SUBJECT: MINOR VARIANCE APPLICATION A-2/2001 – Jerry Scknekenburger
Chairman Graham Warwick called the meeting to order at 9:35 p.m. to discuss the Minor
Variance Application for Jerry Scknekenburger, at 23734 Thomson Line, Part Lot 12,
Concession X, Municipality of West Elgin.
The Clerk advised that proper notice had been given under Section 44(5) of the
Planning Act. Comments were received from the Lower Thames Valley Conservation
Authority with no concerns.
Ted Halwa, Planning Consultant reported that the lands are located in the northwest
corner of Thomson Line and Kerr Road. He went on to say that the subject lands
comprise a rectangular-shaped parcel having an area of 20.2 hectares (50 ac.), a
frontage of 301.8 metres (990 feet) on Thomson Line, and a flankage of 670.4 metres
(2200 feet) on Kerr Road. The owner proposes to erect 11 tobacco kilns on the lands.
The subject lands are zoned Agricultural (A1) in Zoning By-Law No. 90-50 of the former
Township of Aldborough. The closest kiln would be situated 6 metres (20ft.) from the
front line (i.e. Thomson Line) whereas the By-Law stipulates a minimum distance of 15
metres (49.2 ft.) from the front line for buildings or structures in the A1 Zone. In order for
this to proceed a variance to the By-Law is required.

In the matter of Section 44 of the Planning Act, Zoning By-law No. 90-50
as amended, and an application for minor variance to allow:
RESOLVED that applicant be granted relief, from the Aldborough
zoning By-Law Bi, 90-50, specifically Section 5.1.5 to the property
owned by Mr. & Mrs. Schnekenburger, located at Part Lot 12,
Concession X, to permit a maximum of two tobacco kilns to be
erected 6.0 metres (19.7 ft.) from the front of the lot line.
Location of the property: Part Lot 12 Concession 10
The request is granted.
REASONS:
The variance is minor, the general intent of the Official Plan
and Zoning By-law are maintained and the variance is desirable for the use
of the land.
i) the intent of the Township of Aldborough Official Plan is maintained;
ii) the intent of the Township of Aldborough Zoning By-Law is
maintained;
iii) the variance is considered “minor”, given the circumstances;
iv) the variance is desirable for the appropriate use and development of
the lands.
