September 21, 2000 Committee of Adjustment M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COMMITTEE OF ADJUSTMENT WEST ELGIN COUNCIL CHAMBERS st September 21, 2000 MEMBERS PRESENT: Mayor Duncan McPhail, Deputy Mayor Graham Warwick Councillors: Paul Gangle, Trudy Balint, Brad Bandeen, Mike Mooser STAFF PRESENT: Joanne Groch Administrator/Treasurer Rita DeWild Secretary/Treasurer ALSO IN ATTENDANCE: Ted Halwa Planning Consultant SUBJECT: MINOR VARIANCE APPLICATION A8/2000 – ORVILLE LONG Also in attendance: Orville Long Chairman Duncan McPhail called the meeting to order at 8:30 p.m. to discuss the Minor Variance Application of Orville Long, 15096 Blacks Road, Municipality of West Elgin. The Secretary/Treasurer advised that proper notice had been given under Section 44(5) of the Planning Act. Comments were received from the Lower Thames Valley Conservation Authority with no concerns. Ted Halwa, Planning Consultant reported that the lands are zoned Rural Residential Three (RR3) in the Township of Aldborough Zoning By-law. Ted advised that the subject lands are occupied by a single unit dwelling and a detached garage and comprise an area of 928 square metre (0.2 acres), a depth of 29 metres (95 feet) and a frontage of 32 metres (105 feet) on Blacks Road. The applicant proposes to construct an addition to the northerly side of the dwelling. The addition would be in line with the dwelling already in existence and would be situated at its closest point, 7.2 metres (23.6 ft.) from the front lot line. The relief requested is for a decrease in the front yard depth by 2.8 metres (9.2 ft.) as Section 11.1.7 of the Zoning By-law requires a minimum front yard depth of 10 metres (32.8 ft.). RES. NO. 1 Moved by Balint Seconded by Mooser In the matter of Section 44 of the Planning Act, Zoning By-law No. 89-20 as amended, and an application for minor variance to allow: The applicant proposes to construct an addition to the northerly side of the dwelling. The dwelling would be situated, at its closest point, 7.2 metres (23.6 ft) from the front lot line being the property line abutting Blacks Road. Section 11.1.7 of Zoning By-law 90-50 stipulates a minimum front yard depth of 10 metres (32.8 ft). The relief requested is for a decrease in the front yard depth by 2.8 metres (9.2 ft). REASONS: The variance is minor, the general intent of the Official Plan and Zoning By-law are maintained and the variance is desirable for the use of the land.
