SUBJECT: Homes — Foot Care Services
INTRODUCTION:
The Long Term Care Homes Act, 2007 requires every home to ensure that each
resident of the home receives preventative and basic foot care services.
DISCUSSION:
Victoria Order of Nurses (VON) has previously provided preventative foot care services
to long-term care homes in Elgin County. As of October 2015, that service was no longer
available to individuals. To ensure that the Homes provide access and choice to
residents for these types of services, an expression of interest was advertised for Foot
Care Services.
A respondent has been identified and is ready to provide service beginning January
2016 to interested residents/personal representatives. This service is at no cost to the
County and is billed directly to the resident/personal representative by the service
provider. The fee for basic foot care service through this provider is $25.00 per visit.
The provider will follow the appropriate infection control guidelines and meet the
requirements under the County of Elgin's Alternative and Complimentary Therapy
policy.
CONCLUSION:
Accessibility to preventative foot care services for the Homes' residents is a requirement
under the LTCHA, 2007 and a necessity for the provision of resident centered care.
RECOMMENDATIONS:
THAT Council authorize staff to sign the Foot Care Services agreement with Theresa
Cundy for a one-year (1) term with option for renewal of an additional one-year (1) term,
and;
THAT the By -Law for fees and services be updated accordingly.

SUBJECT: Provincial Offences Act (POA) Facilities
INTRODUCTION:
On January 4, 2016 the attached letter from the Ministry of the Attorney General (MAG)
was received regarding the County's request to lease court facility space at the
Wellington Street Courthouse. The letter is inviting the County to discuss this matter in
further detail. This report seeks Council's approval to enter into discussions/
negotiations with the province with the purpose of achieving a favourable lease
agreement for the County's POA facilities.
DISCUSSION:
As a result of a recommendation made from the Report to County Council titled
"Provincial Offences Act (POA)" Facilities dated October 13, 2015 a letter was sent to
MAG on November 16, 2015, thanking them for their ongoing consideration of our
request to lease space at the Elgin Consolidated Courthouse located at 4 Wellington
Street.
In the response a suggestion has been made to lease courtroom space on a per diem
basis for an interim period of time, until such time as the ministry requires that
courtroom space. An understanding of exactly what MAG means by this statement is
required. If the intent of the statement is lease the County courtroom space, along with
the ancillary space requirements, until such a time as the province's demand dictates
that they can no longer share the space, then an agreement acceptable to both parties
might be achievable. It is staff's understanding that the use of the currently built -out
courtrooms on Wellington Street are well below capacity and the facility has space for
two more courtrooms to be built. The facility was constructed to meet the 30 year
demands of the province and therefore, the County could potentially share space with
MAG for many years.
If the intent is to only lease courtroom space, but not provide space for staff and
prosecution offices, the use for the County would be limited to one-off lengthy trials that
may not be able to be accommodated within our own facility. However, such an
arrangement would not be a suitable solution to overall court operations.
Further in the response, MAG requests that the County advise their designated staff on
the position of leasing on per diem basis so that MAG can work with Infrastructure
Ontario on financial implications to the Ministry and ensure that any agreement is
fiscally neutral to the province and is consistent with their Alternative Financing and

Procurement (AFP) contract MAG has with their facility provider. The invite of providing
a response on the position of a per diem lease should be taken as an opportunity to
engage in discussions outlining the full needs which include: office space for 4-5 staff;
courtroom space for regularly scheduled POA sittings; per diem office for prosecution;
per diem courtroom space as required for lengthy trials; shared Justice of the Peace
office shared use of cells; per diem use of meeting space; staff lunchroom; and
restroom facilities.
CONCLUSION:
The County needs to enter into discussions with MAG to fully understand the extent of
MAG's per diem proposal. Hopefully common ground exists that will allow for the
discussions to progress into negotiations to achieve an agreement that meets the needs
of both parties. Staff is seeking Council approval to enter into such discussions/
negotiations.
RECOMMENDATIONS:
THAT staff be permitted to enter into discussions and negotiations with MAG to lease
Provincial Offences Act (POA) facilities at the Wellington Street Courthouse; and
THAT a copy of the MAG response letter and a copy of the report titled "Provincial
Offences Act (POA) Facilities" dated January 7, 2016 be forwarded to MPP Jeff Yurek's
office.

1 am happy to hear that you feel the meeting with the Provincial Offences Act Manager for
Elgin County and the Manager of Court Operations on September 22, 2015 was a
productive one:
I: understand at the meeting an inquiry was made as to whether Elgin County Council
would consider the possibility of leasing courtroom space on a per diem basis for an
interim period of time, until such time as the ministry requires that courtroom space.
As you may be aware the Elgin County Courthousewas built under the government's
Alternative Financing and Procurement (AFP) model. This model is based on the transfer
of risk to the project team to oversee ail maintenance and lifecycle costs over a 30 year
period. Any arrangement would therefore need to be consistent with the AFP model
agreement.

On June 23, 2015, I attended County Council to make a presentation showcasing the successes of the Elgin
Clean Water Program. At the end of that presentation, and on behalf of the four conservation authorities in
Elgin County I respectfully requested that the County consider contributing $40,000 to the program in
2016. At that time, Councillor Martyn made the motion to support the request, Councillor McWilliam
seconded and the motion carried.
However, the minutes that were approved at the following Council meeting only reflected $20,000 being
requested. I have attached the presentation notes from the meeting as well as the Aylmer Express article
that note the $40,000 request.
I would like to seek clarification as to the amount that the Council approved for consideration in 2016 and
hope that Council would still consider $40,000 in support of the Elgin Clean Water Program in 2016.
