NO. 1 Moved by Mooser Seconded by Balint RESOLVED that Deputy-Mayor Warwick be appointed as Chair for the meeting in the absence of the Mayor. DISPOSITION: Carried SUBJECT: MINUTES RES. NO. 2 Moved by Balint Seconded by Mooser RESOLVED that the minutes of the meetings of Council held on the following dates be adopted as printed and circulated. th July 26, 2001 Regular Meeting, as amended thnd July 26, 2001 2 Court of Revision th July 26 , 2001 Public Meeting DISPOSITION : Carried th The amendment to the July 26 minutes is as follows: change the name of “Anita” Carter to “Andrea” Carter, page 5 – Water Report. SUBJECT: MAJOR GENE SMITH – PEACEKEEPING CAMP Major Gene Smith gave council a presentation on the proposed peacekeeping camp at the location of Con. 2, Lot 16 & 17. He handed out an information package outlining in some detail the plans for an adventure training camp, a memorial museum and park, as well as a physically challenged recreational facility in the future. The proposal committee feels that this area is ideal for what they have planned. Council explained that it would require an official plan amendment as well as a zone amendment. Council asked if they had made provisions for water and sewage. Mr. Smith stated that there are two existing wells on the property and they would be speaking with the County Health officials to determine the best way to address the sewage requirements. Their organizing committee are applying for charitable status, so they can further their fund raising. The committee hopes to be a self sustaining group, once they get started. He also stated that they would host an open house to meet with the public and explain the plans for the camp, once they get to the point of applying for an official plan amendment. Council thanked him for the presentation and wished his group success in their endeavours. 1 th July 26, 2001/council mtg SUBJECT: MISCELLANEOUS ITEMS Councillor Mooser reported on his conversations with Steve Peters office regarding Erie Flooring. The problem is still on-going and the owner will be requested to address the issue with Mr. Peter’s office. Regarding the weed issue, the Clerk informed council that the County Weed Inspector had laid a charge on a property in West Lorne. Truck parking in the subdivision at West Lorne is still an on-going issue. Since we now have an amendment to the Property Standards By-Law, which will cover certain parking issues, the By-Law Officer will be requested to look into the problem again. Council was reminded that the By-Law Officer only acts on written complaints. SUBJECT: RECREATION ISSUES Councillor Balint reported on some recreation topics, since the Recreation Manager is on holidays. She reported that the summer art camp went so well, that the art teacher would like to host an adult art camp in the fall, which would be run on a private basis, with her renting the room at the recreation centre at the normal rental fees. Councillor Balint also reported on the Derby events planned for the Labour Day Weekend. Councillor Bandeen brought council up-to-date on the Day Camp status, with Janet Pinder over-seeing the supervisors and instructors at the Day Camp. It seems to be working out well. SUBJECT: MISCELLANEOUS ITEMS Council discussed the closing of the Post Office location in West Lorne. They have been assured by Gar Knutson’s office that it will be temporarily set up at the BJ’s Variety and Canada Post are attempting to make arrangements for a permanent location as soon as possible. Deputy- Mayor Warwick and Councillor Bandeen reported on their meeting with Ruth Newman, regarding the Temporary Use By-Law. They feel that she has a good understanding of the regulations set out in the agreement. Councillor Bandeen reported that the Rodney Town Hall interior painting is nearing completion and it looks like they’ve done a good job. SUBJECT: GOLDEN YEARS SENIORS CLUB Irene McGregor, a representative from the Golden Years Senior Club sent a request to council for support in their initiatives to make application to the Trillium Foundation for a grant. RES. NO. 3 Moved by Balint Seconded by Bandeen RESOLVED that Council is supportive of the initiatives of the Eagle adult Community Centre in publishing “The Golden Years” (quarterly publication) and their application for funding from the Trillium Foundation. DISPOSITION: Carried SUBJECT: BUILDING REPORT Council looked at the written report from Lorne McLeod, Chief Building Official, for the month of July indicating that eleven permits have been issued during the month of July totalling $402,800 worth of construction. Total permits to date is 54 equalling $2,360,500 worth of construction. th August 9/01 2 SUBJECT: MUNICIPAL WEB SITE Deputy-Mayor Warwick reported that the Municipal Web Site is up and operational. It can post ten photos at a time and can include information about the municipality as well as future economic development information. SUBJECT: ROAD REPORT Rick Jackson gave a report on his monthly activities. The work crew is currently trying to control the dust, however the brine will not work effectively without rain. It is anticipated that the West Lorne streetlights will be delivered in the next week or so, and the new sidewalk construction will begin this week in Rodney, and then move to West Lorne. It was noted that there are still complaints coming in regarding the roadside grass cutting, however, they are working at it, as time permits. Tom Mohan will be attending the th Ontario Municipal Truck Rodeo in Fergus on September 12, to represent the municipality as well as the County of Elgin, with his truck driving abilities. SUBJECT: DEEMING BY-LAW 2001-32 RES. NO. 4 Moved by Bandeen Seconded by Balint RESOLVED that By-Law No. 2001-32, being a Deeming By-Law to designate a plan of subdivision that has been registered for eight years or more, not to be a plan of subdivision, under Section 50(4) of the Planning Act and that this shall be the first and second reading and provisional adoption thereof. DISPOSITION: Carried RES. NO. 5 Moved by Mooser Seconded by Bandeen RESOLVED that a By-Law under section 50(4) of the Planning Act, being a Deeming By-Law to designate a plan of subdivision that has been registered for eight years or more, not to be a plan of subdivision shall be hereby read a third time and finally passed, signed, sealed and numbered – By-Law Number 2001-32 – Deeming By-Law – L & G Begin. DISPOSITION: Carried SUBJECT: BY-LAW 2001-34 – ROAD BOUNDARY AGREEMENT RES. NO. 6 Moved by Mooser Seconded by Bandeen RESOLVED that Council of the Municipality of West Elgin approves the Boundary Road Maintenance Agreement with the County of Chatham- Kent and that a copy of this agreement shall become a part of this By-Law and this shall be the first and second reading and provisional adoption thereof. NO. 7 Moved by Balint Seconded by Mooser RESOLVED that Council of the Municipality of West Elgin approves the Boundary Road Agreement with the County of Chatham-Kent and the Agreement shall be a part of this By-Law as Schedule “A” and shall now be read a third time and finally passed, signed, sealed and numbered By- Law 2001-34 – Chatham-Kent County Road Maintenance Agreement. NO. 8 Moved by Mooser Seconded by Bandeen RESOLVED that the mover be granted leave to introduce a by-law to impose a special annual drainage rate upon land in respect of which money is borrowed under the Tile Drainage Act and this shall be the first and second reading and provisional adoption thereof. (Cheques #610 – 913 plus Roads/General/Water/ Payroll) DISPOSITION: Carried SUBJECT: GLENCOE WATER CONNECTIONS Administrator Groch spoke with council regarding the expensive cost to connect to the Glencoe water distribution system. After discussions the following resolution was passed: RES. NO. 11 Moved by Mooser Seconded by Balint RESOLVED that the Municipality of West Elgin agree to begin negotiation meetings with Glencoe/Southwest Middlesex for connections to the Glencoe water lines. Recreation Committee - July 26, 2001 SUBJECT: KRUMM SEVERANCE Council reviewed the revised plan for the Krumm severance proposal, Con. 9, Lot 10 and they were in agreement with the revised plan presented, which includes the removal of the old kiln at the rear of the proposed severed parcel. Council have no objections to the severance application subject to: 1) rezoning, if required 2) apportionment of Municipal Drainage Assessments 3) drainage outlet & drainage agreement if required 4) requirements of the Municipal Road Department regarding access and/or drainage 5) no further residential development on the retained agricultural portion. th August 9/01 5 SUBJECT: WEST LORNE HEALTH CENTRE DRAIN Discussions took place regarding the process for the Municipal Drain on non-agricultural lands needed for the new Health Centre.The Drainage Superintendent will speak with some of the property owners involved and explain the petition drain process. SUBJECT: ZOLY & ROSEMARY SABO – SEVERANCE PROPOSAL Council reviewed the severance application proposal for the Sabo property, Con. 7, Pt. Lot 3 and council agreed in principle that they would comply with an A2 zoning, and council have no objections subject to: 1) rezoning, if required 2) apportionment of Municipal Drainage Assessments 3) drainage outlet & drainage agreement, if required 4) requirements of the Municipal Road Department regarding access and/or drainage 5) no further residential development on the retained agricultural portion. SUBJECT: BY-LAW 2001-35 - TAX RATES Administrator Groch presented the final budget figures for council, and following discussions a resolution was passed: RES. NO. 13 Moved by Bandeen Seconded by Balint RESOLVED that the mover be granted leave to introduce a By-Law, pursuant to the Municipal Act, R.S.O. Chapter M45 and as amended thereof, to establish the tax rates and special charges for the Municipality of West Elgin for the year 2001 and that this shall be the first and second reading and provisional adoption thereof. DISPOSITION: Carried RES. NO.14 Moved by Mooser Seconded by Bandeen RESOLVED that a By-Law pursuant to the Municipal Act, R.S.O. Chapter M45 and amendments thereof, to establish the tax rates and special charges for the Municipality of West Elgin for the year 2001, and that this By-Law shall be hereby read a third time and finally passed, signed, sealed and numbered – By-Law No. 2001-35 – Set the Tax Rate Levy for 2001. DISPOSITION: Carried SUBJECT: L. A. RESTAURANT Notice was received that the Alcohol & Gaming Commission will be holding a hearing on th September 14, 2001 to address the status of the liquor application for the L.A. Restaurant in New Glasgow. SUBJECT: ANNUAL PLOWING MATCH An invitation to attend was received from the Annual Plowing Match which will be held th on Saturday, September 8, at Andrew’s Farm. SUBJECT: CLOSED SESSION RES.NO. 17 Moved by Bandeen Seconded by Balint RESOLVED that Council of the Municipality of West Elgin adjourn to a closed session to discuss a matter in respect of personal matters about an identifiable individual.
