision,goals and objectives,
as well as set out a series of actions that the Ontario government will undertake over the next 15 years to improve wetland
conservation across the province.
The public review and comment period for Wetland Conservation in Ontario:A Discussion Paper extends until October 30,
2015. During this time the Ministry of Natural Resources and Forestry will be holding a series of public listening sessions to
seek feedback and ensure all thoughts and ideas are considered. The details of the sessions are as follows:

This regular session of the West Elgin Recreation Committee was called to order at 7 pm with
the following members present: Grace Blanchard, Jennifer Blanchard, Johnathan Wolf, and
Recreation Superintendent Jeff Slater.
Item# 1 Delegations: There were no delegations present.
Item #2 Adoption of the Minutes: The members [present did not feel comfortable approving
the minutes as only one member present was present at that session.
Item #3 Business Arising from the Minutes:
There was little discussion regarding Business Arising from the.Minutes as the three members
connected with that project were not present.
Item#4 Correspondence: No correspondence presented.
Item#5 New Business:
1. Aquatic Safety Audit: The Recreation Committee discussed the Aquatic Safety Audit
that was done at the Beach as part of the Blue Flag Process.
2. Next Meeting: The Recreation Superintendent will poll the members to determine if
there is a meeting necessary before the run.
