Lot Description: Frontage+/-31.7m (104.011.)each parcel Depth Irregular Area+/- 1,100m2 (11,840.3 ft.2) In the matter of Section 45(1)of The Planning Act R.S.O 1990, the Municipality of West Elgin Comprehensive Zoning By-Law 2015-36, and an application for a minor variance. The Planner advised that proper notice had been given under Section 45 (5)of the Planning Act. Correspondence was received on the day of the meeting. A ratepayer asked that the Municipality of West Elgin supply a copy of the decision of the Committee of Adjustment or notice of adjournment of hearing, if any. The Planner gave a summary of the proposed amendment as follows: The property is zoned Residential First Density (R1) in the Municipality of West Elgin Zoning By-law. An enclosed municipal tile drain runs through the subject lands. The owners/applicants are requesting a minor Minor Variance to Section 4.12 c) Setbacks from Municipal Drains of the Municipality of West Elgin Zoning By-law No. 2015-36 for a reduction in the minimum setback to the centerline of a municipal tile drain, from 7.5 m (24.6 ft.) to 3.048 m (10.Oft) to permit the construct of an accessory building (detached garage). A- + 1 May 12116...Pg. 2 of 3 The application is hereby granted subject to the following conditions: 1. That notwithstanding Section 4.12 c)the minimum setback to the centerline of the municipal tile drain for a proposed accessory building is 3.048m (10.0 ft.), as indicated on Schedule'A'; 2. That any future development on the property conforms to the provisions of the Zoning By-law; and; 3. That the Decision applies only to the proposed development as indicated on Schedule'A'attached to and forming part of this Decision. Section 45 (1) of the Planning Act gives the authority of granting minor relief from the provisions of Zoning By-law to the Committee of Adjustment. Such relief can only be granted if the Minor Variance passes four tests. If the Committee is not satisfied on all four tests,then the Minor Variance cannot be approved. Reasons: 1. The variance maintains the intent and purpose of the Official Plan. 2. The variance maintains the intent and purpose of the Zoning By-law. 3. The variance requested is desirable and appropriate and orderly development and use of the lands and buildings.. 4. The variance is minor in nature. The application has been assessed for appropriateness with regard to existing policy and the impact of the proposal on the surrounding land uses. INTRODUCTION 1 DISCUSSION: The Recreation Department was approached by Deputy Mayor Bodnar , representing the Rodney Horticultural. Society, regarding the Wishing Well signs at the north and south entrances to Rodney. The flower beds, the wood portion was examined and it has been determined that the boards surrounding the planters are need of repair. So much repair that it would be prudent to replace the entire boxes at this time. Recreation staff can rebuild the boxes using 6x6 pressure treated lumber at a reasonable cost. The Horticultural Society has designed a sign, which includes the Service Club signs, and would like to proceed with this project. Pavilion:The Recreation Superintendent reported that the area around the pavilion has been seeded.The facility has been vandalized in the past.Some of the lights were damaged,and the hydro box for the receptacles was damaged.The Recreation Staff also had to repair/replace some of the tops of the tables.The Picnic tables have been chained together to prevent the moving of the tables.
