October 26, 2000 Special Meeting M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN WEST ELGIN COUNCIL CHAMBERS OCTOBER 26th, 2000 MEMBERS PRESENT: Mayor Duncan McPhail, Deputy Mayor Graham Warwick Councillors: Paul Gangle, Mike Mooser, Brad Bandeen, Robert Coles, Trudy Balint STAFF PRESENT: Joanne Groch Administrator/Treasurer Rita DeWild Clerk Mayor McPhail opened this Special Session of Council at 9:30 a.m. and explained the purpose of the meeting was to deal with matters of business arising since the last meeting. SUBJECT: BY-LAW – 2000-49 – TO APPOINT A TILE DRAIN LOAN INSPECTOR RES. NO. 1 Moved by Bandeen Seconded by Coles RESOLVED that a the mover be granted leave to introduce a by- law to appoint a tile drain loan inspector for the Corporation of the Municipality of West Elgin and this shall be the first and second reading and provisional adoption thereof. DISPOSITION: Carried RES. NO. 2 Moved by Balint Seconded by Mooser RESOLVED that a bylaw to appoint a tile drain loan inspector be now read a third time and finally passed, sealed and numbered. Number 2000- 49 – Appointment of a Tile Drain Loan Inspector. DISPOSITION: Carried SUBJECT: BY-LAW – 2000-53 – POLICY FOR PRICE SHARING OF WATER LINE EXTENSIONS RES. NO. 3 Moved by Coles Seconded by Bandeen RESOLVED that the mover be granted leave to introduce a by-law to adopt a policy for price sharing of water line extensions for the Corporation of the Municipality of West Elgin and this shall be the first and second reading and provisional adoption thereof. Number 2000- 54 – Amendment of By-law 94-39. DISPOSITION: Carried SUBJECT: BY-LAW 2000 - 55 – PROVISION OF POLICE SERVICES RES. NO. 7 Moved by Balint Seconded by Mooser RESOLVED that the mover be granted leave to introduce a by-law to authorize the execution of an agreement between the Solicitor General of Ontario and the Corporation of the Municipality of West Elgin, the Corporation of the Municipality of Bayham, the Corporation of the Township of Southwold, the Corporation of the Municipality of Central Elgin, the Corporation of the Municipality of Dutton/Dunwich and the Corporation of the Township of Malahide (known as the Elgin Group) for provision of police services and this shall be the first and second reading and provisional adoption thereof. NO. 8 Moved by Gangle Seconded by Warwick RESOLVED that a bylaw authorizing the execution of an agreement between the Solicitor General of Ontario and the Elgin Group for provision of police services be now read a third time and finally passed, sealed and numbered. Number 2000- 55 – Police Services Agreement DISPOSITION: Carried SUBJECT: BY-LAW 2000-56 – TO REPEAL BY-LAW 2000-37 RES. NO. 9 Moved by Gangle Seconded by Mooser RESOLVED that the mover be granted leave to introduce a by-law to repeal By-law 2000-37 for the erection and operation of traffic control signals at the intersection of Main Street and Graham Street in the Municipality of West Elgin and this shall be the first and second reading and provisional adoption thereof. NO. 11 Moved by Bandeen Seconded by Coles RESOLVED that Perry Clutterbuck be a delegation. DISPOSITION: Carried Perry Clutterbuck, President of the Green Lane Trust Fund presented a cheque in the amount of $5,000.00 towards the new swimming pool. Perry reported that five percent of tipping fees collected by the Township of Southwold is put into a trust fund and used for recreation projects and other community needs. Council extended their gratitude for the funds. SUBJECT: BY-LAW 2000 – 57 – HEALTH & SAFETY – POLICIES & PROCEDURES – DRAFT Rita DeWild, Clerk presented a draft copy of the Health & Safety – Policies and Procedures Manual. Rita reported that an order had been received from the Ministry of Labour to have these policies in place by the end of October. Rita explained that the members of the Health & Safety Committee have been meeting on a weekly basis to put this policy together. Information was gathered from the County of Elgin, OCWA and from the Municipal Health and Safety Association. Rita reported that Section 1.280 – Driving Standards requests that driver abstracts are required for all employees of the Municipality including part- time employees at the cost of the Municipality. Council recommended that the Municipality pay for abstracts for current employees but if a new position is advertised and a driver’s licence is required, the abstract should be submitted along with the resume at the applicant’s cost. Council authorized Rita to investigate if an employee is under the influence of drugs or alcohol, should this be included in the policy. Council will review the policy and if no concerns the policy will be adopted at the next meeting of Council. SUBJECT: CLOSED SESSION RES. NO. 12 Moved by Gangle Seconded by Warwick RESOLVED that the Council of the Municipality of West Elgin adjourn to a closed session to discuss personal matters about an identifiable individual, including municipal or local board employees. DISPOSITION: Carried RES. NO. 13 Moved by Bandeen Seconded by Coles RESOLVED that the Council of the Municipality of West Elgin do now rise and report. DISPOSITON: Carried RES. NO. 14 Moved by Warwick Seconded by Gangle RESOLVED that the Council of the Municipality of West Elgin agree with the Human Rights Commission Minutes of Settlement of October 23, 2000 regarding Complaint #SHEY-4DANES. DISPOSITION: Carried RES. NO. 15 Moved by Balint Seconded by Gangle RESOLVED that the portion of Resolution #5 of April 20, 2000 as it relates to Robert White be rescinded. DISPOSITON: Carried 3 October 26, 2000…Page 4 of 4 SUBJECT: CONSTRUCTION/MAINTENANCE – DRAINAGE – FUNDING Joanne Groch, Administrator/Treasurer reported that a request for funding for fifty percent of the drainage superintendents salary as well as one-third of drainage maintenance was submitted in February for this year’s allocation. No further information has been received to date. Joanne reported that no drainage billings can be done until further information is available. Deputy Mayor Warwick reported that this affects all rural municipalities and that the Ontario Federation of Agriculture is also working on this matter. Council requested that this concern be forward to the Minister of Agriculture and the Association of Municipalities of Ontario. RES. NO. 16 Moved by Warwick Seconded by Gangle WHEREAS the Municipality of West Elgin has submitted a Grant Allocation Request for the Drain Maintenance/Superintendent Program in February 2000; AND WHEREAS there has been no confirmation to date of funding from the Provincial Government regarding this Program; AND WHEREAS the billing for maintenance and construction drains cannot be completed until confirmation of funding is received; NOW THEREFORE the Council of the Municipality of West Elgin does hereby petition the Minister of Agriculture to provide an immediate response to municipalities involved in the Drainage Maintenance/Superintendent Program as to their funding level for the 2000/2001 Program. DISPOSITION: Carried SUBJECT: RODNEY LIBRARY Councillor Bandeen presented a request from the West Elgin Community Policing Committee to apply a safety film on the windows of the Rodney Library. The Committee felt that with the new equipment in the library, further protection is required. Brad presented a quote from Rodney Auto Glass in the amount of $490.83 including taxes to apply the film. Council were in agreement and Mayor McPhail reported that he would request that the County of Elgin pay fifty percent of the cost. SUBJECT: MISCELLANEOUS ITEM Councillor Mooser requested an advertisement be included in next week’s paper regarding disposal of leaves in the villages. Rodney has two scheduled pickups for leaves and West Lorne residents may put their leaves out for pick up by Green Lane Environmental. ADJOURNMENT RES.
