SUBJECT: REZONING OF PART LOT 13, CONCESSION X – THOMPSON
Also present for discussion: John Thompson, and Peter Wiles.
Mayor McPhail called the meeting to order at 9:30 a.m. The Clerk informed those
present that notice of this meeting had been given under Section 34(12) of the Planning
Act by prepaid first class mail to all assessed owners within 150 metres of the subject
property as well as provincial agencies and ministries as prescribed by regulation.
Correspondence was received from the Eldin-St. Thomas Health Unit, and the Lower
Thames Valley Conservation Authority with no concerns. A faxed letter was received just
prior to the meeting from Karl Arvai, regarding his objections to the zone amendment.
Mr. Wiles presented a document on behalf of the Thompsons’ to address any possible
objections to the re-zoning. Council took some time to read through the information.
Dan Smith, Planning Consultant reported that the proposed amendment would change
the zoning of lands located on the east side of Kerr Road just south of Marsh Line, being
part of Lot 13, Concession X, from the Agricultural (A1) Zone to the Rural Residential
Three (RR3) Zone.
The lands proposed to be zoned Rural Residential Three (RR3) is comprised of a
rectangular-shaped parcel, having an area of 2,929.2 square metres (0.7 acres) and a
frontage of 42.7 metres (140 ft.) along Kerr Road. The parcel is occupied by a single unit
dwelling (circa 1962). The minimum lot area, maximum lot area, and frontage

requirements (1850 m, 4000 m and 30 m respectively) of the RR zone would be
satisfied.
The re-zoning is necessary to maintain compliance with the Zoning By-Law and fulfill a
condition imposed by the County of Elgin Land Division Committee in granting
permission to create a residential lot for the purpose of disposing of a surplus farm
dwelling, subject to the usual conditions, including no further residences be erected on
the agricultural parcel.

The Clerk was directed to prepare the Zone Amendment By-Law for the next meeting of
Council.

RESOLVED that the public meeting concerning a proposed Zoning By-Law
Amendment for property located at Part of Lot 13, Concession X in the
Municipality of West Elgin be hereby adjourned.
