Councillor Leatham commented that the event was very successful and well attended. Deputy Mayor Bodnar -Deputy Mayor Bodnar commented that the Home for Christmas Event was from November 19,2016 to December 3, 2016. -Deputy Mayor Bodnar told Council that the next West Elgin Neighbourhood Watch meeting is at the Rodney Legion on Monday November 28,2016 at 7:00 p.m. Mayor Wiehle -Mayor Wiehle mentioned that the Warden's banquet was being held at the West Lorne International Club on November 18,2016. -Mayor Wiehle told Council that Rodney. Fair Board is looking for new volunteers (Board members-Associate Directors or Directors) and ideas. The mayor mentioned that the Fair Board meets twice a month. -Mayor Wiehle mentioned that while attending an event as Warden in Southwold,there was a discussion and presentation on the battle of Vimy Ridge. The Mayor reminded Council that next year is not only Canada's and Ontario's 150th celebration,Vimy Ridge will have occurred 100 years ago prior in 2017. Council discussed the laying of wreaths on behalf of the Municipality of West Elgin at the West Lorne and Rodney Remembrance Day ceremonies. Deputy Mayor Bodnar would be attending West Lome and Councillor Leatham and Mayor Wiehle would be attending Rodney. CLOSED SESSION RES. The proposed amendment would amend the Rural Residential (RR) Zone as it applies to a portion of the lands situated on the north side of Johnston Line, in the former Township of Aldborough. INTRODUCTION: Currently, the West Elgin landfill operates under summer and winter schedules which uses different times depending on days and seasons. In an effort to simplify this for residents and staff, it is recommended that one schedule with standard hours be used on a year round basis. DISCUSSION: After discussion with the landfill operator and review of usage history, it is being recommended that landfill operating dates remain Wed, Fri & Sat and that hours of operation be modified to a consistent 9am —4pm year round. This will continue to give residents landfill access on the normal days but may also help prevent Incidents where residents arrive too early or too late due to the changing hours. Secondly, due to environmental regulations, all items containing refrigerant must be properly drained and tagged before being sent for recycling. After speaking with other municipalities dealing with the same issue, it is being recommended that West Elgin continue to accept these items at the landfill and have a technician remove the refrigerant on site at a cost of$20.00 per unit. The purposed disposal fee, to be paid in cash at the time of drop off, will go fully towards properly preparing the unit for recycling. Items that have been properly drained and tagged by a qualified technician will still be accepted at no Q,4rge. A recommendation from Council was to consider setting up an Economic Development Committee to spearhead economic growth in the municipality. A draft Terms of Reference is attached for consideration to form an Economic Development Committee for the Municipality of West Elgin. The committee is designed from a model successfully being used by the Township of Southwold for the past five years. If the Committee is approved that funding be included in the 2017 Municipality of West Elgin Budget. Municipality of West Elgin Official Plan The subject lands are designated as `Hamlets' on Schedule 'E' Rural Area Land Use & Transportation Plan in the Municipality of West Elgin Official Plan. The primary use in this designation is single unit dwellings. Secondary uses such as small-scale commercial, industrial, institutional and recreations uses and home occupations with limited servicing needs are also permitted. A Site Plan Control Agreement is required. Comment: The proposed microbrewery is a small-scale commercial/industrial use and is therefore a secondary use. A site plan control agreement is required prior to construction, to be entered into between the owner and the Municipality and registered on title. The site plan control agreement will address such issues as access, parking and loading areas, landscaping, external lighting, accessibility for persons with physical disabilities and buffering and other measures to protect adjacent lands. November 10, 2016 Dear Head of Council: We are writing to announce the release of the Ontario Municipal Partnership Fund (OMPF) municipal allocations for 2017: In 2017, the province will maintain OMPF funding at $505 million, which will provide unconditional support to 388 municipalities across the province. The province will continue.to provide unconditional funding in 2017 and beyond. When the OMPF is combined with the provincial uploads, the municipal benefit will total more than $2.4 billion in 2017. This is nearly four times the level of funding provided in 2004, and is the equivalent of 13 per cent of municipal property tax revenue As you know, the OMPF was redesigned in 2014 following consultations with municipalities from across the province. Consultations with municipalities and the Association of Municipalities of Ontario (AMO) have continued over the past year and have focused on refining the program to ensure it meets the long-term priorities of municipalities. The 2017 OMPF reflects the core objectives of the redesigned program, while balancing the range of views expressed by municipalities through this year's consultations. - The 2017 program will further target support to municipalities with more challenging fiscal circumstances by increasing the Northern and Rural Fiscal Circumstances: Grant to $82 million from $67 million in 2016. This is an increase of over 20 per cent to this grant component and means that municipalities with more,challenging fiscal circumstances will see their funding through this grant component increase in 2017. Through the consultation process, we heard positive feedback on the funding enhancement introduced last year that is targeted to municipalities with the highest levels of farm land, in recognition of their unique challenges. In 2017, the Rural Communities Grant.wiil be increased.to $148 million from $143 million in 2016 to further target funding to municipalities across the province with the highest levels of farm land. ...Icont`d � L 3 In addition, the 2016 Budget announced that the government is introducing a new Connecting Links program that will provide $20 million in 2076 71.7 to help municipalities pay for construction and repair costs for municipal roads that connect two ends of a provincial highway through a community or to a border crossing. Funding for this program will increase to $30 million per year by 2018- 19: In September, the province signed a bilateral agreement with the federal.government to make funding available under the federal Clean Watet and Wastewater Fund (CWWF). The Province.will contribute about $270 million in funding through the program to support immediate improvements to water distribution and treatment infrastructure, starting in 2016-17. I regret the delay in replying to you. As the Minister responsible for small business and tourism, I am interested in learning about the challenges entrepreneurs face. The Income Tax Act contains longstanding rules that are intended to prevent the use of a corporation to defer personal taxes on investment income. These rules draw a line between the tax treatment of business income at the corporate level (taxed at lower rates for small businesses) and property income (generally taxed at higher rates). For the tax treatment of property income, where the principal purpose of a business is to derive income from property, the Canada Revenue Agency (CRA) considers it to be a specified investment business. There is an exception to this rule if the business employs more than five full-time employees throughout the year. CRA has published guidance material and a news release on the factors that are relevant in making this determination. You can access the news release at www.cra-arc.ac.ca/nwsrm/stnmt/2016/stl6O823-eng.hfxnl. With regard to campgrounds, CRA understands that, in many cases, a corporation carrying on such a business may not typically employ more than five full-time employees throughout the year. Therefore, in these situations, the ability of a corporation to claim the small business deduction is reviewed on a case-by-case basis. CRA considers the specific facts of each case in order to determine whether a corporation's income qualifies for the small business deduction. 2 Canada 1 - 2 - For example, if a campground provides significant additional services that are integral to the success of its business operations, CRA may consider that its principal purpose is as a small business and not to earn income from property. In these select instances, a corporation's income may be able to qualify for the small business deduction. This could be the case even if the campground did not employ more than five full-time employees throughout the year. The Government of Canada remains committed to protecting and maintaining the fairness and 'integrity of Canada's tax system for all Canadians. Taxpayers who disagree with their notice of assessment or reassessment have access to recourse. Objections and appeals processes are available to all taxpayers. CRA encourages taxpayers to consider these options when necessary. POO AMCTO MEN THE MUNICIPAL EXPERTS November 17,2018 Government Releases Changes to Municipal Legislation Yesterday the government tabled Bill 68, Modernizing Ontario's Municipal Legislation Act, which will introduce a series of reforms to the Municipal Act, and Municipal Conflict of Interest Act. While it's too early to assess the overall impact of these changes, we were pleased to see many of AMCTO's recommendations incorporated in the bill, including a clear definition of a meeting, new rules around open meetings, a requirement for municipalities to adopt codes of conduct, and a shorter lame duck period amongst others. Some of the key highlights can be found below. A more detailed update is also available on our policy blog. Codes of Conduct • Codes of Conduct will now be mandatory for all municipalities Integrity Commissioners • All municipalities now need to provide their citizens access to an Integrity Commissioner(IC)—either by appointing their own, keeping one on retainer, or working with another municipality through a shared serviced arrangement • The role of the Integrity Commissioner will also be changed and expanded in a number of ways, including by giving them authority over MCIA violations, and the power to refer matters to the courts Closed, Open & Electronic Meetings • There is going to be a clearer definition of a "Meeting," under the Municipal Act's open meeting provisions • There will also be an expanded number of discretionary exemptions where councils can meet in closed session • Under the broader changes to open meetings, there will be a new requirement for municipalities to report back on how they intend to address a closed-meeting investigation • Councillors will now also be able to participate in meetings electronically, if there is an in-person quorum MCIA • The range of penalties for Municipal Conflict of InterestAct(MCIA)violations will be expanded (likely new i penalties will include suspensions or fines), giving judges more latitude when dealing with these types of violations • Municipalities will also be required to create a registry that tracks all registered conflicts of interest Fiscal sustainability • Notably the government will not be giving municipalities access to any new revenue tools • However, the government's current prudent investor standards will be expanded • The MA will also be changed to make tax sales easier to complete • There will be a series of technical changes to property taxation and collection Staff-Council Relations • All municipalities will have to create a formal policy on staff-council relations AMPS • Municipalities will be given the authority to use AMPS (administrative monetary penalties system) for a broader range of offences Parental Leave • Councillors will be guaranteed a minimum period of parental leave Regional Council Composition • There are a number of changes to regional council composition, including a new requirement for regional governments to review their council composition following every second municipal election starting in 2098 • A lower tier council will also be able to temporarily appoint an alternate in situations where the permanent member cannot attend an upper-tier council meeting Municipal Elections • There are a number of changes to the MA that will have an impact on municipal elections, including changes to the lame duck period, self-financing, and the individual contribution limit Climate Change • The Municipal Act will now give municipalities explicit authority to deal with climate change Community Hubs • The changes will also give the Minister regulatory authority for community hubs More details on these changes can be found on our policy blog. Alzheimer's disease is a degenerative brain disorder that most often occurs in people over the age of 65 but can affect people in their 40s and 50s. There are currently 564,000 Canadians living with Alzheimer disease or other dementias. In Elgin County there are 1,448 people living with dementia with the number is expected to grow to 1,628 by 2020. It is important for awareness of Alzheimer's and dementia because for every one person living with dementia, 10- 12 people are affected. Using a community approach to help build a Dementia Friendly Community that supports those living with dementia will enable people with dementia to maintain an active role in their community and be able to enjoy their life with confidence. AMO will be reviewing each Bill in detail but wanted to give its members the key highlights. Some of the proposed changes are very welcomed and others less so. Municipal Affairs Minister Introduces Amendments to the Municipal Act, City of Toronto Act (COTA) and Municipal Conflict of Interest Act (MCIA) The review of these Acts has resulted in some amendments that are relatively substantive,and others that are more technical in nature. Many of the changes relate to transparency and accountability,conflict, and behaviour. Some impose a new obligation and others introduce flexibility. AMO will be reviewing the language of the Bill in depth in the coming weeks and will update members accordingly. Key highlights of the more substantive changes: • Require that all municipalities provide access to an Integrity Commissioner(IC)and all of the functions of an IC. • The role of the IC is expanded to: i)conduct inquiries upon complaint or own initiative for MCIA(financial interests of elected officials),and code of conduct matters(ethical behaviour);ii)provide advice to councils and local boards respecting their obligations under the MCIA and code of conduct;and iii)provide educational information to the public,councils and local boards on these matters. • Under the MCIA,an IC can investigate a complaint from any person concerning an alleged contravention,and upon completion of an investigation,the IC can apply to a judge for a determination as to whether the member has in fact contravened the Act. • The mandatory penalties for contraventions of the MCIA will be replaced with a broader range of penalties(e.g., fines, suspension). Other new provisions under MCIA relate to the need for written disclosure of interest,dealing with influence, and a registry. • All municipal governments will be required to have a Code of Conduct for councils and local boards that informs ethical behaviour(different from the financial interests of the MCIA). • Councils will also be required to have a formal policy on council-municipal staff relations to address the roles and responsibilities of municipal public service and the interaction with council. • Definition of Open Meeting: The government is moving to clarify that a meeting with council,local board or committee involves a quorum of council members and that they discuss a matter in a way that"materially advances"the business or decision-making. • Electronic meetings: Councils and Committees to have the authority to allow electronic participation in their procedural by- law.However,electronic participation will not be counted for quorum purposes. • Open meeting exceptions to include: i)information supplied in confidence by Canada,a province or territory or a Crown agency; ii)certain third party information supplied in confidence;iii)trade secret or financial,commercial,etc. information that belongs to the municipality or local board and has monetary value or potential monetary value;or iv)instructions,etc.to any negotiations by or on behalf of the municipality or local board. • Requirement to pass resolution on how Council/Local Board intends to address a meeting investigation report where the situation was contrary to open meeting provisions. • Regional council composition can now be changed by by-law rather than need for Minister's regulation. i • Regional municipal governments will be required to review their council membership that represent their lower-tier municipalities at least once following every second municipal election,starting after the 2018 municipal election;Minister would have power to make a regulation changing a regional council's composition if a regional municipality is unable to come to a local decision within two years following every second municipal election. • A lower-tier council can temporarily appoint an alternate member of lower-tier council who is a member of both the lower- tier and upper-tier council to replace the member who is unable to attend an upper-tier council meeting. • Add a new broad authority to use administrative monetary penalties for municipal bylaw contraventions. • Repeal a provision so that municipal by-laws will have effect in areas under jurisdiction of conservation authorities. • Require adoption of a policy for pregnancy leaves and parental leaves for council members. • Eligible investments framework changes to add a prudent investor standard regime subject to a regulatory design that if done well could take advantage of the One Investment Program of AMO and Municipal Finance Officers Association as a prudent investor. • Added flexibility to deal with forfeited corporate property and to administer tax sales faster. • Add a new broad power to deal with climate change(although cannot exceed the Building Code or other provincial statutes) and to clarify the municipal role in energy planning. • The Minister will have regulation-making authority to prescribe actions(unknown at this point)that municipalities must take to support local integrated planning in order to implement community hubs. • Require a municipality to meet prescribed conditions before it establishes a small business program instead of obtaining ministerial approval. • Municipal Election Act to be changed to reduce the time between the election of councils and their first meetings,proposed to be Nov 15;increase the maximum contribution limit to a single candidate or third party advertiser so that it is the same as the province($1,200); and introduces formula to limit self-funding. Fall Budget Bill While the omnibus Bill was introduced today(Nov. 16)it is not available on Hansard as yet.We understand it contains changes to: • Require direct election for all regional government chairs(some are currently directly elected through previous specific legislation). • Interest arbitration regime for fire and police that would remove the requirement for the parties to go through a conciliation process before the interest arbitration process can commence;require pre-hearing submissions;and prohibit boards of arbitration from referring items in dispute back to the parties for further negotiation,unless the items relate to implementation of an award,or if both parties agree that items can be referred back prior to the making of a final award.The municipal. priority issue of capacity to pay was not acted upon,however,the Minister will continue to hold discussions with the fire and municipal sector. Bill 65 Introduces Photo Radar in School and Community Safety Zones Creates authority for municipal governments to introduce Automated Speed Enforcement(photo radar)in school and community safety zones to reduce speeding infractions.It also allows municipalities to create community safety zones with reduced speed limits to improve pedestrian and cyclist safety, and the flexibility to reduce speed limits below 50 km/h. This is a scoped application of photo radar and limits local decision-making on where it can be used,rather than give municipal governments the base authority. For example,municipal governments feel photo radar would be helpful in construction zones to protect the safety of road workers. Next Steps It is anticipated that the Fall Budget Bill,as with most budget bills,will have a quicker legislative approval process than the other Bills.AMO will review that Bill in detail once it is available on Hansard to determine if there are any additional changes that will impact municipal governments. More work is ahead as well for the other two Bills as we review their legislative language with a view of what makes sense to improving municipal governments authority and where unintended consequences might occur.
