November 01, 2001 Court of Revision - Page Drain M I N U T E S OF THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN COURT OF REVISION WEST ELGIN COUNCIL CHAMBERS st November 1, 2001 MEMBERS PRESENT: Chair: Mike Mooser Members: Brad Bandeen, Graham Warwick STAFF PRESENT: Joanne Groch Administrator/Treasurer Linda Cranston Clerk/Deputy-Treasurer SUBJECT: COURT OF REVISION – PAGE DRAIN Also in attendance: John Spriet, Sr. – P. Eng., and Wray Ramsay, Drainage Superintendent, as well as Tom Page, property owner. RES. NO. 1 Moved by Bandeen Seconded by Warwick RESOLVED that the second Court of Revision for the Page Municipal Drain be convened. DISPOSITION: Carried The Clerk informed those present that a letter from a Mr. J. Evans, Texas was received. The letter was fairly lengthy and touched on a number of issues. Copies had been handed out to the Court members. It was decided that the Engineer would correspond with Mr. Evans and explain his portion of the grant available and the resulting net costs. When all is said and done, the net for Mr. Evans will be approximately $310.00 as his share. RES. NO. 2 Moved by Warwick Seconded by Bandeen RESOLVED that Council agrees to accept the letter of appeal from Mr. John Evans, Texas. The Engineer will correspond with Mr. Evans to explain his net costs. DISPOSITION: Carried RES. NO. 3 Moved by Bandeen Seconded by Warwick RESOLVED that the Court agrees to hear the verbal appeal from Tom Page. DISPOSITION: Carried Mr. Page questioned the members about the zoning that had never been changed over the years. He was reminded that this meeting was to deal with assessment questions and concerns. He stated that he disagreed with the assessment of his property as being residential, since it is currently open space and he cannot build on it at this time. The Engineer stated that to answer that question he asks, “will it benefit the property owner?” The answer is yes, however only if the lands are developed. Mr. Page said that the cost to develop the property is so expensive that he could never hope to recoup the costs. Mr. Page also asked why Ontario Hydro didn’t get assessed. Mr. Spriet replied that they do not benefit from the drain. RES. NO. 4 Moved by Bandeen Seconded by Warwick RESOLVED that the Engineer’s Report be changed to take $400.00 from Tom Page property and re-distribute it to the Sexton Street Road. DISPOSITION: Motion Defeated RES. NO. 5 Moved by Bandeen Seconded by Warwick RESOLVED that the assessment on the Page Drain be confirmed as per the Engineer’s Report. DISPOSITION: Carried Wray Ramsay stated that he had received a phone message from a ratepayer concerning this drain, however, they had only left a phone number. He left a return message, and to date has not received another call in that regard. RES. NO. 6 Moved by Warwick Seconded by Mooser RESOLVED that there being no further business, the Court of Revision on the Page Drain is hereby adjourned.
